To either of the Constables of the Town of Norwell, in said County of Plymouth and Commonwealth of Massachusetts.
GREETINGS :
In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of the Town of Norwell, qualified to vote in elections and Town affairs to meet at the Senior High School in said Norwell, on Monday, the twelfth day of March 1962 at 7:30 p.m., then and there to act upon the following articles, to wit :
Article 1. To see if the Town will accept the reports of its offi- cers and committees as printed in the Town Report, or act on any- thing relative thereto.
Article 2. To see what sums the Town will raise and appropriate or appropriate from available funds to pay Town debts, expenses and charges including debt and interest for the ensuing year and to fix the salary and compensation of all elective officers of the Town, effective from January 1, 1962, as provided by Section 108 of Chap- ter 41 of the General Laws, as amended, and to provide for a re- serve fund, and raise and appropriate the same for the following : Moderator, Selectmen's Department, Town Meetings and Elections, Town Accountant, Treasurer, Town Collector, Assessors' Depart- ment, Town Counsel, Town Clerk, Registrations and Listings, Board

Article 3. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1963, and to issue a note or notes therefor, payable within one year in accordance with General Laws, Chapter 44, Section 4, as amended, and to renew any note or notes as may be given for less than one year in accordance with General Laws, Chapter 44, Section 17, as amended, or act on anything relative thereto.
Article 4. To see if the Town will vote to appropriate the sum of $14,025.00 or any other sum from available funds in anticipa- tion of repayment by the Commonwealth of Massachusetts, for Chapter 81 work on the highways, or act on anything relative thereto.

Article 5. To see if the Town will vote to appropriate the sum of $8,000.00 or any other sum from available funds in anticipa- tion of repayment by the Commonwealth of Massachusetts and the

County of Plymouth, for Chapter 90 work on West Main Street, or act on anything relative thereto.

Article 6. To see if the Town will vote to appropriate the sum of $14,250.00 or any other sum in anticipation of repayment by the Commonwealth of Massachusetts and the County of Plymouth and the sum of $4,750.00 as the Town's share for Chapter 90 highway work on the Tiffany Road -East Street Bridge, or act on anything relative thereto.

Article 7. To see if the Town will vote to raise and appropriate or appropriate from available funds the sum of $945.00 for the pur- pose of hot topping the existing sidewalks at Norwell Center for a total distance of approximately one thousand three hundred and fifty feet, or act on anything relative thereto.

Article 8. To see if the Town will vote to raise and appropriate or appropriate from available funds the sum of $1,000.00 or any other sum to be added to the Town Highway Account for mix and place surface on Prouty Avenue for a distance of one thousand feet, or act on anything relative thereto.

Article 9. To see if the Town will vote to raise and appro- priate or appropriate from available funds the sum of $1,310.00 or any other sum to be added to the Town Highway Account for mix and place surface on Duncan Drive for a distance of one thou- sand three hundred and ten feet, or act on anything relative thereto.

Article 10. To see if the Town will vote to raise and appro- priate or appropriate from available funds the sum of $1,000.00 or any other sum to be added to the Town Highway Account for mix and place surface on River Street for a distance of one thou- sand feet, or act on anything relative thereto.

Article 11. To see if the Town will vote to raise and appro- priate or appropriate from available funds the sum of $900.00 for the purpose of grading and resurfacing with tar Green Street for a distance of 1,200 feet from Pleasant Street, or act on anything rela- tive thereto.

Article 12. To see if the Town will vote to raise and appro- priate or appropriate from available funds the sum of $500.00 for the purpose of removing ledge in the center of Wilder Road at its junction with Grove Street, or act on anything relative thereto.

Article 13. To see if the Town will vote to raise and appro- priate or appropriate from available funds the sum of $13,000.00 for the purchase of a four-wheel drive tractor loader, or act on any- thing relative thereto.

Article 14. To see if the Town will vote to raise and appropriate or appropriate from available funds the sum of $700.00 or any other sum for the purchase of a snow plow, or act on anything relative thereto.

Article 17. To see if the Town will vote to raise and appro- priate or appropriate from available funds the sum of $48,000.00 to install water mains of not less than six inches, but less than six- teen inches in diameter in Old Oaken Bucket Road from the end of the existing main at the junction of Norwell Avenue, Central Street and Old Oaken Bucket Road to the Scituate Town Line, or act on anything relative thereto.

To see if the Town will vote to raise and appro- priate or appropriate from available funds the sum of $3,000.00, said sum to be added to the Developing Well and Well Fields Ac- count and to be spent to conduct tests on potential well or water source sites, or act on anything relative thereto.

Article 20. To see if the Town will vote to raise and appro- priate or appropriate from available funds the sum of $5,960.00 for the purchase of a two ton truck, or better, for use by the Tree and Moth® Departments, or act on anything relative thereto.

Article 21. To see if the Town will vote to raise and appro- priate or appropriate from available funds the sum of $2,100.00 or any other sum to purchase a new Police Department Cruiser to replace the present 1961 cruiser, or act on anything relative thereto.

To see if the Town will vote to accept a portion of Brantwood Road as a Town way as laid out by the Selectmen in accordance with the description and plan presented at a hearing in the Cushing Memorial Town Hall and now on file in the Town Clerk's office, without appropriation, or act on anything relative thereto.

To see if the Town will vote to accept Beers Avenue as a Town way as laid out by the Selectmen in accordance with the description and plan presented at a hearing in the Cushing Mem- orial Town Hall and now on file in the Town Clerk's office, with- out appropriation, or act on anything relative thereto.

