"The board of Treasury having considered a Letter of the 5th inst., from George Bryan, Esq'r, Vice President of the State of Pennsylvania, to the Delegates of that State, referred to them by Congress,

The Hon'ble Joseph Reed, Esq'r, returned by the Sheriff of the County of Philadelphia as having been duly elected Councellor for the said County, attended the Council & represented, That he is now one of a Committee of Congress for arranging the Army, which Committee has sat for several Months past, de have gone far into business, which appears to be of great importance, and that as

considerable part of it has necessarily fallen on him, it will be improper for him at present to retire from the Committee, & there- fore, begs the Council may not consider him as' inattentive to.his duty to the Public, if he shall not attend the Council until the said arrangement is completed; At the same time declaring his rendi- ness to accept such Post as his County may think proper to call him to, for the service of the Public, as soon as it is in his power so to do.
It appearing that John Williams, of the Northern Liberty Town- ship, & Jacob Bright, of the City of Philadelphia, Merchant, two of the Commissioners for Taxes & Levies for the County of Phila- delphia, who should have continued in office, for want of a new choice in October last, have been made Prisoners by the British Army, lately possessed of the said City ; that the said John Wil- liams was carried away by the said Army ; that the said Jacob Bright is now at his place of abode, but is considered as a Prisoner under Parole ; & that both of these Commissioners are disqualified from acting : Council considering that Isaac Snowden, the third. Commissioner, cannot alone, in the present case, if in any, with the Assessors, (who also continue for want of an Election as aforesaid,) nominate & fill up the vacancy caused as aforesaid, do thereupon, by virtue of the power vested in them by the Twentieth section of the Constitution, supply the vacancy caused by the disqualification of John Williams & Jacob Bright, as aforesaid, by appointing Ed- ward Bartholomew & William Antis of said County to the office of Commissioners of the County of Philadelphia, until the said office can be filled in the time and manner directed by Law & the Constitution.
N. B. Edw'd Bartholomew & William Antis were highest in vote as Commissioners at the Election for chusing a Councellor for the County of Philadelphia.
Ordered, That the Bridge laid by the Navy board over the River Schuylkill at the middle ferry, be immediately repaired & removed to its place again, & that the bridge now there be removed to Gray's ferry.
Ordered, That Major Casdrop be appointed to superintend & direct the removal of the said bridge.

The Petition of the Hon'ble George Taylor, Esq'r, setting forth his claim to the lands & works known by the name of Durham for- nace, & that the same had been seized by Mr. George Wall, one of' the Agents appointed for seizing forfeited Estates, & put under the care of a certain James Morgan, was read. A notification signed by the said George Wall, & directed to Mr. Moses Yeaman, a Ten- ant under the said George Taylor, forbiding him to take & carry away any more Stamped metal from the said Furnace, & the writ- ten agreement signed by the said Joseph Galloway, under which he claims the possession of the said Furnace, were also read ; And the same being considered,
Ordered, That Mr. George Wall be directed to pay due respect to the written agreement between Joseph Galloway, Esq'r, & the Hon'ble George Taylor, Esq'r, for the lands & works known by the . name of Durham furnace, & that he do not disturb Mr. Taylot in the peaceable possession & enjoyment thereof, agreeable to the terms of the said agreement. And as the said George Taylor has represented that he has a quantity of Wood cut, & ore raised, at a considerable expence, it appears to the Council to be just & equita- ble that he should have a Lease of the Premises for so long as the Council or their Agents are authorized by Law to let the same in preference to any other, on such reasonable terms as may appear to be just. The Council, therefore, recommend it to Mr. Wall to treat with the said George Taylor, relating to the Premises, & agree with him on equitable & reasonable terms ; Such lease not to ex- tend beyond the 1st day of April, 1780.

