And also one acre be it more or less, being known by the name of the little lots, bounded by some part of Hooke pond South & land that was formerly Robert Dayton's West the highway and Calf Pasture North & George Myller's land East.


Page 15 .- And also one parcel of land more being part of a third division of land being at the end of his addition contain- ing two acres more or less, bounded by John Stretton's lot South the Common West, Mr. Bond's land North.


Also one parcel of land more in Georgica neck containing eleven acres more or less bounded Norward by a highway and by Mr. Backer's lot Eastward and the Cove or pond South- ward and Willyam Mulford's land Westward.


And one parcel more upon the Indian well plain being seven acres more or less bounded by William Mulford on the one side and Richard Brooks on the other side, and the highways South and North.


And also one parcel of meadow at Napeake as being part of his division of waste meadow containing about one acre more or less, being the first lot that was cast Westward towards the Town and bounded by Joshuah Garlick's Sr. his meadow Eastward and the beach or sand Southward and Northward and a little narrow screede of meadow land that at present lieth as common land Westward.


And also one parcel of land more being part of a fourth di- vision of land joining to the rear or Norward end of his second home lot, containing four acres more or less, and bounded Westward by some land that doth belong to John Kirle &

Norward by the present Common and Eastward by Richard Stretton's land.


As also one parcel of land more which is a part of a fourth division of land & lying upon the farther part of the Norwest woodland plain containing near about Twenty seven acres more or less and bounded toward the Southward by Thomas Chatfeilds land and Westward by the highway and Common, and Norward by the present common land & Eastward by a highway that parteth between his land and another division of land.


And also one little parcel of land more containing three acres & thirty seven pole more or less as a part of a fourth division or at least laid out at the same time, being at the Noreast end of the Town and bounded by a highway South that men goeth into the Eastward by the general plain fence & Eastward by land that now doth belong to John Stretton Sr. & Norward by some land that was laid out to Steven Hedges but now in the possession of John Richeson & the Commons Westward.


And one parcel of land more containing four acres more or less at the rear end of his second home lot bounded by John Kirle's land on one side and Richard Straton's land on the other side & a highway Norward.


And one piece of land more being part of a fifth division of land Norward of Newtowne lots & containing about seventeen acres and a half & bounded by Mr. Thomas Chatfeild Eastward and a highway Southward and the Common Norward & Nath- aniell Baker Sr. Westward.


(A later entry.) Also one parcel of land it being part of a fifth division containing twelve acres at Three Mile Harbor bounded Northward with Thomas Baker's land he had of Chatfield the common land West and Southwest, and the har- bor aad cart path Southeasterly and South. This last above written is bounded as it was given in to me by Shubal Talmage.

Page 15g .- And one parcel of meadow more granted to Thomas Tallmage at Napeake and it is Westward of an acre of meadow that was formerly granted to him & it is all the spots of meadow that lieth upon Napeak beach Westward of that acre of meadow formerly mentioned all that meadow towards the highland.


Also one parcel of land more containing one acre three quarters and twenty-two pole it being two third parts of what fell to said Talmage's allotment by virtue of an award given by an arbitration in the year 1696, it being bounded by Geor- gica Westward and by the widow Elizabeth Baker's land Eastward and by common land North and South.


Also two pieces of land more which Onesimos Talmage bought of John and Abiall Carle, as by their deed of sale more fully may appear, it being a fourth part of what was allowed by virtue of the abovesaid arbitration to the allotment that was formerly belonging to John Hand Sr. and is in the whole one acre and three quarters and two pole and half, it being bound- ed by Georgica pond both pieces to the West, one piece being bounded to the East by Thomas Diamond's land, to the North by common land and to the South by Onesimos Tal- mage's own land, the other piece bounded to the East by James Diamond's land, by Onesimos Talmage's own land North and br common land or beach to the South.


And also one parcel more of land being measured and staked out to Nathaniell Talmage being part of a sixth division of land and is the eleventh lot lying on the Southwest side of Goose Creek in that neck, and is in the whole eight acres and one quarter and seven and twenty poles, one acre and half and twenty poles of which came by virtue of a purchase made by the said Nath'll Talmage & Stephen Hedge's with Samuell Hand, the other part of the premises is his right by virtue of one third part of a twenty acre allotment, and is bound by the said Goose Creek and Mr. Benjamin Conklings land North-

ward, and by Duck Creek and some land in Stephen Hand's possession to the Southward and to the Westward by the high- way that lies by the side of John Brook's house lot all which is as it was measured unto the said Nathan'll Talmage for eight acres and one quarter & twenty seven poles more or less.


