To either of the Constables of the Town of Norwell, in said County of Plymouth and Commonwealth of Massachusetts.


GREETINGS:


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of the Town of Norwell, quali- fied to vote in elections and Town affairs to meet at the Senior High School in said Norwell, on Monday, the eighth day of March, 1965, at 7:30 p.m. then and there to act upon the following articles, to wit:


ARTICLE 1


To see if the Town will accept the reports of its officers and committees as printed in the Town Report, or act on anything relative thereto.


ARTICLE 2


To see what sums the Town will raise and appropriate, or appropriate from available funds to pay Town debts, expenses and charges including debt and interest for the ensuing year and to fix the salary and compensa- tion of all elective officers of the Town, effective from January 1, 1965, as provided by Section 108 of Chapter 41 of the General Laws, as amended, and to provide for a reserve fund, and raise and appropriate, or appropriate from available funds for the following: Moderator, Selectmen's Department, Town Office Manager and Accountant, Town Hall Clerks, Town Meetings and Elections, Treasurer, Tax Title Account, Town Collector, Assessor's Department, Town Counsel, Town Clerk, Registrations and Listings, Board of Appeals, Planning Board, Development and Industrial Commission, Permanent Building and Maintenance Committee, Conservation Commis- sion, Council on Aging, Town Hall and Annex, Police Department, Dog Officer, Fire Department, Civil Defense, Emergency Communications Center, Sealer of Weights and Measures, Tree Warden and Moth Superin- tendent, Moth Department, Dutch Elm Disease, Operation and Maintenance of Equipment, Pest Control, Tree Maintenance, Removal and Replacement, Roadside Brush Control, Maintenance of Public Grounds, Building Inspector, Gas Inspector, Wire Inspector, Board of Health, Inspector of Animals,

To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1966, and to issue a note or notes therefor, payable within one year in accord- ance with General Laws, Chapter 44, Section 4, as amended, and to renew any note or notes as may be given for less than one year in accordance with General Laws, Chapter 44, Section 17, as amended, or act on anything relative thereto.


ARTICLE 4


To see if the Town will vote to raise and appropriate, or appropriate from available funds, the sum of $14,300.00, or any other sum, in anticipa- tion of repayment by the Commonwealth of Massachusetts, for Chapter 81 work on the highways, or act on anything relative thereto.

ARTICLE 5


To see if the Town will vote to raise and appropriate, or appropriate from available funds, the sum of $19,500.00, or any other sum, in anticipa- tion of repayment by the Commonwealth of Massachusetts and the County of Plymouth, for Chapter 90 work on the highways, or act on anything relative thereto.

To see if the Town will vote to raise and appropriate, or appropriate from available funds, the sum of $4,750.00, or any other sum, in anticipa- tion of repayment by the County of Plymouth, for Chapter 90 work on the highways, or act on anything relative thereto.

ARTICLE 24


To see if the Town will vote to accept an alteration of a part of the present layout of Bowker Street, as laid out by the Selectmen, in accord- ance with the description and plan presented at a hearing in the Cushing Memorial Town Hall and now on file in the Town Clerk's Office, and to raise and appropriate, or appropriate from available funds, the sum of $1,000.00, or any other sum for the purpose of paying land damages in connection with the alteration, or act on anything relative thereto.

ARTICLE 25


To see if the Town will vote to raise and appropriate, or appropriate from available funds, the sum of $5,000.00, or any other sum, to be used by the Permanent Drainage Committee for the replacement of culverts, field engineering and other drainage work throughout the town, or act on anything relative thereto.


Requested by the Permanent Drainage Committee.


ARTICLE 26


To see if the Town will vote to appropriate the sum of $40,000.00, or any other sum or sums, to be expended under the direction of the Per- manent Building and Maintenance Committee for the purpose of construct- ing a Town Garage from plans developed and supervised by a registered architect, and to meet such appropriation by appropriating the sum of $5,000.00, or any other sum or sums from available funds, and by author- izing the Treasurer, with the approval of the Selectmen, to borrow for and on behalf of the Town of Norwell, the sum of $35,000.00, or any other sum or sums for said purpose, by the issuance of bonds or notes under the provisions of Chapter 44 of the General Laws and Acts in amendment thereof or in addition thereto, or both, or act on anything relative thereto.

