Resolved, That such of the Persons now confined in the Lodge as shall take & Subscribe the Oath or Affirmation of Allegiance re- quired by Law in this Commonwealth, or that shall take & Sub- scribe the following Oath or Affirmation, to wit: " I do Sweer (or affirm) that I will be faithful & bear true allegiance to the Commonwealth of Pennsylvania, as a free & independent State," shall be thereupon discharged.

An order was drawn on Dav'd Rittenhouse, Treasurer of the State, in favor of Ja's Worrell, Evan Evans, & Rob't Allison, for the Sum of One hundred & forty-eight Pounds Seventeen Shillings & Six Pence, for taking down the Spouts, &ca, to be charged to account of Congress.


Congress by their Resolve of the fourth ins't, having recom- mended this Council to give orders that all the Militia of this State hold themselves in readiness to march at a Moment's warning, & that they see that their Arms be put in as good condition as possi- ' ble, & that the Council call out five thousand Militia from the City & County of Philadelphia, & the Counties most adjacent, &ca.


On consideration,


Ordered, That one Class of the Militia, in addition to those al- ready in Service, be ordered into Service from the City of Philadel- phis, & the Counties of Philadelphia, Chester, York, Cumberland, &z Northumberland ..


Ordered, 'That on the present emergency, when the Enemies' Army endeavouring to penetrate to this City, may be aided by a Fleet in the Delaware, the actual Command of the Naval force be committed to John Hazlewood, Esq'r, as Commodore in this Depart- ment, on account of the Age & infirmities of Tho's Seymour, Esq'r, his superior Officer, as it is manifest to Council that Commodore Seymour, in the present State of his Health, cannot be capable of of that vigour & activity which are essential to the service at this time of danger, in which the most strenuous efforts of the stoutest will be necessary.


A resolve of Congress of this date, recommending to this Coun- cil to hear what Israel Pemberton, & divers others therein named, can alledge to remove the suspicion of their being disaffected or dangerous to the United States, being read & considered,


Resolved, That the President do write to Congress & let them know that the Council has not time to attend to that business, in the present alarming crisis, & that they were, agreeably to the re- commendation of Congress, at the moment the said Resolve was Brought into Council, disposing of every thing for the departure of ti Prisoners.

The Council being informed that there is great uncertainty of a supply of Wood for the Salt Works now erecting in New Jersey ; thereupon,


Ordered, That the Hon'ble John Coxe, Esq'r, be requested and authorized to purchase a Tract of Wood Land, in the neighbourhood of the Salt Works in New Jersey, belonging to this State, on the best terms it can be obtained, for the use of the said works.


Jonathan Mifflin, Esq r, D. Q. M. G., having applied to Coun- cil by Letter for a number of Waggons, & there appearing to be a necessity of a considerable number for various purposes; there- upon,


Resolved, That one hundred Waggons be ordered to be sent in from Berks County, & one hundred Waggons from the County of Lancaster.


A Remonstrance from the people confined in the Mason's lodge, was presented by the Secretary, & read ; thereupon, the Secretary was ordered to acquaint Doct. Hutchinson, one of the Gentlemen who delivered the said Remonstrance to him, that Council had re- ferred their case to Congress.


Resolved, That John Morris, jun'r, Esq'r, be appointed and su- thorized to appear at the next Court of Quarter Sessions of the

Peace, for the County of Bucks, there to Prosecute in behalf of this Commonwealth.


Congress, by their resolve of this day, having recommended to Council to discharge Will'm Imlay, now a Prisoner, on his Parole, that he will forthwith repair to Kingston, in the State of New York, , & take the Oath of Allegiance to the said State, of which he is a citizen ; thereupon,


Resolved, That the Council do agree to the discharge of the said William Imlay accordingly.

The Secretary reports, that he waited on Will'm Imlay, and gave to him the Resolve of yesterday, but that he had not Signed the Parole offered him by the recommendation of Congress.


Colo. Will'm Bradford now attended the Council & reported, That he had on Friday Evening last, waited on the Prisoners now confined at the Masons' Lodge, & shewn to them the Certified Copy Of the Resolve of Council relating to them of the 5th inst, and had given them a Copy thereof, but that the Prisoners had given him -no reason to expect a compliance with the terms proposed them. The following Resolve of Congress was read, to Wit :


" In Congress, Septem. 8, 1777.


" Resolved, That it would be improper for Congress to enter into xay hearing of the Remonstrants or other Prisoners in the Masons' Lodge, they being inhabitants of Pennsylvania, and therefore, as & la . Council decline giving them a hearing, for the reasons assigned their Letters to Congress, that it be recommended to said Council, to order the immediate departure of such of the said Pri- somers as yet refuse to swear or affirm allegiance to the State of Pennsylvania, to Stanton in Virginia.

