Y.) dairyman called at a drug store there for a doctor to come aod see his child, then very sick with cranp. Not finding the doctor in, he left word for him to come at once on his return. One of the besetting sins of the ex. pert witness is the habit or tendency to use a lot of Latin words in describa- ing an injury to the jury. In some ex- ceptional cases, doubtless, this is done wilhout affectation or for a purpose, but we have uo hesitation in saying that iu the ntajorlty of Instances it ix a very good index of the learning and capacity of the expert, on the assump- liou that the more words of this sort are used tbe more probability there is that they cover a deficiency of knowl- elge and thorough grounding ou the part of the user. A really able man In his profession will always accommo- date himself to circumstances, and, realizing the capacity of the average juror, use very different forms and methods of expression in testifying be- fore court and jury than if he were making an address or delivering a paper on some scientific subject before an audience of bis professional hreth- ren.
A physiclan, for example, wbo, when upon the stand. he is asked to describe something to the jury, uses all the high- sounding terms and expressions he can muster, deserves to have very little attention paid to hls testimony-and usually gets his deserts. An amusing example of this truth is given in the following account of an actual happen- ing in an English court. It is from a little book entitled "Hints on Advo- acy," publisbed first in England:
"I discovered considerable ecchy- mosis under the left orbit, caused by extravasation of blood beneath tbe cuticle," said a young house surgeon, In a case of assault, at the assizes. you Baron Bramwell-I suppose megn tbe man bad & black eye? Scientific Witness-Precisely., my

"Perhaps, if you had said so in plain English, those gentlemen would better understand you."
"Precisely, my lord," answered tbe learned surgeon, evidently delighted
that rne junge understood bis meaning. This incident, which might be paral- leled many times In court in this conn. try. carrles Its own comment. Whst the jury wants is to be enlightened on disputed polnts, and the way to do this is not to use purely technical expres- sions, but to explain in plain, homely language. There is no danger that In doing this the expert will be liable to detract from the general estimate of his own abilities, but rather the reverse will be the case .- Albany Law Journal.
