Motion made and seconded to raise and appropriate or appropriate from available funds the sum of $27,000. to install water mains of not less than six inches in diameter but less than six- teen inches in diameter in Old Oaken Bucket Road from the end of the existing main at the junction of Norwell Avenue, Central Street and Old Oaken Bucket Road to Cross Street. After much discussion, it was moved, seconded and voted to table Article 17.

Motion made and seconded to appropriate the sum of $27,000 to install water mains of not less than six inches but less than sixteen inches in diameter in Norwell Avenue from the end of the existing main at the junction of Norwell Avenue, Old Oaken Bucket Road and Central Street to the junction of Norwell Avenue, Lincoln and Grove Streets and to meet such appropriation by appropriating the sum of $23,345. 72 from available funds ( E. & D). ) and $1,201.46 from the 1958 River Street Water Mains Fund and $2,452.82 from the 1959 River Street Water Main Fund. After much discussion, it was voted to do this.

March 14, 1962


The meeting was called to order at 7: 40 P. M. with 227 registered voters present. Voted to admit Mr. and Mrs. Kelly, resident property owners of Prospect Street, who wish to speak on Article 28. Privilege granted.


Arthur Raymond, John Clark and Harold Dutton appointed tel- lers and sworn in.


Article 20. Motion made, seconded and voted to appropriate from available funds, (E. & D. ) the sum of $5,960. for the purchase of a two ton truck, or better, for use by the Tree and Moth Departments.


Article 21. Motion made, seconded and voted to appropriate from available funds (E. & D. ) the sum of $2,100. to purchase a new Police Department cruiser to replace the present 1961 cruiser.


Article 22. Motion made and seconded to accept Section 22D of Chapter 40 of the General Laws relating to the towing of improperly parked vehicles from municipal public ways. Motion made and seconded to lay this article on the table was defeated. Motion to re- consider was made and lost. Main motion was then voted, that is : to accept Section 22D of Chapter 40 of the General Laws, relating to the towing of improperly parked vehicles from municipal public ways.


Article 23. Motion made, seconded and voted to accept a portion of Brentwood Road as a Town way as laid out by the Selectmen in accordance with the description and plan presented at a hearing in the Cushing Memorial Town Hall and now on file in the Town Clerk's office, without appropriation.


Article 24. Motion made, seconded and voted to accept Beers Avenue as a Town way as laid out by the Selectmen in accordance with the description and plan presented at a hearing in the Cushing Memorial Town Hall and now on file in the Town Clerk's office, with- out appropriation.


Article 25. Motion made, seconded and voted to accept a portion of Ridge Hill Road as a Town way as laid out by the Selectmen in accordance with the description and plan presented at a hearing in. the Cushing Memorial Town Hall and now on file in the Town Clerk's office, without appropriation.

Article 26. Motion made, seconded and voted to accept a portion of Millwood Circle as a Town way as laid out by the Selectmen in accordance with the description and plan presented at a hearing in the Cushing Memorial Town Hall and now on file in the Town Clerk's office, without appropriation.


Article 27. Motion made, seconded, but failed to carry, to accept an alteration of the layout of a portion of Winter Street as laid out by the Selectmen in accordance with the description and plan presented at a hearing in the Cushing Memorial Town Hall and now on file in the Town Clerk's office.


Article 28. Motion made, seconded, but failed to carry to accept an alteration of the layout of a portion of Prospect Street as laid out by the Selectmen in accordance with the description and plan pre- sented at a hearing in the Cushing Memorial Town Hall and now on file in the Town Clerk's office.


Article 29. A motion made and seconded to extend the term of the General School Building Committee for one year. Thereafter the report of the General School Building Committee was read. After some discussion, it was moved to amend the main motion by voting to dis- charge the General School Building Committee and to establish a Permanent Building and Maintenance Committee, whose function shall be the planning, construction and recommendation of maintenance policy of all Town buildings, said Committee to consist of the present eleven members of the General School Building Committee, vacancies to be filled by appointments by the Selectmen.


The amendment was voted, and then the amended motion was unanimously voted.


Articles 30 through 37, Inclusive. Successive and independent motions were made, seconded and voted to indefinitely postpone action on each of these Articles.


Article 38. Motion made, seconded and voted to amend Article XIV of the revised By-Laws of the Town of Norwell as amended, to read as printed in a pamphlet entitled "Building Code of Norwell - Commonwealth of Massachusetts" and of which copies accompanied the Warrant. Motion to recommit for further study was defeated.