Tho's Fisher, (Son of Joshua,) Sam'l Fisher, (Son of Joshua,) Myers Fisher, 10 Elijah Brown, 11 John Hunt, 12 Phineas Bond, 13 Rev'd Tho's Coombe, 14 Cha's Jarvis, 15 Will'm Drewitt Smith, 16 Cha's Eddy, 17 Tho's Pike, 18 Owen Jones, jun'r, 19 Edw'd Pennington, 20 Will'm Smith, Broker, 21 Tho's Gilpin, 22 Tho's Afflick, apprehended by Council as persons who have uniformly manifested by their general conduct & conversation a Disposition highly inimical to the cause of America, imprisoned in the Free Masons' lodge in this City, they refusing to confine themselves to their several dwellings, & thereby making the restraint of their persons in another manner necessary, & having refused to promise to refrain from corresponding with the Enemy, & also declined giving any Assurance of Allegiance to this State, as of right they ought, do thereby renounce all the priviledges of Citizenship, & that it appears they consider themselves as subjects of the King of Great Britain, the Enemy of this, & the other United States of America, & that they ought to be proceeded with accordingly.


Resolved, That persons of like Character, & in emergencies equal to the present, when the Enemy is at our Door, have in the other States been Arrested & Secured upon suspicions arising from their general behaviour & refusal to acknowledge their Allegiance to the State of which they were the proper Subjects ; and that such proceedings may be abundantly justified by the conduct of the freest Nations & the authority of most judicious Civilians; there- fore,


Resolved, That the persons whose names are mentioned above, be without further delay removed to Stanton, in Virginia, there to be treated according to their Characters & Stations, as far as may be consistent with the securing of their persons.


Also Resolved, That Will'm Imlay, said to be a Subject of the State of New York, having behaved in like manner as the persons above mentioned, & in particular declined to give "Assurance of Allegiance to the State of New York, be removed and secured with the rest.


Ordered, 'That Colo. Nicola, Town Mayor, secure the Prisonera above named in the Masons' lodge, & assist in removing them out of the City.


The representation of the Corporation of the rector, Church Wardens & Vestrymen of the United Episcopal Churches of Christ Church & St. Peter's Church, in the City of Philadelphia, in the Province of Pennsylvania, was read.


Will'm Imlay now solicited by the Secretary, that be may be permitted to sign a Parole agreeable to the Resolve of Congress, & that he be enlarged thereupon ; and the Secretary reports that 'he has signed the Parole accordingly.


Sam'l Murdoch having petitioned to be enlarged from his present confinement, & be allowed the bounds of the City in order to take care of his private affairs; thereupon,

An order was drawn on Rob't Towers, Esq'r, Commissary of Stores, in favor of Colo. Lochry, Lieutenant of the County of West- = moreland, for Three hundred weight of Gunpowder & Eight hun- dred weight of Lead.


An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer of che State, in favor of Colo. Archibald Lochry, Lieutenant of the County of Westmoreland, for the Sum of One thousand and five andred Pounds, for the purpose of purchasing riffled barrel Guns, For the use of the Militia of the said County, and for hiring substi- Tates, for which he is to account.


An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer of -ne State, in favor of James Carter, for the Sum of Five hundred ounds, to Pay Workmen for repairing Arms, &c., & for which he to account.


Resolved, That Will'm Fullerton, Warwick Coats, Ratcliffe Abertson, in the South part of the City & Suburbs, & that Jacob iller, Sam Brewster & Israel Castle, in the North part of the City BE suburbs, be appointed to collect & detain all the boats, flats, Dances & Batteaus & other embarkations whatever, in the Dela- Ware Dear this City, provided that no hindrance be given to the samoval of families by Water in Shallops or other Craft, that lesvo Town & proceed to a distance, or to Ferries.

That the Continental Board of War be reminded of the great number of Prisoners of War now in the New Goal.


Resolved, That Major Casdrop be directed to attend with a Ser- geant's Guard, at the Bridge over Schuylkill, in order to remove it when ordered by this Board or the Commanding officer, and that he remove the Boats from the West Side of Schuylkill.


Resolved, That no person be suffered to go over the West side of Schuylkill, unless they produce a pass signed by Benj'n Paschall, Esq'r, or W'm Heysham, or unless they produe a Certificate of their having taken and Subscribed an Oath or Affirmation of Allegiance to this, or the United States of America, but persons bringing pro- visions to Market are to be permitted to pass & re-pass without interruption.


