. The Council taking into consideration the necessity of laying an Embargo on Provisions, as well to prevent the supplying of the Enemy, as to secure a full supply for the Continental Army,


Ordered, That a Proclamation be issued for laying an Embargo to prevent the exportation of Provisions from this State to any place.


" By the Supreme Executive Council of the Commonwealth of Pennsylvania :


" A PROCLAMATION.


" WHEREAS, The exportation of Victuals & Provisions from the United States of North America hath occasioned much difficulty in procuring supplies for the American Armies, & by the Capture of divers Vessels employed in such exportation, the forces of the Ene- my have relieved from distresses otherwise likely to embarrass their operations for .remedy, whereof, the Council do hereby an embargo on the exportation of Wheat, flour, rye, oats, spelts, bar- ley, Indian Corn, beef, pork, or other Victuals, whether alive or dead, from this State to any parts or place beyond sea, & for that purpose do forbid the clearing out and dispatch, & the Sailing of any Ship or other Vessel on which any such Goods & Victuals shall be laden, of which the Naval Officer, & the Commodore of the State Fleet, are required to take notice & govern themselves accord- ingly : Provided always, That the embargo shall be continued for Thirty days from the date of these Presents & no longer, & that the necessary Stores & Victuals during their voiages, as well for Ships of War as Merchant Vessels, shall not be hereby re- strained.


" Given by order of the Council, under the hand of the Honorable George Bryan, Esq'r, Vice President, & the Seal of the State, at Philadelphia, the first day of August, in the year of our Lord One thousand Seven hundred & Seventy-eight.

Ordered, That Thomas Humberge do bring down the Gunpow- der now in his possession, & deliver it to Capt. Joseph Stiles, of this City, for the use of the State.


An order was drawn on the Treasurer in favor of Peter De- haven, for the Sum of Two thousand Pounds, for the use of the Gun Factory.


And an order was drawn on Will'm Henry, Esq'r, of Lancaster, for Two hundred Gun Locks, to be taken from the insufficient Dutch Arms belonging to the State in his possession.


The Council considering the dangerous tendency of Precedents of assumed Power in cases which may appear to be justifiable from necessity ;


Ordered, That a solemn Protest against the proceedings of Con- gress on the 8th day of June last, for laying an embargo on Pro- visions to prevent the exportation thereof, be entered on our Min- utes, that the said proceeding may not be hereafter drawn into a Precedent, in favor of any claim of right hereafter to be set up to use & exercise the power & authority to lay embargoes in this Stste. And the following being Prepared and read, the same was ap- proved & ordered to be inserted as their protest :

Ordered, That the full Rations of Mr. Sprogell, Muster Master, be furnished to him by Mr. Crispin, Commissary of the State Fleet. (These Rations are not be drawn farther back than to the 18th of June.)

George Stewart, of Earl Township, be re- quired to attend this Council on Thursday the fifth day of Septem- ber next, at nine o'Clock in the forenoon, to answer the Charge of misbehaviour in his Office, as Agent for seizing of forfeited Estates, in the Sale of Goods lately belonging to Michael Wittman; And that a Copy of this Minute be forwarded to him, be considered as a summons for his appearance.


Ordered, That Advertisements be put up at or near Ephrata, giv- ing public notice of the foregoing order, requiring the evidences in the aforesaid case to appear in Council on the day appointed for hearing the same, or otherwise to make deposition before some Jus- tice or Justices of the Peace for the County of Lancaster, of such evidence as they may be able to give in the Premises, giving notice in writing to the said George Stewart, of the time & place of taking such depositions, at least five days before the taking of the same, such depositions to be carefully forwarded to Council by the Justice or Justices before whom they shall be taken.

Hon'ble Rob't Morris & Hon'ble Dan'l Roberdeau attended in Council, & informed the Council That they were directed by Con- gress to inform the Council that the Ambassador Plenipotentiary of his Most Christian Majesty was to receive his first Public au- dience in Congress this day at 12 o'clock, & that the doors of Con- gress would be open to the Vice President & Council, if they shall think proper to attend.


On consideration,


Agreed, That the Council will attend the Public Audience in Congress of the Ambassador Plenipotentiary from the Court of France.

An order was drawn on the Treasurer in favor of Mr. Robert Paisley, or his order, for the Sum of Four thousand five hundred & Ninety Pounds, for the above Six hhds. of Spirits, the said Som to be charged to the account of William Crispin, Commissary of the State Fleet.


Peter Thompson, Jacob Barge, & - Musgrove. three of the Warders of the City of Philadelphia, attended in Council, & represented that they were in great distress for want of Money to pay the Debts contracted by them to purchase the necessary Sup- ply of Oil, & to pay the Watchmen; That the situation of the Taxes will not admit of the necessary collection in time for the said purpose, & therefore, pray that a Sum of Money be put into their hands for these emmergencies, to be repaid as soon as may be ; That the Sum of Fifteen hundred Pounds will probably answer these purposes.


