An order was drawn on David Rittenhouse, Esq'r, Treasurer of the State, in favor of Sam'l Smith, Esq'r, Sub Lieutenant of the County of Bucks, for the Sum of Nine hundred Pounds, to be charged to Colo. Jos. Kirkbride, Lieutenant of the said County, for the purpose of Paying Substitutes, purchasing Blankets, &ca., for which sum he is to account.
The Petition of upwards of Twenty of the Freeholders of the Town & Township of Easton, and of Forks Township in the County of Northampton, setting forth that Rob't Traill & Henry Fullert, Esq'ra, had declined, & still continue to decline to take the Oaths necessary to qualify them to act in the Office of Magistrate, & that great inconveniences unavoidably & daily arise from there being no Magistrate resident in the said Town of Easton, & also setting forth that it is necessary that one or more Magistrates should be seated in the said Town of Easton, &ca., &ca., was read, & the same be- ing considered ; thereupon, ·
On motion, Agreed, That Rob't Levers and Abraham Berlin be appointed & Commissioned as Justices of the Peace for the said County of Northampton, & that they be Commissioned accordingly, in the room of the said Rob't Traill & Henry Fullert. .
An order was drawn on David Rittenhouse, Esq'r, Treasurer of the State, in favor of Ja's Loughead, Paymaster of the City Mili- tia, for the Sum of Two Thousand Dollars, for which he is to ao- count.
Francis Hopkinson, Esq'r, from the Continental Navy Board, ap- plied to Council & requested that a Pilot may be put on Board each of Two Ships intended to be ordered down the Bay by the said Navy Board; thereupon,
Ordered, That the States Navy Board be directed to furnish the Continental Navy Board with Two Pilots, either from among the Chevaux-de-Frize Pilots now in the Pay of this State, or any other Pilots which they may be able to obtain for the said Purpose.

A Letter from Gen'l Hand, dated Fort Pitt, 24th July, 1777, requesting that orders may be given to the Militia Oficers of West- moreland & Bedford, to furnish him with what Men they can spare, for the purpose of penetrating the Indian Country & destroying their settlements, which he apprehends to be necessary to prevent the continuance of the Cruelties which they have lately practised, as appears inclosed in the General's letter,

The Continental Board of War having made application to the Council for a guard, in case it shall be found necessary to remove the Prisoners from Lancaster ; thereupon,
Ordered, That on application of the Commissary of Prisoners, ox- his Deputy, the Lieutenant of the County of Lancaster, do fur- , Da esh the Guard which may be necessary for the said purpose.
Mr. James Dundass applied for Money to pay off several Con- tracts with Workmen, for tools, &ca., and an order was drawn on Jacob S. Howell, in favour of said James Dundass, for the Sum of One thousand five hundred pounds, for which he is to account. On motion, agreed, That Mr. John White be appointed paymas- ter of the Militia of the State of Pennsylvania.
Mr. John Sullivan, a Prisoner on Parole, having prayed an en- largement of his Bounds ; thereupon, Agreed, That he be indulged with the liberty of the City & County on the West side of Dela- ware for Six Miles.

carry him out of this State to places far remote from. his Witness, & where, it is probable, he may be detained during his life, &os ; & that by reason of the Courts of Justice being shut, he can pro- cure no process whereby his person may be secured till the matter in dispute can be legally determined ; & therefore prays that moss- ures may be taken, so as to secure his person from injury till the Courts of Justice shall be opened, as to this Council may seem expedient ; and thereupon,
Ordered, That Mrs. Ann Humphreys ( Widow of Mr. Jonathan Humphreys, late of this City,) be written to, requesting that she will not proceed in selling the aforesaid Negro Harry, until she shall make it clearly appear that she has a right so to do.
Will'm Mollaston, one of the Pilots engaged in the service of this State by the late Council of Safety, applied for his discharge from that duty, in order to go on Board the Delaware Frigate ; thereupon,
Ordered, That the aforesaid Wm. Mollaston be discharged ao- cording to his request.

