The recommendation by four of the Justices & the Sheriff of the County of Northampton, of Robert Clarke, convicted of Felouy in the said County, as a fit object of Mercy, & interceding for the remission of his fine and corporal punishment, was read, & the res- sons, whereon the same is founded being considered ; whereupon,


Ordered, That the fine & corporal punishment adjudged by the Court of the County of Northampton, to be inflicted on a certain Robert Clarke, be remitted.


An order was drawn on the Treasurer in favor of Mr. Joseph Carson, for the Sum of Nine thousand & forty-three Pounds and Ten Shillings, the balance due to him for a quantity of Woollens seized by this Council in the Great Swamp in the County of Bucks, & applied to the Cloathing of the Continental Troops, agrecable tos resolve of Congress for that purpose ; the said Sum, together with the Sum of Seven Thousand Pounds drawn in favor of the said Carson of the 7th January last, be charged to James Meas, Esq'r, Clothier General of the United States.


Mr. James Futhy having delivered into the Continental Stable, Eleven Horses purchased by him,


Ordered, That the Secretary give Mr. Futby a Certificate of the same.


An Address from the Wives & near friends of the Prisoners in Virginia being read & considered ; thereupon,


Ordered, That the Prisoners now in Virginia be brought to this Borough, instead of being enlarged at Shippensburgh.


The board of War having sent to Council an order to Jos. Holmes, Esq'r, to deliver over to the order of the President & Council of this State all Prisoners of this State now under his care; thereupon,


Ordered, That an order be endorsed thereon for the delivery of the said Prisoners to Mr. Francis & Capt. Lang. .


An order was drawn on the Treasurer in favor of David Watson, Esq'r, for the Sum of One thousand & five hundred Dollars, for the purpose of purchasing Horses in the County of York, for the Con- tinental Cavalry.

Lieut. Killer of the 10th Pennsylvania Battalion, sent into Lan- caster County, with orders on the Lieutenant of the County. Lieut. MoClellan, of the 1st Pennsylvania Battalion.


Capt. Miller of the 7th Pennsylvania Battalion, sent into the County of Cumberland, with orders on the Lieutenant of the mid County.


The following orders were drawn on the Treasurer, Viz :


In favor of Capt. Weaver, for the Sum of One hundred & fifty Dollars.

SUPREME EXECUTIVE COUNCIL.


Capt. Tho's Gourly, of the 9th Pennsylvania Regiment, having requested by Colo. Butler to undertake the Recruiting Service, attended the Council & received Recruiting orders for the County of York, with the general instructions to call on the Lieut. of the said County for Money.


Major Gen'l Green having represented to the Council, on the 13th instant, that there may probably be cases of great necessity for Waggons for the Army, which cannot be supplied by the mode di- rected by the Waggon Law; and that great difficulties have arisen in procuring Waggon Masters & Teamsters,. in consequence of the demands made upon them for their services in the Militia, or Pay- ment Substitution Money, in lieu of such Service ; and the same being taken into consideration, this Council are of opinion, That whenever, &ca. (See the 18th instant.)

An order was drawn on the Treasurer in favor of Elias Boyce, for the Sum of Six hundred & five Pounds, to be charged to Will'm Crispin, Commissary.

Ordered, That a draft be given to Mr. Spyker, on. Colo. Jacob Morgan, Lieut. of the said County of Berks, for the Sum of Six Thousand Pounds, and accordingly,


An order was drawn on Colo. Jacob Morgan, Lieutenant of the County of Berks, in favor of Henry Spyker, for the Sum of Six Thousand Pounds to Pay the Militia, for which he is to account.


An order was drawn on the Treasurer in favor of Mr. Christ'n Lower, one of the Commissioners for purchasing of Horses in the County of Northampton, for the Sum of Two thousand Five hun- dred Pounds to pay the Militia, for which he is to account.


An order was drawn on the Treasurer in favor of Fred'k Snei- der, Doorkeeper, for the Sum of One hundred & thirty-one Pounds One Shilling & Six Pence, being the Amount of his account for

sundry small expences paid by him, and for his attendance 123 days, ending the 16th instant.


An order was drawn on the Treasurer in favor of Robert Craig, one of the Commissioners of Lancaster County, for purchasing Cloathing, for the Sum of Two thousand Pounds, for which the said Craig is to account.


It having been represented to this Council that a considerable number of the Militia of the County of Chester, heretofore called in their respective Classes, from various circumstances have not performed their Tour of duty, nor as yet paid their Substitution Money, & the same being now considered ; thereupon,


Ordered, That such of the Militia of the County of Chester as have not performed their Tour of duty, or paid their Substitution Money, bo now called into service, & that the serving two Months under the present call, shall be accepted in lieu of their former service.


