JOHN SEARS, 55. Peirce City truck gardener. who is being held : :a connection with the killing of i Charles Schroeder. 50, his neighbor. there Saturday morning, was taken to Mount Vernon Saturday after- : noon and placed in the Lawrence county jail. A preliminary hearing has been . set for July 30. in the foot of Justice Z. T. Martin but stad a change of renue.

The motive : for the ' action of Sears. against whom Prosecuting i Attorney Charles Landrum filed A ·· · ··· dreier murder Sat-

Schroeder noticed his neighbor had a gun when he passed by on his way after the cows, according to the story told by Sears, and acked ! What are you doing with the' gun?“

"I'VE GOT THEM" -+

Sears said he told Schroeder tha: :

he was after some rabbits, to which the siain man is said to have re- plied, "Well. I've got the rabbits you want. I guess.' At thus, ac- cording to the story Sears is said ito : bave told the officer, he raised his gun, s .12 gauge shotgun, and fired at Schroeder at close range. The load of shot struck Schroeder the left check, but did not kill him Instamiy Bueinarks in the grass indicated that he.walked about 150 paces before falling to the ground at the spot where his body was later found by Marshal Harper and Deputy Coroner William Wes- sell.

Parce City residents, whose sym- pathy was said to be predominantly for Schroeder's widow and four small children. ranging in age from 2 :0 11 years could not account for ·the killing. Both men were highly regarded citizens, it was said, and . were not known to have had any serious trouble. They had lived on adjoining farms. at the south edge : of town for several years.

ORDERED FROM PASTURE

It was reported. however, that Schroeder had recently ordered Bears out .of his pasture when the 'Jaster had failed to repair the fence after hauling some wood through the fle! This difference had been . patched up. it was thought.

Coroner E. L. Patton of Aurora "Investigated the case, together with Prosecutor Landrum, but did not conduct a formal inquest. in view ( ' Sears' statement to Marshal Har-

were no eyewitnesses, it is believed. The point where Schroeder's body was found was more than 200 yards no one has been found who heard | the shot fired.

The death certificate. signed by Coroner Patton. stated that Schroeder "came to his death by a gunshot wound fired by John Sears and which caused instant death."

Bater and Medlin, attorneys of Aurora, are preparing Sears' de- j iense. It is not believed ne will waive preliminary hearing Follow- ing the granting of a change of venue at the hearing Saturday afternoon. Justice Martin of Peirce City refused to allow Sears to make bond, so he was taken to the county

jaul at Mount Vernon by Sheriff A. :. Hensley.

No funeral arrangements have yet been made for Schroeder, but it is expected burial will take place Mon- day near Peirce City.

John Sears is a brother of Fay W Spare of 2206 Pierre avril in 11:0 city. The Springfield man wen. to ! Peirce City immediately after he ! learned of his brother's arrest Sal- urday, but he would make no con- ment last night about the killing.