Article 39. Motion made, seconded and voted to amend Article VI, Section 1, of the revised By-Laws of the Town of Norwell by adding thereto the office of " Inspector of Buildings."

Article 40. Motion made, seconded and voted to amend the re- vised By-Laws of the Town of Norwell by removing from Article VI, Electrical Installations, Paragraphs A, B, C and D and redesignating said paragraphs as Article XIV, Section XII, Paragraphs A, B, C and D.


Article 41. Motion made, seconded and voted to further amend Article VI of the revised By-Laws pertaining to Electrical Installations, Paragraph D by removing therefrom the words "may be removed by the Selectmen for due cause" and substitute therefor the words "may at pleasure be removed by the Board of Selectmen."


Article 42. Motion made, seconded and voted to amend Article XV of the revised By-Laws of the Town of Norwell by revoking and striking out in their entirety the present Title and Section 1 to 3 inclusive.


Article 43. Voted to amend Article 43 by adding "providing these remunerations and expenses do not exceed the fees charged." A mo- tion was made, seconded and voted to appropriate from available funds the sum of $1,500. for remuneration and expenses of the Build- ing Inspector providing the remunerations and expenses do not exceed the fees charged.


Article 44. Motion made, seconded and voted, 144 yes, 33 no, to amend its Zoning By-Laws as follows :


1. By amending Section III so that the first two paragraphs will read as follows :


The Town is hereby divided into seven classes of districts : Residential Districts A, B and C Business Districts A, B and C Saltmarsh Conservation District


Residential and Business Districts are shown on "Zoning Map, Town of Norwell, September, 1959 as Revised August 18, 1960," which is filed in the Town Clerk's office and is made a part hereof.


2. By adding to Section III the following paragraph :


Saltmarsh Conservation District - The Saltmarsh Conservation District shall be the area along the North River from the River itself to the upland edge of the marsh as defined and shown on the 1915 Plan of the North River Authorized by Chapter 112, Resolves of 1914, William F. Williams, Chief Engineer, a copy of which is on file in the office of the Town Clerk and is made a part hereof.

3. By adding a new Section VIB as follows :


Section VIB


A. In the Saltmarsh Conservation District no structure shall be erected except non-commercial docks, catwalks, piers, wharves or floats, nor may any area within said zone be filled, drained, dredged or excavated.


PROVIDED, however;


B. The owner of any land located in this District, or his agent, may apply to the Zoning Board of Appeals for a special permit for the construction of any structure which would have been permitted on said land prior to the adoption of this Section VIB, or for filling, drainage, dredging or excavation. No permit shall be granted which will adversely affect the natural character of the area in which the land referred to in the application is located. No such permit shall be granted except after notice and hearing as is provided by law for the granting of variances. In addition, notice shall be given by registered mail to the Chairman of the Conservation Commission or his desig- nated representative. The Conservation Commission shall file a report setting forth the opinion of the Conservation Commission as to wheth- er or not the granting of a permit will be consistent with the natural character of the area and the aims and purposes of the Conservation Commission. If the Conservation Commission shall fail to file its re- port on or before the date set for the hearing on the permit, the Zon- ing Board of Appeals shall assume that the Conservation Commission has no objection to the granting of the permit, and the Conservation Commission shall have no standing to appear or be heard in any further proceedings relative to such permit.

ADJOURNED ANNUAL TOWN MEETING March 15, 1962


The adjourned Annual Town Meeting was called to order by the Moderator, with 332 voters present.


Article 45. Motion made, seconded and voted to appropriate from available funds ( Excess & Deficiency ) the sum of $6,550. to add to the Conservation Fund under the provisions of General Laws, Chapter 40, Section 50, Clause 51 and Section 8C, as amended.


Article 46. Motion made and seconded that Zoning By-Laws be amended by adding a new business district, as printed in Article 46, Transcript of the Warrant. Amendment by Arthur Du Long suggesting specific and detailed measurements and distances with respect to loca- tions of prospective buildings. On a point of order the Moderator ruled the amendment was out of order because no notice was pro- vided to voters not at the meeting. After considerable discussion, the amendment to the Zoning By-Law was defeated on a rising vote, 127 to 145.


Article 47. Motion made, seconded and voted to indefinitely post- pone action on Article 47.