Resolved, That the Gentlemen of the Light Horse of this City, except two who are to attend the prisoners now at the Lodge to Reading, on their March to Staunton, in Augusta County, in the State of Virginia, do proceed immediately to Camp on a Tour of duty, & that the said two Gentlemen join the Corps after they have discharged the said duty, as soon as possible.


Intelligence having been received of the Enemies' motion towards the City, the following Proclamation having been read & proposed to be published, Vizt. :


" PHILAD'A, Septem. 10, 1777.


" By the Supreme Executive Council of the Commonwealth of Pennsylvania.


" A PROCLAMATION :


" The time is at length come in which the fate of ourselves, our Wives, Children, & Posterity must be speedily determined; Gen'l Howe, at the head of a British Army, the only hope, the last resource of our Enemies' has invaded this State, dismissing his ships & disen- cumbering himself of his heavy Artillery & baggage, he appears to have risked all upon the event of a movement which must either de- liver up to plunder & devastation, this Capital of Pennsylvania & of America, or forever blast the cruel designs of our implacable foes. Blessed be God, Providence seems to have left it to ourselves to determine, whether we shall triumph in victory & rest in freo- dom and peace, or by tamely submitting, or weakly resisting, deliver ourselves up a prey to an enemy, than whom none more cruel & perfidious was ever suffered to vex & destroy any people. View then on the other hand, the freedom & independence, the glory & the happiness of our rising States, which are set before us as the reward of our courage. Seriously consider on the other hand, the wanton ravages, the Rapes, the Butcheries, which have been per. petrated by these men in the State of New Jersey, & on the fron-

tiers of New York ; above all consider the mournful prospect of seeing Americans like the wretched inhabitants of India, stripped of their freedom, robbed of their property, degraded beneath the brutes, & left to starve amid plenty, at the will of their lordly Masters, and let us determine once for all, that we will Die or be Free.


"The foe are manifestly aiming either by force to conquer, or by Stratagem & Stolen marches to elude the vigilence of our brave Commander ; Declining a battle with our Countrymen, they have attempted to steal upon us by surprise. They have been hitherto defeated, but numbers are absolutely necessary to watch them on every Quarter at once.


" The neighbouring States are hurrying forward their Militia, & we hope by rising as one Man, & besetting the foe at a distance from his Fleet, we shall speedily inclose him like a Lion in the toils.


The Council therefore most humbly beseech and intreat all Per- sons whatsoever, to exert themselves without delay, to seize this present opportunity of crushing the foe, now in the bowels of our Country, by marching forth instantly under their respective officers, to the assistance of our great General, that he may be enabled to environ & demolisb the only British army that remains formidable in America, or in the World. Animated with the hope that Hearen, as before it has done in all times of difficulty & danger, will again crown our righteous efforts with success, we look forward to the prospect of seeing our insulting foe cut off from all means of escape, & by the goodness of the Almighty, the Lord of Hosts & God of Battles, wholly delivered into our hands.

Resolved, That the Lieutenant of the City be ordered to Call out all the well affected Militia of this State, to meet on the Commons, Dear the centre House, to-morrow Morning at 10 O'Clock, with their Arms, Accoutrements, Muskets & intrenching tools, of all kinds.


Colo. Nichola, Town Major, representing that he could not pro- Cure the horses necessary for the Guards ordered to escort the prisoners from the Masons' lodge towards Reading,


A Warrant to impress Six Horses with Saddles was issued, direc- ted to him.


An order was drawn on the Treasurer, in favor of Mr. Alexs. Nesbitt & Sam'l Caldwell, Gentlemen of the Light Horse, ordered to escort the Prisoners on their way to Augusta, for the Sum of One hundred Pounds, to pay their Expenses, as far as the present escort may go, & for which they are to account.

The Rev'd Tho's Coombe having by the Rev'd Mr. White and Colo. Cadwallader, requested to be permitted to go to Virginia under Parole, & from thence to the Island of St. Eustatia, on con- sideration,


Resolved, That he be enlarged on Parole accordingly.

Mr. Morgan represented to Council that divers of the People of the County of Berks were desirous of having Tho's Parry appoint- ed one of the Justices of the Peace of the said county; there- upon,


Resolved, That Thomas Parry be appointed one of the Justices of the Peace of the County of Berks.


Phineas Bond, Esq'r, by Doctor Tho's Bond, & requested to be permitted to go to Virginia under Parole & from thence to the West Indies ; on consideration,

An order was drawn on Mr. Towers, in favour of Bartram Gal- braith, Esq'r, for One thousand Musquet Cartridges, One hundred Pounds of Powder & Two hundred & fifty pounds of Lead.