Ordered, that the retained Rations of Col. Nicola, as Town Ma- jor, be estimated at Two Shillings & Six Pence ? Ration, accord- ing to the regulation of Rations ordered by Congress.
The Board of War having given an order on their Commissary General of Military Stores for a supply of Lead, Powder, & flinta, to the order of Council.
Ordered, That the Ammunition for the Militia sent to Standing Stone, at the Rate of Thirty rounds Per Man, & half a Ton of Powder & s proportion of Lead, & a reasonable quantity of Flints, be delivered to Colo. John Carothers, Lieut. of the county of Cum- berland; That the Ammunition for the Militia sent to Sunbury, & one-third of the Ton of Gunpowder & a proportion of Lead, with a proper number of flints, be delivered to Colo. Bartram Galbraith, Lieu. of the County of Lancaster; That the other Two-thirds of the said Ton of Gunpowder & proportion of Lead, be delivered to the Lieutenants of the Counties of Berks & Northampton, an equal quantity to each; That the Ammunition for the Militia order to Easton, be delivered to Colo. John Weitzel, Lieutenant of the County of Northampton.

Ordered, That two or three of the Barges or Guard Boats, pro- perly equipped & manned, be immediately sent into Delaware bay to watch the Cruisers of the Enemy, procure & transmit intelli- gence, & seize upon any of their Merchant Vessels which may be found there ; And that as many of the Gallys be furnished with Cannon, & fitted out as can be manned, sent down the River, & em- ployed in watching & guarding the same against the Enemy, or any disorderly persons disturbing the Navigation ; That the Galley rigged as a Brig be repaired & fitted out with all expedition, under the Command of a proper Officer, & employed in defending & pro- tecting the Navigation of Delaware Bay.

An order was drawn on the Treasurer in favor of Mr. Rob't Ali- SOD, House Carpenter, for the Sum of One hundred & fifty Pounds, for which sum he is to account.
The Secretary informed the Council that Thomas Clark, Carpon- ter, now in this City, is reported to have joined the Enemy in New Jersey, & to have landed with them at the head of Elk, maroh- ed with them to this City, & that he went over the Delaware with them on their Retreat. That these facts are spoken of by the in- habitants of this City as certain & acknowledged.
On consideration,
Ordered, That the aforesaid Thomas Clark be arrested by the Sheriff, kes. of the County, & bring him before this Council to answer the said charge, & to be dealt with according to Law.
Upon reading & considering two acts of Congress, one of the fourth of June last, in the following words, to-wit :
" Resolved, That should the City of Philadelphia be evacuated by the Enemy, it will be expedient & proper for the Commander-in

Chief to take effectual care that no insult, plunder or injury of any kind, may be offered to the inhabitants of the said City; That in order to prevent public or private injury from the operations of ill disposed persons, the General be directed to take early & proper care to prevent the removal, transfer, or Sale of any Goods, Wares or Merchandizes, in possession of the inhabitants of the said City, until the property of the same shall be ascertained by a joint Com- mittee, consisting of persons appointed by Congress & of persons appointed by the Supreme Executive Council of the State of Penn- sylvanis, to-Wit : so far as to determine whether aby or what part thereof may belong to the King of Great Britain, or to any of his Subjects."
And another Act of Congress, dated the 23d instant, in the following words, to-Wit :
" Resolved, That Mr. Duer, Mr. Harvie, Mr. Holton & Mr. Drayton, in conjunction with the Committee appointed or to be ap- pointed by the Supreme Executive Council of the State of Penn- sylvania, be authorized to ascertain the property of the Goods, Wares & Merchandize in possession of the inhabitants of the City of Philadelphia at the time it was evacuated by the Enemy, Vix : so far as to determine whether any or what part may belong to the King of Great Britain or to any of his Subjects, agreeable to the resolution of the 4th June last. Extract from the Minutes.

