that no danger will ensue by granting such permission, that they recommend them to the Officer commanding the Troops next to the Enemy, who, upon such recommendation, may, at his discretion, permit the persons to go in."
AND WHEREAS, Officers in the service of the United States have exercised the powers mentioned in the above Resolve without any application to this Board, & the same having been represented to Congress on the 25th of January last, no determination has yet been had or notice taken thereof, from which the exclusive power of the Board in the Premises seems to be doubtful :
Resolved, Therefore, that this Council will not give any further recommendations until the determination of the said power; but that persons desirous to go within the Enenty's lines, be referred to the Hon'ble the Congress for their permission or licence.

ton, complaining of his, Col. Weitzell's conduct in calling out the Militia of the said Battalion, addressed to the General Assembly, & by them referred to this Council, was read. Col. Weitsell being asked if he admitted the truth of the facts alledged against him, he said he did not admit them, & thereupon he laid the Minutes of the proceedings of him, the said Lieutenants & Sub-Lieutenants, in the case, with some other papers, tending to justify his conduct.
On consideration,
Ordered, That Wednesday the 24th day of March next, be ap- pointed to hear the complaint of the Petitioners of the fourth Bat- tallion of the County of Northampton, against Col. Weitzele, in the Council Chamber, & that the Parties have notice to attend with their Witnesses, or with depositions taken, being Robert Levers or John Arndt, Esq'rs, two of the Justices of the Peace of the Coun- ty of Northampton, in the presence of the Parties, if they should think proper to attend, after due notice given to them in writing.
The following three orders were drawn on the Treasurer in favor of Warwick Coats, Sen'r, or his order, Viz :
One for Fifty-two Pounds & fifteen Shillings, for work done by him on board the Franklin Galley.
One for Fifty-five Pounds & Fifteen Shillings, for work done by him on board the Hancock Galley ; and
One for Seventy Two Pounds Seven Shillings & Six Pence, for work done on board the Sloop Speedwell.
A Petition & Sundry Papers from the Overseers of the Poor be- ing read & considered ;
Resolved, That it is the opinion of this Board, that the Auditors of the Accounts between the United States & this State, ought to make a reasonable charge, as well for the use of the House of Em- ployment, as the New Goal, Powder House & other Public build- ings occupied by the United States, the State House excepted.

Harbor, dated October 22, 1778, & that it appeared clearly to him, that the Note in the Margin of the said entry has been altered in a darker coloured Ink & a different hand writing. The word "went" being written over what appeared to have been the word "sent," & the word "direction" (abreviated) written over what appears to have been the word "order" abreviated; Whereupon, a message was sent to Mr. Petit, requesting his attendance in the Council Chamber, & he attended accordingly.
The Council then laid before Mr. Petit their information con- cerning the alteration in the Deputy Quarter Master's Book, & re- quested him to lay the same book before this Council for their in- spection, & after altercation on the subject, in which Mr. Petit gave it as his sentiment, that the same could not be demanded of him of right, he brought it, & on examination in Mr. Petit's presence, the alteration plainly appeared, and there appeared also; in the same book, that the last entry therein, of the 30th day of October last, was totally obliterated, not by a common erasure, but by & black blot, done with evident design totally to conceal the entry there . made, consisting probably of two lines.
The Board taking into consideration the Conduct of John Mitch- ell, Deputy Quarter Master General, in his said Office,
Resolved, That the said John Mitchell have notice, that the board will proceed against him upon the resolve of Congress of the of February, 1777, on the complaint of Andrew Boyd, Deputy Waggon Master, & on the several facts appearing therein in proof against him, unless he attend and shew cause to the con- trary forthwith.

Mr. John Mitchell, Deputy Quarter Master General, attended in Council, & the Resolve of Congress of the 9th February was read to him, and also divers proceedings relating to the calling of a large number of Waggons in or about September last, (at least 1100 waggons,) & he was called upon to answer for his conduct in per- mitting the Waggons of this State to be called into the service of . the United States, under the authority of Law, to be applied by Gen'l Arnold to his private use, & for the alterations evidently made in his (Mitchell's) Memorandum book, of the entries made of that transaction, as an improper entry. Mr. Mitchell, among other things in the course of his representation to Council, soknow- ledged, That the blot in his Memorandum book of the 30th of Octo- ber, 1778, was done by his order, to conceal a Memorandum entered by his Clerk, of that date, "of the return of Mr. Jordan's Bri- gade of Waggons from Egg Harbor, & that the obliteration was made after the charge against Gen'l'Arnold for having used the Public Waggons for his private business, had come to his (Mitchell's) . knowledge."

