A Quorum of the Supreme Executive Council being assembled, and information thereof given to the General Assembly,


The General Assembly, by a Member, acquainted the Council that they are ready to proceed on an election of a President and Vice-President of the Supreme Executive Council, if the Council shall think fit to join them, And thereupon It was Agreed,


That the Council are ready to join the General Assembly, and proceed to the Election of a President and Vice President of this Council.


Agreed,


That the Council will meet again at the Council Chamber to- morrow Morning at ten o'Clock, and report the proceedings at the said Election.

That the Speaker, immediately after the Election was declared in the House of General Assembly, had Administered to the President then chosen, the Qualifications required by the Constitution of this Commonwealth ; and he also Reports,


That the Council, in conjunction with the General Assembly, had agreed to Publish the said Election at the Court House in this City this day at twelve O'Clock, and to proclaim the President ; thereupon Agreed,


That the Council will proceed to the said Publication and Pro- clamation accordingly, and meet again in the Council Chamber to- morrow Morning at ten O'Clock, and report the proceeding.

That the Election of the President and Vice President had been Published at the Court House yesterday at Noon ; and that at the same time the President was proclaimed by the Stile and Title of " His Excellency Thomas Wharton, Junior, Esquire, President of the Supreme Executive Council of the Commonwealth of Pennsyl- vania, Captain General and Commander-in-Chief in and over the same."


His Excellency the President Administered the Qualifications directed to be taken by the Constitution of this Commonwealth to George Bryan, Esquire, Vice President, who Administered the said qualifications to all the Members of Council then Present, Viz. : to John Evans, Jonathan Hoge, John Lowdan, and John Prector, Esq'rs.


The Petition of Timothy Matlack being laid before the Council, praying to be appointed Secretary to this Council, Agreed That Timothy Matlack be Secretary of this Council.


Timothy Matlack appeared and took the Affirmation required by the Constitution to Qualify him for his Office of Secretary of this Commonwealth.

The Resolve of Congress of December 11, 1776, recommending in the following words, Vizt :


" Whereas, the just War into which the United States of Ame- ries -have been forced by Great Britain, is likely to be still con- tinued, by the same violence and injustice which have hitherto animated the Enemies of American Freedom; And Whereas, it becomes all Public Bodies, as well as private Persons, to reverence the Providence of God, and look up to him as the Supreme Dis- poser of all events, and the Arbiter of the Fate of Nations; There- fore the Congress hereby Resolve,


" That it be recommended to all the States, as soon as possible, to mppoint a day of Solemn fasting and humiliation, to implore of Almighty God the forgiveness of the many Sins prevailing among all Ranks, and to beg the countenance and assistance of his Provi- dence in the Prosecution of this just and necessary War. The Congress do also, in the most earnest manner, recommend to all the members of the United States, and particularly to the Officers, Civil and Military, under them, the Exercise of Repentance and reformation; and further do require of the said Officers of the Military Department, the strict observation of the Articles of War in general, and particularly that of the said Articles, which forbids Profane swearing and all other immoralities ; of which all such Officers are desired to take Notice. It is left to each State to issue out Proclamations, fixing the day that appear most proper for their several bounds ; ' being laid before the Council, and the same being considered;' thereupon,


"Ordered, That Thursday the third day of April, be appointed for the said purpose. A Draft of a Proclamation thereof being laid the Council, was read and approved, and is in the words follow- ing, Vizt.

' By the Supreme Executive Council of . the Commonwealth of Pennsylvania.


"A PROCLAMATION.


" Whereas, the Hon'ble the Continental Congress, pointing out to Public bodies, as well as private persons, the duty of revereno- ing the Providence of God, and looking up to him as the Supreme disposer of all events, & the Arbiter of the fate of Nations; did, on the 11th day of December last, resolve to recommend to the several States the appointment of a day of Solemn Fasting and Humiliation, to implore of Almighty God the forgiveness of the many Sins prevailing among all Ranks, and by the countenance and assistance of his Providence, in the prosecution of the most just and necessary War into which the United States have been forced by Great Britain, and which is still likely to be continued by the same violence and injustice that has hitherto animated the Ene- mies of American Freedom, and did, also, in the most earnest man- ner, recommend to all the members of the United States, and par- ticularly to the Officers, Civil and Military, under them, the exercise of Repentance and reformation, leaving it to each State to fix on such day for the same as may be most proper for its bounds:


" We, therefore, do hereby recommend to all the People of this Commonwealth, to observe and keep Thursday the third day of April next, as a day of Solemn Fasting, Humiliation, and Prayer, for the purposes before mentioned, of which the inhabitants of this State aro desired to take notice.

The Petitions of Mathew Clarkson, Paul Fooks, Steiner & Cist, Simon Dricebach, divers Officers of the Putnam Galley, & James Smith, were read and ordered to lie on the Table.


Ordered, That the Secretary purchase Burnes' Justice, and Black- stone's Commentaries, for the use of the Council.


The Council of Safety representing to this Council That the Sum of One Hundred Thousand Dollars is immediately wanted for the Paying of the necessary Current expence of the War, and request the same may be put into their hands :


Thereupon Ordered, That Mr. Evans and Mr. Hubley wait ou the Honorable House of Assembly, and inform them of the said Application.


Mr. Evans & Mr. Hubley Report :


'That they had waited on the Honorable House of Assembly, and informed them of the application to this Council from the Council of Safety for a supply of One Hundred Thousand Dollars, and that the House were pleased to say they would take the same into their consideration.


Adjourned to Ten O'Clock to-morrow Morning.

That the House had taken into consideration the application of the Council of Safety for a Sum of Money, And as that body must of necessity continue to act for some time longer, the House recom- mended to the Supreme Executive Council to apply to Congress for the Sum of One Hundred Thousand Dollars, to be put into the bands of the Council of Safety, to be accounted for by them.


