Order on the Contenental Board of War to Capt. Dougherty, for Thirty-five stand of Arms & accoutrements, for a Company of Volunteers, who propose to turn out with two Pieces of Cannon.


His Excell'y reports that the President of Congress had delivered to him an order on the Continental Board of War for One thousand stand of Arms, and that he had endorsed the same to Capt. John Campbell, of the City Guards.


Capt. Moulder applied for Sixty belts, Sixty Knapsacks, Sixty Cartridge boxes, & Sixty Canteens, and an order was drawn on . the Board of War of this State for the same.


A Company of Artillery offering their service to the Public, and the Oficers of it requesting to be Commissioned; thereupon,


Ordered, That the following Gentlemen be Commissioned as Officers of the said Company, Viz. : Henry Daugherty, Capt. ; Win- gate Newman, Capt. ; Lieu't James Craig, Ist Lieu't; Alex'd Henderson, 2d Lieu't; Will'm Greenway, Lieut's fire-worker.

"In Congress Assembled, Saturday 14th June, 1777.


" Resolved, That Maj'r Gen'l Arnold be authorized to take upon him the Command of all the Militia now at Bristol, and in every other part of the River to the Eastward of Philadelphia, which have been called forth into service by a requisition of the 24th Day of April last, & that he be authorized to dispose of himself & the Troops under his Command, in such a manner as he shall Deem best adapted to promote the Public Service."


Ordered, That a Copy of the foregoing resolution be sent to the President and Supreme Executive Council of the State of Pennsyl- vania for their concurrence.


On motion,


Ordered, That the 2d Class of the Militia of the County of Philadelphia, Chester, Bucks, Lancaster, York, Cumberland, Berks, & Northampton, be Ordered to march to the places to which the first Class of the said Counties respectively are ordered; and that the third Class be got in readiness to march, and also that the 1st and 2d Class of the City Militia be ordered to march for Bristol, & ' that the 3d Class hold themselves in Readiness to march at the shortest warning.


On motion.


Resolved, That the 1st class of the Militia of the County of Northumberland, be ordered to march to Bristol, and that the 2d be got in readiness to march at the shortest notice. As the great demand for money has drained our 'Treasury, and a Considerable Sum is immediately wanted for paying of substitutes and other purposes, necessary to get the Militia ready for the field, and the Money ordered to be struck by the General Assembly cannot be signed in time; thereupon,


Resolved, That Application be made to Congress to lend the Council the Sum of Fifty Thousand Dollars, to be repaid in a few days, so as that it may not pass to the General Account of the State.


The Secretary laid before the Council a Letter which he this Day received from John Kidd, Esq'r, dated the 31st May, wherein he expressed that he is obliged to decline the honor of becoming one of the Executive Council, on account of his state of health.

On motion,


Agreed, That Colo. Bull be appointed Adjutant Gen'l of the Militia of this State.


On Motion, agreed, That Colo. Walter Stewart be appointed Colo. of the State Regiment in the room of Colo. Bull, who is promoted to be Adjutant General.


One of the Delegates of this Stato in Congress, informed the . Council that Congress had ordered twenty Copies of their minutes to be Delivered to this State.


Ordered, That the Secretary apply for the said minutes, retain them in his hands, to be disposed of as the Council shall direct.


Capt. Montgomery attended the Council with a Message from Gen'l Mifflin, informing the Council that Gen'l Sullivan had or- dered the Militia collected at Coryel's Ferry to march forward to- ward the Enemy in New Jersey, and that is, therefore, necessary to send a number of the militia to occupy that Post, which is now entirely vacant.


Jonath'n Bayard Smith, Esq'r, sent in by the Secretary, a draft of Congress, signed by the Speaker, on John Gibson, Esq'r, Au- ditor General, for the Sum of Fifty Thousand Dollars, payable to the Hon'ble The President & Supreme Executive Council of the State of Pennsylvania, or their order, it being advanced to said State, for which it is to be accountable.


Ordered, That the same be made payable to Dav'd Rittenhouse, Eng'r, Treasurer of the State.


Ordered, That a Draft be made out on Dav'd Rittenhouse, Esq'r, Treasurer, in favor of John Maxwell Nesbitt, Esq'r, Trea- surer of the Board of War, for the Sum of Twenty Thousand Dollars, for which suin he is to account.