Article 48. Motion made, seconded and voted to indefinitely post- pone action on Article 48.


Article 49. Motion made and seconded to amend Article 49 by adding after " shall be entitled to two weeks vacation with pay" the words "and each employee who has worked for the Town an average of twenty or more hours a week for five consecutive years shall be entitled to three weeks vacation with pay." This motion was defeated by voice vote. Motion made, seconded and voted to change the By- Laws by striking out Section 1 of Article XVII and substituting in its place the following :


"Each employee, other than those employed by the School Com- mittee and the Board of Public Welfare, who has worked for the Town an average of twenty or more hours a week for six months prior to June 1 of any calendar year shall be entitled to one week's paid va- cation, and each employee who has worked for the Town an average of twenty or more hours a week for twelve months or longer prior to June 1 of any calendar year shall be entitled to two week's vacation with pay. The amount of vacation pay shall be equal to the average weekly earnings from the Town of the employee during the preceed-

ing six or twelve month period whichever is effective in determining the vacation period. Such vacation to be taken during the period June 1 to December 31 of the respective year and in no instance shall va- cation time be accumulative. "


Article 50. Motion made, seconded and voted to appropriate from available funds ( Excess & Deficiency ) the sum of $385.67 for unpaid expense account bills incurred in 1961 as follows :

Article 52. Motion made, seconded and voted that the Town res- cind its action to the extent of $100,000. for the loan authorized, but unissued, under Article 26, March 7, 1960, Senior High School.


Article 53. Motion made and seconded to appropriate trom avail- able funds the sum of $86,000. to be added to the Stabilization Fund, as provided by the General Laws, Chapter 40, Section 5B. Mr. Repass spoke against the article and indicated that he would make an ap- propriate amendment after disposition of Article 59 at the time when Items 111-117 would be presented to the meeting for consideration. It was voted to take up Article 53 after consideration of Item 111 - 117 and after Article 59.

Article 54. Motion made, seconded but defeated by a vote 125 yes, 130 no, to instruct the Selectmen to install and maintain under- ground gasoline storage tanks on Town property and to maintain a supply of gasoline for all Town-owned vehicles and to instruct all elected and appointed Town officials and department heads that gaso- line for Town-owned vehicles, must come from these tanks and to in- struct the Town Accountant and Town Treasurer, that no bills for gas- oline for Town-owned vehicles, except gasoline for these tanks shall be paid, except in extreme emergencies; the operation of this Town-owned gasoline supply to take effect when all departments are notified thereof by the Board of Selectmen that the system is in operation, but in no event later than July 1, 1962, and to appropriate from available funds the sum of $4,700. for said purpose.


Article 55. Motion made, seconded and voted to indefinitely post- pone action on Article 55.


Article 56. Motion was made and seconded, but failed to carry, to raise $8,000. to be added to $1,000. gift of Norwell Women's Club for tennis courts, to the School Committee. Motion made, seconded and voted to thank the Norwell Women's Club for its gift of $1,000.


Article 57. Motion made and seconded that the Town vote to continue the Town Government Study Committee for additional study and to analyze the effect and value of its recommendations, acceptable to Town officials and boards, which were presented in the Commit- tee's report to the Town in this the 1962 Annual Meeting. Said com- mittee to present its recommendations at a special town meeting on or before October 1, 1962 and to report its written recommendations to the towns people at least seven ( 7) days before said town meeting, and that the Advisory Board be authorized to make appointments to provide for replacement or resignations.


Amendment was made that the Committee be given power to make its own appointments. Failed. Amendment made, seconded and voted that the Moderator be given the power to make appointments. Vote passed 147 yes, 86 no. Amendment "subject to approval of the Com- mittee" failed. FINAL VOTE: Motion made, seconded and voted that the Town continue the Town Government Study Committee for additional study and to analyze the effect and value of recommenda- tions, acceptable to Town officials and boards, which were presented in the Committee's report to the Town in this the 1962 Annual Meet- ing, said committee to present its recommendations at a special town meeting on or before October 1, 1962 and to report its written recom- mendations to the townspeople at least seven ( 7) days before said town meeting, and that the Moderator be authorized to make appoint- ments to provide for replacement or resignations."

Motion made, seconded, but failed to carry, to ap- prove analysis of the public records of the 1960 and 1961 property tax assessments and commitments under the direction of the Town Government Study Committee for the purpose of determining the value and effect of recent total reappraisal procedures with consultant partici- pation and to appropriate the sum of three hundred and fifty dollars ( $350.00 ) for the public distribution of such analysis.

