On motion, agreed that William Atlee, Esq., be appointed one of the Judges of the Supreme Court of this Commonwealth.
John Connolly, a prisoner confined in the Goal of this City, be permitted to retire to the Plantation of James Ewing, Esq., giving security himself in Two Thousand Pounds, and Two Freeholders in One Thousand Pounds each, this Security being given for his good behaviour, and that he will continue within five Miles of the same, vizt : That John Connolly do not either write to, speak or Correspond with any person or persons whatsoever, employed by or under the Authority of the King or Parliament of Great Britain, nor to or with any person or persons unfriendly to the United States of America, knowing them to be such, nor take up Arms, or employ or procure any other person or per- sous to take up Arms against the said States, or aid or assist the Enemies thereof in any sort whatsoever, nor do or say any matter or thing, directly or indirectly, which in any wise is or may be in- jurious to the said States or any of them : And that the said John Connolly do confine himself on the Plantation of the above named James Ewing, and within five Miles of the said Plantation, situated in the County of York, and the same whereon the said James Ew- ing now dwells, and that he, the John Connolly, shall be and appear before the Supreme Executive Council of the Commonwealth, when thereto he shall be required, then the above obligation shall be void, or otherwise remain in full force and virtue.

Ordered, That a Copy of the Letter from General Washington be immediately sent to the Board of War.
Ordered, That Expresses be immediately sent to Northumber- land and Cumberland Counties, with the Sub-Lieutenants' Commis- sions.
The Continental Board of War laid before the Council The ex- amination of James Molessworth, who was executed as a Spy.
Ordered, That the Secretary write To Richard Tea, Esq'r, and request his attendance in Council.
On motion, Agreed, That James Reed, Esq'r, be appointed Pro- thonatory of the County of Berks, and that he be Commissioned accordingly.
On motion, Agreed, That Walter Shee be appointed Collector of the duties of Tonnage.
Agreed that a Prothonatory for the County of Chester be chosen by ballot; and Benjamin Jacobs was elected and appointed Pro- thonatory of the County of Chester.
Agreed that Jonathan Bayard Smith be appointed Prothonatory of the City and County of Philadelphia, and that he be Commis- sioned accordingly.
Mr. Isaac Hazelhurst represented to the Council that a Sum of Money, the property of Robert & N. Hyde & Company, of Man- chester, had been lodged in his hands by William Wild, and that he had given'a bond to the Committee of Inspection of Philadel- phia, to be accountable to this Council for the said Money, and Prays that the said Bond may be Cancelled.
Colo. Francis Gurney, who was acquainted with that transaction, being called before the Council and examined, and there appearing no sufficient reasons for detaining the said Money any longer ; thereupon,
Ordered, That the said Bond be delivered up to Mr. I. Hazle- burst.

The Petition of Capt. Blewer, Mr. Milton, Mr. Gardner and Doc- tor Phile, were read.
On motion, Agreed that a Naval Officer be balloted for ; where- upon, Doctor Frederick Phile was chosen and appointed Naval Officer for the Port of Philadelphia.
A General Commission of the Peace for the County of Chester was issued this day, dated the 81st March, 1777, and the Dedimus Potestatem for the same County was also made out, dated April 10th, 1777.

Agreed that the Delegates of this State apply to Congress to call out the Militia of Pennsylvania, that the sense of Congress be taken on the Number necessary, and for how long time; And as the Militia has lately been out, and many of them are disgusted that the Non Associators of this State have not yet been compell- ed to contribute any thing towards the Association, or in support of - the American cause, and that some of the Associators have screened themselves from the service of the last Campaign ; And they com- plain very heavily that the burthen lays entirely on those who are willing to go forth : there is also great complaints: of some of the Militia being obliged to go home without their Pay ; the opinion of Congress is desired whether a Bounty ought not to be given, and how much.
Frederick Phile appeared and took the Oaths required by the Constitution of this State, to Qualify him for the Naval Office ; thereupon,
Ordered, That a Commission be made out to Frederick Phile, as Naval Officer for the Port and District of Philadelphia.
Mr. Jonathan Bayard Smith acquainted the Council that the Representatives of this State desired a conference with the Council, which the Council agreed to, and Mr. Morris, Mr. Robberdeau, Mr. Jonathan Bayard Smith, Mr. Wilson, Mr. Clymer, were intro- duced into the Council Chamber. They laid before the Council the information received by Congress respecting the probability of

