The legislature convened at Albany, January 28th, 1806. Dr. Sheldon was again elected Speaker. Immediately a struggle arose over the unprecedented course adopted in choosing the Council of Appointment. A snap caucus of the Republican members of Assembly was called to accommodate De Witt Clinton, whose polit- ical opponents were in the majority in his own district, and who would, therefore, have been defeated for member of the Council had the proceedings been held in the regular way. This caucus nomi- nated DeWitt Clinton of Queens, Robert Johnston of Dutchess, Adam Comstock of Saratoga, and Henry Huntington of Oneida, all Republicans.

March 26th, the Council removed Thomas Tillotson from the office of Secretary of State and appointed Elisha Jenkins to the vacancy thus created; Maturin Livingston was removed from the office of Recorder of New York to make way for Pierre C. Van Wyck, a friend of DeWitt Clinton. The Governor and Mr. Huntington protested against these high-handed proceedings. Carrying out the policy to retire from active official life, the friends of Governor Lewis, in order to defeat his re-election, the majority of the Council proceeded to remove sheriffs, surrogates, county judges, county. clerks and justices of the peace by the wholesale. Archibald McIn- tyre was appointed State Comptroller.

SARATOGA COUNTY.


It appearing to the Council that on the 8th day of April last an adjutant was appointed in the regiment of militia in the county of Saratoga, whereof Thomas Rogers is lieutenant colonel command- ant, by the name of Nicholas Angle, when he ought to have been appointed by the name of Nicholas W. Angle, and that at the same time an ensign was appointed in the same regiment by the name of William Harris, when he ought to have been appointed by the name of William Harris, junior; therefore, Resolved, that the Secretary be authorized to make the necessary alterations in the names aforesaid on the minutes of the Council; and also that the said lieutenant colonel commandant be authorized to make the like alterations in the commissions of the said adjutant and ensign respectively, and that the Secretary transmit him a certified copy of this resolution in order that he be authorized so to do.
