The President having laid before the Board a very complete & elegant draught of the proposed Fortifications for the defence of the River Delaware & the City, made by the General De Portail & his Assistants, at the joint instance of Gen'l Washington & this Board,


Resolved, That the thanks of this Council be given to General De Portail, for his important services in this respect; & that, as is customary on such occasions,


An order was drawn on the Treasurer in favor of the said Gen- eral De Portail, for Two Thousand Dollars, which he be desired to accept, as an additional acknowledgement, for his time & labor spent in the service of the State.


Resolved, also, That an order be drawn in favor of Col. La Ra- dine, assistant Engineer to Gen'l De Portland, for One Thousand Dollars, & for Six Hundred Dollars in favor of Ville- panche, to be delivered in like manner, for their services in the samo business.


A Petition from the Officers & Men of Col. Eyre's Battalion of Militia Artillery, now in Garrison at the Posts on the River, was read & considered ; Whereupon,

Charles Hil, Esq'r, Assist't Q'r M'r Gen'l, having applied to the Board for the approbation & Warrant to call out a number of Teams for the transportation of Provisions and Stores for the Sup- ply of the Troops ordered to the Western frontiers,


Resolved, That the same be complied with, & the Waggon Mas- ters of Lancaster, York & Cumberland, (in which Counties the said Provisions are) do furnish the number required with all expe- dition, & that the same be as follows, Viz :- from Lancaster 40, York county 30, Cumberland 25.


Gen'l St. Clair, Commanding officer of the Pennsylvania line, having certified that Adam Hubley, Esq'r, Lien. Colonel of the Reg't of the Troops raised by this State, is the oldest Lieu. Colo- nel in the line, & therefore entitled to succeed to the vacancy made by the resignation of Col. Hartley, in the 11th Reg't.


Ordered, That the said Lieu. Colonel Hubley be recommended to the Hon'ble Board of War for the Commission of Lieu. Colo- gel Commandant of the Eleventh Regiment.

SUPREME EXECUTIVE COUNCIL.


A certificate signed by Holker, certifying that the Schooner Swan, Capt. James' Robinson, is freighted to transport Three Hun- dred barrels of Flour to St. Pierre of Martinique, for the use of the Fleet Commanded by His Excell'y, the Count d'Estaing. & ap- plication by George Meade, &ca, Owners of the said Schooner, for permission to clear out for St. Pierre accordingly.


, Ordered, That the Naval Officer do clear out for St. Pierre, Martinique, The Scho. Swan, Capt. Ja's Robinson, freighted with Three hundred barrels Flour, for the use of the Fleet commanded by His Excell'y, the Count d'Estaing.


Ordered, That the State Treasurer be requested to furnish the Council with an account of the Monies paid by him upon orders drawn by Auditors of accounts.


The Petition of John Taylor, a disabled soldier of the Flying Camp, was read ; thereupon,


Ordered, 'That it be recommended to the Justices of the County of Northampton, to enquire whether the Petitioner has been wound- ed in an engagement, or whether he has been disabled by natural sickness; if the former be the case, the said Justices will provide for him, according to the Act of Assembly for the relief of disa- bled soldiers & seamen, passed 18th September, 1777; if disabled by natural sickness, it is recommended to the Overseers of the Poor to make provision for the Petitioner, according to his circum- stances & necessity.


Letters from Gen'l Du Portail ; & from Board of War, dated instant; from Col. Henry, with return of oficers of Militia elected, with the date of their election.


Ordered, That Commissions be accordingly issued.

A like order in favor of Will. C. Bradford, Pay-master of the State Fleet, or his order, for the Sum of One Thousand & five Hundred Pounds, to be charged to his account.

An order was also drawn on the Treasurer in favor of the Hon'ble Matt'w Smith, Esq'r, or his order, for the Sum of Forty Thousand Dollars, of which said sum Twenty Thousand Dollars are to be by him sent to Col. Lochry, of the County of Westmoreland, to bes applied in raising Men in that County; Ten Thousand Dollars to be sent to the Captain of the Company to be raised in the County of Cumberland ; & Ten Thousand Dollars to be applied in raising the Companies in Lancaster and in Northumberland Counties.


Ordered, That the Muster M'r Gen'l do Muster the Officers, Seamen, & Marines of the Ship Gen'l Green, as near the time of her sailing as may be.


A transcript of the Record of conviction of Thomas Taylor, Esq'r, late of Cocalico Township, in the County of Lancaster, be- fore the Judges of the Supreme Court, held at Lancaster, on the fifth day of May ins., of Felony & Robbery, & the sentence of the Court thereupon : " That the said Thomas Taylor be hanged by the Neck 'til he be dead ;" being read ;


On consideration, .


Ordered, That Saturday the fifth day of June next, be appointed for the execution of the said sentence, between the hours of Ten ot the Clock & Two of the Clock of the same day, at the usual place of Execution ; & that a Warrant, under the less Seal of the State, signed by the President, & attested by the Secretary, be accordingly issued.


A transcript of the record of conviction of Catherine Fisher, late of the County of Lancaster, before the Judges of the Supreme Court, held at Lancaster, on the fourth day of May instant, of Murder, & the sentence of the Court thereupon : "That the said -Catherine Fisher be hanged by the Neck 'til she be dead ;" being read ;


On consideration,


Ordered, That Saturday the fifth day of June next, be appointed for the execution of the said sentence, between the hours of ten of the Clock in the forenoon & two of the Clock in the Afternoon of the same day, at the usual place of execution ; & that a Warrant, under the less seal of the State, signed by the President, & attested by the Secretary, be accordingly issued.