An order was also drawn on the Treasurer, in favor of Lewis Granow, Esq'r, Sub-Lieutenant of the County of Chester, for the Sum of Four Thousand Dollars, to be charged to Robert Smith, Beq'r, Lieutenant of the said County, for the purpose of procu- ring Substitutes, Blankets, &c.

Richard- son, now confined in the Gaol of the County of Lancaster, where he has been for near Four Months, on a charge of Counterfeiting and uttering the Bills of Credit of New Jersey, &ca, & no applica- tion having been made to this State respecting him ; thereupon,


Resolved, That the said Jos. Richardson be enlarged, on giving reasonable bail for his appearance, &ca, to answer the said charge. An order was drawn on the Continental Board of War for One Thousand stand of Arms, to be delivered to Colo. Bull, Adjutant General of the State.

A letter from Rich'd Peters, Esq'r, Secretary to the Continental Board of War, enclosing the following Resolves of Congress of the Ist April, was presented by his Excell'y, the President of the Board, and read, viz :


"By the United States in Congress assembled.


" April 1st, 1777.


" Resolved, That no Officer already appointed, or to be hereafter appointed, in the Army of the United States, shall take rank by virtue of a Commission antedated, but Rank shall be determined by the time of appointment, unless otherwise directed by special resolution of Congress.


" Resolved, That it be recommended to the Legislatures, and in their recess to the Executive Powers of the respective States, that they forthwith transmit to the Board of War exact lists of all offi- cers appointed by them in the Continental Army, with the date of their Commissions, and time of appointment."

"Ordered, That a Copy of said Resolves & Letter be transmitted to the Board of War, and that the said Board be requested to furnish this Council with the List of Officers appointed by this State, with the times of their appointment, and the dates of their Commissions, cad an account of all Monies expended on account of Prisoners of War.


The following Resolve of the General Assembly being laid before Council was read, viz. :


"In General Assembly, Tuesday June 10th, 1777.


" General Mifflin desired leave to be introduced into the House; which being done, he informed that he had it in charge from His Excell'y Gen'l Washington, to Assure them that it was his firm opinion that the Enemys Army meditated a sudden & immediate attack upon some part of this State, and that he, therefore, ear- nestly requested that the Militia of this State, and particularly of this City and its neighbourhood, might be ordered to hold them- selves in readiness to march at a moment's warning to such parts as aray be necessary." It was thereupon,


Ordered, that Dr. Gardner & Mr. M'Clean, be a Committee to wait on the President and Council, and inform them of the said intelligence, and request them, in the name of this House, to take the most speedy & effectual measures to answer the purposes of His Excell'y the General's message, & to frustrate the hostile intentions of the Enemy ; thereupon,


Ordered, That a Copy of the said Resolve be delivered to the Delegates of this State in Congress, and that they be requested to transact this business with Congress in the way they shall think most proper.


Ordered, That application be made to the Board of War for an estimate of the Expences of levying & clothing the State Battalion now commanded by Colo. Stewart, The Regiment of Artillery com- man ded by Colo. Proctor, and the Company under Capt. Pugh, with the state of the said Battalions & Company.


Colo. Kirkbride applied for a further Sum of Money to procure Substitutes in the room of such of the Militia as refuse or neglect to go into service ; thereupon,


An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer, in favor of Colo. Kirkbride, for the Sum of Two Thousand Dollars, for the purpose of procuring Substitutes, &oa.

His Excell'y the President lail before the Council a Letter from Gen'l Arnold, dated 18 June, 1777, enclosing Copy of a Letter from his Excell'y Gen 1 Washington, relative to fortifying Delaware River.


James Young, Esd'r, attended in Council, & took the Oath re- quired by the Constitution to Qualify him to act as a Justice for the City & County of Philadelphia.


An order was drawn on the Board of War of this State in favor of Will'm Henry, Esq'r, Lieutenant of the City, for as many Knapsacks, Canteens, &ca., as he may call for.