And also eight acres and forty six pole of land laid out to Nathaniell Talmage, it being his part of a seventh division laid out to him in Amaganset woods bounded with the brick hill path to the Norwest, Samuel Mulford's land to the Northeast and John Gardiner's land to the Southwest.


Page 16 .- And also half an acre of land or low swampy low land joining to his meadow at the West side of Norwest creek bounded with Joseph Osborn's meadow to the North- ward and Stephen Hedges' meadow to the Southward.


And also three acres and half and twenty-three poles of land laid out to Nathaniel Talmag at Little Norwest, begining at a great pine tree against Thomas Mulford's meadow and so joining to his own meadow running up to the swamp, taking in the marshy low land adjoining thereto, and about a quarter of an acre of land joining to his meadow on the other side of the creek running up to the aforesaid swamp.


The aforesaid parcels of land was given in by the layers out as the said Talmage full proportion of the half acre division.

Book O, page 4 .- This agremnt made betweene Thomas James Tho. Chatfeild Senr. John Stretton Senr. & Tho. Dia- met Senr. all Inhabitants of Easthampton And Major Indian of Montaukut, whereby the said major doth firmely bind & engage himselfe to goe to sea a whalekilling for ye aforesaid persons next winter ensueing from ye Date hereof a privateer faithfuly to performe att all times and seasons till the full time bee over for killing whales ye worke to his utmost abilitie & carefully to preserve ye boates Irons & warpes, alsoe to pro- vide another sufficient hand together with himselfe to goe in ye boate with him : Allsoe the aforesaid persons doe under- take to provide a good boate oures warpes & Irons sufficient to carrie on ye designe next winter & to allow ye said Major the halfe both of oyle & bone he shall get he allowing accord- ing to ye ussuall price for what charge may be conserning his part of the same.

Book O, page 45. No date .- Whereas we ye Constable & Overseers haveing lately given out order yt the Inhabitants of this Towne were to bring in their States in reference to ye making of a Towne rate to Answere towne Charges & ye estates being brought in : among others Jonathan Osborne sent or brought in his estate & alsoe delivered or presented in a bill of Charge to ye vallue of 05£ OSs 00d & there is noth- ing due to him from ye towne uppon those accounts : & wee therefore looke uppon it as a false bill sent, in way of scorne & derision of ye Authority of ye place, & we therefore lay a fine uppon him for this Contemptious carriage of his, to ye value of 00-10s-00 for ye publike use.

BOOK O, page 44 .- It is ordered by ye Constable & Over- seers yt noe oxen nor Cowes shalbe bayted on any part of ye plaine within ye fence for this Summer and if any shall act contrairie to this order And soe any cattell of this kind bee found uppon ye plaine yt they shalbee pounded & ye pounder shall have six pence a peice for ye same, And all horses or mares yt are found on ye plaines if they bee not fast Tyed & kept from Doeing Damage & ye owners neere them they shal- bee pounded & to pay one shilling to ye pounder & those yt are ye pounders apoynted by the Overseers is John Hopping &-yet what ever cattell or horses thus found contrarie to this order though pounded their owners are to pay all Just dam- ages & Two shillings six pence a beast besides for ye Townes use alsoe it is ordered by ye Constable & Overseers yt what ever person shall leave open any gates belonging to ye plaine or pull downe any rayles or bars & soe leave them not shutt & set upp againe hee or they soe doeing shall pay all damage yt doe arise thereby & alsoe Two shilling six pence for ye Townes use besides.


And whereas by reson of ye unrulines of horses yt are brought into ye pound whereby ye pound is often broken & wanteth repairing it is ordered by ye Constable & Overseers yt what ever horses or Mares young or ould yt are either haltered or marked in ye pound they shall pay one shilling to ye Towne a peice for to helpe ye repairing of ye pound : & all persons hereby are required to attend to what ye Coun- try law requireth of them for ye entering of what horses or Mares they Doe marke & yt uppon ye penalty of ye forfeiture in ye law specified for their neclect of ye same : And if it fall out yt any cattell be bayted contrarie to this order on ye plaine & it should fall out yt they are not pounded for want of time or opertuuity yet the owners shall pay however ye Two shillings six pence to ye Townes use a peice though not pounded.

