The Council being informed that a quantity of Indigo belonging to the State, purchased by the Council of Safety, is lodged in the hands of Robt. Levers, Esq'r, at Easton,


Ordered, That the Secretary do write to Robt. Levers, Esq'r, & direot him to send the said indigo down to this City by the first opportunity.


Col. Knox & Capt. Blower attended the Council and requested an order for Twenty-five Muskets & Twenty-five Men from the Galleys, to go on board the Brig Convention.

On consideration,


Ordered, That Thomas Philips be appointed first Lieut. of the Armed Brig Convention, & that James Simpson be appointed 2d Lieut. of the said Armed Brig.


On consideration of the conduct & character of the Agents for forfeited Estates in Bucks County, Richard Gibbs, Esq'r, having resigned, & the necessity that the most vigorous measures be taken within the said County to secure the Estates of Traitors belonging to thisState; it was


Resolved, That John Lacey, jun'r, Esq'r, and George Wall, jun'r, Esq'r, be appointed Agents & Factors for forfeited Estates within said County, & that the former appointments of Agents and Factors for that purpose within the County of Bucks be super- ceded, And the Secretary is directed to prepare instructions & trans- mit the same with this Minute, to the Agents now appointed.

An order was drawn on the Treasurer in favor of Jacob Stein- mitz, for the Sum of One Hundred & nine Pounds Two Shilling & Six Pence, for Bricks furnished by him for repairs to be done at the State House.

Mr. Arthur Donaldson having represented to Council that he found himself under difficulties in procuring necessary supplies for the raising the Wrecks in the River; thereupon,


Ordered, That the Navy board & the Commissary of Stores, do from time to time furnish Mr. Arthur Donaldson with such Stores & other assistance as he may have occasion for in his attempts to raise the Wrecks in the River Delaware : It is probable that the Gallies and Boats may be wanted in this Service, & in case they are, Mr. Donaldson is to have their assistance.


Jacob Barge & Reuben Haines, two of the Wardens of the City, attended the Council & represented that, from the situation of pub- lic Affairs no Lamp & Watch Tax has been Collected for Two Years past, and that the Wardens have contracted considerable debts in supplying the Lamps with Oil, paying Watchmen, &ca, & that the stock of Oil is now entirely expended, in consequence whereof the Lamps cannot be lighted, nor have they been lighted for sometime past; That a Tax for the raising of Money for this purpose cannot be collected in any short time, & therefore, request the Council to lend them One Thousand & five hundred Pounds, to pay the Debts contracted with private persons, & furnish a present supply of Oil, the said sumn to be repaid as early as possible.


On consideration,


An order was drawn on the Treasurer in favor of Jacob Barge, one of the City Wardens or his order, for the Sum of Five hundred Pounds, to purchase a present supply of Oil for the City Lamps, to be charged to the City Wardens, & to be repaid by them as soon as possible.

Ordered, That Mr. Allison do furnish John Mitchell, Esq'r, D. Q. M. G., with a Waggon load or two of the Pickets taken up from the Redoubts, for the purpose of repairing a breach in the bank of the State Island.

An order was drawn on the Treasurer in favor of William Cris- pin, Commissary of the State Fleet, or bis order, for the Sum of Five hundred Pounds, to be charged to his account.


The Resolve of the Hon'ble House of General Assembly of the 17th instant, recommending to this Council " to retain & employ in the Public Service such able Council as they may think neces- sary, to Assist the Attorney General in the prosecution of Public offenders, & that they make a proper compensation for their ser- vices," being read, & the same being considered,


Ordered, That the Hon'ble Joseph Reed, Esq'r, be applied to & retained to Assist the Attorney General for the present year, & that the Sum of Two thousand Pounds be allowed him for his ser- vice for one year.

Mrs. Frances Raddon, wife of Capt. Raddon, having requested of the Secretary a Pass to New York, & represented that she was Pregnant & near the time of delivery, that she was very desirous to be with her husband, on whom she depends for her support, & that she has no intention of returning to this City ;


On consideration;


Ordered, That a Pass under the State seal be made out, signed by the President & attested by the Secretary, permitting the sand Frances Raddon to pass on her way to New York, & recommending her to the Officer Commanding the Troops next to the Enemy.


On consideration of the proposal of Arthur Donaldson for raising the Wrecks in the River Delaware,

The Council now took into consideration the Resolve of Congress of the 15th instant, with the Papers therewith enclosed, relating to the case of Frederick Verner, under sentence of death, passed by a Court Martial, on which the opinion of the Hon'ble Thomas Mc- Kean, Esq'r, Chief Justice of this State, has been given in the following words, vizt :


" I have perused & considered the proceedings of a General Court Martial, held in the city of Philadelphia by order of Major General Arnold, on the 29th day of July now last past, upon Frederick Ver- ner, and also the Extract of a Letter from the said General to Con- gress, dated the 15th instant, which have been referred to me by the Supreme Executive Council of the Commonwealth of Pennsyl- vania, & upon the whole, beg leave to advise in favor of life; that the said Frederick Verner should be tried by the Laws of Pennsyl- vania for treason, & that he be detained in safe Custody until the next Court of Oyer & Terminer & General Goal Delivery to be holden at Philadelphia for the City & County of Philadelphia, then to be tried, & in the mean time, that the several witnesses be bound over to give evidence at the said Court, & that Maj. Gen'l Arnold be desired to send for Capt. Allen McLean, or any other person now in the Army in the State of New York, who can give evidence against the Prisoner, for the purpose aforesaid.