Council agree that the Hon'ble Vice President, Mr. Hart, Mr. Read & Mr. Hoge, be a Committee of this Council to meet with Mr. Duer, Mr. Harvie, Mr. Holton & Mr. Drayton, for the pur- poses set forth in said Act of Congress. At the same time, they can- not but remark, that the Clothier General & other Officers of Con- gress, about four Weeks since, & soon after the evacuation of said City, which happened on the Eighteenth day of June last, did purchase from divers inhabitants of the City of Philadelphia, possessors of Merchandize mentioned in the said Acts of Congress, large quantities thereof, at a price deemed to be equivalent to the cost of the same; that Gen'l Arnold, commanding the Continental Troops in said City, did soon after said purchase, publish a permis- sion to the persons possessed of said goods, on certain terms to trans- fer & sell the said Merchandizes ; that since that publication, very considerable quantities of the Merchandises aforesaid, have sold & . delivered to a very considerable number of buyers & consumers, greatly in need of the same ; that it appears to Council to be now very late & very difficult to go into a particular discussion of the property of the goods in question ; yet as there may be quantities of Stores & Merchandise concealed in said City, which were the prop- erty of the King of Great Britain, & which would fall to the United States of North America, & also goods which were the private property of his Subjects devolving to this State, & as Congrom may

be possessed of information concerning the same, the Committee of Council are instructed to pursue, in conjunction with the said Committee of Congress, all prudent & legal measures to attain the ends proposed by Congress in their said Acts above recited.
The Council taking into Consideration the report of the proceed- ings of a Court Martial held at Trenton, May 19th, 1778, wherein John Gilfroy, boatswain of the late Ship Montgomery, being found guilty of Mutiny & deserting to the Enemy, was adjudged to be worthy of Death,
. Ordered, That John Gilfroy, late boatswain of the Ship Mont- gomery, now under sentence of Death for Mutiny & deserting to the Enemy, be pardoned, this being the first conviction of an offence of this kind in the State Fleet.
Ordered, That Commodore Hazelwood be authorized to issue & Proclamation offering full Pardon to all deserters from the State Fleet who shall return to their duty, & deliver themselves up to him or some one of the Officers of the said Fleet, on before the first day of September next.

Mr. Andrew Bunner, in behalf of the owners of the Privateer Sloop "Gerrard," represented to Council that the said Sloop was detained from a Cruize against the Enemy for want of four or five hundred weight of Powder, & requested an order for that quantity on Wm. Henry, Esq'r, to be replaced as soon as possible.
On consideration,
Ordered, That Wm. Henry, Esq'r, Lieu. of the City of Phila- delphia, do deliver to Mr. Andrew Bunner, or his order, four or five hundred weight of Gunpowder, for the use of the Privateer Sloop " Gerrard," to be re-paid by him as soon as possible.

Ordered, That Doct. James Hutchinson be appointed Surgeon of the State Fleet.
The Navy Board informed the Council that the armed Brig is nearly ready for Service, & recommended Capt. Tho's Houston · to be the Captain of the said Brig. The appointment of a Captain to the Armed Brig being put to Vote, a majority of Six against one . was appointing Capt. Richard Eyre; & thereupon,
Ordered, That Capt. Richard Eyre be appointed Commander of the Armed Brig Convention, belonging to this State, & Commis- sioned accordingly.
Council having received information that a Ship called the Albion, which was sunk in the River Delaware & seized by the Navy board of this State, on or about the 27th day of June, Thats Libel had been

filed in the Court of Admiralty by Dav'd Beverage of this City, Merchant, in behalf of himself & others, Claiming the property of said Ship & her Cargo, & had given security in the said Court for the value thereof, & received the same into his possession ; The Council considering the importance of the trial, and the great weight of business which now falls on the Attorney General, which renders assistance herein absolutely necessary,
Ordered, That Jacob Rush, Esq'r, be employed to assist the At- torney General in the trial before the Court of Admiralty respect- ing the Ship Albion, & that the Secretary be directed to pay bim the Sum of One hundred Dollars, as a Fee for his Services therein; And an order was drawn on the Treasurer in favor of the Secre- tary, for the Sum of One hundred Dollars, to be paid by him as the Fee above mentioned.
On application,
Ordered, That the Navy board furnish Mr. James Carson & Jos. M'Culloch with three hundred weight of Gunpowder, & half a ton of round & grape shot, to be re-paid by them as soon as possible.
The Petition of Rob't Lumsden, of this City, praying to be ap- pointed Wharfinger & Weighmaster of Hay at the Draw Bridge in this City, was read, & information being also given that Joshus Humphreys solicited those offices,