Mr. Penrose, Mr. Dunlap, Mr. Hall, Mr. Hunter, & other Gen- tlemen of the Light Horse, waited on the Council & informed that Benja. Chew, Esq'r, was, in conformity to the order of Council, made Prisoner, and remained at his own House as a Prisoner ; and that the Hon'ble John Penn, Esq'r, was also made Prisoner, & would, at 12 O'Clock this day, be at the House of Will'm Allen, Esq'r, subject to the orders of the Council ; And the Council there- upon,
Ordered, That information be given to Congress, that the Hon'ble John Penn, Esq'r, late Governor of Pennsylvania, & Benja: Chew, Esq., Chief Justice, Register General of Wills, dea, & one of the Governor's Council of the same, have been made Prisoners agreeable to the recommendation of Congress ; That both of them refuse to sign a Parole of any kind ; and that Congress be requested immediately to order them to be removed out of the State.

Agreeable to the order of the day, Francis Armstrong of the Township of Little Britain, in the County of Lancaster, Complain- ant against James Whitesides, Justice elect of the said Township, . George Ewing of the same place, & John Allison, one of the Judges of the Election for the choosing of Justices for the said Township, appeared and laid before the Council divers depositions and evi- dences said to be respecting the said Complaint, which having been daly examined, do not appear to contain any matter immediately relating either to the disqualification of the said Whitesides to fit the Office of a Justice of the Peace, or tending to prove any unfair proceedings at said Election.
And the Council taking the return of Justices for the Township of Little Britain, in the County of Lancaster, into their considera- tien, Agreed, That James Whitesides & Patrick Ewing be appointed Justices for the County of Lancaster .- [See a Minute of this ap- pointment, antea pa. 251.]

Chew, Esq'ra, Prisoners to Fredericksburg, in Virginia, and direct them to call at the War Office & receive their instructions as soon as possible, and the resolutions of Congress respecting the removal of the aforesaid Gentlemen being read ; thereupon,
Ordered, That the Officers of Light Horse of this City be re- quested to select from among themselves & their escort an officer & Six Gentlemen to escort John Penn & Benj'a Chew, Esq'rs, as Pri- soners to Fredericksburg, in Virginia, & that the escort call at the Continental War Office & receive their instructions as soon as pos- sible.

A Letter from Gen'l Potter respecting the promise of the Sub- Lieutenants of Bucks County to their people, that they shall be discharged when the time of those that entered first is out,
Ordered, That a Copy of the said Letter be sent to Col. Kirk- bridge, Lieutenant of the County of Bucks.
Mr. White, lately appointed Paymaster of this State, having de- clined to accept that appointment, as he chose to enter the Service in another line,
On motion, Agreed, That Capt. Thos. Dorsey be appointed Pay- master of the Militia of this State.
An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer, in favor of Will'm Crispin, for the Sum Two Thousand Pounds, for which he is to account.
The Committee of Philadelphia County appointed to drive off Cattle, &ca, request that Joseph Ashton & Simon Bennett, of Lower Dublin, & John Rode and John Stevenson, of Byberry, be added to that Committee ; & on consideration, Agreed that they be added to the said Committee accordingly.
On motion, Agreed, That Col. Nicola furnish a proper guard over John Penn & Benja. Chew, Esq'rs, to relieve the Gentlemen of the Light Horse from that duty until the Continental Board of War shall take charge of them.
An order was drawn on David Rittenhouse, Esq'r, Treasurer of the State, in favor of Capt. Tho's Dorsey, Paymaster of the Militia of this State, for the Sum of One Thousand Pounds, for which he is to account.
Divers depositions relating to abuses offered to several persons therein named, of the County of York, by Lieut. Reynolds, Lieut. McCoy, of Capt. Steele's Company, & one Ogilvie, being laid be- fore the Council & read, thereupon a Warrant was issued, directed to James Claypoole, Esq'r, Sheriff of the County of Philadelphia, to apprehend the said Lieut. Reynolds, Lieut. McCoy, and Ogilvie, & bring them or either of them, before this Council, to answer the complaints contained in the depositions aforesaid.
On motion, Agreed, That Mr. Marshall Edwards be appointed Paymaster of the County of Philadelphia Militia.

The Rev'd Doct. Ewing, in behalf of Benja. Chew, Esquire, ap- peared in the Council, & declared Mr. Chew's willingness now to sign the Parole offered to him, & requested that he might be per- mitted to do so, at the same time declaring that Mr. Chew had not arefused to sign the Parole offered to him, from any want of respect to the Council, but from a desire that the cause of his Arrest might Thave been inserted in the Warrant for arresting him, in order that he might be able to satisfy his friends upon what he is Arrested, & that it may not be supposed that he stands charged with having Committed any crime against the States, but that he is arrested as an Officer under the late Government of Pennsylvania.
An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer of the State, in favor of Peter Dehaven, or his order, for the Sum of One Thousand Pounds, for which he is to account.

