The Hon'ble James M'Clean, Esq'r, elected Councellor for the County of Cumberland, & the Hon'ble Matthew Smith, Esq'r, elected Councellor for the County of Lancaster, respectively took the Oaths required by the Constitution to qualify them to act as Councellors.


An order was drawn on the Treasurer in favor of Major Gen'l John Armstrong, of the Militia of this State, or his order, for the sum of Four hundred & thirty-one Pounds' & twelve shillings, balance due to him for his Pay & Rations to the 5th of March, 1778, and to be charged to Congress.


Representation of Charles Campbell, late Sub-Lieutenant of the County of Westmorland, praying the Payment of a bill drawn by him on Council, & a consideration of his case, was read; and thereupon,


Ordered, That the representation of the case of Charles Camp- bell be referred to the llon'ble House of General Assembly.

Gen'l Lacey & Col. Knox, a Committee of the Hon'ble House of General Assembly, attended in Council & laid before Council a Letter from Gen'l Wayne, to the Hon'ble House of Assembly, in- closing divers Letters from the Officers of the Army, & the same were read.


Josiah Wood produced an account for making Six Hundred Shovels for the use of the Army, & three hundred handles for Shovels, & a Certificate in support of the said account, signed by Colo. John Bull; and thereupon,


An order was drawn on the Treasurer in favor of Josiah Wood, for the Sum of Two hundred and Seventy Pounds, for shovels made by him for the State of Pennsylvania.


The Council resumed the consideration of the return of the Election for Justices of the Peace for the Northern liberties of the City of Philadelphia ; and thereupon,


Ordered, That Henry Negle & Joseph Copperthwaite be ap- pointed & Commissioned to be Justices of the Peace for the Coun- ty of Philadelphia.

MINUTES OF THE


'An order was drawn on the Treasurer in favor of Lien. Col. North, or his order, for the sum of One hundred . & Thirty- Six Dollars, bounty due to Ensign George Knox for enlisting John Kennedy into the 9th Pennsylvania Regiment.


An account of Expences & Pay due for attending the Light House, was laid before the Council by Eleanor Hitchcock,. Widow of John Hitchcock, deceased, Amounting to the sum of Forty-Six Pounds twelve Shillings & six Pence.


Ordered, That it be recommended to the Officer appointed to collect the duty of Tonnage for the support of the Light House, doce., to settle the account of the Widow of John Hitchcock, And pay her the Balance due to her.


An order was drawn on the Treasurer in favor of Themas Shep. erd, or his order, for the Sum of Twenty Two Pounds & Ten Shil- lings, for 30 bushels of Lime, for the use of the House of Office, & some repairs in the State House.

Justice .of the Peace. for the said County of Bedford, & for .the Township of Bedford, And that James Coyle & James Carmichael be appointed Justices of the Peace for the County of Bedford & for the Township of Dublin, & that they be Commissioned accoord- ingly.


The Council also took into consideration the return of the Elec- tion of Justices of the Peace for the Township. of Peters, in the County of Cumberland; & thereupon,


Ordered, That William McDowell be appointed a Justice of the Peace for the County of Cumberland, & that he be Commissioned accordingly.


On consideration,


Ordered, That the Secretary do attend the Hon'ble House of General Assembly, & acquaint the House that the Council are in- formed that a hearing on the return of the Election for the County of Chester is to be had in the House to-morrow, in the forenoon, & as the determination of the Election for Sheriffs will depend on the same evidence as that of the representatives in General Assembly, they propose to the Hon'ble House that the Council be admitted to attend the hearing, & to take such notes of the proceedings as they may judge to be necessary to assist them in their determination, con- cerning the Election of Sheriffs for the said County of Chester.


A Letter from Col. Heartley, dated 9th instant, was read, do


Ordered, That the same be laid before the llon'ble House of Assembly.


The Secretary reports that he had delivered the Message to the Hon'ble House according to order, & that the Speaker was pleased to say, That the House will take into consideration the message from Council.


An order was drawn on the Treasurer in favor of James Long- head, paymaster of the City Militia, for the Sum of One Thousand & five hundred Pounds, to pay the Militia now to be discharged, & to charge the same to account of the said James Loughead.


The Clerk of the Hon'ble House of General Assembly attended in Council, &e returned Colo. Hartley's Letter, and he informed Council, That the House was ready to join a Committee of Council to assist in representing to Congress the situation of the frontier Counties.


The Clerk of the House again attended & informed the Council, That the House of Assembly had taken into consideration the ver- bal Message from Council, & that the House are disposed to ao- commodate the Council within the Bar at the hearing of the case of the Chester County Election, & that the hearing was, on motion, put off 'till Thursday next.


Ordered That the Secretary inform the House, That Council propose to apply to Congress, thro' the Delegates of the State, for the March of some of the Confederate Troops, & that if any diff- culty arise in the case, Council was inform the House and ask their assistance.

It appearing by the Records that John Ellwood, late of Bucks County, Pilot, is convict of High Treason at a Court of-Oyer & Terminer, holden on the Twentieth day of October last, de sentenced to be hanged by the Neck 'till he is dead; it is


Ordered, That a Warrant for the Execution of said sentence on Wednesday the Second day of December next, between the hours of Ten of the Clock in the forenoon, & two of the Clock in the After- noon of the same day, be issued.