The Petition of Col. Francis Johnston, respecting expences in- curred in procuring Cloathing, &ca, for the Regiment formerly Gen'l Wayne's, was read ; d; thereupon,
Ordered, That Col. Johnston's application be referred to the pro- per Board, appointed by Congress for examining claims, with the recommendations of Col. Johnston as an active & Zealous Officer, which probably brought this burthen on him.
An order was drawn on the Treasurer in favor of Rob't Allisce, or his order, for the Sum of Three Hundred Pounds, for which he is to account.
An order was drawn on the Treasurer in favor of Col. Lewis Farmer, or his order, for the sum of Two Thousand Pounds, to be applied to purchasing necessaries for the Army, agreeable to the Resolves of the Hon'ble House of General Assembly, & for which sum the said Farmer is to account.

This Board having at length received from the Camp a proposed plan of distribution of the Articles provided for the Troops, agree- able to a Resolve of the House of Assembly of the 5th of December last, & also a recommendation of Captain Ziegler as a proper person to distribute the same,

Resolved, That the said Captain Ziegler be & he is hereby ap- pointed Distributor of the said Articles, & that he have such allow- ance therefor as the same Officer from the State of Maryland is al- lowed,
2nd. Resolved, That the said Articles be distributed pursuant to the said Resolve of Assembly, at one-fourth part of the Original Cost, for Cash only, & that the usual allowance be made to Capt. Ziegler for wastage.
3d. Resolved, That the said Articles be distributed in quantity in the following manner, Viz : 1 pint of Rum { Week ; ) Ration ¿ib Muscovado Sugar ; + do. tib Coffee ; #do. 1 oz. of Tea ; do. jib Chocolate ; 2 oz. hard Soap, stb of Tobacco.

4th. Resolved, That due regard be had in the said Distribution to the Rank of the Officers, & that each Officer be entitled to draw from the Store in exact proportions to the number of Rations to which he is entitled on the Continental Establishment, Vist : The Weekly allowance of a soldier for every Ration.
5th. Resolved, That the Prices of the said Articles now' sent, be at the following Rates, Viz : Quart of Rum (21s. 8 & 23s. 9 } Gal- lon) as in quality ; Pound of Sugar, 3s. 1 & 3s. 4, as in quality ; Pound of Tea, 14s. 9 ; Pound of Coffee, 38. 6; a Pound of Choco- late, 6s. 3; a Pound of Tobacco, 1s 3 & 1s. 104; a Pound of hard Soap, 2s. 41 ; Loaf of Sugar, 7s. The above being the One-fourth part of the Original Cost of said Articles.
6th. Resolved, That as the above Articles are designed for the comfort of the Officers & Soldiers actually in Camp, none on Fur- low be deemed entitled to draw for the time he is absent.
7th. Resolved, That Capt. Ziegler do make regular returns of his issues to the Board once a Month, & be deemed accountable for the Money accrueing to the State, after due allowance made as aforesaid.
A Message to the General Assembly of Representatives of the Freemen of Pennsylvania was read, considered, approved, & or- dered to be signed by the President. And the same is as follows :
" Gentlemen :
"By an Act of Assembly passed the second day of January, A. D., 1778, intitled ' An Act for the better supply of the Army of the United States of America,' The several Officers appointed under the said Act were directed to obey the orders & Instructions of the Legislature, & during their Recess, of the Supreme Execu- tive Council. We have, during your Recess, distributed the Cloathing procured, made some new purchases, & directed the Sale of such Cloth on hand as was not suitable for the Army, & given such other directions as appeared to us beneficial to the Army & proper for the State.
" Mr. Howell, the present Receiver General, having signified his intention to resign some time ago, we would wish you to make a new appointment, & also direct the settlement of his accounts, with those of Capt. Lang, late an Officer in that department. We ap- prehend one Officer to be quite sufficient for that purpose, & if you should not conceive the business too extensive, it might be attended with a public saving to employ the purchasing Commissioner of the Articles mentioned in your Resolution of the 5th of December. In this view only we mention it.
"The Bridge on Schuylkill is an Article of considerable expence to the Public, & the rates of Ferriage having been settled by Act of Assembly, when the real & nominal value of money bore a more just proportion to each other than they now do. These rates are at present very inadequate & insufficient. By the papers transmitted

