" A Letter from Tho's Hartley, Esq'r, Colonel of one of the Congress Regiments, to the Speaker, desiring leave to inlist for his Regiment within this State, & to be furnished with the bounty granted by this State for Recruits, & inclosing a resolve of Con- greas, that the men so inlisted should be considered as part of the quota of this State, was read, & it was thereupon
" Resolved, That the said Col. Hartley be permitted to enlist with- in this State, & that the men so by him recruited, be entitled to the bounty lately granted by this State for Soldiers inlisted for the Regiments of this State."

M., has lately sent to Boston a Brigade of Waggons, which it is suspected were Public Waggons, drawing Public Forage, & that they have been employed in bring- ipg Merchandize from Boston on some private account ; wherenpon, Ordered, Tho's Silliman, Sam'l Rea, Esq'rs, of the County of Northampton, be required to Summons such persons as may be probably acquainted with the said transaction, & fully examine them on Oath concerning it, & to take the necessary measures for securing all persons which may be concerned in carrying on this or any other public fraud, and make Report of their proceedings here- in, no. well to do justice to the United States as to the Character of Mr, Backhouse, if the report shall appear to have been without foundation.

The Hon'ble House of General Assembly having entered into the three following Resolves :
" In General Assembly, April 1, 1778, A. M.
" WHEREAS, It is absolutely necessary that the quota of this State towards the Continental Army should be raised with the ut- most expedition, And that all means should be used for attaining that important end,
1. " Resolved, That the Sum of Sixteen Dollars, lately resolved by this House to be paid to the recruiting Officer for each Soldier he shall inlist, shall also be paid to any person within this State, who shall procure an able-bodied recruit to inlist in any regiment belong- ing to this State, which said Sum shall be paid to the said person by the Lieutenant or nearest Sub. Lieutenant of the County, upon his delivering the said Recruit to him, together with an attestation of such inlistment, under the hand & Seal of some Justice of the County.
2d. " Resolved, That it be recommended to the Supreme Execu- tive Council to call upon the Lieutenants & Sub- Lieutenants of the several Counties of this State, for fair & exact lists, distinguishing battalions & Companies, of all the Officers & Soldiers within this State, which shall be delivered in, on or before the first day of May next.
3d. " Resolved, That it be recommended to the said Supreme Executive Council, to endeavour to procure the most exact & acou- rate accounts of what will be the deficiency of the quota of this State on the said first day of May next ; and that thereupon, & as soon as the said deficiency shall be kuown, theCouncil will fix, ascer- tain & allot to each of the said battalions the quota, proportion, or- number of men required of it for completing the Troops of this State; and as soon as the said requisition and allotment are made known to the Commanding Officer of the Battalion, the Field Offi- cers thereof shall meet together & allot, fix & ascertain the number of men required of each Company of the said battalion , and the same being notified to the Commanding Officer of each Company, the Officers thereof shall procure by draught, lot, or any other means whatsoever, the number of Men required of the said Com- pany ; And the said men shall be delivered by the Commanding Officers of the Companies respectively, to the Lieutenant or uearest Sub-Lieutenant of the County, within ten days after such requisition made to the Company, who shall give a Certificate of their being received; and the said Lieutenant or Sub-Lieutenant shall deliver the same men to the nearest recruiting Officer, who shall also give a Certificate of their receipt. And the said men so draughted or otherwise procured, shall serve as Soldiers in the Continental Army for the space of nine months, or during the Campaign, unless sooner discharged.

4th. " Resolved, That every Militia Man who shall voluntarily inlist himself without draughting or lot, in pursuance of these Re- solves, shall be exempted from all Taxes for one Year after his time of Service elapsed ;" Thereupon,
Ordered, 'That the Lieutenants of the several Counties be re- quired immediately to make the returns to this Council as ordered by the above 2nd Resolve, & that he take care to have them made on or before the said first day of May.

the Council on the best means of reducing three Reg'ta belonging to the quota of this State, & also to resolve & determine in codjano- tion with Council, which Regiments and what officers shall be so reduced; & that they make report of their proceedings to this House at their next Sitting."
The Hon'ble the Speaker of the House, Colo. King, Col. Clark, & Mr. MoLene, of the Committee mentioned in the foregoing Re- solve of the Hon'ble House, & also the Hon'ble Joseph, Reed, Esq'r, one of a Committee of Congress lately at Camp, attended in Council.
The present State of the Thirteen Battalions belonging to this Commonwealth, now being read before the Council & Gentlemen in conference & in the Continental Service, the circumstances at- tending them respectively, carefully attended to by them; and after full discussion of the difficulties arising from the various modes proposed for reducing the three Regiments, agreeable to the Roso- lution of Congress,
Ordered, That the 13th, 12th & 11th be joined with some other of the Regiments.
'That as the State of the Second & third Battalions require com- siderable alterations to be made, the 13th Battalion be incorpora- ted with the Second, & that Colo. Walter Stewart take the ' Com- mand in the room of Colo. Becker.
That the Twelfth Battalion be incorporated with the third Bat- tolion.
That the Eleventh Battalion be incorporated with the tenth, be- ing the next youngest Battalion; and that Colo. Humphreys take the Command in the room of Colo. Nagle.
That the arrangement of the other Officers be submitted to the direction of the Committee of the Hon'ble Congress, lately sent to Camp, as they will be possessed of the best information whereon to found a judgment herein. At the same time, it is recommended to them to regard the date of Commissions where there is equal merit ; but as the reason on which the rule adopted in such cases in older Countries is founded, does not fully extend to a service 80 new as that of the United States of America is, where there are de- ficiencies in the conduct of any Officer, and it appears to be for the interest of the Service to remove him & to advance others in con- sideration of merit, that the interest of the service be allowed its dne weight.

