Keller in forcibly taking away two Horses from Adam Kimmel, which were in the service of Council, thro' a deception, be dis- charged on taking & Subscribing the Oath or Affirmation of Alle- giance to the State, and that Jacob Keller, jun'r, & Jacob Brindle, on their taking & subscribing the Oath or Affirmation of Allegiance to the State, and giving Security for their good behaviour for one year, themselves each in the Sum of Four hundred Pounds, & one Sufficent Freeholder in the Sum of Two hundred Pounds, be en- larged.
Colo. Bayard & Colo. Coats attended the Council in the name of the Hon'ble House of Assembly, requested a conference with Council, (either in the Assembly Room or in the Council Cham- ber, as the Council think fit,) on the situation of the State, with respect to the Continental Army going into Winter Quarters; thereupon,
Agreed, That this Council will attend the House in the Assembly Room.
The Conference with the Hon'ble House of General Assembly having been had, & it being unanimously agreed to remonstrate to Congress against the Army going into Cantonments,

An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer of the State, in favor of Peter Dehaven, for the Sum of Two hundred Pounds, for which he is to account.
Council being informed that there is a quantity of Gun powder, Salt Petre, & Sulphur, belonging to either this State or to the Continent, which is at present in the hands of Tho's Himeburg, near the Yellow Springs, which appears to be insecure ; therefore,
An order was given for the delivery of the same to the Hon'ble Tho's Urie, Esq'r, to be by him secured, and an order was also drawn directing Mr. Rob't. Towers, to deliver to the said Tho's Urie such Public Stores as are now in his hands belonging either to the Continent or to this State.
An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer of the State, in favor of Mr. Blaithwaite Jones, for the Sum of Two La undred Pounds, to be charged to Congress, in part Pay for his services in superintending the Works at Billingsport.

" In Council, Lancaster, Decem. 24, 1777.
" To the Representatives of the Freemen of the Commonwealth of Pennsylvania:
"The Council having found great inconvenience and mischief arise from the want of a Law for regulating Carriages employed in the Service of the Army; That such Laws having been found proper & useful in former times, when Soldiers have been employed & Quar- tered in Pennsylvania, are become more necessary than ever, from the great extent & burden of that duty at present ; That contrary to the Policy of free States, Quarter Masters, Commissaries, & other persons of Character, purely Military, have been left through necessity, to press Waggons & Horses, a practice big with mischief & oppression, such Officers regarding merely their own convenience & ease, & burdening chiefly the neighbourhood where they reside, & forcing into Service Carriages carrying in the Town food & fuel to the immediate distress of the inhabitants; That Council have endeavoured to interpose their influence in extending the burden of this necessary duty to the People generally, but that want of an- thority to enforce their Rules by punishing offenders & restraining the Military Officers aforesaid, have undermined all their efforts, and must continue to do so, whereby the Waggon Service will be- come an intolerable grievance to many worthy Farmers, and will be performed with reluctance & insufficiency ; That the need of s better reward than Thirty Shillings P. Diem, for the service of a Team of four Horses & & Waggon, has been fully manifest to Council; That they have represented to our Delegates in Congress that adequate Wages are essentially necessary to the performance of this important Service, & they have recommended that Forty- five Shillings or Fifty Shillings Per Diem be hereafter allowed; Council therefore, are of opinion that a Law on the Subject of Car- riages & Horses for Continental Service is indispensibly necessary, & if it should be considered as proper, Council will frame heads of a Bill for expediting the same.

On Monday last Mich'l Smith, Waggon Master, delivered to Council Nine Bales of Woollens & five small Bales of Shalloons, which had been Seized by Colo's Smith & Keiklein, of the County of Bucks, & sent forward for the purpose of Cloathing of Troops; and an order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer of the State, in favor of the said Mich'l Smith, for the Carriage of the said Goods, for the Sumof Ninety-four Pounds & ten Shillings, to be charged to account of Cloathing the Troops of this State.
Ordered, That Capt. John Harrison be appointed to the Com- mand of the Dickinson Arm'd Boat, and that he be commissioned accordingly.

Joseph Green, of the County of Northumberland, laid before the Council an Account of Expences in supplying the Militia of that County with Provisions, on an expedition up the West branch of Susquehanna River, to defend the frontiers against the Indians, Amounting to One thousand Four hundred & Sixty Six Pounds Se- ven Shillings & Six Pence, as he has stated it; but Council not having before them the vouchers necessary to support the said ao- count, & it appearing that a considerable Sum of Money will be wanted in that department, this account is ordered to be rendered to the Lieu't of the County; And an order was drawn on the Tres- surer, in favor of Joseph Green, for the Sum of One Thousand & Six hundred Pounds, to be by him paid into the hands of Samuel Hunter, Esq'r, Lieutenant of the said County, & to be charged to the said Hunter.

Mr. Sam'l Caldwell rendered an account of the Expences paid by him & Mr. A. Nesbitt, in conducting the Quaker Prisoners to Reading, Amounting to One hundred & Fifty-Nine Pounds Three Shillings & four Pence; And an order was drawn on the Treasurer, in favor of Mr. Sam'l Caldwell, for the Sum of Fifty-Nine Pounds Three Shillings & four Pence, balance of the aforesaid Account.