Mr. Parker, a member of the Hon'ble House of General Assem- bly, laid before the Council the following Resolve of the Hon'ble House, viz :


"In General Assembly, Thursday June 19, 1777. " On motion,


"Resolved, That the President and Council be Authorized & impow- cred to borrow from the Congress any sum of Money not exceeding One Hundred Thousand Dollars, to answer the immediate exigen- cies of the State, and to be repaid in a very short time, out of the moneys now issuing by virtue of the Two Hundred Thousand Pounds Act enacted at the last sitting of this House.

On motion, agreed, That a Copy of the Resolve of General As- sembly, empowering this Council to borrow of Congress the Sum of One ITundred Thousand Dollars, be delivered to the Delegates of this State in Congress, and the President is desired to write to the Hop'ble John Hancock, Esq'r, President of Congress, re- questing that Congress will lend to this State the Sum of Fifty Thousand Dollars, in addition to the like Sum already borrowed of them, to serve the present emergency.


Mr. Proctor reports that Rob't Levers, Esq'r, appeared before him some time ago, and took the Oaths required by the Constitu- tion to qualify him to act as Prothonotary of the County of North- ampton, and Qualify the Magistrates of that County.


SUPREME EXECUTIVE COUNCIL.


The Representatives of the Freemen of the. County of York having informed the Council that Chas. Lukens had declined to accept the Sheriff's office for that County ; thereupon,


Agreed, That Will'm Roan be appointed Sheriff of the County of York, and that he be commissioned accordingly.

The great inconveniences arising from the Waggoners bringing their Waggons into the State House Yard, & the noise of the Drums, which greatly incommodes, not only the Council, but also the Con- gress and General Assembly, whenever the Companies or Battal- jons exercise or Parade in the Yard, & having been observed by the Council with great concern ; thereupon,


Ordered, That no Drums be admitted into the State House Yard, & that the Waggoners be forbid to bring their Waggons into the State House Yard without permission so to do.


Robert Smith, Esq'r, Lieutenant of the County of Chester, ap- plied for Arms for the Militia of the said County ; whereupon,


An order was drawn on Will'm Henry, Esq'r, or Captain Camp- ble, in favor of the said Colo. Robert Smith, for Four hundred Bland of Arms.

The following Resolve of the Gen'l Assembly was laid before the Board, Via:


"In General Assembly, Monday June 16, 1777. " On motion,


" Resolved, That all the Militia men of the State now going into the Field, be allowed A Gill of Rum or Whiskey each man -per day, over and besides the Rations allowed by Congress, and that the 'President & Council take the proper means for supplying the mame."


Doot. Robert Wilcox applied for a pass to go to Providence, in New England.


Ordered, That the Secretary make out and sign a pass for him.


The Council took into consideration the appointing of a Pro- thonotary of the County of Chester, in the room of Benja. Jacob, who declines accepting that Office; thereupon,


Agreed, That Caleb Davis be appointed Prothonotary of the County of Chester, & Commissioned accordingly.

An order was drawn on Capt. Campbell, in favor of Rob't Smith, Esq's, Lieutenant of the County of Chester, for four hundred Can- teens, four hundred Knapsacks, four hundred Priming Wires, four hundred brushes, and Four hundred Cartouch Boxes, for the Militia of that County.


On motion,


Agreed, 'That John Beaton be appointed Paymaster of the Ches- ter County Militia.


An order was drawn on David Rittenhouse, Esq's, Treasurer, in favor of Rob't Smith, Esq'r, Lieutenant of the County of Chester, for the Sum of two Thousand Pounds, to be applied in paying Sub- stitutes, &os.

SUPREME EXECUTIVE COUNCIL.


Gon'l Mifflin, Mons. de Coudray, wi'h Nicholas Rogers, who speaks the French and English Languages, attended the Council, and laid before the Council a Copy of the report of the Committee of Congress for viewing the works erected for the defence of our River, and the resolves of Congress thereon of the 11th June Instant.

Colo. Stewart waited on the Council, & informed them that, hav- ing received orders to march his Battallion to Billingsport, he had Paraded his men, and, was about to march accordingly, but that he bad received intelligence from the Hon'ble John Hancock, Eeq'r, that a resolution of Congress of yesterday, respecting this Battalion being taken into Continental Service, which would render an imme- diate compliance with the orders he had received rather inconveni- ent ; that the said Resolution of Congress had been given in charge to the Delegates of this State to communicate to the Council, which would probably alter his Orders.

