WHEREAS Lieutenant Colonel (John) Lincklaen and Lieutenant Colonel (Samuel) Clemens, commandants of two regiments of militia in the county of Chenango, whereof Jonathan Forman is brigadier general, together with Samuel S. Forman and James Green, majors in the said Colonel Lincklaen's regiment, and Samuel Sincler and Joseph Dixon, majors in the regiment commanded by the said Colonel Clemens and several commissioned officers belong- ing to the said regiments have, through Michael Myers, esquire, major general of the fifth division of the militia of this State, trans- mitted to his Excellency the Governor their resignations of the offices by them held in the militia, without the said major general's expressing any opinion thereon; and the reasons assigned by Lieu- tenant Colonel Clemens and several of the officers of his regiment, literally alike with those assigned by Lieutenant Colonel Lincklaen and several of the officers of his regiment, they, therefore, involve

the same consideration, and it appears to the Council manifest, that the said Lieutenant Colonel Lincklaen and Lieutenant Colonel Clemens, with such of their respective officers as have signed the said resignations, have availed themselves of the permission given them by law of assigning their reasons for their resignations, not only to animadvert on the proceedings of his Excellency the Governor on disaffirming the sentence of a court martial held on the conduct of Lieutenant Colonel Benjamin Hovey, but also to censure and con- demn the conduct of the late Council of Appointment in the removal of Brigadier General (Jonathan) Forman, which procedure, on the part of the said lieutenant colonels and their said officers, this Council conceive not only to be highly indecorous and repre- hensible, but evidential of a spirit of combination calculated to sub- vert the established discipline of the milita and to produce amongst them insubordination. Therefore, Resolved (Mr. (Lemuel) Chipman, dissenting), that the said resignations so made as aforesaid be not accepted; but inasmuch as the said Lieutenant Colonel Lincklaen and Lieutenant Colonel Samuel Clemens and their said majors appear to the Council unworthy to hold any longer their said offices, it is further Resolved, that the said John Lincklaen and Samuel Clemens, lieutenant colonels, and Samuel S. Forman and James Green, the said majors in the said regiment commanded by Lieu- tenant Colonel Lincklaen, and Samuel Sincler and Joseph Dixon, the said majors in the said regiment commanded by Lieutenant Colonel Clemens, be and they are hereby suspended from holding the said offices respectively, and that supersedeaes issue accordingly; and RESOLVED, further, that the further consideration of the resig- nations of the aforesaid captains and subaltern officers, who may have been unduly influenced by their superior officers, be postponed until the next meeting of the Council.

In Brigadier General Henry Wisner's brigade: Daniel Carpenter, second lieutenant of a company of artillery.


ONONDAGA COUNTY.


WHEREAS Alpheus Bouttell was, on the 17th March last, appointed first lieutenant of a company of artillery in the brigade of militia in the county of Onondaga, whereof Asa Danforth is brigadier general, by the name of Alpheus Boutwell, and Abraham Boggess, on the IIth of the same month, an ensign of a company in the regiment of militia in said county, whereof Nehemiah Earl is lieutenant colonel commandant, by the name of Abraham Boggs-RESOLVED, that new commissions issue to them respectively to take rank from the days on which they were appointed by wrong names as aforesaid.

In Lieutenant Colonel Commandant Benjamin Huntting's regi- ment :


Silvanus Halsey, a captain; David Dayton and Abraham Ford- ham, junior, lieutenants, and Matthew Howell, an ensign, having (irregularly) resigned, their resignations are severally accepted.


Benjamin Rogers, captain, vice Silvanus Halsey, resigned; Caleb Halsey, lieutenant, vice Benjamin Rogers, promoted; Jesse Wood- ruff, ensign, vice Caleb Halsey, do; Isaac Wickham, lieutenant, vice David Dayton, resigned; Jeremiah Miller, junior, ensign, vice Isaac Wickham, promoted; Simon Sayre, lieutenant, vice Abraham Ford- ham, junior, resigned.

STATE HISTORIAN.


1803.


I. An official report and representation of Anthony J. Blanchard, brigade inspector of the brigade of militia in the county of Washing- ton, made to Henry K. Van Rensselaer, brigadier general of the militia of the county of Rensselaer and commandant of the third division of the militia of this State, dated October II, 1802, respect- ing the conduct of David Thomas, lieutenant colonel commandant and commandant of the brigade of militia of the said county of Washington, at the last annual brigade inspection.


2. A report and representation of Captain Daniel Mason of the said brigade made as aforesaid on the same subject.


3. A representation of sundry of the officers in the said brigade addressed to the honorable the Council of Appointment, dated the 30th November, 1802, on the same subject.


4. An order of the said Lieutenant Colonel David Thomas, as commandant of the brigade aforesaid, approving of the sentence of a court martial ordered by him for the trial of the said Captain Mason, dated October 28th, 1802.


5. A certificate of Adjutant David Corswell, certifying his having received the said order on the 2d day of November, 1802, and of his having served the same on Captain Mason on the same day.


6. An affidavit of Adjutant Daniel Shepherd and Captain Caleb Brown, two of the members of the court martial held as aforesaid for the trial of Captain Mason, stating their decision in the said trial to have been made on the 13th day of October, 1802.


7. A letter from General Henry K. Van Rensselaer, addressed to his Excellency the Governor and the honorable the Council of Appointment, enclosing the representations and reports of the said Anthony J. Blanchard and Captain Mason, with his opinion thereon. And the same being read and considered.
