RENSSELAER COUNTY.


The Council proceeded to take into consideration the remon- strance of a number of officers in the regiment lately commanded by Lieutenant Colonel (Samuel) Shaw, in the county of Rensselaer, against Thomas Palmer, the present lieutenant colonel commandant of the same, and having heard and considered the facts and reasons on which the said remonstrance is founded, are of opinion that there is reason to apprehend that the said Thomas Palmer ought not to continue in that office; RESOLVED, that the further consideration of this subject be postponed until the twenty-ninth day of September next, and that his Excellency the Commander-in-chief be requested to suspend the said Thomas Palmer from the command of the said regiment in the meantime: ORDERED, that a copy of this resolution and of the said remonstrance be transmitted by the adjutant general to the said Thomas Palmer to the end that he may have an oppor- tunity of then appearing before the Council or of making to them any communications that he may think proper.

The first clash between the Governor and the Council of Appoint- ment over the exclusive and conclusive authority of making appoint- ments, the Governor or the Council, had occurred in October, 1793. The Federalists favored the appointment of Egbert Benson to the Supreme Court bench as an additional or fifth judge. Governor Clinton himself was opposed to the Republican candidate, Peter W. Yates, and naturally was supported by a large proportion of his party. The Governor manifested reluctance in his refusal to nominate Judge Yates, because of the factional quarrel that such a course might engender. He diplomatically protected him- self, by questioning the advisability of adding one more judge to the Supreme Court bench. Two of the members of the Council of Appointment, Messrs. Frey and Hasbrouck, agreed with the Governor on this proposition; their colleagues, Messrs Gelston and Woodworth, differed with them, but were unable to decide upon a candidate. It was here that the Council and the Governor estab- lished their first conflict. The members claimed the concurrent right with the Governor in the nomination of all officers and endeav- ored to exercise that right. Further consideration of the subject was deferred until the following Monday. The deadlock still con- tinued, and Governor Clinton adjourned the proceedings from the government house in New York to the city hall in Albany, the first Tuesday in January, 1794. Resenting the course of the Council in their failure to elevate Egbert Benson to the new judgeship, the Federalists, who were largely in the majority in both branches of the legislature, began a violent attack upon the Governor and Council, through Josiah Ogden Hoffman, as soon as Governor 1 Clinton and the Senate left the Assembly chamber at the opening of the session in January, 1794. Mr. Hoffman condemned the Council in unsparing terms, and made a motion that the House pro-

ceed at once to the election of a new Council. Several members pro- tested against such a course on the ground that the old Council had not served a year, and that the appointment of a new one at this time might lead to all sorts of complications. Mr. Hoffman's proposition prevailed however, and the House accordingly elected Philip Schuy- ler, Zina Hitchcock, Selah Strong, Federalists, and Reuben Hopkins, Republican. The new council assembled in the Senate chamber, Albany on Wednesday, January 29, 1794, and, fulfilling the purpose for which they were chosen, appointed Egbert Benson a judge of the Supreme Court. Governor Clinton protested in vain against" this proceeding, insisting that under the constitution the exclusive right of appointment was vested in the Governor.


With this undecided problem in mind, Governor Jay in his first address to the legislature in 1796, requested the passage of a declaratory law fixing the proper construction of the constitution in the matter of the exclusive power of appointment. Although both branches of the legislature returned respectful addresses to the Governor's speech, a significant silence was maintained on this proposition. Since the Benson episode the attitude of both parties had become reversed. So long as the Governor represented the Republicans and a majority of the Council of Appointment, the Federalists, it was to the interest of the Republicans, from the patronage standpoint, to demand that the sole authority was lodged not in the Council but in the Governor, as it was for the Federalists to claim that the Council, not the Governor, possessed equal power. But now the Governor, Jay, was a Federalist. The Federalists could not, therefore, without stultification de- mand power for the Governor of their party which they had denied to their Republican opponents, any more than the Repub- licans could attempt to deprive the Federalist Governor of authority

which they maintained had belonged to the representative of their party, when they exercised executive control.


Under the enumeration of 1795 submitted to Secretary of State, Lewis Allaire Scott, January 20, 1796, the freeholders of the State numbered 36,338, and the voters, including those entitled to vote for members of Assembly, 66,017. Under the provisions of the first constitution, when the number of electors in any one district should increase to an amount equal to one twenty-fourth of the whole num- ber in the State, as then existing, an additional Senator should be chosen by such district, and the number of Senators might be increased until the total number of Senators numbered one hundred. Twenty additional Senators were therefore to be elected-increasing the total number of Senators to forty-four-seventeen of whom were assigned to the western district. For equalization purposes, Albany and Saratoga, by legislative enactment, were transferred to the east- ern district.

" His Excellency the Commander- " in-chief having on the report and recommendation of the adjutant " general thought proper to form a troop of horse at present : "to consist of one captain, one lieutenant, two sergeants, two i " corporals, one sadler, one farrier, one trumpeter and twenty four " privates to be raised from the regiment commanded by Lieutenant "Colonel Peter Yates in Brigadier General (Volkert) Veeder's " brigade in the county of Montgomery, the troop to be compleated "out of Lieutenant Colonel Charles Newkerk's regiment when "Lieutenant Colonel Newkerk or the commandant of said regiment ' shall report the regiment prepared to furnish its proper proportion