A transcript of the record of conviction of Tho's Crouch, late of the Township of Exeter, in the County of Berks, Yeoman, before the Judges of the Supreme Court, held at Reading, on the Eleventh day of May ins., of Felony & Burglary, and the sentence of the Court thereupon : "That the said Thomas Crouch be hanged by the neck until he be dead ;" being read ;

Ordered, That George Farrell, Patrick Goff & Will. Alexander, now confined in the Gaol of Philadelphia, belonging to Col. Proc- tor's Reg't of Artillery, enlisted to serve during the War, be ship- ped on board the Ship General Green.

A return of an Election of Justices of the Peace for the Town- ship of Barroe, in the County of Bedford, being now laid before the Board & considered,


Resolved, That by the Act of Assembly passed the 15th Feb'ry, 1777, each Township in Cumberland, Bedford, Northumberland & Westmoreland, is restricted to one Justice of the Peace, & Robt. Smith, Esq'r, having been commissioned as a Justice of the Peace for the said Township of Barree, it is not within the power of this

Board to Commission another. If the Township is so large that one Justice will be inconvenient, application should be made to the Justices of the Pesce at the County Court to divide the Township, which being done, an election may be held for the Township so.di- vided, and a Justice of the Peace duly Commissioned.


Capt. Martin having returned from Maryland, attended in Coun- cil, & informed That he had secured & brought from Baltimore four men belonging to the State Fleet; & that there were on board Capt. Buchannan's Brig, Two men belonging to the State, which which he could not obtain, & that one man belonging to the State was detained by Capt. Loxley & Mr. Purviance, on a writ issued for the recovery of Money advanced to him by them. Capt. Mar- tin also exhibited an account of his expences, Amounting to Seven- ty-five Pounds, which appearing to be as reasonable as the times will admit of, the same is allowed.


Ordered, That the Paymaster do pay to Capt. Henry Martin, or his order, for the Sum of Eighteen Pounds fifteen Shillings, due to John Brannon, one of the Seamen deserted, & the like Sum due to Rob't Martin, another of the Seamen deserted, and charge the same to the said Brannon & Martin ;


And an order was drawn on the Treasurer in favor of Captain Henry Martin, or his order, for the Sum of One hundred Dollars, balance of his account of expences to Baltimore, to be charged ('aptain Montgomery.


Ordered, That Capt. Jas. Montgomery be directed to charge the Sum of One Hundred Dollars, one-half of the expences of Captain Martin, on his journey to Baltimore, to the two Seamen belonging to the Ship General Green, which Capt. Martin arrested at & brought from Baltimore, one-half, ( Viz .: eighteen Pounds & fifteen Shillings,) to each.


Ordered, That Matt'w Dill be appointed a Sub-Lieutenant of the County of York, in the place & stead of Mr. Rob't Stevenson, lately deceased.


A Resolution of Congress of the 18th ins., recommending to the Executive Powers of the States of Pennsylvania, Delaware, Mary- land, Virginia & North Carolina, respectively, to permit One Thous- and bushels of Indian Corn to be exported from each of the said States, for the relief of the distressed inhabitants of the Bermuda Islands, &ca., was read; & the same being considered,


Resolved, That it is very clearly the opinion of this Council, that the said Resolve of Congress cannot be complied with, consistent with the Laws of this Commonwealth.


A Letter from Col. Walter Stewart, of the Second Pennsylvania Battalion, recommending Will'm Murran to be appointed to be an Ensign in the said Regiment.

SUPREME EXECUTIVE COUNCIL.


Ordered, That Will'm Murran be appointed an Ensign in the Second Pennsylvania Battalion, commanded by Col. Walter Stewart.


Application was made by Mr. Jos. Pennell, for an order to the Naval Officer to clear out the Continental Schooner Hannah & Polly, Dav'd Latham Commander, bound to Boston, laden with 300 bbls. of Ship Stuff, & 51 bbls. of Bread, Shipped by the Com- missaries of the Navy Board for the middle district, for the use of the Navy.


Ordered, That the Naval Officer do clear out the said Schooner Hannah & Polly.

A Petition of Margaret Potts, Wife of John Potts, praying to be permitted, with her three Children and a Maid Servant, to go into New York, & to take with her three feather beds with furniture, & some Kitchen furniture, was read ; & thereupon,


Ordered, That a recommendation be granted to Margaret Potts, agreeable to her request, She giving security in the Sum of Two Thousand Pounds, that she will not return without leave of the Council ; And also, That the Articles mentioned be accounted for with the Commissioner of forfeited Estates, if it shall hereafter appear that they are now the property of John Potts.


A Petition from a number of Merchants addressed to Congress respecting the Court of appeals, was sent into Council, with a re- quest that Council would give the same their Countenance & have it laid before Congress.


Ordered, That the same be delivered into the hands of the Dele- gates of the State in Congress, with a request to them to lay it be- fore Congress, & to express to them the concurrence of Council therewith.


Ordered, That as the purpose of the Embargo is in a good degree answered, That a Proclamation be issued for taking off & annuling the same, & the following Proclamation being read & considered, was ordered to be issued; Viz. :