Ordered, That if it shall happen to be the Tour of duty in the Militia, of any Workman which shall be employed in making Bayo- Dets & Belts for Colonel Broadhead's Brigade, he shall continue in that employment, & be allowed Rations & Pay as if actually
. in the field, & that it be considered as a performance of his Tour of duty for such time as he shall be actually employed in making such Bayonets & Belts; and that the Lieutenants & Sub-Lieutenants of the County are hereby directed to take care that this Resolve be faithfully executed, without abuses of any kind.

An order was drawn on the Treasurer in favor of George Ross, jun'r, for the Sum of Thirty-three Pounds Nineteen Shillings & Eight Pence, advanced by him as aforesaid ; this last order being interwoven in the former onc.

Ordered, That Mr. Benja. Rittenhouse be allowed, for Superin- tending the Gun Lock Factory, the Sum of Five hundred Pounds Ann., to Commence from the 15th Feb'ry last.
Petitions of divers Volunteers who went from Antrim & Peters' Township into service in November last, setting forth,
That in consequence of the invitation of the President & Gen'l Armstrong, & that they have served at Camp in expectation that it would have been considered as a tour of duty done by them, but that the Lieutenant of the County is now about to order them to be fined for not turning out in their Classes respectively, being read ; on consideration,
Ordered, That agreeable to the order of Council to the Lieuten- ants of the several Counties dated the 23d day of October last, all persons who had not gone out in their turn in the Classes called before that time, & who turned out & served two months according to the said order, such service shall be considered as a full compen-

sation for their former neglect, & that all persons whose turn it was' not then to go into the field, & who notwithstanding, went out vol- untarily & served a tour out of their turn, be exempted from their then next tour of duty ; But Council hath not any legal authority to extend this exemption to those who refused to go in their turn under the Officers which had been duly chosen by the People, & Commissioned accordingly.

"In Congress, March 19th, 1778.
" Resolved, That it be recommended to each State to appoint some suitable person or persons to get made, with all possible dis- patch, as many complete sets of accoutrements & spare bayonet Sheaths as shall be sufficient for their respective quots of Troops; The Cartridge Boxes to be made to hold at least Twenty nine rounds of Cartridges, when made up with ounce Balls, & the cover of good substantial leather, with a small cover or flap under it, that the Ammunition may be most effectually guarded against main ; & to prevent impositions from the workmen, that proper inspectora be appointed to examine & receive the accoutrements, with orders to reject such as are bad & insufficient .; & that the accontrements so provided be sent forward with the Troops, or as soon after as possi- ble ; That in case in any State they have quantities of Tin, instead of the Cartouch Boxes, an equal number of Tin Cartridge Cannis- ters be furnished, agreeable to a pattern or description to be sent by the board of War."
Ordered, That William Henry, Esq'r, be appointed to procure the accoutrements to be made agreeable to the foregoing Resolve of Congress.
The Resolve of Congress of the 16th March last, "That the board of War be directed to deliver over to the order of the Presi- dent & Council of Pennsylvania, the Prisoners sent from this State to Virginia," being now read, & the law for the further security of the Government taken into consideration, as far as the same may affect the said Prisoners; thereupon,
Ordered, That the said Prisoners, to Wit : Israel Pember- ton, John Hunt, James Pemberton, John Pemberton, Thomas Wharton, Edward Pennington, Henry Drinker, Thomas Gilpin. Charles Jervis, Thomas Fisher, Samuel Pleasants, Thomas Af- flick, Elijah Brown, Owen Jones, jun'r, Samuel Fisher, -Wil- liam Smith, Miers Fisher, Charles Eddy, & William Drewitt Smith, be brought to Shippensburgh in this State, & there on- larged ; That they be informed of the Law passed for the fur- ther security of the Government, by giving to Mr. Israel Pem- berton, or some one of the said Prisoners a printed Copy of the said Law for the inspection of the whole ; That Mr. Francis Bailey & Capt. Lang be appointed to apply to the Board of War for, & receive from them an order for the delivery of the Prisoners sent from this State to Virginia, & that the Board of War be requested to give orders for such assistance in procuring Waggons to bring the Prisoners into this State as may be necessary ; That the said Francis Bailey & Capt. Lang receive & conduct the said Prisoners to Shippensburgh in this State, & there set them at liberty; and that on their journey they be treated with the respect due to their Characters.

" Pay to the Hon'ble the President & Council of the State of Pona- sylvania, or order, the Sum of Fifty Thousand Dollars, it being to be by them put into the hands of proper persons, for the purpose of purchasing Horses in said State for the use of the Army of the United States, & to be paid out of such Money as you have or may receive in consequence of issues of Loan Office Certificates, the said State to be accountable.