herewith, you will see what proposals the Quarter Master General of the United States has made with respect to the use to be made of the said Bridge by the Public Teams. As this part of the ba- siness is yet incomplete, unless your Hon'ble House will finish the Treaty we have had on this subject, it will be necessary to empower this Board to act therein, as the Quarter Master has represented to us that it will be very prejudicial to the public service to compel the Teams to pay Toll as they pass respectively.
" In our message of the 5th of February, we observed that the State of the Treasury, the Season of the year, & other circumstan- ces, had concurred to prevent our purchase of a Ship for the defence & protection of Trade. But having never lost sight of this im- portant object, we now acquaint you that we have in contemplation Two Vessels, which are recommended to us as suitable for the pur- pose, one just launched, the other lately arrived from sea, provided with Guns, &ca. The papers herewith will show an estimate of the cost of the former. The proposals respecting the latter being not yet answered, we cannot ascertain the probable expence, but, doubt- less it will bear some proportion.
"The ways & means of answering the expence in this case, will deserve your attention, & we mention it the more particularly, that if this important service should fail for want of the necessary sup- ply, it may not be attributed to inattention or neglect in us; As both interest & duty lead us to give all public relief to our mutual · constituents. In this instance, we have nothing to reproach our- selves with, whatever may have been insinuated to the contrary. We have now further to acquaint you, that in order to carry our design into Execution more effectually, we some time ago wrote to the States of New Jersey, Delaware, Maryland & Virginia, respec- tively, proposing an embargo on all outward bound Vessels, not only to deprive our enemies of their expected prey, but in order to enable us to man & fit out our Vessels of defence with the greater expedition.
"From the spirit which seems to prevail in Maryland, we can hardly doubt their concurrence, & we hope it will meet the appro- bation of the other States ; On our part nothing shall be wanting to make effectual provision against every species of depredation, whether on the Frontiers or elsewhere. We observe in your report of the conference entered in your Vote of the - February, an idea is held forth that Council will prepare a plan of general de- fence for the Frontiers & River.
" As a Committee of your Hon'ble House then existed for con- sidering the State of the Frontiers, & providing for their defence, & had conferred with a Committee of Congress thereupon, have since agreed upon a plan, & Congress have transmitted to us their Resolves thereupon, we apprehend no propositions from this Board can be expected. The President, with several Gentlemen, whose

knowledge & experience may be of signal service, are going to- morrow to view the several defences & State of the River, & to consider what further addition may be made. Your Hon'ble House will doubtless be acquainted with the result of their observations, so far as the communication of them is consistent with the secrecy necessary to public security. For as the objects of these means, (Viz :) safety & a repulsion of the Enemy, are common to us all, we can have no views or interests in which you do not partake. And we trust our mutual exertions will convince the good people of the State, that their dearest interests, either in the deliberative or executive branches, are not committed to unfaithful or negligent bands.

A Petition of Elias Lewis Treckel, was read; & the same relat- ing to a claim of his on a House forfeited to the State by Lawrence Fagan ; the same was rejected & the Petitioner referred to the Judge of the Supreme Court.
A Certificate signed " Holker, Consul of France & Agent Gene- ral of the Royal Marine," That the Brig Convention, William Al- len, Commander, Blair McClenaghan, owner thereof, has been Chartered to carry to Martinique 340 barrels of Bread, 60 barrels of Pork, & 40 barrels of Flour, for account of his most Christian Majesty, & for the use of the Squadron Commanded by His Ex- cell'y Vice admiral Count D'Estaing, being read and considered: I Ordered, That the Naval Officer be directed to clear out the said brig Convention.
The Secretary reports, That the Six blank Commissions for pri- vate Ships of War, last received from the Hon'ble the President of Congress, have been issued.
Ordered, That application be made to the President for a farther supply of blank Commissions for private Ships of War.

Mr. Morris & Dr. Gardiner, a Committee of the Hon'ble House of General Assembly, attended in the Council Chamber, & repro- sented, That their House had made application to Congress, thro' the Delegates of the State, to supply this Council with such sums of Money as the Exigences of the State may require, until the Monies arising from the State Taxes shall come into the Treasury ; & that Congress had expressed the utmost readiness to comply with the re- quest as far as they were able; but that it appeared to them (the Congress) necessary, (previous to a resolution of Congress on the said application,) to ascertain with some degree of precision the sum which would probably be wanted : Wherefore, the Hon'ble House had appointed this Committee, to request that the Council will pre- pare, an estimate of the expence which will necessarily be incurred in Six Months from the present time.
A return of Justices elect for the Township of Brothers Valley, wherein it appears that Abraham Cable and Jacob Glasner, were duly elected; being read & considered,
Ordered, That Abram Cable be appointed & Commissioned to be one of the Justices of the Peace for the County of Bedford.
The proceedings of Congress in the case of the Sloop Active, being laid before the Council by Mr. Searle, the same were read.