An order was drawn on the Treasurer in favor of Patrick Fuller- ton, Lieu. in the 13th Pennsylvania Reg't, or his order, for the Sum of Six hundred & Eighty Dollars, for the Recruiting Service, to be charged to his account.


Messrs. Blewer & Cox, from the State Navy Board, represent, that the Brig. Convention, Commanded by Capt. Rich'd Eyre, is nearly fitted for Sea, desire further instructions concerning that Vessel ; Whereupon,


Council considering that the danger of the Enemy's return into this River is greatly lessened by various Circumstances, & there is reason to expect that the said Brig. may greatly annoy the Enemy by Cruising upon the Coast, do recommend that the Navy Board fit

The Hon'ble Rob't Morris, Esq'r, represented that a number of Arms & Gunlocks ordered by the former Council of Safety, were arrived from the West Indies in a Vessel belonging to him.


Ordered, That the Arms which are now arrived from the West Indies, in a Vessel belonging to the Hon'ble Rob't Morris, Esq'r, be put into the hands of Capt. Stiles, Commissary of Military Stores.


The Council took into consideration the State of the Navy, agree- able to the request of the House signified in the course of the con- ference yesterday, & having spent some time thereupon, adjourned.

The Council having considered the enquiries of the Hon'ble House of Assembly concerning the State Navy, propose that the Commodore & supernumerary Officers of the State Navy be all dis- charged ; that the Galleys, except two or three, be all disarmed & the Vessels laid up or sold; That the Guard boats, except two or three, be all sold ; That the Brig. Convention, now ready for Sen, be sent out on a Cruise for Six weeks, manned by Volunteers, ou the terms of a Priveteer; That the Navy Board having failed in getting out the said Brig. in Seven Weeks, elapsed since the de parture of the Enemy, be dismissed, & that Capt. Blewer, or other proper person, be employed to dispatch said Brig. immediately, or else that the said Brig. be sold without loss of time; The Cannon, Ammunition, Fire Arms and other Weapons, be secured in the State Stores.

Divers Letters from Colo. Hartley, dated at Sunbury, August the 9th & 10th, were read.


Ordered, That the same be laid before the Board of War, & that Col. Smith & Mr. Hoge attend that Board, and enquire whether Colo. Hartley is ordered to the Westward, & to confer with the Board on the situation of the Forces on the frontiers.


The order of Congress of the 14th instant, relating to Mr. Wil- liam Straker, lately made Prisoner by the Count D'Estaing's Squad- ron, was read, to wit :


" In Congress, August 14, 1778.


" The Board of War, to whom was referred the memorial of the Hon'ble Sieur Gerard, relative to Mr. William Straker, having made report thereon, & the same being read,


" Ordered, That the said report & papers referred to, relative to Mr. Straker, be referred to the Government of the State of Penn- sylvania, to determine whether they will consider Mr. Will'm Stra- ker, lately made Prisoner by the Count D'Estaing's Squadron, as a Citizen of the State of Pennsylvania, & if the said Government shall determine to consider & receive the said Will'm Straker as a Citi- zen of their State, that they be desired to transmit a Certificate of their determination to. the Sieur. Gerard, Minister Plenepotentiary of his Christian Majesty.

On Consideration of the Case of Mr. William Straker, not only from the evidence now laid before them, but from his known resi- dence & his past conduct in this Country, the Council are unani- mously of opinion that he is a Citizen of this State, & ought to be considered & treated as such.

The following Resolves of the Hon'ble House of General Assen- bly of the 15th instant, were read, Vizt .:


" In General Assembly of Pennsylvania.


"SATURDAY August 15, 1778, P. M.


" Resolved 1st, That this House do recommend to the Hon'bh the Vice President & Council, to discharge, on or before the Twentieth day of this instant, August, from & out of the Pay of this State, the Commodore & all other the Officers & Men belonging to the Fleet or Navy of this Commonwealth, except such as they shall deem necessary to Officer & Man a number of Gallies, not exceeding three, & a number of Guard boats, not exceeding three, without pay- ing any regard to rank or seniority.


" Resolve 2d, That it be recommended to the Hon'ble the Vies President & Council, to set such & so many of the Guard boats u they may think proper.


" Resolve 3d, That it be recommended to the Hon'ble the Vice President & Council, to appoint Capt. Thomas Houstons to be Cap. tain of the Brig. Convention, & Colo. Robert Knox & Capt. Jours Blewer to fit out, Man & send the said Brig. upon a Cruize against the Enemies of the United States, & upon such terms as Privations are usually sent.


" Resolve 4th, That it be recommended to the Hon'ble the Vies President & Council, to dismiss the Navy Board of this Commes- wealth.


" Resolve 5th, That the Gallies, Guard boats not sold, Cannes, Ammunition, Weapons & implements of War, riggle tackle & for- niture, be properly secured & preserved.

" Resolve 6th, That the thanks of the House be given to the members of the State Navy Board, & to the Officers & Men of the Navy, for their Services in the Public cause.