Francis Trumble proposing to the Council to give security for the appearance of a certain Joseph Worra (now a Prisoner in this City on a charge of having grieviously beaten a certain - at the next Court of Quarter Session, to be held at, then and there to answer the said charge.


Ordered, That Mr. Evans take the said Bail, the Principal in the Sum of Two Hundred and Fifty Pounds, and


A Letter from His Excellency General Washington, to the Cows- cil of Safety was laid before the Council.


Adjourned to half after Three P. M.

The Petition of Wm. Lyon, Esquire, praying to be appointed Prothonotary of Cumberland County, was read and ordered to lie on the Table.


The Petition of Wm. Lyon, praying to be appointed Prothono- tary of the County of Cumberland, having been again read, was taken into consideration, and thereupon Agreed,

A Return of the Sheriffs and Coroners elect for the County of Backs, being made to the Council, was now read, by which it ap. pears that John Thompson and Garrat Dungan were duly elected to serve as Sheriffs, and Benjamin Fell and Robert Ransey wore duly elected to serve as Coroners; and the said John Thompson & Garrat Dungan attending at the door, were introduced to the Coun- cil, and offered their service in the Sheriff's office ; and they having retired,


Ordered, That John Thompson be appointed'High Sheriff of the County of Bucks, and that on his giving the security required by Law, He be Commissioned accordingly.


Ordered, That Benjamin Fell be appointed Coroner of the Coun- ty of Bucks, and that on his giving the Security required by Law, he be Commissioned accordingly.

The Council taking into consideration that the Civil Department of this Commonwealth requires great attention, and will for some time fully employ them to discharge the duties thereof, and that it is also of great importance that a due attention be still paid to the War which we are engaged in ; Therefore Resolved, That A Board of War for the Land Service of the State, consisting of Nine Per- sons, be appointed, and have full Power and authority to do and perform all matters and things necessary in the said department, subject, nevertheless, to the direction and examanation of this Council from time to time, as we may deem expedient, and saving to ourselves always the power of appointing officers, agreeable to the constitution of this Commonwealth ; Thereupon Resolved, that David Rittenhouse, Owen Biddle, William Moore, Joseph Dean, Samuel Morris, Senior, Samuel Cadwalader, W. Corris, John Bay- ard, George Gray, and John Bull, Esquires, Be a Board of War, and that they, or any three of them, be Commissioned and empow. .

ered to Act agreeable to the foregoing Resolution, the commission to continue in force untill revoked by this or a future Supreme Ex- ecutive Council; And a Commission being made out accordingly, the same was Signed by the President : Thereupon Ordered, That Mr. Hubley administer to the several members of the Board of War the qualifications required by the Constitution of this State, for the faithful discharge of their office.


The Council also taking into consideration the necessity of ap- pointing a Navy Board : Thereupon Resolved, that a Navy Board, consisting of Eleven Gentlemen, to be appointed, and have full power and authority to do and perform all Matters and things Relating to the Navy of this State, subject nevertheless to the di- rections and examinations of this Council, from time to time, as we may judge expedient, and saving to ourselves always the power of appointing Officers, agreeable to the Constitution of this Com- monwealth ; Thereupon Resolved, That Andrew Caldwell, Joseph Blewer, Joseph Marsh, Emanuel Eyre, Robert Ritchie, Paul Cox, Samuel Massey, William Bradford, Thomas Fitzsimmons, Samuel Morris, Jun'r, and Thomas Barclay, be a Navy Board, and that they, or any three of them, be Commissioned and empowered to Act agreeable to the foregoing Resolution ; the Commission to continue in force until revoked by this or any future Supreme Executive Council; And a Commission being made out accordingly, the same Was signed by the President ; Thereupon,


Ordered, That Mr. Hubley administer to the several Members of the Navy Board, the qualifications required by the Constitution of this State, for the faithful discharge of their Office.


" Resolved, That the Board of War be directed to apply to Con- gress for the Sum of One Hundred Thousand Dollars, to be ac- counted for by this State."

"By the Minutes of this Board, which we have the Honor to int close, you will perceive that Nine Members present have resolved not to take the oath or afirmation of allegiance tendered to them by a mem- ber of your Honorable Board. We do not apprehend that the reasons on which our dissent are founded is expected, but we think it neces- sary to make known to your honors that we are willing and ready to take an Oath of Allegiance to the United States, as well as the Oath of Office; And that We are extremely desirous of rendering every service in our power to this Stato, in any Capacity in which we can be useful.

Ten Members.


Mr. Hubley, from the Supreme Executive Council, having tendered to the Members of this Board the Oath or Affirmation of Allegiance prescribed by the 40th Section of the Frame of Gov- ernment formed by the late Convention of this State, it was agreed to take the sense of the Members on that Subject, and the question being put, there appeared Against it,

" Whereupon : " Ordered, That a Copy of this Minute be sent to the Council, with an Address expressive of the attachment of this Board to the Independence of America, and their readiness to serve this State on any occasion./

"CORNELS SWEARS, Ses'y.


Divers Evidences respecting the burning of the Powder Mills at French Creek having Been examined in the presence of Mr. Book, one of the Powder Makers, and on the whole there appeared no proof sufficient to justify The imprisonment of any of the persons taken on the suspicion of firing the said Mills; thereupon :


Ordered, That Mr. Beck and his Workmen be discharged.


A Remonstrance of Divers Officers of the Tenth Battalion, re- specting the arrangement of the Officers of that Battalion, was read in Council.


Ordered, That the said Remonstrance lie on the Table for Con- sideration.


The Council met.
