convention, spoken and voted against the new Federal constitution. February 24th, Judge Yates formally accepted the nomination. Three days later, Chief Justice Richard Morris of Westchester, who was favored by many Federalists, renounced the proposition to non- inate him. Of the 12,353 freeholders who were then allowed to vote for Governor, Clinton received 6,391, Yates 5,962 votes. The Federalists carried the counties of New York, Westchester, Dutchess, Columbia, Albany and Montgomery. Governor Clinton was the only nominee on the Republican or anti-Federalist ticket who was elected. The county of Ulster, where he began his pub- lic career, saved him, for out of 1,245 votes cast he obtained all but 106. The Council of Appointment consisted of Samuel Townsend of Queens, Peter Van Ness of Albany; Generals John Hathorn of Orange and John Williams of Charlotte (Washington), all anti- Federalists.


At this session of the Legislature a bill was passed providing for the election of two United States senators, but it was vetoed by the Council of Revision. A two-thirds vote of the Legislature not being available to revoke the action of the Council of Revision, the Legislature by joint resolution appointed General Philip Schuyler and Rufus King as United States senators from New York.


MONTGOMERY COUNTY.


His Excellency the Governor having signified to the Council that he had thought proper to form the militia of that district in Mont- gomery county comprized within the following bounds, to wit: West of the line of property south of the Wood creek, the Oneida lake and the Onondaga river, east of the line of session by this State to the State of Massachusetts and north of the town of Chemung and the lands purchased of the Oneidas in the year 1785 into a bat-

The resignation of Major (Harman) Van Buren, of Lieutenant Colonel Philip Van Alstyne's regiment in Columbia county, being read was accepted; and the pretensions to rank of Captains Peter John Vosburgh and Isaac P. Van Valkenburgh being laid before the Council, together with the different documents to support the same, respectively, by his Excellency the Governor, were read and taken into consideration; thereupon, RESOLVED, that the said Peter John Vosburgh be second major of the said regiment in the room of Major (Harman) Van Buren, resigned.


ALBANY COUNTY.


His Excellency the Governor having signified to the Council that he had thought proper to form the companies heretofore com- manded by Major Peter Van Rensselaer, in Brigadier General Henry K. Van Rensselaer's brigade, into a regiment, RESOLVED, that the said Peter Van Rensselaer be lieutenant colonel command- ant thereof.


His Excellency the Governor having also signified to the Council that he thought proper to arrange the companies in the aforesaid brigade commanded by Major Samuel Shaw, while a captain, and the companies commanded by Captain Jonathan Niles into two separate battalions, RESOLVED, that of the latter, the said Jonathan Niles be major of the said battalion, to take rank from the twenty- second of March, 1788, inclusive, and that James Jones and Hosea Moffat be captains of companies in the said battalion; also, that Ichabod Cone be captain of a company of light infantry in the bat- talion commanded by Major Jonathan Niles, Reuben Delanoe, lieu- tenant, Henry Platt, ensign.

The Governor laid before the Council the case of Captain Van Wagener of General (William) Malcolm's brigade, stating his claim to promotion instead of Captain (John) Vandyck, who has been appointed a major; whereupon, RESOLVED, that his Excellency be requested to appoint a board of officers to settle their relative ranks antecedent to the promotion of the said Major Vandyck, in order that justice may be done, and that the said report be attended with the documents on which it shall be founded.


January 15, 1790. Philip Livingston of Westchester, John Can- tine of Ulster, Philip Schuyler of Albany, and Edward Savage of Washington, were chosen as members of the Council of Appoint- ment. Messrs. Livingston and Schuyler were Federalists; Cantine and Savage Republicans. At this time General Schuyler held the positions of State Senator, Member of the Council of Appointment and United States Senator. January 27, by a vote of 34 to 22, the Assembly adopted a set of resolutions in effect that it was incom- patible with the principles of the United States Constitution for a person to hold an office under the United States government and a seat in the State Legislature at the same time, and that a person appointed or elected to an office under the Federal government should vacate his seat in the Legislature. The Senate also adopted the resolutions, but General Schuyler never surrendered.