Major Gen'l Green having on the 13th instant represented to the Council that there may probably be cases of great & immediate necessity for Waggons for the use of the Army, which cannot be supplied in the mode pointed out by the Waggon Law, so as to an- swer such emergency; & he expressing an earnest desire of acting in the discharge of his duty as Quarter Master Gen'l in perfect harmony with this State, & of conforming to the Laws of it, pro- posed that some further authority be given by Law to him & his deputtes in extra cases. The Subject being duly considered, this Council are of opinion, That whenever a Sudden & extraordinary emergency shall make the impressing of Waggons by a Military force absolutely necessary, that necessity must, from the nature of things, justify the impressing by force of Arms, but that it would be improper to trust such powers in the Military by Law: And Maj. Gen'l Green having represented to Council That great diffi- culties had arisen in the procuring of Waggon Masters & Team- sters, in consequence of the demands made on them for their ser- vice in the Militia, or for Payment of Substitution Money in lieu of such Service; On consideration the Council are of opinion, That Waggon Masters & Waggon drivers, actually enlisted in the Conti- Dental service for a reasonable time, are not liable to serve in the Militia during the time of their continuing in such service, nor sub- ject to the Payment of Substitution Money : And that an enlist- ment in either of these services for Six Months, or longer time, ought to be considered by the Lieutenants & Sub-Lieutenants of the respective Counties of this State, as a good and sufficient cause to forbear levying the Substitution Money in such cases.

Joshua Williams is appointed to the recruiting Service in the place of Lieu't Henderson ; that Capt. Joseph Irwin & Lieu't Vanleer, of the 9th Pennsylvania Battalion, were appointed also to the re- eruiting service, & that Colo. Butler had sent out other Officers to recruit, requesting they may be supplied by Council with Money for that purpose.


Ordered, That these Gentlemen be furnished with recruiting or- ders & drafts for such Monies as shall be necessary.

These orders not being endorsed to Mr. Sommers, & therefore not payable to him, the Council found a difficulty in granting an order on the 'Treasury ; but Capt. Joseph Blewer having represented that the Money had been long due, & that Sommers was in Partnership with Lasky & Shriver ; on consideration,


An order was drawn on the Treasurer in favor of Captain Josoph Blewer, for the Sum of One hundred & Sixty-Seven Pounds five Shillings, to be charged to Will'm C. Bradford, Paymaster of the Fleet.


Also an order was drawn on the Treasurer in favor of Capt. Joseph Blewer, for the Sum of of One Thousand One hundred & Twenty Eight Pounds, Seventeen Shillings & Six Pence, the same to be charged to Will'm Crispin, Commissary.


Petition of John Young, (convicted in the County of Bedford, of having stolen 2 lbs of lead, & sentenced to receive Seven lashes,) Praying that his Punishment may be remitted, & the recommen- dation of him as an object of mercy by several Justices of the said .County, (and offering himself a Soldier in the Continental Army,) was read; Thereupon,


Ordered, That the Corporal Punishment of the said John Young be remitted, he entering into the Continental Army, to serve three Years or during the present war.


The two following orders were drawn on the Treasurer, for the recruiting Service, Vizt :


In favor of Philip Gibbons, Lieut. in the Sixth Pennsylvania Reg't, for One hundred & fifty Dollars, for which he is to account. In favor of Capt. Jacob Monser of the sixth Pennsylv'a Reg't, for One hundred & fifty Dollars, for which he is to account.


An order was drawn on the Treasurer in favor of the Hon'ble George Bryan, Esq'r, for the Sum of Four hundred & Fifty Pounds, balance of his half year's salary, due the first of March last.


Capt. Joseph Blewer of the Navy board, attended the Council, and informed that it was intended to have sunk the Gondolas, kes, on Tuesday last, near 'Trenton, & therefore, there cannot be & Ty further use in continuing the Men belonging to them at Trenta, and that there is about twenty sick & wounded belonging to Boats, which require care & attention ; That the Ammuniti Sails, Arms, Stores, belonging to the Boats, are at Pitts-town New Jersey, and require some guards to be kept over them ; 'T the Cannon & shot are sunk in different places in New Jerse That about 76 pieces of Canvas & some Oznabrigs, which were