Article 60. Motion made, seconded and voted to appropriate the 1961 Dog Tax Refund to the School Department Operation Account, in the amount of $1,259.94.


Motion made, seconded and voted that it be spread on the record that the Town extends thanks to Mr. Paul Rasmussen, Mr. Paul Jevne and Mrs. Margaret E. C. Reeser, for their years of service to the Town on the Advisory Board.


Mrs. Gunvor Armstrong made a motion which was seconded and voted by a rising vote that the "1962 Town Meeting go on record to say 'thank you' to an elected School Committee official - Mrs. Nellie L. Sparrell- who has served this town for nearly half a century. ( 45 years )"


Article 61. Motion made, seconded and voted that the Selectmen be instructed, when preparing the Warrant for the annual town meet- ing for 1963, to serve notice that in case all the articles in the War- rant are not acted upon at the annual meeting called for the second

Monday of March, March 11, 1963, that the adjourned session shall be held on Tuesday, March 12, and if more time is needed, on Thurs- day, March 14 and Friday, March 15.


Motion made, seconded and voted to instruct the Selectmen to in- vestigate Article 26 of the 1962 Scituate Town Warrant, which affects Norwell town ways, namely Winter Street, Cross Street, a portion of Main Street, and to take such action as to protect the rights, safety and privileges of Norwell citizens.


Motion made, seconded and voted to instruct the Selectmen to meet jointly with the Assessors and the Advisory Board before the Annual Town Meeting; and when the necessary figures are available, to dis- cuss the appropriate figures which can be used for Free Cash and which can be given to the Advisory Board to use in their re- capitulation.


Motion made, seconded and voted to instruct all town officials, elected or appointed, boards, committees and commissions reporting to a town meeting regarding subject matter requiring action by the voters at said meeting, that they shall provide two complete and final writ- ten copies of such reports at least 21 week days before any town meet- ing to the Board of Selectmen, who are hereby instructed to distribute copies of the report to each resident of the town at least seven days before town meeting.


Motion made, seconded and voted to instruct the Town Govern- ment Study Committee to print its report, which was delivered orally to the Annual Town Meeting and distribute same to all residents of the Town.


Motion made, seconded and voted to instruct the By-Law Com- mittee to consider incorporating in our by-laws rules of ethical limita- tions, generally known as "conflict of interests, " and if legally possible to include the following : "No officials, board or committee members are to accept any compensation of any nature for any services in any transaction, negotiation, agreement or contract directly or indirectly involving town responsibilities or expenditures excepting compensa- tion paid by the Town for generally accepted official services."


Fish Rights were sold to Mrs. James D. Brokaw and Richard F. Pelton for $3.00 each.


Thanks were extended to the School Committee for the use of the fine new auditorium of the High School.


The business of the Warrant having been completed, motion was made, seconded and voted to adjourn the Annual Town Meeting of the Town of Norwell, for 1962.

ANNUAL TOWN ELECTION


March 17, 1962


Pursuant to the Warrant, the voters met at the Elementary School on Main Street, Saturday, March 17th, 1962 for the Annual Town Election.


The Town Clerk delivered 2432 ballots, 2 ballot boxes, 3 sets of voting lists, tally sheets, master sheet and counting board to Ralph H. Coleman, Warden, who was in charge of the meeting.


The polls were opened at 12 noon and closed at 8 P. M.


Joseph M. Silvia, Moderator, opened the meeting and swore in the following Election officers : Ralph H. Coleman, Warden, John Lindsay, Deputy Warden; Roger Dangora, Clerk; Agnes Albert, De- puty Clerk; Irene MacDonald, Rosalind Whittemore, Inspectors; Carol Marsh, John Regan, Sr., Ruth Murray, Deputy Inspectors; Eleanor Benner, Julia Rosebach, Arline DiStasio, Alice Feneck, Donald Wiese, Catherine Leslie, Ann J. Valair, Phyllis Lindsay, Joan F. Fadden, Katherine Crandall and Barbara Farren, Tellers.


After all who had voted who wished, the 11 absentee ballots re- ceived were checked on the voting lists and the ballots deposited in the ballot box.


At the close of the meeting, the register on the ballot box was re- conciled with the two voting lists.