The Council taking into Consideration the case of Joseph Wilson & John Lawrence, now under Sentence of Death :


Ordered, That Joseph Wilson & John Lawrence, now under Sentence of Death, be Pardoned, & that a Pardon be issued accord- ingly.


The Council taking into Consideration the case of Charles Wil- liams, convicted of Felony at the City Court, & now under sentence to receive twenty-one Lashes & pay a fine of ; and it appearing that a certain hath since confessed that she was guilty of the Felony whereof the said Charles Edwards was so convicted, which, with some other circumstances, rendering it in some degree uncertain whether or not the said Charles Williams had been guilty of the said Felony ; & thereupon,


Ordered, That the sentence of the City Court against Charles Edwards, so far as relates to the corporal Punishment & fine, be remitted.

A Letter from the board of War, inclosing copy of a Letter from his Excell'y Gen'l Washington, requesting a guard of 400 or 500 Men, to conduct the convention Prisoners thro' this State on their way to the Southward, was read ; & thereupon,


Ordered, That the first Class of Militia of the County of Bucks be immediately called into service, & that they March with all pos- sible expedition to Easton, to guard the Convention Prisoners from thence to the south ward.

Ordered, That one Class of Militia of all those Battalions of the County of Philadelphia from which there is now no detachments in service, be immediately called into service, & that they March with all possible expedition to Easton, to guard the Convention Prisoners from thence to the southward.


The Resolve of Congress of the 17th ins., November, recom- mending to the Legislature or Executive authority of each of the United States to appoint Wednesday the 30th day of December next to be observed as a day of Public thanksgiving & praise, be- ing read, & the same being considered,


Ordered, 'That it be recommended to the good People of this State to set apart Wednesday the said Thirtieth day of December next, for the purpose aforesaid, and that a Proclamation be accord- ingly issued.

" WHEREAS, it hath pleased Almighty God, through the course of the present year, to bestow great & manifold mercies on the people of these United States, & it being the indispensible duty of all Men gratefully to acknowledge their obligations to him for benefits received ; And the Congress having recommended to the Legislative or Executive authority of each of the said States, to ap- point Wednesday the thirtieth day of December next, to be ob- served as a day of Public Thanksgiving & Praise, that all the people may, with united hearts, on that day express a just sense of bis unmerited favors, particularly in that it hatb pleased him, by his overruling Providence, to support us in a just & necessary War for the defence of our rights & liberties, by affording us reasonable supplies for our Armies ; by disposing the heart of a powerful Monarch to enter into an alliance with us, & aid our cause ; by de- feating the Councils & evil designs of our Enemies, and giving us Victory over their Troops; & by the continuance of that union among these States, which, by his blessing, will be their future strength & glory :


" And Whereas, Congress bath further recommended, That to- gether with devout Thanksgiving may be joined a penitent con- fession of our Sins, & humble Supplication for pardon, through the merits of our Saviour, so that under the smiles of Heaven, our pub- lic Councils may be directed, our Arms by land and Sea prospered, our liberty & independence secured, our Schools & Seminaries of learning flourish, our trade be revived, our. Husbandry and Manu- factures increased, & the hearts of all impressed with undissembled

Petition of J. M. Nesbitt & Thomas Fitzsimmons, praying to be admitted to Ship on board the Sloop Eliza & Mary, John Light- burne, Commander, bound from this Port to Bermuda, 8 bbls. of Bread, One barrel of Flour, One barrel Pease, four barrels Beef, - . & two barrels Pork, as Stores for the Brig Neptune, lately built at & now lying in Bermuda, & intending a Voyage to the West In- dies for a Cargo of Salt, to be brought to this Port, was read.


On consideration,


Ordered, That it be recommended to the Naval Officer to clear out the said Provisions as necessary Stores for a Vessel trading to this State.

usual place, between the hours of ten O'Clock in the forenoon and two O'Clock in the Afternoon of the said day.


The Committee of Council appointed to confer with a Commit- tee of the Hon'ble House of General Assembly, upon the time and place of electing, by the joint bullot of the members of the House and of Council, a President and Vice President of this Council, report :


That having conferred with the Committee of the House upon the subject committed to them, It is agreed, That the Hon'ble House of General Assembly will meet in the Council Chamber to-morrow Moruing at Eleven O'Clock, and proceed to the Election of a President and Vice President, agreeable to the Constitution ; That after the Election is finished, the Council and Assembly pro- ceed to the Court House and there make Proclamation of the Presi- dent and Vice President so chosen ; That after Proclamation being made, that the Council and Assembly do dine together at the City Tavern.


And the Committee submit to the Council the Order of Proces- sion.

The General Assembly & Council then proceeded to chuse a Vice President, & the votes were as follows, Vizt:


For George Bryan, Esq'r, Sixty-two Votes. For Joseph Hart, Esq'r, One Vote.


And thereupon it was declared, That Joseph Reed, Esq'r, was then duly chosen to be President, & George Bryan, Esq'r, was then duly chosen Vice President.


And the following declaration of the said Election being read, was signed by the Hon'ble George Bryan, Esq'r, Vice President, & the Members of the Council then present; & the same was also signed by the Hon'ble John Bayard, Esquire, Speaker of the House of General Assembly, & by the Members of the House of General Assembly then present, to Wit : by