"On motion,


" Resolved, That it be recommended to the Hon'ble the Vice President & Council, to take proper measures for preserving & se- curing as much of the Wrecks, Cargoes, Furniture and apparel of the Vessels sunk or left in the different parts of the River Dela- ware, as may be possible."


Ordered, That in Consideration of the recommendation of the Hon'ble House of General Assembly, That Capt. Thomas Houston be appointed & Commissioned to be Captain of the Armed Brig. Convention, And that Col. Robert Knox & Capt. Joseph Blower be appointed to fit out, Man & send the said Brig. upon a Cruise against the Enemies of the United States, upon such terms as Pri- vateers are usually sent.


Ordered, That in pursuance of the third, fourth & sixth Resolves of the Hon'ble House of General Assembly, & for the reasons as- signed by the House, the Navy Board of this Commonwealth be dismissed, & that they be furnished with a Copy of the said Re- solves.


In Consequence of Col. Richard Butler's recommendation of Capt. Jos. Mcclellan, of the 9th Pennsylvania Reg't, as a suita- ble Person to Recruit,


Ordered, That the said Capt. Jos. Mcclellan be furnished with Recruiting instructions, & that he be directed to call on Colo. Rob't Smith, Lieut of the County of Choster, for Money for that purpose.


'Thomas Sinith, Esq'r, of the County of Bedford, attended in Council, & represented that the Board of War had under their con- siderstion the building of a Stockade Fort at the Town of Bedford, & that the said Board was desirous of being informed of the Sen- timents of this Council respecting the propriety & necessity of it.


On consideration of the advantages to be derived from such a for- tification in the keeping open the Communication with Pittsburgh, especially while an expedition to the Westward is on foot, Coun- cil are of opinion that the erecting of such a fort will be very proper.


Garret Davis, a disabled Seaman, Solicited his half Pay, due to him from the first of August last, agreeable to the order of the Council of Safety, & it appearing by a Letter from J. M. Nesbitt, Heq'r, that the same is due to him on the first instant,

An order was drawn on the Treasurer in favor of the Secretary, for Sixteen Pounds & Ten Shillings, being eleven Months half Pay due to Garret Davis, to be by the Secretary applied in such manner as the most effectually to relieve him from his present distross.

A Letter from the Hon'ble Thomas Scott, dated Westmorland, Aug't 1st, 1778, was read, & the same containing some informa- tion relating to the boundaries between the State of Virginia & of this State,


Ordered, That the same be laid before the House of Gen'l As- sembly.


Resolve of Congress of the 14th instant, requesting that one the artned Galley's may be stationed near the mouth of the Cape May Channel, was read.


An order was drawn on the Treasurer in favor of Lieut. Arch'd Campbell, of the Sixth Pennsylvania Reg't, for the Sum of Eight hundred Dollars, for the Recruiting Service, for which he is to be accountable.


An order was drawn on the Treasurer in favor of Colo. Rob't Knox & Capt. Joseph Blewer, for the Sum of One thousand Pounds, for the purpose of fitting out for Sea the armed Brig Con- vention, for which they are to be accountable.


An order was drawn on the Hon'ble Board of War for the fol- lowing Articles, vizt : 50 Rounds of Cartridges for eight Gums, two Pounds each ; 2 Kegs of Powder, one of them fine ; one rem of Cartridge Paper; 1006 Musquet Cartridges ; 500 Pistol Out- ridges; Twenty-five Musquets with Bayonets; & two four Pous- ders, to be delivered to Col. Rob't Knox & Capt. Jos. Blewer, fer the use of the Armed Brig Convention, belonging to this State.


It being represented by Rob't Galbraith, Esq'r, & othere of the County of Bedford, that there are in the Goal of the said County divers persons said to have been guilty of treasonable practices, & one man said to have committed Murder ;


A list of the persons said to have been guilty of treasonable practices was laid before the Council, and ou consideration of the many important trials which will probably come before the Su- preme Court, & of the danger there may of the said Traitors being rescued, as well as other difficulties which the people of the Com- ty of Bedford now lie under, which render a speedy trial of the said offenders highly necessary,

SUPREME EXECUTIVE COUNCIL.


& Commissioned to enquire, on the Oath of good & lawful men of the said County of Bedford, of & concerning the said offences, & to determine the same according to law, &ca.


Ordered, That a Dedimus Potestatum be made out, authorizing & empowering Robt. Galbraith & John Piper of the County of Bedford, Esq'rs, or either of them, to administer to the aforesaid John Armstrong, Bernard Dougherty, James Martin, Archibald MoClean & John Hubley, Esq'rs, respectively, the Oaths or Affir- mation required to be taken to qualify them for the Office & trust roposed in them by the Commission so to be issued.

Council having received information that there are seven Store- Ships belonging to the Enemy in the Bay of Delaware,


Ordered, That the Navy Board do immediately send two of the Galleys now in repair, most fit for the purpose, into the Delaware Bay, to annoy the Enemy, and at the same time to give orders to the Commanders of the said Galleys to exert themselves to pre- vent the exportation of provisions, either thro' the Cape May Chan- nel or the Delaware.