ARTICLE 27


To see if the Town will vote to adopt the following resolution:


WHEREAS the General Court sitting as a Constitutional Convention, did on July 16, 1963, give initial approval to a Home Rule amendment to the state Constitution, and


WHEREAS this bill of rights for local governments requires a second approval by the members of the General Court during this legislative session, and


WHEREAS we, as members of this Town Meeting, feel competent to handle the affairs of our town without strict supervision by the Commonwealth of our every act and deed.


NOW THEREFORE BE IT RESOLVED that this town meeting hereby instructs its representatives to the General Court to vote in favor of the Home Rule proposal (H1384 of 1963 as revised) when it comes before them.

from available funds, the sum of $2,500.00, or any sum, for the purchase of a 1965 Station Wagon Police Cruiser to replace the present 1963 Station Wagon Police Cruiser, or act on anything relative thereto.

ARTICLE 29


To see if the Town will vote to raise and appropriate, or appropriate from available funds, the sum of $15,000.00, or any other sum, to purchase and equip a new combination Fire Truck for the Ridge Hill Fire Station, or act on anything relative thereto.


Requested by the Board of Fire Engineers.


ARTICLE 30


To see if the Town will vote to raise and appropriate, or appropriate from available funds, the sum of $6,800.00, or any other sum, to install a two-way radio base station in the Emergency Communications Center and to install two-way radio mobile units in such town-owned vehicles as may be designated by the Emergency Communications Center Board, such radios to operate on a frequency as assigned and approved by the Federal Communications Commission for the use of the Town of Norwell only, and which shall be distinct from the Fire and Police frequencies already in use and which shall be under the control of the Emergency Communications Center Board, or act on anything relative thereto.

ARTICLE 31


To see if the Town will vote to raise and appropriate, or appropriate from available funds, the sum of $700.00, or any other sum, to purchase approximately one and one-half acres of land on the southerly side of Mount Hope Street adjacent to the Scituate town line for the establishment of a town dump, or act on anything relative thereto.


Requested by the Board of Selectmen and the Board of Health.


ARTICLE 32


To see if the Town will vote to amend Article VIII, Legal Affairs of the Town By-laws, by adding Section 6 to read as follows:


Section 6. Improper storage of unregistered, disabled or junked motor vehicles unfit for use.


No such vehicle permanently disabled, dismantled or in any way inoperative shall be stored, parked or placed upon any land in the Town, unless the same shall be within a building or in an area properly approved for the keeping of the same by licensed motor dealers or junk dealers.

The Selectmen's judgment shall be final as to determining whether or not a motor vehicle is permanently inoperable. Penalty for breach thereof shall be in an amount not in excess of $20.00 for each offense, which may be recovered by indictment, or on a complaint before a district court.

ARTICLE 33


To see if the Town will vote to adopt the following By-law:


A committee to be known as the "Capital Budget Committee" shall be established, composed of two (2) members of the Advisory Board appointed by and from it, one member from the Planning Board, appointed by and from it, and two (2) additional members to be appointed by the Board of Selectmen. One member from the Advisory Board and one at large shall be appointed for one year terms. The other appointees shall be appointed for two (2) years and in the manner of the original appointments. The committee shall annually prepare a Capital Budget Program for use by the Advisory Board, the voters, other town boards and officials in their deliberations. The committee shall publish such report, or a summary thereof, in a suitable manner in the Annual Town Report and file the original copy with the Town Clerk; or act on anything relative thereto.

ARTICLE 34


To see if the Town will vote to amend Section VII, Subsection B- SETBACKS, of the Zoning By-laws by striking out Paragraph 1, and sub- stituting therefor the following new paragraphs:


1a. From Public Ways in Residential District A.


No building shall be erected or placed within 75 feet of the center line, nor within 50 feet of the way line of any public way, except that no building need be set back more than the average setback of the dwellings on either side, a vacant lot to be considered as if occupied by a dwelling set back 75 feet from the center line and not less than 50 feet from the way line.


1b. From Public Ways in Residential Districts B and C. No building shall be erected or placed within 60 feet of the center line, nor within 35 feet of the way line of any public way, except that no building need be set back more than the average setback of the dwellings on either side, a vacant lot to be considered as if occupied by a dwelling set back 60 feet from the center line and not less than 35 feet from the way line. Or act on anything relative thereto.

