Motion made, seconded and VOTED to amend as follows: "That the Town vote to amend Article VIII, Legal Affairs of the Town By-laws by adding a Section 6 to read as follows:
"No unregistered motor vehicle which has become permanently inoperable and unfit for vehicular use because of being disabled, dismantled, or junked, shall be stored, parked or placed upon any land in the Town, unless the same shall be within a building or in an area properly approved for the keeping of same by licensed motor dealers or junk dealers. Penalty for breach thereof shall be in an amount not in excess of $20. for each offense, which may be recovered by indictment, or on a complaint before a district court.

"The Selectmen's judgment shall be conclusive in determining whether or not a motor vehicle is permanently inoperable and unfit for vehicular use."
ARTICLE 33
VOTED THAT the Town adopt the following By-Law:
"A committee to be known as the 'Capital Budget Committee' shall be established, composed of two (2) members of the Advisory Board appointed by and from it, one member from the Planning Board, appointed by and from it, and two (2) additional members to be appointed by the Board of Selectmen. One member from the Advisory Board and one at large shall be appointed for one year terms. The other appointees shall be appointed for two (2) years and in the manner of the original appointments. The committee shall annually prepare a Capital Budget Program for use by the Advisory Board, the voters, other town boards and officials in their delib- erations. The committee shall publish such a report, or a summary thereof, in a suitable manner in the Annual Town Report and file the origi- nal copy with the Town Clerk.
ARTICLE 34
VOTED yes 238, no 1, that the Town amend Section VIII, Subsection B SETBACKS, of the Zoning By-Laws by striking out Paragraph 1, and substituting therefor the following new paragraphs:
1a. From Public Ways in Residential District A.
No building shall be erected or placed within 75 feet of the center line, nor within 50 feet of the way line of any public way, except that no building need be set back more than the average setback of the dwellings on either side, a vacant lot to be considered as if occupied by a dwelling set back 75 feet from the center line and not less than 50 feet from any way line.
1b. From Public Ways in Residential Districts B and C. No building shall be erected or placed within 60 feet of the center line, nor within 35 feet of the way line of any public way, except that no building need be set back more than the average setback of the dwellings on either side, a vacant lot to be considered as if occupied by a dwelling set back 60 feet from the center line and not less than 35 feet from the way line.

ARTICLE 36
Motion made, seconded and DEFEATED UNANIMOUSLY to amend Section VI of the Zoning By-Laws by deleting paragraph "C" and sub- stituting the following:
C. Multi-family dwellings or apartment buildings shall be permitted in Business District "B" provided that said buildings shall not contain more than eight family units and the conversion of existing dwellings shall be permitted as provided in Section IV, paragraph "A".
In accordance with vote taken previously, Article 38 was taken up for consideration before Article 37 and after Article 36.
ARTICLE 38
Motion made, seconded and UNANIMOUSLY DEFEATED that the Zoning By-Laws of Norwell be amended by inserting therein a new Section VIIC entitled "Permits for the Removal of Gravel, Loam, Soil, Clay, Peat and Stone" with sub-sections 1, 2 and 3 thereunder in the exact form printed in the Transcript of Articles in Warrant for this meeting.

VOTED to INDEFINITELY POSTPONE action on Article 37.
ARTICLE 39
VOTED that the Town appropriate and transfer from Free Cash the sum of $5,000. said sum to be added to the Developing Well and Well Fields Account and to be spent to conduct tests for new water sites or wells.
Motion made, seconded and VOTED to consider Article 41 before Article 40.
ARTICLE 41
VOTED 273 yes, 10 no, that the Town appropriate the sum of $70,000.00 for the acquisition of land and the construction of a water storage tank (standpipe) of approximately 500,000 gallon capacity, and to meet said appropriation the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow the sum of $70,000.00 under authority of General Laws, Chapter 44, and to issue bonds or notes of the Town therefor payable in accordance with said Chapter 44, so that the whole loan shall be paid in not more than twenty years from the date of issue of the first bond or note.
VOTED that the Town postpone action on Articles 40, 42, 43, 44, 45, 46, 47, 48 and 49 until the next special town meeting, such meeting to be held April 12 and for the purpose of appropriating funds for the final plans and specifications for a new elementary school and for the consid- eration of water and bridge articles.

VOTED that the Town authorize the Town Accountant to close out the unexpended balances of the various appropriations listed under Article 50 which total $2,681.91.

VOTED that the Town appropriate and transfer from Free Cash the sum of $150.00 for the purpose of maintaining during the ensuing year Mosquito Control Works, as estimated and certified to by the State Reclamation Board, in accordance with the provisions of Chapter 112 Acts of 1931.

