mandant of a regiment in the brigade of militia of the county of Washington whereof John Williams, esquire, was then brigadier general, although it was determined by the officers of the said regi- ment (to whom the same was submitted by the directions of the said brigadier general) that Captain Solomon Baker was by rank entitled to that promotion, owing to his having been a lieutenant when the said Day was only a sergeant, and their commissions as captains being of equal date; but that the name of the said Solomon Baker was omitted by the brigadier general in the return for promotion from party considerations.


Resolved, therefore, that the said Elkanah Day be and he is hereby removed from the said office of lieutenant colonel commandant, and that a supersedeas issue accordingly; and, Resolved, that the said Solomon Baker be and he is hereby appointed lieutenant colonel commandant in the room of the said E. Day, superseded, to take rank from the said 10th day of April, 1800.
