His Excellency the Governor having communicated to the Coun- cil that he had thought proper to form a distinct battalion of the militia in Ulster county residing westerly of the towns of Woodstock, Hurley, Marble Town and Rochester, thereupon RESOLVED, that . The Federalists had strengthened their party organization under the skillful leadership of their resourceful leaders. effort had been spared to weaken and destroy Governor Clin- ton's influence. As a preliminary to the opening of the campaign, a savage attack was made upon Governor Clinton by the Federal- ists in the Legislature for his agency and partiality in the sale of the public lands. The war was carried into every county, and the general result unquestionably proved injurious to the Governor. At the same time, the Federalists suffered for the want of an acceptable candidate. Judge Yates declined a renomination; the patroon, Stephen Van Rensselaer, would listen to no argument; Chancellor Livingston's name was mentioned now and then, more or less favor- ably, and Chief Justice John Jay, though regarded as the best equipped and strongest candidate in the estimation of the politicians, refused his consent. Aaron Burr had begun to marplot against friend and enemy in the game of national politics. His ambition was unbounded. The governorship of New York was to be used as a stepping stone to that loftier office which he all but succeeded in grasping, a few years later.


John Jay had held a greater variety of public offices than any other man in New York State. As a member of the Provincial Con- gress; of the Committee of One Hundred; of the Continental Con- gress; as president of Congress; as regent of the University; as a boundary commissioner, and as minister to Spain, he had acquired a vast fund of knowledge of public affairs and of human nature, which, properly applied, would prove of incalculable advantage to his State. Upon his return from Madrid, he was trebly honored. The city of New York presented him with the freedom of the city in a gold box; the State of New York with the appointment of dele- gate to Congress; the Congress with the responsible position of secretary for foreign affairs. As secretary he had opened up to him all the weaknesses and deficiencies of the articles of

confederation. Thus he was enabled to join Hamilton and Madi- son as a powerful contributor to the Federalists in the plan to form a strong central government. His popularity had been tested in 1788, when he received all but 98 out of 2,833 votes, in running as a delegate from the city of New York to the State convention called to ratify the Federal constitution. With Wash- ington, Jay had always been a great favorite. It was not surpris- ing, therefore, that the first President, upon the organization of the national government, should have offered to Jay any office within his gift. Jay selected that of chief justice of the Supreme Court of the United States, but acted as Secretary of State, at the request of Washington, until Thomas Jefferson reported for duty at the seat of government. In 1785 he had declined to take the nomination for Governor of New York, although warmly importuned by his most intimate friends; but in 1792, though preferring the more con- genial life of a jurist, he finally yielded to the solicitations of his friends, who had been reinforced in the movement by Washington. The State canvassers, consisting of a joint committee of both branches of the Legislature, six from each house, convened on the second Tuesday in June, 1792. A dispute arose among the canvassers over the right of canvassing and accepting the returns from the counties of Clinton, Otsego and Tioga. Under the law the sheriff of each county was required to transmit the ballot boxes to the Secretary of State. The votes of Clinton county were delivered to the Secretary of State by a person not legally qualified, although he had received them from the sheriff of the county; those from Otsego were forwarded by a hold-over sheriff; and those from Tioga were received by the Secretary from a clerk of the special deputy appointed by the sheriff. in dispute to the two United States Senators, Rufus King and Colonel Aaron Burr. The former expressed the opinion that the votes of all three counties should be accepted. Colonel Burr favored the canvassing of the votes in Clinton county, but believed that the votes in Otsego and Tioga counties should be rejected. A majority of the canvassers concluded to reject the votes from the three coun- ties, and under the law their decision was final. This decision defeated John Jay; for, had the votes in Otsego county been counted, his election would have been assured. Clinton's majority was one hundred and eight.

The Assembly this year selected as members of the Council of Appointment David Pye of Orange, Philip Van Cortlandt of West- chester, Stephen Van Rensselaer of Albany, and William Powers of Columbia. The first two were Republicans and the last two Federalists.