ELEMENTARY SCHOOL SITE COMMITTEE 1964 - 1965"
GENERAL REPORT
The initial meeting of the committee was called by Mrs. Reeser for May 1, 1964. The members of the committee are:

Mr. Richard Caldwell Norwell Council for Public Schools
Mr. Robert Detwiler Member at large
Mr. Theodore Love Planning Board
who resigned and was replaced by Mr. John Randall Planning Board
In accordance with the instructions under article 22 of the Town Warrant of 1964 the committee's duty was to select a site for the con- struction of an Elementary School. To do this the committee considered the following:
A) Areas not presently covered by Elementary Schools
B) School population in the above areas
C) Building permits issued in space from 1961-1964 in the above areas.
D) Present and proposed developments in the above areas
Having compiled these data the committee compared the areas of Old Oaken Bucket Road and Church Hill.
1) The Old Oaken Bucket Road area included: Mt. Hope St., Mt. Blue St., Summer St., First Parish Rd., Old Oaken Bucket Rd., Cross St., and Parker St., Winter St., Mill Lane, Central St., and Norwell Ave.
2) The Church Hill area included:
Barque Hill, Stetson Rd., Meadowbrook Rd., Tiffany Rd.,

The results of the comparison showed the Old Oaken Bucket Road area to be the logical site for the next Elementary School.
The committee personally surveyed the area using the Planning Board's plot plans and topographical maps as guides. The committee used the following criteria for selecting possible sites:
A) Minimum area of fourteen acres (state requirement)
B) Freedom from hazards
C) Safety and convenience of approach
D) Centrality to area to be served
E) Elevation and drainage
F) Probable minimum cost
G) Minimum site development costs
The sites investigated were:
A) Old Oaken Bucket Road
1) Lot 102
2) Lot 21 and 19 and 23
3) Lot 89 and 97 and 100
B) Cross Street
1) Lot 80
2) Lot 79 3) Lot 10
C) Central Street
1) Lot of 44 acre plot (no number)
The committee, for its own education, investigated areas in the Church Hill location on Stetson Shrine Road and on Pine Street.
The committee decided that lots 100 and 97 on Old Oaken Bucket Road were the most desirable with the above criteria in mind. Obtaining per- mission from Mr. Leonard Cox to have his land tested, the committee contacted the State Board of Health. The tests were made on 14 Dec., 1964 and the perculation rate was found to be 1" in 5 minutes. The State Board of Health listed this site as "marginal." This term "marginal" being used in all cases where a community lacks a central sewage system.
The committee then planned to test two other sites in February, and also to personally contact the State Board of Health to discuss the drainage of the Cox property.
The committee tested the Haskell and the Weller properties on Cross Street in February.
A member of the committee, Mr. John Randall, met with Mr. Anderson of the State Board of Health to discuss the drainage of these three prop-

erties. Mr. Randall presented a map with the probable location of the school and leaching bed on the Cox property. Mr. Anderson told Mr. Randall that the State Board of Health must test the Old Oaken Bucket site again in April for water table level before the department would give its approval.
The final meeting of the committee was held just prior to the Town Meeting with Mr. Rimmer and Mr. Housely in attendance. It was agreed that the Cox property with a perculation rate of 1" in 5 minutes was good relative to the State's minimum requirement of 1" in 20 minutes. Mr. Rimmer suggested that the Weller and Cox properties be tested for water table along with the High School and Osborn Grade School. Relative to the Cox property, the committee felt that it would be better to take all the 29 acres in that Old Oaken Bucket location rather than leave a few land- locked swamp acreage. The committee also felt that it would be unlikely that the State Board of Health would turn down its site on Old Oaken Bucket Road in April due to the fact that the state (Mr. Anderson) suggested that this site would lend itself to a raised leaching bed installation.
Therefore, we the Site Committee will present to the town a report recommending that the site for the next Elementary School will be on Old Oaken Bucket Road per plan submitted by the Planning Board.

ARTICLE 53
VOTED 297 yes, 1 no, that the Town appropriate and transfer from Free Cash the sum of $20,000.00 to purchase or take by eminent domain, for use as an elementary school site, approximately 29 acres of land located southerly of Old Oaken Bucket Road, near the junction of Old Oaken Bucket Road, Mt. Blue Street, and Summer Street, being Parcel No. 98, and a portion of Parcel No. 100, as shown on Sheet 9, and a portion of Parcel No. 11, as shown on Sheet 15 of "Atlas of the Town of Norwell."
ARTICLE 54
VOTED that the Town appropriate and transfer from Free Cash the sum of $10,000.00 to be expended under the direction of the Permanent Building and Maintenance Committee for the purpose of acquiring topo- graphical surveys of town-accepted elementary school sites and pre- liminary elementary school plans.
ARTICLE 55
VOTED that the Town appropriate and transfer from Free Cash the sum of $10,000.00 to be expended under the direction of the Permanent Building and Maintenance Committee for the purpose of reconstruction and expansion of the sanitary leaching bed at the Center Elementary School.