On motion, Agreed, That John Armstrong, Esq'r, be appointed first Brigadier General for the State of Pennsylvania. Agreed, That John Cadwallader, Esq'r be appointed second Brigadier Gen- eral of the State of Pennsylvania. Agreed, That James Potter, Esq'r be appointed Third Brigadier General of the State of Penn- Bylvanin. Agreed, That Samuel Meredith, Esq'r, bo appointed Fourth Brigadier General of the State of Pennsylvania.
Ordered, That the Brigadier Generals be immediately Com- missioned.
The Board of War informed the Council that the Hundred Thousand Dollars borrowed of Congress, and put into their hands, is expended, and that there are many of the Troops prevented from Marching, and the Recruiting and other Public Business in- terrupted for want of Money, and therefore, they request a Supply of Two Hundred Thousand Dollars ; thereupon,
Agreed, That the Board of War of this State be empowered to apply to Congress for the Sum of Two Hundred Thousand Dollars, for the purpose aforesaid.
Mr. Hubley, Representative in this Council for the County of Laneaster, presented to the President a resignation of his Seat in Council ; thereupon,
Ordered, That a Writ be immediately made out and directed to the Sheriff of the County of Lancaster, authorizing and command- ing him to hold an Election for the choosing a Councellor in the room of Mr. Hubley ; on motion,
Agreed, That John Hubley, Esq'r, be appointed Prothonotary of the County of Lancaster, and that he be Commissioned accord- ingly.
Agreed, That John Hubley, Esq'r, be appointed Clerk of the Orphans' Court of the County of Lancaster, and that he be Com- missioned accordingly. John Hubley, Esq'r, appeared and took the Qulifications required by the Constitution to Qualify him for the said Offices : he was Commissioned accordingly.
The Navy Board presented a List of Officers, whom they recom- mended to be Commissioned on Board the Navy, as follows : Fire Sloop Etna, Capt. William Clerk ; Fire Brig Volcano, Lieut. On motion, Agreed, That Paul Fooks, Esq'r, be appointed No- tary and Tabellion Public for the English, French & Spanish Lan- guages, and Interpreter of the same.
Walter Shee appeared and took the Oath of office required by the Constitution to Qualify him for the Office of Collector of the duty of Tonnage.
On motion, Agreed, that John Creigh be appointed Clerk of the Orphans' Court of the County of Cumberland, and that he be Commissioned accordingly.

Colo. Costs applied to Council for John Norris, (a Son of William Norris,) a lad of fifteen Years, taken with Major Stock ton, and now in our Goal, requesting that he may be liberated, on the fath- er's engaging to see him forth coming when called for. Agreed that he be liberated accordingly.
Mary Taylor, Wife of John Taylor, of the Township of Ridley, in the County of Chester, complained to the Council of a violent assault, committed against her yesterday by Thomas Forrest, (for- merly a Servant of Alexander Kidd,) he presenting at her a gun, which she understands was loaded, and that she is afraid he will do her some bodily hurt; and she being sworn to the said facts, there- upon,
Ordered, That the said Thomas Forrest be committed to Goal, untill he finds Security to keep the Peace.
William Dewees, Esq'r, late Sheriff of the City and County of Philadelphia, laid before the Council an Account of the Fees due from a number of persons, delivered to the order of the late Council of Safety.
Ordered, That the same be referred to the Board of War.
On motion, Agreed, That Jacob Plankenhorn be appointed the Oficer for inspecting of Flour for the City & County of Philadel- phia.
On motion, Agreed, That David Rittenhouse, Owen Biddle, Joseph Dean, Richard Bache and John Shee, be appointed and Commissioned to act as a Board of War for this State.
Petition of John Ord praying to be continued 'Notary Public, was read ; and thereupon,
Ordered, That John Ord be appointed a Notary Public, and that he be Commissioned accordingly.
The following orders were drawn on the Treasurer of the State, Vist :
An order in favor of Timothy Berrett, for the Sum of Nineteen Pounds Ten Shillings, for Candlesticks, &c., purchased for the use of the Council.
An order in favor of Robert Bell, for the Sum of Nineteen Pounds Ten Shillings, for Books, &ca, purchased for the use of the Council.
An order in favor of Michael Boyer, for the Sum of Ten Pounds Ten Shillings, for riding several times as an express for Council.
Richard Tea, Esq'r, Councellor for the County of Berks, sent in a Resignation of his Seat; and thereupon,
Ordered, That a Writ be immediately issued for electing Councellor for the County of Berks, in the room of Richard Tes, Eeq'r.

On motion, Agreed, That a Commission be given to William Atlee, Esq'r, to hear and enquire concerning certain charges against Joseph Richardson, said to be confined in the Goal of Lancaster, for certain misdemeanor, and to take Bail for his appearante to an- swer much charge, or otherwise, as to him shall seem just.