Ordered, That the men belonging to the Navy be ordered up to this borough, under the direction of such Officers as the Navy Board, to whom they are best known, may judge most proper, & that two Months' Pay, over & besides what is due to them, be paid to the remaining Officers & then discharged, as there appears not to be any further service for them at present; That a small guard bo left at Pitts Town until the Stores be removed; That the Sick be ordered to this Borough, by way of Reading; That the Am- munition & most valuable Stores be removed from Pitts town to Easton, in the County of Northampton, & the remainder com- mitted to the care of Mr. Moore Farman ; That the Waggon Mas- ter of the County of Bucks, furnish Waggons to the State Navy Board for the removal of the Sick & baggage from Trenton to this borough ; That the Waggon Master of the County of Northamp- ton furnish Waggons to the State Navy Board for the removal of the Stores from Pitts town, in New Jersey, to Easton, in this State.

Ordered, That James McGill, Will'm Morgan, John Wiggons, Jacob Crusel, James McCarty, Abram Vankirk, and David Wil- liams, be committed to the Goal of this County, until further orders from this Council.

Lang & Mr. Bayly report, That they had received from Alex's White, Esq'r, who acted for & in behalf of Joseph Holmes, Esq'r, Deputy Commissary of Prisoners, the following persons, agreeable to the orders of this Council, Vizt : 1 Israel Pemberton, 2 James Pemberton, 3 John Pemberton, 4 Henry Drinker, 5 Sam- uel Pleasants, 6 Will'm Smith, 7 Edw'd Pennington, 8 Tho's Wharton, 9 Owen Jones, 10 Charles Eddy, 11 Charles Jervis, 12 Elijah Brown, 18 Thomas Fisher, 14 Sam'l R. Fisher, and 15 Myers Fisher ; and that the said Gentlemen were now in this bo- rough, agreeable to the order of Council.


They also report that they had received at the same time the three following persons, Vizt : William Rodan, formerly of Phila- delphia, Waterman, Thomas Patterson, formerly a servant of Mr. Dav'd Sproat of Philadelphia, & Jacobus Quigg, late of New Jersey, who had been sent to Virginia with the aforesaid Prisoners, and that they had been informed by. Alez'a White, Enq'r, that Thomas Gilpin & John Hunt were dead.

Thomas Afflick, one of the Prisoners sent to Virginia, having obtained leave to come to this borough, in consideration of the dangerous illness of his Wife, being also arrived here,


Ordered, That John Rodan, Tho's Patterson & Jacobus Quigg, be sent to Goal until further examined.


The case of the Prisoners brought from Virginia, & now in this borough, being considered ; thereupon,


Ordered, That they be immediately sent to Pottagrove in the County of Philadelphia, & there discharged from confinement; and that they be furnished with a copy of the order, which shall be deemed a discharge.


NOTE, under the Certified Copy of this Resolve, given to the respective Gentlemen, the following Certificate was inserted & signed by the Secretary, Vist :


(A. B.,) of the City of Philadelphia, Gentleman, one of the Prisoners referred to by the above order of Council, is hereby permitted, with his Horses, Servants & Baggage, to pass unmoles- ted into the County of Philadelphia, agreeable to the said order, which is to be respected as their discharge.


Mr. John Pemberton's tender conscience being hurt by the words, " agreeable to the said order, &ca.," the Secretary inserted in bis Certificate the following, "and he is there to be considered as dis- charged."


A pass to Philadelphia for Mrs. Jones, Mrs. Pemberton, Mrs. Pleasants & Mrs. Drinker, & for Israel Morris, who attended them, being requested ;


On consideration,


Ordered, That a Pass be granted to the aforesaid persons, with their servant, to return to Head Quarters, & from thence to Phila- delphia, if Gen'l Washington shall think it proper for them so to do.


The following orders were drawn, Viz't :


In favor of " Mr. Will'm Hart, or his order, for the Sum of One thousand Pounds, for the purpose of purchasing Horses for the use of the Army, and inform Dav'd Rittenhouse, Esq'r, Treasurer there- with, that he may charge Mr. Hart with that Sum, & Credit the same to Col. Joseph Kirkbride, Lieut. of the County of Bucks."


This order directed Col. George Wall, jun'r, Sub-Lieut. of the County of Bucks, and an order on the same Gentleman in favor of " Mr. Jos. Greer, one of the Commissioners of Bucks County, for purchasing provisions, &ca. for the Sum of Two hundred Pounds, and inform Dav'd Rittenhouse, Treasurer of the State, therewith;" in order that he may charge the same to Mr. Greer, & Credit Colo- nel Joseph Kirkbride, Lieutenant of Bucks County.