BOOK F, page 8 .- May ye 5, 1679-Mr. Backer have entered one mare of a bright Bay Couler & a dark browne Mane & Tayle with a croacked white streke downe her face & about 12 yeeres ould cropt in ye left eare & slit downe in ye same & a halfe peny in the under side of ye right eare Branded with B. on ye left Buttuck and A on ye right Buttock, alsoe one horse of Two yere ould being a bright bay of a flaxen myngled coulered mane & Tayle & a long starr in ye forehead & Two white feete behind marked with a crop on ye left eare & slit downe in ye same yeere & a halfe peny under ye right eare, & alsoe one yereling mare being a bright bay & a flaxen mane & Tayle & one white hoofe behind & marked with a crop on ye left eare & a slit downe in ye same & a half peny on ye under side of ye right eare & these Two are Branded with B on ye left buttuck. And alsoe one young horse Cowlt of a bright Bay and a white streeke downe ye face marked with a crop in ye left eare & a slit in ye same & a half peny under ye right eare.


Tho. Backer Junr. have one bright Bay mare of six yere ould with a black mane & Tayle & a white streke downe ye face marked with a crop & a slit on ye left eare & a halfe peny under ye right eare alsoe one mare coult of a bright Bay with a white streke downe ye face & ye outside of some part of ye hoofe of ye right foote white & eare marked as ye rest above mentioned & alsoe one bay horse with a black mane & Tayle & a black list downe ye back & foure yere ould & marked on ye yere as ye rest above mentioned & a star on ye forehead.

Book O, page 31 .- [Concerning the horse mill built or or- dered August 5, 1678]-It is agreed uppon by this Company heere subscribed yt not any one person as hath not yet sub- scribed his name to the agrement for building this mill aforc- said shall bee received as a partner with ye rest neither direct-

ly nor Indirectly without ye Consent of ye whole It is farther agreed upon by ye aforesaid myll Company yt none that have share in the said mill shall grind above two bushells of corne in a day to ye hinderance of any other of his partners upon the penalti of payinge two shillings ye bushell to ye party soe hindered.


The above written premises about the mill with the names of ye men belonging to her is a true Coppy as it was inserted in ye Originall agrement by me Tho. Tallmage Recorder.


Book F, page 15 .- Mr. Thomas Backer hath delivered in xchang to Nathaniell Backer who went in other places as it is crediblie reported by the name of John Edwise one bull of about six ere ould of a dark redd colour with a star like a hart in his forehead and a little white uppon both flankes & some white upon his hinder leggs & white on the end of his Tayle & marked with a cropp on ye left eare & a slit downe in ye same care & a half peny under ye right eare & this bull have some white under his belly : upon this exchang the foresaid Nathaniell. Backer or Edwise have delivered unto Mr. Thomas Backer Two cattell both of them redd & 2 yere ould one of them a litle white about her bagg and a white face marked with a crop on ye right eare & halfe the forepart of the left eare cut of & now marked by Mr. Backer with a crop on ye left eare & a slit downe ye same & whereas before this beast was marked with a cropp on ye right eare he is now marked with a halfepeny under the same eare & marked on ye left horne wth B & the other being a redd heifer the midle of her face white & her cheecks white with some redd from her eyes to her nose & a white belly from her bagg to her Dew lapp & a little white upon ye end of her Tayle & eare markt as it was & as is now formerly mentioned on ye other heifor above mentioned & branded as formerly mentioned in ye other beast: entered this 31 of May 1679.

Book F, page 6 .- Symon Heillier have entered one bay horse of a yeere ould & vantage with a starr in his forehead a browne mane & Tayle & brownish leggs marked with Two slits in ye left eare & a half peny under ye same which came of a mare yt hee hadd formerly of Thomas IIand.

BOOK O, page 40 .- The Militia of This Towne being at present without Coulours & it being this day proposed to the souldiers that there might besome meanes used for ye procure- ing and suplying of yt want & severall wayes were proposed for ye attayning of them among which Beniamin Conckling made this tender yt he would purchase a paire of Coulors for the use & service of this place such as may bee good & suit- able for yt end & yt at his owne Cost & Charge if hee might bee freed for his life time from Trainings & from wachings & wardings uppon ornarie times onely yet if such times of dan- ger & trouble should befall us yt wee must stand uppon our defence for our safty son as to kepe Corts of guard for or waches in ye night season & ward by day & for feare of some apparent danger yt yn hee did not looke to bec freed when all. men in Generall was to stand uppon the defence uppon which account as is here spoken his motion is accepted & he freed by Consent of ye said Towne.