Lieut. Will'm McCoy, & Ensign John Reynolds, were brought by the Sheriff before the Council, & on examination, it appearing that they were the persons charged with being guilty of a riot in the County of York, on the 2nd of this instant, August, & there- upon,
Ordered, That the said Will'm McCoy & John Reynolds do give security for their appearance at the next Court of Quarter Sessions in the County of York, there to answer the said charge, each of them himself in the Sum of £150, & two sufficient securities for Gach, in the Sum of £150 for such appearance, and that they stand com mitted until such security is given.
Whereas, In the course of the examination of the aforesaid Will'm McCoy & John Reynolds, it appears that Serjeant And' Byer, in Capt. Nichols' Company ; Ezekiel Sample, in Capt. Steele's Company ; - Davis, in Capt. Butler's Company ; Ensign -Wilson, of Erwin's Comp'y, Will'm Coyle, or Kyle, John Hogg, Ensign, & John Magee, Ensign, have been active in the said Riot; therefore the Council issued a Writ, directed to the Sheriff of the County of Philadelphia, authorizing him to appre-

hend the said Andrew Byer, Ezekiel Sample, Davis, Wilson, Coyle, or Kyle, John Hogg, & John Magee, & bring them, or any of them, before this Council, to answer the complaints aforesaid.
Doctor Drummond having applied to the Council by Petition, praying to be enlarged on Parole, the same was now taken into consideration, & thereupon,
Ordered, That his parole be taken to confine him to his House, & on the West Side of Delaware, within Two Miles of the same ..
The Parole to contain the conditions in other respects contained in Mr. Smith's Parole, lately taken.
Colo. Bull, Adjutant General, applied to Council for assistance in removeing the Troops from Billingsport to Fort Island ; there- upon,
Ordered, That the Navy Board do give the necessary assistance in removing the Troops from Billingsport to Fort Island.
On motion,
Ordered, That Mr. Matthias Bush procure One thousand Knap- saoks for the use of the Militia of this State, on the best terms they can be had, for which he shall be. allowed One Shilling each as Commission-the price of materials & making to be charged at the first cost.
And'w Byers, John Hogg, & Ezekiel Semple, were brought be- fore the Council & examined. Whereupon, John Hogg & Ezekiel Semple were discharged, the evidente against them being insuffi- cient to justify the detaining them. And'w Byers appearing to have been concerned in the above mentioned riot, was ordered to give security for his appearance at the next Court of Quarter Sessions for the aforesaid County of York, to answer the said charge himself, in the Sum of Fifty Pounds, & one sufficient surety in the like Sum.

Ordered, That the Secretary write to the said Frederick Lem- boch, Esq'r, & inform him of the said Petition, and explaining the Law respecting the foundation on which a Commitment on a suspi- cion of a Spy is to be founded, & also to desire the said Magistrate not to extend the said Law in the execution thereof, beyond what it will justify, & to recommend to the said Magistrate, in case any difficulty should arise in the discharge of the Petitioners, to take two other Magistrates to his assistance, & re-consider the case ; And if any difficulty shall prevent the enlargement of the Petitioners, Tuesday the ninth of September is appointed for hearing of the Parties.
A Resolve of Congress of this Date, recommend to this Council, for the reasons therein mentioned, to Arrest & confine Thomas Light- foot, being read ; thereupon,
Ordered, That Congress be informed that Thomas Lightfoot is not an inhabitant of this State.
The Council taking into consideration the demand made by Gen- eral Gates, of Seven Hundred & Fifty Men to his Assistance in the Northern Department,
Ordered, That the second Class of the Militia of Bucks County, & the second Class of the . Militia of Northampton, repair imme- diately to Peckskiln, & there wait the orders of Gen'l Gates.
On motion, Agreed, That James Hamilton, John Lawrence, Edward Shippen, jun'r, Joseph Shippen, jun'r, & James Humph- reys, Esq'r, have the bounds prescribed in their respective Paroles enlarged to the whole State of Pennsylvania.