An order of Congress on John Gibson, Esq'r, Auditor General, in favor of the Council, for Fifty Thousand Dollars, was sent up to Council, and thereupon, the President endorsed the same, making it payable to David Rittenhouse, Esq'r, Treasurer of the State.


James Claypoole now offered Blair McClenagan & David Cham- bers as security for his faithful performance of the duty and Office of Sheriff in the City & County of Philadelphia ; was agreed to by Council.


The Council resuming the consideration of the orders given to the Lieutenants of the Counties for marching the Militia,


Agreed, That Philadelphia & Bucks Counties do send the first & second Class, and hold the third in perfect readiness. That Lan- caster, Berks, and Northampton, send forward the first Class, and hold the second in perfect readiness. That Cumberland; York, & Northumberland, hold the 1st Class in readiness, and that Letters be written to the Lieutenants of the respective Counties accordingly.


An order was drawn on David Rittenhouse, Esq'r, Treasurer, in favor of Colo. Benj. Brannon, Sub Lieutenant of the County of Chester, for the Sum of Two Thousand Dollars, for the purpose of Paying Substitutes.

PHILAD'A, Wednesday June 25, 1777.

A curious performance of I. Stewart, of London, the Senators' remembrancer, consisting of Fourteen Copper plates, done on white satten, and most elegantly framed and gilt, presented to the Public by Doc't Benja. Franklin, were placed in the Council Chamber.


On motion, Agreed, That the Pay of the Commodore of the Navy of this State be allowed and paid at the rate One hundred and Twenty-five Dollars P. Month, inclusive of Rations.


On motion, agreed, That the Pay of Capt. Hazlewood, the se- cond in Command in the Navy of this State, be allowed & paid at the rate of one hundred dollars P. Month, inclusive of Rations.


Mr. Cox and Mr. Eyres, from the Navy Board, having requested A further Sum of Money, and the Board of War having also made application for Money, An order was drawn on Dav'd Rittenhouse, Esq'r, in favor of John Maxwell Nesbitt, Esq'r, the Treasurer of the Board of War, &ca., for the Sum of Twenty-five Thousand Dol- Jars ; Board of War Twelve thousand Dollars, & Navy Board thir- teen thousand Dollars.


The Council taking into consideration the intelligence received by Congress from Gen'l Washington, respecting the movements of the Enemy, and the extreme inconveniency arising from the march of the Militia in the time of Harvest, Agreed, That the Lieut's of the Counties of Lancaster, Berks, & Northampton, be informed that. the Council think it unnecessary for the 1st Class of Militia re- spectively, to march, but that they hold the first class in the most perfect readiness to march at the shortest warning. That the Lieu- tenants of the Counties of Philadelphia and Chester, be informed that it is unnecessary to march the 2d Class of their respective Counties, but that the 1st Class be marched, and the 2d Class beld in perfect readiness to march at the shortest notice.

The members of Council met, & requested to be fur- nished with a Sum of Money for procuring Substitutes, Blankets, &ca. ; thereupon, An order was drawn on David Rittenhouse, Esq'r, Treasurer, in favor of Col. Andrew Boyd, Esq'r, for the Sum of Two Thousand Dollars, for the aforesaid purposes.


On motion, Agreed, 'I'hat Jamas Loughead be appointed Pay- master of the Militia of the City & Liberties of Philadelphia. .


An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer, in favor of James Loughead, Paymaster of the City and Liberties aforesaid, for the Sum of Three Thousand Dollars.


Mr. Bache, Col. Shee, and Col. Dean, of the Board of War, at- tended Council, & complained of a certain Wm. Sykes, who had taken an opportunity of bringing off a very considerable quantity of Goods which had been removed out of the City, from the place where they had been deposited by order of the Committee appointed for that purpose, and this at a time when it was generally believed the Enemy was bending their force against this city.

Jos. Gamble, Will'm Marshall, Mich'l Dawson, Chevaux de Frize Pilots, informed the Council that they had this day applied to the Commissioners of Appeal, setting forth their employment as a plea against their being fined as Non-Associates under the late Law, &ca., and that the plea was rejected as insufficient.