On consideration that the said Charles Dingee was committed to the Goal of the County of Lancaster as a place of greater security than that of the Countyof Chester at the time of his commitment,


Ordered, That the Sheriff of the County of Chester be author- ised & empowered to remove the said Charles Dingee from the Goal of the County of Lancaster to the Goal of the County of Chester, at the expence of him, the said Charles Dingee.

& gave the following account, to-wit : That about 11 O'Clock a Gun was fired at the Window, but struck below the Window, be had not two rounds of Ammunition at this time in his possession; his nearest neighbours refused to assist him in guarding him.


Ordered, That Capt. Stiles, Commissary'of Military Stores, do deliver to Capt. McAffee Ammunition & 4 Militia Men.

Petitions of John Knowles, Alexa. Murray & William Moland, were read, Praying, That as they had been made Prisoners by the British Troops, & were now upon their Parole, Abraham Iredell and others might be sent into New York to be exchanged for them, whereby they may be restored to their liberty.


Accounts of John Eyre & of Jacob Miller, for Lumber & plank that was taken from them & used by the Enemy in building a Fort, & afterwards taken & used by the State for the same purpose, laid before Council.


Ordered, That application be made to the President of Congress for Twenty-four blank, Commissions for private Ships of War; (the 12 ordered on the 27th not being furnished us.)


Samuel Morris the elder, Esq'r, & eighteen other Citizens of repu- tation, attended the Council, & the said Sam'l Morris, in the name of the rest, addressed the Hon'ble Vice President, & requested That the Council would compassionate the case of the four unhases Prisoners, Criminals, now under Sentence of Death, & spare the lives of the said Criminals, or some of them, they all appearing to be very penitent & sensible of their great offence, as well as of the justice of the sentence pronounced against them. The Hon'ble Vice President remarked the imposibility of suporting an armed, without making examples of offenders in this way, & that whatever the feelings the members of Council may have as Men, it must be remembered that the Council are to consider themselves as being

Ordered, That it be recommended to the Hon'ble Tho's Mo- Kean, Esq'r, Chief Justice, to make further enquiry into the said charge, & proceed therein according to Law.

Petition of Ignatius Labatte & Philip Angle, inhabitants of Fort Pitt, praying a pass with a Batteau laden with fur, to New Orleans, was read ; & thereupon,


Ordered, That a pass be accordingly granted.


A Resolve of the Hon'ble House of General Assembly was read, in the following words, to-Wit : ·


"In General Assembly, Friday Septem. 4, 1778, A. M.


" Resolved, That the Vice President & Council be authorized, impowered & required to take the most effectual measures for pre- venting the exportation of provisions from this State, until a law shall be enacted, or other regulations made by this Assembly. On consideration,


Ordered, 'I'hat agreeable to the Resolve of the Hon'ble House of General Assembly, the Embargo on provisions be continued for & during fifteen days from this date, & that a Proclamation be is- sued for that purpose accordingly.


The Resolve of Congress of yesterday being read, to wit :


" In Congress, September 3d, 1778.


"WHEREAS, Gen'l Washington has required that the Continental Troops in Philadelphia be sent to join the main Army, & that they they be replaced by the City Militia :


" Resolved, That the Supreme Executive Council of the State of Pennsylvania be requested to call out immediately three hundred of the Militia of the State, to serve as Guards in the City of Phila- delphia, & perform such other Military Services as shall be required of them.


"Resolved, That the Artillery Reg't raised in Pennsylvania, Com- manded by Col. Tho's Proctor, be considered as part of the quots of Troops to be furnished by that State, which is to be Credited for the Men now in the Regiment, & also for any which shall be hereafter recruited therein, & that the Government of the said State be requested to furnish Col. Proctor with the State bounty, to enable him to fill up the Regiment to its compliment of Men.

A Letter from Col. Will'm Irvine, of the 7th Pennsylvania Reg't, recommending Capt. Bratton & Lieut Russel & Millegan to go on the recruiting Service, and thereupon Recruiting orders were ao- cordingly given them as follows :


To Capt. Will'm Bratton to Lancaster County, with orders to the Lieutenant of the said County, to Supply him with Money from time to time, as he may have occasion ; and to Lieu. James Mille- gan to York Town, with orders to the Lieu. of the County of York to furnish him with Money for this service, and Lieu. Alex's Rus- sell, to Carlisle, with orders on the Lieu. of Cumberland County. Lien. Millegan to have orders to call on the Lieutenants of York & Cumberland. Lieu. Russel orders to the Lieutenant of the County of Lancaster.


An order was drawn on the Treasurer in favor of Cap't John Pearson, of the 9th Pennsylvania Reg't, or his order, for the Sum of One Thousand Dollars, for the Recruiting service, for which he is to aoco't.
