Periodically an agitation arose that demanded the publication of the proceedings of the Council of Appointment. January 22, 1791, the matter took formal shape in the Assembly by the adoption of the subjoined resolution on motion of Mr. Cornelius J. Bogert of New York:
Resolved, That the honorable the Council of Appointment of this State be informed that it is the sense of this House that the journal of their proceedings ought to be published at the close of each of their sessions, in the newspaper printed by the printer to this State; and that the speaker of this House transmit a copy of this resolution to his Excellency the Governor.
On February 15, Governor Clinton in a brief message to the ' House submitted the following copy of the entry of the proceedings of the Council of Appointment, which read:

At a meeting of the Council of Appointment, held at the city hall, in the city of New York, on the eleventh day of February, 1791. Present: His Excellency the Governor, Isaac Roosevelt [of New York], Alexander Webster [of Washington], Peter Schuyler [of Montgomery] and Thomas Tillotson [of Columbia].
His Excellency the Governor laid before the Council a resolution of the honorable the Assembly, of the 22d of January last, express- ing it as their sense that the journals of the proceedings of the Coun- cil of Appointment ought to be published at the close of each of their sessions, in the newspaper printed by the printer for this State. Whereupon, the Council having taken the same into consideration, conceive it incumbent on them to observe that as the manner in which they are to proceed in the execution of the business committed to them is prescribed by the Constitution, and by the statute for organizing the government of this State, and the minutes of their proceedings declared to be public records, and placed in the cus- tody of the secretary of the State; it would, therefore, in their opinion be improper, and might subject them to reprehension. if at the instance of one branch of the Legislature the Council should depart from regulations so established.
And the Council further beg leave to observe that, even if this objection could be obviated, they would still find themselves in a delicate situation, not having the power to exact the performance of the measure required or the means of defraying the expense attending it.
Resolved, That his Excellency the Governor be requested to trans- mit a copy of the preceding entry to the honorable the Assembly.