Joseph Reed, Esq'r, attended the Council, and informed them that some conditional engagements to Gen'l Washington, which he had entered into some time ago, were of such a nature that until some movements of the Enemy were made, and their designs in some measure known, and for some other reasons, he could not at present accept the appointment, but that he held himself bound to do everything in his power for the Interest of his Country, and as the Council intended an adjournment, he would consider farther of the matter & fix his resolution on this subject, &ca.
The State Navy Board sent in a recommendation of Two Officers of the Navy, Viz: Brigantine Convention, first Lieu't Douglas Spence. Battery Putnam, 2d lieu't George Myers. .
Agreed, That the Paymaster of the Pennsylvania Fleet be al- lowed Captain's Pay.
Ordered, That Lieut. Douglas Spence, and Second Lieut. George Myers, recommended by the Navy Board, be Commissioned accord- ingly.
The Secretary of the Board of War laid before the Council a draft by Congress on John Gibson, Esq'r, Auditor General, in favor of this Council, for One Hundred Thousand Dollars, date yester- day.
Ordered, That the same be made payable to John Maxwell Nes- bitt, Esq'r, Treasurer to the Board of War.
Mr. Clymer, Mr. Robberdeau, Mr. Smith, and Mr. Wilson, at- tended and laid before the Council a Letter from General Patnam, dated Yesterday, respooting the motions of the Enemy.
Agreed, That Two Members of the Board of War of this State be requested to attend the Council.

Ordered, That the following Address to the Public be imme- diately published and dispersed :

" In Council, Philadelphia, April 9th, 1777. " To the People of Pennsylvania :
"By the intelligence which the Council have this - day received from General Putnam, the Enemy are in motion toward South Amboy, and it is probable they will once more attempt to pass through New Jersey, and endeavour to gain possession of Phila- delphia. The Council think it a duty which they owe to the Pub- lic, to give them the earliest intelligence of the movements of the Enemy, that every possible effort may be made effectually to op- pose them, and prevent the many great inconveniences and disa- greeable consequences which must arise from the loss of the City, consequences which will effect not only the People of Philadelphia, & the State of Pennsylvania, but also the whole Continent of America. This City has been once saved by the vigorous, manly efforts of a few brave Associators, who generally stept forward in the defence of their Country, and it has been repeatedly and justly observed, and ought to be acknowledged as a signal evidence of the favour of Divine Providence, that the lives of the Militia, in every Battle during this just War, has been remarkably spared ; confi- ding, therefore, in the continuance of his blessing who is indeed the God of Armies, let every Man among us hold himself ready to march into the field whenever he shall be called upon so to do; if the Enemy really intend to make an attack on this State, no time should be lost; every moment should be employed in putting our- selve in perfect readiness to repel them.
" The inconveniencies which naturally and unavoidably will arise from the Militia taking the field, induseth The Council to wait as long as may be consistent with the Safety of the State, before they call them to Arms. In Justice to yourselves and posterity, we en- treat you to be ready, for whenever the time shall come wherein you must either tamely submit yourselves to the immediate insults of haughty Tyrants, whose lust and avarice will make a prey of every thing which human beings, while they retain their senses, esteem worth possessing, or bravely determine to oppose your ene- mies in the field. The notice will be short. The call must and will be sudden, and it is too probable, may happen in a few days. The Militia of this State, it is feared, cannot be arranged under the

Law, in time for the present emergency. Yet, we have not the least doubt but that the same spirit of Liberty which blazed forth in the Winter Campaign, will animate every virtuous breast to act once more on the same generous principles, which in the depth of Winter led you forward to. a harvest of Glory on the Hills of Princetown. The cause is the same, and the Prize we contend for far from losing its lustre, is become more valuable to Us, by the price we have already paid for it. Those who shall go into the field on the present occasion, will be considered as having taken their 'Tour of duty, and will not be called upon again untill the Whole Militia of the State shall have served in turn, agreeable to the Spirit of the Militia Law. Congress propose to form a Camp near the City of Philadelphia, to which the Militia of Pennsylva- nia will, when called upon, repair. Arms, Tents, and the necessary Camp Equipage, are provided, and the utmost attention will be given to the measures necessary to make a Spring Campaign as agreeable to you as possible. It is your own virtue and firmness, next to the care and protection of Heaven, that you must depend for your Liberty and Safety, and a spirited conduct in the time of danger will fix your character both at home and abroad.

An order was drawn on the Treasurer of the State in favor of Jonathan Hoge, Esq'r, for the Sum of Sixty-Eight Pounds Seven Shillings & Six Pence, in full for his attendance as Councellor, and Mileage one Hundred and Eleven Miles, at Ten pence p Mile.
An order was drawn on the Treasurer of the State in favor of John Lowdan, Esq'r, for the Sum of Eighty-five Pounds One Shil- ling and Eight Pence, in full for his attendance as Councellor, and Mileage one Hundred and Seventy Miles, at Ten pence p Mile.
An order was drawn on the Treasurer of the State in favor of John Proctor, Esq'r, for the Sum of Ninety Pounds, Twelve Shil- lings and Six Pence, in full for his attendance as Councellor for Sixty-Three days, and Mileage for Two hundred and Eighty-four Miles, at Ten pence @ Mile.
Mr. Gunning Bedford and Mr. Thomas Nevil having examined the Old Goal of this City, and reported to the Council that con- siderable repairs were necessary ; thereupon,