ARTICLE 35


To see if the Town will vote to amend Section V of the Zoning By-Laws by deleting paragraph "C" and substituting the following:


C. Multi-family dwellings or apartment buildings shall be permitted in Business District "A" provided that said buildings shall not contain more than eight family units; and the conversion of existing dwellings


shall be permitted as provided in Section IV, paragraph A; or act on anything relative thereto.

ARTICLE 36


To see if the Town will vote to amend Section VI of the Zoning By-Laws by deleting paragraph "C" and substituting the following:

ARTICLE 37


To see if the Town will vote to amend the By-Laws by deleting there- from Article XVI relative to regulation of soil removal, or take any other action relative thereto.

ARTICLE 38


To see if the Town will vote to amend the Zoning By-Laws by inserting therein the following:


SECTION VII C


Permits for the removal of gravel, loam, soil, clay, peat and stone.


1. Permits issued by the Board of Appeals.


Except as outlined in paragraph 2 below, no gravel, loam, sand, clay, soil, peat or stone shall be removed from land in any zone of the Town without written permit from the Zoning Board of Appeals after public hearing and under such conditions as the Board of Appeals may deem suitable in the reasonable regulation of such removal and for the purpose of avoiding detriment to the area involved. No permit may be granted under this section unless the applicant has submitted to the Board, at least seven (7) days prior to the date of hearing, a topographical plan of the premises in question showing specifically the boundaries and dimensions of the area from which the proposed

removal of material is to take place. The plan shall show present and proposed grades and elevations with topography in five (5) foot contours and grades in profiles. Topographical detail shall show physical character of the premises, including natural drainage and direction of water flow.


2. Removal without permit.


The material listed above may be removed without permit for the following purposes only:


a. Where necessary as an incidental part of farm, garden or nursery activity.


b. When incidental to landscaping or similar activities in direct connection with constructed buildings and limited to the portion of the premises or lot upon which the build- ing stands.


c. When such material is not necessary in connection with the construction of a building being built under a permit used by the Building Inspector, the amount to be removed to be limited to the volume of the foundation and basement of the building.


d. When such material is not needed in connection with the construction of a private roadway or drive.


e. No such removal shall be allowed except upon condition that four inches of topsoil shall be replaced or allowed to remain in place, except where, due to the construction of permanent physical features such condition is un- necessary.


f. Public and municipal activities authorized under statutes and by-laws.


3. No permit for the removal of the above materials which is in effect at the time of the adoption of this By-law shall be adversely affected by this By-law.

ARTICLE 39

ARTICLE 40


To see if the Town will vote to raise and appropriate, or appropriate from available funds, the sum of $15,000.00, or such other sum as the Town may vote, to purchase or take by eminent domain, for the protection of the Pleasant Street Town Water Source or well, 88.4 acres, more or less, of land, on the easterly side of Pleasant Street as shown on "Plan of Land for Protection and/or Development of Water Supply - Town of Norwell, June 18, 1963 - by Loring H. Jacobs, Reg. Land Surveyor," or act on anything relative thereto.

ARTICLE 41


To see if the Town will vote to appropriate $70,000.00, or any other sum, for the acquisition of land and the construction of a water storage tank (stand-pipe) of approximately 500,000 gallon capacity and to meet the foregoing appropriation from the 1965 tax levy and/or to authorize the Treasurer, with the approval of the Selectmen, to issue bonds or notes of the Town or act on anything relative thereto.

ARTICLE 42


To see if the Town will vote to raise and appropriate, or appropriate from available funds, the sum of $15,000.00 for the acquisition of land and the construction of a foundation for a proposed stand pipe, or act on anything relative thereto.

ARTICLE 43


To see if the Town will vote to establish an additional fee to be added to the existing fee for all building permits for the construction of new buildings, but not to be added to fees for the construction of appurtenances or additions to existing buildings, of an amount equal to 3/4 of 1% of the cost of such new construction or buildings and to instruct the Treasurer to deposit all monies received from such additional charges in a special account, to be used exclusively for the future expansion of the water storage and pumping equipment for the Town Water system, or act on anything relative thereto.