The two Armies being now engaged, & the event doubtful,


Ordered, That all Shops & Stores be immediately Shut up, ex- cept those only where workmen are employed in making or repairing the Public Arms, & that every Man capable of bearing arms, or repairing Arms repair to his Captains' Quarters at Two O'Clock this Afternoon.


The Commissioned Officers are hereby Commanded to exert themselves in the execution of this Order, & order that the Drums beat to Arms immediately.


Ordered, That Colo. Heister, Colo. Corsey, Colo. Antis, & Colo. Dean's respective Battalions, do immediately rendezvous at the Sweed's Ford, & that Colo. Moore, Colo. McVeaugh, rendezvous at the Falls of Schuylkill, & Colo. Warner's at Derby.


Ordered, That the issuing Commissary supply Provisions to the Militia at the Sweed's Ford, Schuylkill Falls, & Derby.


As the Enemy is near at hand & this minute engaging our Army under the Command of his Excell'y Gen'l Washington,


Ordered, That every able bodied man in the County of Bucks, turn out with his Arms, accoutrements & blankets, & that those who cannot furnish themselves with Arms to take with them Axes, spades, & every other kind of entrenching Tools, & that Colonel Roberts, Erwin, & Killer, rendezvous at the Sweed's Ford, and that Colo's Toomb & McElwaine rendezvous at this City.


An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer of the State, in favour of Colo. Melchior, for the Sum of Five hun- dred & thirty-eight Pounds, Two Shillings & Seven Pence, ballance of his Account, to the Twentieth of August, as settled by Caleb David, Will'm Thorne & Philip Marstiller, a committee of Con- gress.


An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer of the State, in favour of Jacob S. Howell, for the Sum of Five hun- red Pounds, for which he is to account.


The Petition of Thomas Robison, praying to be appointed Pro- Chonatary of the County of Northumberland, and also the Petition Of Cap't David Harris, praying to be appointed Prothonatary of the said County, were Read. On consideration,


Resolved, That Cap't Dav'd Harris be appointed Prothonatary Of the County of Northumberland, & was Commissioned accord- ingly.


A Warrant was granted to Joseph Watkins to impress Twenty Horses for the Artillery.


On consideration of the returns of Justices Elected for the County of Bedford, and a recommendation by upwards of twenty Freeholders of Robert Galbraith, for the said Office,

Resolved, That James Mastin, 2d Will'm Parker, 3d Joshua Milott, 4th Martin Longatreath, 5th Tho's Paxton, 6th Robert Scott, 7th Robert Galbraith, be appointed Justices of the Peace for the said County of Bedford.


Ordered, That a Dedimus Potestatum be made out Authorizing & empowering Robert Galbraith, Esq'r, James Martin, & Thomas Urie, Esq'rs, to Administer the Oaths required by the Constitution & laws of this Commonwealth, to Qualify the aforesaid Magistrates & the other Civil Officers appointed or to be appointed in the said County of Bedford.


Ordered, That the Officers commanding the Militia of the County of Bucks, now at the Barracks, do immediately send a guard of Four.Men to Robin Hood Ford, over the Schuylkill, four Men to the upper Ferry, Four Men to the Bridge, & four Men to Gray's Ferry, to take care of the Artillery placed at those places.

An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer of the State, in favor of Will'm Henry, Esq'r, for the Sum of Three Thousand Pounds, for which he is to account.


Ordered, That the Justices of the County of Chester immedi- ately send in as many Waggons as can be procured, and that Colo. Will'm Evans be employed in the County of Chester, & that a Press Warrant be given him accordingly.


Ordered, That the Bucks County Militia be employed as a guard to conduct the British Prisoners to Reading, & such others as may be necessary to be added.


Ordered, That the Third & fourth Class of the Militia of Berks County, the third & fourth Class of Northampton County, the third Class of York County, the fourth Class of Chester, & the Second Class of Northumberland Counties, be Called into immedi- ate service.

Ordered, That Colo. Henry do permit & encourage the Bakers in the Militia to enter the Service under Mr. Ludwick.


Ordered, That two more Companies of Artillery be called into service immediately.


Col. Charles Stewart represented that the Army is in want of Bread ; thereupon,


Ordeerd, That Colo. Cha's Stewart be authorized & empowered to seize all the hard Bread which can be found in the City, Paying for the same at the usual price.


Council appoints Tho's Urie & James Martin, Esq'rs, to be Sub- Lieutenants of Bedford County, in the room & stead of Rich'd Brown & Abraham Cable, who have declined to take upon them the Office.