Article 25. To see if the Town will vote to accept a portion of Ridge Hill Road as a Town way as laid out by the Selectmen in accordance with the description and plan presented at a hearing in the Cushing Memorial Town Hall and now on file in the Town Clerk's office, without appropriation, or act on anything relative thereto.

Article 26. To see if the Town will vote to accept a portion of Millwood Circle as a Town way as laid out by the Selectmen in accordance with the description and plan presented at a hearing in the Cushing Memorial Town Hall and now on file in the Town Clerk's office, without appropriation, or act on anything relative thereto.

Article 27. To see if the Town will vote to accept an alteration of the layout of a portion of Winter Street as laid out by the Select- men in accordance with the description and plan presented at a hearing in the Cushing Memorial Town Hall and now on file in the Town Clerk's office, or act on anything relative thereto.

Article 28. To see if the Town will vote to accept an altera- tion of the layout of a portion of Prospect Street as laid out by the Selectmen in accordance with the description and plan presented

Article 29. To see if the Town will vote to extend the term of the present General School Building Committee one year from Sep- tember 21, 1962 to September 21, 1963 to provide that the next required elementary facility shall be developed and completed by the present Committee, or act on anything relative thereto.

Article 30. To see if the Town will vote to discharge the pre- sent General School Building Committee upon the completion of the present High School thus relieving this Committee from the responsibility of initiating new elementary construction development not to be completed under its direction, or act on anything relative thereto.

Article 31. To see if the Town will vote to purchase or take by eminent domain for a Town Garage site the two parcels of land owned by Nellie L. Sparrell consisting of 1 1/2 acres with a twenty two foot frontage on Central Street and a parcel of 9 1/2 acres lying between Main Street and Mill Lane, excluding that portion currently under option to Sun Oil Company, and contiguous to the aforesaid 1 1/2 acres, and to raise and appropriate or appropriate from available funds the sum of $5,850.00 for this purpose, or act on anything relative thereto.

Article 32. To see if the Town will vote to purchase or take by eminent domain a strip of land along the westerly border of land of Nellie L. Sparrell situated on the northerly side of Main Street in Norwell Center to provide access to the proposed Town Garage site and to raise and appropriate or appropriate from available funds the sum of $5,000.00 for this purpose, or act on anything relative thereto.

Article 33. To see if the Town will vote to accept for highway purposes for a consideration of $1.00 title to a parcel of land now owned by Nellie L. Sparrell and bounded as follows :
Southwesterly by Main Street twenty five ( 25 ) feet
Northwesterly by lands of Francis E. and Marjorie G. MacFarlane, three hundred ( 300 ) feet

Article 38. To see if the Town will vote to amend Article XIV of the revised By-Laws of the Town of Norwell as amended to read as printed in a pamphlet entitled "Building Code of Norwell - Com- monwealth of Massachusetts" and of which copies accompany this warrant and are available at the Town Hall, the James Library, the William J. Leonard Memorial Library, or act on anything relative thereto.

Article 39. To see if the Town will vote to amend Article VI, Section 1 of the revised By-Laws of the Town of Norwell by adding thereto the Office of Inspector of Buildings, or act on anything rela- tive thereto.

To see if the Town will vote to amend the revised By-Laws of the Town of Norwell as amended by removing from Article VI, Electrical Installations, Paragraphs A, B, C and D and redesignating said paragraphs as Article XIV, Section XII, Para- graphs, A, B, C and D, or act on anything relative thereto.

Article 41. Article 44. To see if the Town will vote to amend its Zoning By-Laws as follows :
1. By amending Section III so that the first two paragraphs will read as follows :
The Town is hereby divided into seven classes of districts :
Residential Districts A, B and C
Business Districts A, B and C
Saltmarsh Conservation District
Residential and Business Districts are shown on "Zoning Map, Town of Norwell, September, 1959 as Revised August 18, 1960," which is filed in the Town Clerk's office and is made a part hereof.
2. By adding to Section III the following paragraph :

Saltmarsh Conservation District - The Saltmarsh Conservation District shall be the area along the North River from the River it- self to the upland edge of the marsh as defined and shown on the 1915 Plan of the North River Authorized by Chapter 112, Resolves of 1914, William F. Williams, Chief Engineer, a copy of which is on file in the office of the Town Clerk and is made a part hereof.
3. By adding a new Section VIB as follows : Section VIB
A. In the Saltmarsh Conservation District no structure shall be erected except non-commercial docks, catwalks, piers, wharves or floats, nor may any area within said zone be filled, drained, dredg- ed or excavated.
PROVIDED, however ;
B. The owner of any land located in this District, or his agent, may apply to the Zoning Board of Appeals for a special permit for the construction of any structure which would have been permit- ted on said land prior to the adoption of this Section VIB, or for filling, drainage, dredging or excavation. No permit shall be grant- ed which will adversely affect the natural character of the area in which the land referred to in the application is located. No such permit shall be granted except after notice and hearing as is provid- ed by law for the granting of variances. In addition, notice shall be given by registered mail to the Chairman of the Conservation Commission or his designated representative. The Conservation Com- mission shall file a report setting forth the opinion of the Conser- vation Commission as to whether or not the granting of a permit will be consistent with the natural character of the area and the aims and purposes of the Conservation Commission. If the Conservation Commission shall fail to file its report on or before the date set for the hearing on the permit, the Zoning Board of Appeals shall assume that the Conservation Commission has no objection to the granting of the permit, and the Conservation Commission shall have no stand- ing to appear or be heard in any further proceedings relative to such permit.
