The Republican party was triumphant in the state and nation at the April election in 1803. Accordingly that party organized the legislature in January, 1804. Alexander Sheldon of Montgomery was chosen Speaker. The Council of Appointment was selected by the Assembly February 16th: John Broome of New York, Abra-

Since the memorable struggle for the presidency in 1801, Aaron Burr had been discredited by a large element in his party, who accused him of intriguing to defeat the election of Thomas Jefferson and to elevate himself to the office of president. No effort was therefore made to renominate him for vice-president in 1804, and George Clinton, the most popular representative of his party in the East, became the logical candidate. Recent elections had demon- strated that dry-rot was destroying the Federalist party and that the Republican party had become firmly intrenched in popular esti- mation as the party of the people. The elimination of George Clinton from the field of State politics rather complicated the polit- ical situation when the time arrived to find a candidate of his party for governor. The Republican Members of Assembly, in caucus assembled, conferred the distinction of the gubernatorial nomination upon Chancellor John Lansing, with John Broome for lieutenant governor. The chancellor at first accepted, but subsequently declined the compliment. On the same day, February 18th, the friends of Colonel Burr assembled at the Tontine coffee house in Albany and formally put him in nomination for the office of gov- ernor. Two days later another delegation of his friends met in New York and took similar action. Subsequently a number of citizens of Albany ratified the nomination and supplemented it by the nomina- tion of Oliver Phelps, a wealthy and influential land operator, for lieutenant governor.


In the meantime the Republican legislators held another caucus in Albany, at which Chief Justice Morgan Lewis received the nomina- tion that had been declined by Chancellor Lansing. The address favoring Judge Lewis and Senator Broome was signed by one hun-

dred and four of the one hundred and thirty-two members of the legislature, Senators and Members, thus indicating that the number who supported Colonel Burr must have been small.


The Federalists made no nomination, and therefore were driven to choose between the two Republican candidates. Toward Colonel Burr, the Hamilton wing of the party entertained feelings of the strongest resentment. Hamilton himself habitually alluded to Burr as an unsafe man and an unprincipled politician. Burr was defeated, receiving 22,139 votes against Judge Lewis' 30,829. The genesis of the fatal duel between Colonel Burr and Alexander Hamilton can be traced to the events immediately preceding this election. The election killed Burr politically, as the duel destroyed him socially and professionally.


Immediately upon assuming office Governor Lewis convened the Council of Appointment. Judge Kent was selected as chief justice to fill the vacancy made by the election of Judge Lewis as governor. Daniel D. Tompkins, at that time only thirty years of age, was ele- vated to the Supreme Court bench.


The legislature gathered in November to choose presidential electors. Alexander Sheldon was re-elected Speaker of the Assembly. -

Asa Danforth, brigadier general of the brigade of militia of the county of Onondaga, having by his letter, addressed to his Excel- lency the Governor, of the 27th February last, resigned his said office-Resolved, that the same be and hereby is accepted, and that Robert Earl be and hereby is appointed brigadier general of the brigade aforesaid in the room of the said Asa Danforth, so as afore- said resigned.
