Resolved, That Colonel Butler be advised of the directions of Council that Martha Boggs be left in possession of the aforesaid premises, free from all disturbance, until return be made into the Surveyor General's office of the lott upon the west side of Alle- ghany river, granted to him by act of Assembly and confirmation by Council.


Upon consideration of the resolution of Assembly dated yesterday, . Mr. Biddle, Mr. Hoge and Mr. Hiester, were appointed a com- mittee of Council to confer with the committee of the General As- sembly on the subject of the accounts of James Searle, Esquire.

The Comptroller General's report upon the pay roll of Captain Jacob Sweir's company of Bucks county militia, was read and ap- proved, and an order drawn for their pay from the fifth day of Oc- tober to the fifth day of December, 1784, amounting to two hun- dred and sixty-six pounds thirteen shillings specie, to be paid out of the fines which have arisen from the delinquencies within the county of Berks, of such as refused or neglected to perform their tour of service on the late expedition to Wioming.


The Comptroller General's report upon the accounts of William Guthrie, Esquire, Captain of the Westmoreland County Rangers, from May, 1780, to January, 1781, was read and approved.


A letter from William Maclay, Esquire, inclosing a representa- tion from the Little Beard and the Big Tree, two Sachims of the six nations Indian tribes, was read.

The Comptroller General's report upon the account of Abraham Van Cortwright, Contractor for the supply of the troops employed on a late expedition to Wioming, was read and approved, and an order drawn for twenty-eight pounds three shillings and four pence, being the ballance in his favor.


Mr. Stiles was directed to furnish Mr. James Pearson with such plank boards and other materials, the property of the State, (in his possession,) as may be proper for the repairs now making upon the State House.


An order was drawn upon the Treasurer in favor of the Hon- orable James Irvine, Esquire, for the sum of one hundred and sixty- six pounds thirteen shillings and four pence specie, in full for his salary as Vice President from November the sixth, 1784, untill the fifth day of March, 1785, incl.

Ordered, That the Magistrate, Inspectors, Judges, Constables, &ca., who superintended the late clection of Justices for New Market ward, and the remonstrants against the said election, be advised that Council have set apart Wednesday next for hearing the charges of the latter.


Ordered, That the said remonstrants be directed to come pre- pared with such evidence as they can adduce in support of their charges.

An order was drawn upon the Treasurer in favor of Samuel John Atlee, Esquire, for the sum of one hundred and thirty-four pounds nine shillings and one penny specie, being the balance of his account as Colonel of a State regiment of musquetry, to be paid out of the class tax fund.


The petition of Jane Barker, for her husband Michael Barker, with a recommendation from the Magistracy of the city, was read, and an order taken that the fine of five pounds imposed upon the said Michael on conviction of an assault and battery, be remitted.


Ordered, That Friday next be set apart for hearing and deter- mining upon the complaints against the late election of a Justice of the Peace for the district of Germantown, and that the parties be instructed to bring forward the tally list, and such other evidence as they can respectively adduce.

The Comptroller General's report upon the accounts of the Com- missioners from this Commonwealth for treating with the several Indian tribes, was read and approved, and an order drawn agreea- bly thereto for the sum of four hundred and eighty-four pounds nine shillings and three pence specie, being the ballance due by the State thereon.


The petition of Joseph Rakestraw was read,


Agreeably to an order of Council of Friday the eleventh instant, the Judges and Inspectors of, and remonstrants against, the late election of a Justice of the Peace for the New Market ward ap- peared in Council, and were respectively heard. A farther considera- of this subject was postponed till to-morrow.


The following draft of a message to the General Assembly was presented to Council, read and adopted.

GENTLEMEN :- We have this day received the inclosed letter from the Governor of the State of New York, with the copy of the act therein mentioned. Circumstances requiring that the boundary line should be run and ascertained with all convenient dispatch, we hope for an early determination of your Honorable House upon the business.

A consideration of the late election of a Magistrate for New Market ward was this morning resumed, and the following orders taken, vizt :- That the charges stated against the legality of the election aforesaid are unfounded, and that Joseph Wharton, Es- quire, be commissioned a Justice of the Peace for the said ward, agreeably thereto.


An order was drawn upon the Treasurer in favour of the Honora- ble Isaac Meason, Esquire, for the sum of six pounds two shillings and six pence specie, in full for his attendance in Council untill the eighteenth instant.


The committee appointed to examine the claims of Captain Thomas Houston, to depreciation of pay, and other benefits extended to the Naval Officers of this State, made report thereon, which being read, was transmitted to the General Assembly.

The petition of Captain James Lang, praying that an order be taken for discharging the ballance reported by the Comptroller to be due by the State to him, was read, and an order taken for the sum of one hundred pounds specie, payable out of the monies due by Samuel Penrose, for the rent of Province Island.


The complainants against the election of a Justice of the Peace, held on the thirteenth day of December, 1784, for the district of Germantown, not appearing agreeably to the order of Council of the twelfth instant, their petition and remonstrance was dismissed.


The Comptroller General's reports upon the pay accounts of Colonel Kern and his detachment of Northampton county militia, called forth upon a tour of duty to Wioming, by order of Council, were read and approved, and orders drawn for the ballance due by the State, amounting to one thousand and twenty-five pounds fif- teen shillings and six pence, to be paid out of the delinquencies arising upon this tour of duty.


Colonel Kerns' account for ammunition furnished for public use, was also read and approved, and an order drawn for the ballance, being two pounds and ten pence.


The Comptroller General's reports upon the surplus certificate of Caspar Thomas, Peter Borea, Michael Forker, Peter Diffenback, Christian Fisher, and John Brown, of the county of Berks, were read and approved.

Ordered, That a committee be appointed agreeably to the re- quest of the above mentioned letter, and that Mr. Biddle and Mr. Wall, be that committee.


The Comptroller General's reports upon the surplus certificates of John Wenrick, Andrew Tucker, Andrew Foght, Daniel Reed, Jacob Anspach, Adam Emmerick, Jacob Ortz, Nicholas Weyand, Frederick Wolf, and George Reim, were read and approved.


The following orders were drawn upon the Treasurer in favor of the Honorable John Boyd, Esquire, for one hundred pounds spe- cie, being a part of the ballance due on his account as late Captain of a Ranging company, to be paid out of the arrearages of the eighteen penny taxes, appropriated by resolution of the General Assembly to the defence of the frontiers.

Council proceeded to the appointment of the Agent provided by a law intitled " An Act for directing the mode of distributing the donation lands promised to the troops of this Commonwealth," when Brigadier General William Irvine was appointed.


General Irvine having subscribed the oath of office, an order was issued in his favor for the sum of ninety pounds specie, under the said act, as part of his pay.


A letter from James Milligan, Esquire, informing Council that agreeably to a late act of Assembly, he had proceeded to the ap- pointment of an additional Commissioner for settling the accounts of the citizens of this Commonwealth against the United States, and that John Story, Esquire, was the person so appointed, was read, and an order taken that it be referred to the House of As- sembly.


The farther consideration of Doan's case was postponed untill Monday.