ARTICLE 56
VOTED that the Town instruct the Board of Selectmen to appoint a committee of five (5) members, to be known as the Elementary School Site Committee, one from the School Committee, one from the Permanent Building and Maintenance Committee, one from the Norwell Council for Public Schools, one from the Planning Board, and one member at large, with the Chairman to be named by the Board of Selectmen, to select a site for construction of an elementary school building and to present their recommendations for action at the next Annual Town Meeting.
ARTICLE 57
VOTED that the Town appropriate and transfer from Free Cash the sum of $500.00 for use by the Elementary School Site Committee for the purpose of obtaining preliminary surveys, plans, appraisals, borings, etc., as may be needed to determine the stability of the site proposed for school building purposes.

Motion made and seconded to approve the purchase by the Conversation Commission, of the land of George Farrar at King's Landing, consisting of 14 acres, more or less, for conservation and recreation purposes, for $10,000. with half the price being assumed by the State. Motion made, seconded and VOTED that the Town approve an application of the Conser- vation Commission for partial reimbursement under General Laws Chapter 132A Section 11, and the expenditure from the Conservation Fund of $10,000. for the purchase by said Commission of fourteen (14) acres of land, more or less, of George Farrar at King's Landing as shown on "Plan of Land at King's Landing, Norwell, dated January 4, 1965 (revised) by Loring H. Jacobs, Registered Land Surveyor," except for a portion to the west of the existing roadway to the Lincoln Boat Yard. The motion, as amended, was VOTED.
ARTICLE 60
VOTED that the Town appropriate and transfer from Free Cash the sum of $60,000. to be added to the Stabilization Fund, as provided by the General Laws, Chapter 40, Section 5B.
ARTICLE 61
VOTED to appropriate the 1964 Dog Tax Refund to the School Depart- ment General Education Expenses, in the amount of $1,325.41.

It was voted unanimously that the Town appropriate the sum of $40,000.00 to be expended under the direction of the Permanent Building and Maintenance Committee for the purpose of constructing a town garage on town-owned land from plans developed and supervised by a registered architect, and that to meet such appropriation the sum of $5,000.00 be transferred from Free Cash and that the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow the sum of $35,000.00 under authority of General Laws, Chapter 44, and to issue bonds or notes of the town therefor payable in accordance with said Chapter 44 so that the whole loan shall be paid in not more than 20 years from the date of issue of the first bond or note.
ARTICLE 41. Voted - 273 yes, 10 no, to appropriate the sum of $70,000.00 for the acquisition of land and the construction of a water storage tank (stand-pipe) of approximately 500,000 gallon capacity, and to meet said appropriation the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow the sum of $70,000.00 under authority of General Laws, Chapter 44, and to issue bonds or notes of the Town, therefor payable in accordance with Chapter 44, so that the whole loan shall be paid up in not more than twenty years from the date of issue of the first bond.

ANNUAL TOWN ELECTION
Pursuant to the foregoing Warrant, the qualified voters met at the Senior High School on Saturday, March 13, 1965, and cast their votes.
Before the opening of the polls, the ballot boxes were checked, found empty and the registers set at 0000. At 11:30 A.M. the following Election Officers were sworn in by the Town Clerk: Wilder A. Gaudette, Warden; Mary McBrine, Clerk; John Piotti, Ballot Box Officer; Mary Jane Clark, Arline DiStasio, Eleanor F. Mitchell, Eleanor G. Benner, John A. Reagan, Sr., Rosemary A. Keaveney, Margaret E. C. Reeser, and Betty L. Long.
The polls were closed at 8 P.M. by the Warden. The 10 absentee ballots were then cast. The ballot box read 1630, but upon checking it was found that one ballot had not registered on the ballot box register. The correct total therefore, was 1631 votes cast.
The Town Clerk swore in the following tellers: Ralph H. Coleman, Agnes Albert, Claire Foulsham, Yolanda Ryan, Catherine Edmonds, John D. Lindsay, Helen M. Marsden, Carol Harding, Emma Oronte, Barbara Farren, Patricia J. Pollock, Barbara J. Benzaquin, Ruth C. Sinowski, Charles W. Bayley, Jr., Ann J. Valair, Dale Barnecott, Alice Feneck, Barbara B. Meacham, Ruth C. Hersey, Marie Nagle, Jean Lantz and Mae Brown.
