The Legislature assembled at Albany, January 2, 1798. Dirck Ten Broeck, of Albany, Federalist, was elected speaker of the Assembly over William Denning, of New York, Republican. The Council of Appointment consisted of Ezra L'Hommedieu of Suf- folk, Republican, and William Thompson of Orange, Moses Vail of Rensselaer, and Dr. Joseph White of Otsego, Federalists. This was an interesting year in State politics. After an exciting cam- paign John Jay had been reelected Governor by a flattering indors- ing majority over his devoted friend of many years' standing, Chan- cellor Livingston. To fill the vacancy caused by the death of Mr. Scott, Major Daniel Hale of Albany had been appointed Secre- tary of State by the Council of Appointment against the protest of Governor Jay, who had successively nominated several persons who were as successively rejected by the Council. Robert M'Clal- len of Albany, who five years later was discovered to be a defaulter to the State to the amount of $33,000, was appointed State Treasurer.

Court bench, a very interesting series of judicial promotions began. John Lansing, junior, of Albany, was appointed Judge Yates' suc- cessor. James Kent, then recorder of the city of New York, made his first appearance on the Supreme Court bench, to succeed Judge Lansing. When Judge Lansing was promoted chancellor in 1801, he was succeeded for a time as chief justice by Morgan Lewis, who in turn was followed by James Kent. In 1814, when the age limit necessitated the retirement of Chancellor Lansing, the Council of Appointment elevated Chief Judge Kent to the vacancy created.


ALBANY COUNTY.


1798. February 17.


WHEREAS on the ninth day of April, 1796, a commission was issued to John Starks, as an ensign in the regiment of militia in the county of Albany whereof Jellis A. Fonda is lieutenant colonel com- mandant, and whereas the person intended to be appointed is James Starks, therefore, RESOLVED, that the said James Starks be an ensign in said regiment, vice John Starks, and that he take rank from the said 9th day of April, 1796.

WESTCHESTER COUNTY.


1798. February 20.


WHEREAS on the 15th day of March last, Stephen Brown of Cort- landt Town in the county of Westchester was appointed a paymas- ter in Lieutenant Colonel (Gilbert) Strang's regiment, but the com- mission was issued without the addition of Cortlandt Town, AND WHEREAS a certain Stephen Brown of Stephen Town in the said county did receive the said commission and having taken the usual oaths doth execute the same. Ordered that a new commission be issued to the said Stephen Brown of Cortlandt Town, and that the commission now held by the said Stephen Brown of Stephen Town be and the same is hereby annulled.

His Excellency the Commander-in-chief, on the report and recom- mendation of the adjutant general, has thought proper to order that the brigade commanded by Brigadier General Michael Myers and which before the division of the county of Herkimer comprehended all the militia then in it, shall in future be limited to and composed only of the militia in the present county of Herkimer and in the county of Oneida.


HERKIMER COUNTY.


The adjutant general having represented to his Excellency the Commander-in-chief that the two regiments of militia in said bri- gade commanded by Colonels (George) Weddrick and (Richard) Petri consist of 1600 men-his Excellency has, therefore, in order to promote the convenience of the inhabitants residing therein, thought proper to form the same into three regiments. 1
