ARTICLE 31


VOTED that the Town appropriate the sum of $9,000.00 to be expended under the direction of the Highway Surveyor, for the construction of a sidewalk on the westerly side of High Street from the Southeast Express- way underpass to the Grace Farrar Cole School, a distance of approxi- mately 2,500 feet, and to meet the appropriation the sum of $3,262.70 be appropriated and transferred from the High Street-Oak Street account balance and the Town raise and appropriate the sum of $5,737.30.


ARTICLE 32


VOTED that the Town appropriate and transfer from Free Cash the sum of $18,000.00 to be added to the Highway Town Account, for use by the Highway Surveyor for the resurfacing of sections of Grove Street, and River Street, South Street, Prospect Street, Summer Street, School Street, and Tiffany Road, and for the opening, closing and patching of such ad- vance "across the street" water services in these sections prior to re- surfacing as are approved by the Board of Selectmen, Planning Board, Board of Water Commissioners and the Highway Surveyor and that pro- visions for all water connections shall be accepted by the Board of Water Commissioners as charges against their Water Services Account.


ARTICLE 33


VOTED that the Town raise and appropriate the sum of $7,500.00 for use by the Permanent Drainage Committee to accomplish the design, specifications and construction of the most needed drainage projects within this appropriation, and the Permanent Drainage Committee shall determine if the required construction is to be done by the Town Depart- ments or by competitive bidding.

VOTED UNANIMOUSLY that the Town rescind $200,000.00 of the Treasurer's authority to borrow $800,000.00 for the construction, equip- ping and furnishing of a new elementary school on Old Oaken Bucket Road voted in Article 2 of the October 25, 1965 meeting, as this sum of

VOTED UNANIMOUSLY that the Town appropriate the sum of $20,000.00 for use by the Permanent Building and Maintenance Committee, for plans, specifications, construction or furnishings for the Old Oaken Bucket Road School, with the Committee fully authorized to use this sum for the completion of this elementary school project; and to meet this appropriation the sum of $1,094.42 be appropriated and transferred from the Town Garage Account balance, the sum of $881.90 be appropriated and transferred from the Senior High School account balance and the Town raise and appropriate the sum of $18,023.68.

VOTED UNANIMOUSLY that the Town authorize the Board of Select- men to purchase or take by eminent domain an easement for the purpose of a Highway Storm Drainage System, from the north side of Main Street, near Homestead Farm, through the property of George Clark Whiting to a brook as shown on a plan entitled "Sketch Plan of Drainage Easement in Norwell," dated January 20, 1967 by Loring H. Jacobs, Registered Land Surveyor, a copy of which is on file in the Town Clerk's office and incorporated by reference herein, and to raise and appropriate the sum of $200.00 herefore.

ARTICLE 43


VOTED UNANIMOUSLY that the Town amend Article X of the Town By-laws by adding a new section 8 to read as follows:


Section 8. That prior to the location of any sidewalk a detailed street layout establishing black top and abutters property lines shall be developed for cost estimate and bidding purposes and an Abutters Hearing shall be held prior to the final location of any sidewalk. The specifications for such a project shall have the approval of the Highway Surveyor, Tree Warden and Board of Selectmen, collectively re- sponsible for the required construction, maintenance, operational conditions and contract negotiations.


ARTICLE 44

2. In Business District C no building or structure shall be constructed, altered or placed upon land for any use except as follows, nor shall any building or structure or premises be used for any purpose except:


a. Research laboratories with incidental assembly or test manu- facture.


b. Light manufacturing enterprises.


c. Building materials salesrooms, utility structures, storage ware- houses and buildings, wholesale distribution plants.


d. Printing or publishing establishments, photographic studios, medical or dental laboratories.


f. Cafeterias for employees and other normal accessory uses.


Business or professional offices or banks.


g. Restaurants or other places for serving food or alcoholic bev- erages.


h. Parking areas or garages for use of employees, customers, or visitors.


i. Motels


j. Theaters contained within a permanent structure.


k. Salesrooms for automobiles, bicycles, boats, farm implements and similar equipment.


1. Gasoline service stations, garages and repair shops, provided that:


1. Repairs shall be limited to minor repairs and adjustments unless conducted in a building.


2. There shall be no storage of motor vehicles, appliances and equipment on the premises other than those in process of repair or awaiting delivery.


m. Retail store or service establishment, the principal activity of which shall be the offering of goods or services at retail within the building.


3. The above uses require Board of Appeals approval, which shall be based on satisfaction that said use is appropriate and that it will not create a nuisance by virtue of noise, odor, smoke, vibration, or unsight- liness.


All structures for business use shall be at least 300 feet distant from existing residences located in a residential district, and shall be adequate- ly screened therefrom by trees or shrubs.


4. The following uses are specifically prohibited:


a. Single and multi-family dwelling.


b. Apartments.


c. Nursing Homes.


d. Mobile Trailer Parks.


e. Camp Sites


f. Automobile junk yards.


g. Restaurants and other places for serving food not confined within the structure.


h. Outdoor amusement uses, such as golf driving ranges, go-cart tracks, miniature golf courses, drive-in theaters, etc.