Mr. James Read & Colo. Clarke, a Committee of the Hon'ble House of General Assembly, attended in Council & laid before them the Petition of Forty-four respectable Persons of this County, pro- posing the calling out the whole strength of this State against the Enemy, and proposed a conference between the Council & General Assembly.
Ordered, That John Brown be allowed the liberty of the Goal, as other Prisoners usually are.
The President & Council having attended in consultation with the General Assembly, & it being agreed that the proposal made in the above mentioned Petition be communicated to Congress, A Com- mitteee was appointed to draft a Letter to Congress for this pur- pose.

John Shields, of Westmorland County, Thirty-six Riffle Guns, or such number as are in their possession, to be delivered to Colo. Arch'd Lochry, Lieut. of the said County; and also an order was drawn on William Henry of this borough, for all the Riffles in his possession, to be delivered to Colo. Archi- bald Lochry, Lieut. of the said County.
Ordered, That the Board of War be requested to furnish Her- man Husband, Esq'r, with Two hundred Pounds of Powder & Six hundred Pounds of Lead, for the use of the Militia of Westmore- land County, in defending themselves against the Indiana, and the like quantity for the use of the Militia of Bedford, for the maid purpose.
An order was drawn on the Treasurer, in favor of Jacob S. Howell, for the Sum of Five hundred Pounds, for which he is to account.

Hart; where- upon, Colo. Hart, with the concurrence of Council, delivered the Keys to the said Mr. Anderson, Colo. Dill & Colo. Clarke.
An order was drawn on the Treasurer in favor of Mr. Tolbert, for the Sum of Seven Pounds & ten Shillings, for riding express for General Armstrong.

Ordered, That Congress be informed that the Prisonera now at Winchester, are considered by this Council as the Prisoners of the United States, & that a considerable expence hath been paid this State removeing them to Winchester.

Ordered, That Colo. Lacy, take the Command of the Militia of this State, which may be Stationed between Schuylkill & Delaware, until further orders.
Ordered, That Colo. Kirkbride be directed to send out Thirty Light Horse, to be commanded by a Cornet, to do duty in the Camp under Colo. Lacy. Complaint being made that several Waggons had been impressed contrary to the assurance given by Council to the Farmers sending in Wood, Hay, &ca. to this Borough,

Hartley attended, & being intormed of the Complaint, assured the Council that he had not ordered the impressing of the Waggons above mentioned, & that he would immediately order them to be dis- charged.
Capt. Blewer laid before the Council a Receipt signed by Sam'l Smith, Lieut. Colo. & Commander of Fort Mifflin, for Two hun- dred & Twenty-four pair of Stockings, One hundred & Twelve pair of Shoes, One hundred & Ninety Shirts, & Twenty Coats, for the use of the Party under his Command in the said Garrison.
Ordered, That the same be communicated to the Clothier Gene- ral, that he may charge the said Cloathing to the said Colo. Smith, & credit this State therewith.
The Petition of Lambartus Scheline, Setting forth that he has been confined in the Goal of Berks County, on the common allow- ance, upwards of Two Years & Three Months, under sentence of Death for passing of false counterfeit Bills, in the form & simili- tude of the true genuine Bills, the Currency of Pennsylvania; that he is upward» of Seventy Years of Age, & that shortly after his confinement, thro' sickness and distress he has entirely lost his Eye- sight, & praying a discharge, &ca., now laid before the Council & read; And after mature deliberation on his case, it was
Ordered, That the said Lambertus Scheline be Pardoned & dis- charged from his confinement, on paying the costs of prosecution & Prison Fees.
Mr. Joseph Carson, to whom the Goods lately brought from Bucks County belong, requested that he may be supplied with the Sum of Seven thousand Pounds in Loan Office Certificates, in part of the Amount of the said Goods; & it appearing that there is a considerable sum of Money yet due on the last order of Congress on the Treasury in favor of this Council, & that the Sum required by Mr. Carson may be had at the Loan Office in Certificates, toward the Payment of the said order of Congress; whereupon,
An order was drawn on the Treasurer in favor of the said Jos. Carson, for the Sum of Seven Thousand Pounds, to be paid to him in Continental Loan Office Certificates & charged to him.

The Council taking into consideration a return of Justices made by the Township of Munsey, in the County of Northumberland; thereupon,
Ordered, That Andrew Culbertson & Mordecai M'Kinney be appointed Justices of the Peace for the County of Northumberland, & their Commissions were dated this day.

The Council taking into consideration the appointing of a Wag- gon Master for the State, & Waggon Masters for the respective Counties, according to Law ; thereupon,
Ordered, That James Young, Esq'r, be appointed Waggon Mas- ter of the State, & that the following persons be appointed Wag- gon Masters of their respective Counties : Philadelphia County, Colo. John Moore ; Chester County, Tho's Boyd, Esq'r; Bucks County, John Thompson, Esq'r ; Lancaster County, James Bayly; Berks County, Leonard Reed ; York County, Jos. Jefferys; Cum- berland County, Matt'w Gregg; Northampton County, Conrad Knider ; Bedford County, John Cesna; Northumberland County, Jas. Mc --; Westmoreland County, And'w Linn.
The Council agreed unanimously, that there is a necessity of ap- pointing another Brigadier General ; And thereupon, being voted for by Ballot, John Lacey, jun., was elected by an unanimons vote to be Brigadier General.