ARTICLE 47


VOTED UNANIMOUSLY that the Town amend Section III of Article XVII, Zoning By-Laws of the Town of Norwell be adding under "Business District C" and following paragraph C 1, a new paragraph C 2, as fol- lows:


C 2 Starting at a point in the southwesterly way line of the SOUTH- EAST EXPRESSWAY, and in the westerly boundary line of the Towns of NORWELL and ROCKLAND; thence running southeasterly by the south- westerly way line of the SOUTHEAST EXPRESSWAY, a distance of ap- proximately 3280 feet to the northwesterly corner of Lot 14; thence turning and running southerly by the westerly property line of Lot 14 to the southwesterly corner of Lot 14; thence turning and running easterly by the southerly property lines of Lots 14 and 13 to the northwesterly corner of Lot 12; thence turning and running southerly by the westerly property lines of Lots 12 and 11 to the southwesterly corner of Lot 11; thence running southerly, in a straight line, through Lots 10 and 9 to the northwesterly corner of Lot 8; thence running southerly by the wes- terly property line of Lot 8 to the southwesterly corner of Lot 8; thence turning and running easterly in the southerly property line of Lot 8 to a point in the westerly way line of HIGH STREET; thence turning and running southerly by the westerly way line of HIGH STREET to the northeasterly property corner of Lot 7; thence turning and running southerly by the westerly property line of Lot 7 to a point in the NOR- WELL-HANOVER town line; thence turning and running westerly by the NORWELL-HANOVER town line to a stone monument marking the NORWELL-HANOVER-ROCKLAND corner; thence turning and running northerly by the NORWELL-ROCKLAND town line to the point of be- ginning.

ARTICLE 52


VOTED UNANIMOUSLY that the Town appropriate the sum of $3,000.00 for use by the Board of Selectmen, for the acquisition, by purchase or by petition for a taking in fee by the County Commissioners, in accordance with G. L. c. 114, Sec. 11, Sec. 12, Sec. 13, and Sec. 14, of the following described land for the enlargement of the Town Cemetery located on Washington Street, which expansion is now necessary:

ARTICLE 53


VOTED that the Town raise and appropriate the sum of $5,500.00 for use by the Wetland Study Committee to employ experienced Consultants for the preliminary consideration of the advantages of (controlling) ac- quiring substantial wetland areas and for the determination of the most productive procedure to qualify for Federal and State Grants under the existing and expanding open space and Conservation Programs.


ARTICLE 54


VOTED that action on Article 54 be indefinitely postponed.


ARTICLE 55


VOTED that the Town appropriate and transfer the sum of $4,500.00 from the 1965 Prospect Street Mains Account balance, to be added to the Pumping Station and Equipment account, to be expended under the direction of the Board of Water Commissioners, for the construction of a pumping station, including original pumping station equipment, and for the laying and relaying of water mains, of not less than six inches but less than sixteen inches in diameter, between the pumping station and existing water mains.

VOTED that the Town appropriate the sum of $2,000.00 to be used by the Board of Water Commissioners for provisions for advance "Across the Street" dry water connections in the form of Orangeburg pipe only in Grove Street, River Street, South Street, Prospect Street, Summer Street, School Street, and Tiffany Road, prior to resurfacing, as are approved by the Board of Selectmen and the Planning Board, subject to an agreement by the Board of Water Commissioners to record the locations of the installed services on a street layout and to meet the appropriation, the sum of $723.37 be appropriated and transferred from the 1964 pumping station and mains account balance, and the sum of $1,276.63 be appro- priated and transferred from the 1965 Winter and Cross Street Mains Account balance.

ARTICLE 68


VOTED UNANIMOUSLY that the Town appropriate the sum of $30,000.00 for the laying and relaying of water mains, of not less than six inches but less than sixteen inches in diameter, under the direction of the Board of Water Commissioners, in Circuit Street from the end of the existing main for a distance of approximately 5,000 feet and to meet the appropriation the Town authorize the Treasurer, with the approval of the Board of Selectmen, to borrow $30,000.00 under General Laws Chapter 44, as amended.


ARTICLE 69


VOTED UNANIMOUSLY to transfer from Free Cash the sum of $40,000.00 to be added to the Stabilization Fund, as provided by General Laws, Chapter 40, Section 5B.


ARTICLE 70 Instruction to Town Officers


The Town instruct the Board of Selectmen to use all or any part of the engineering fund, voted and established under Article 26 in the warrant for this town meeting, to employ the services of municipal planners, architects or engineers, to review costs, specifications, preliminary plans, and to develop comparative data on the programs for major capi- tal expenditures prepared by the Planning Board, as contained in the 1966 Annual Report, and prepared by the Board of Selectmen, as pre- sented by Articles 6, 7, 8, 11, 12 and 13 in the warrant for this town meeting, and as outlined in part, in the report of Whitman & Howard, Inc., dated January, 1967, or as otherwise set forth, and to prepare a printed report to the Town, to be completed not later than September, 1967, with the report to be presented to the voters one month before a special town meeting to be called by the Selectmen.


FISH RIGHT #1 was auctioned off to Robert MacWilliams for $5.00. FISH RIGHT #2 was auctioned off to Robert Karoff for $5.00.


The business of the Warrant having been completed, the meeting was VOTED to be adjourned, until the Annual Town Election, March 18, 1967.
