WASHINGTON COUNTY.
A paper was laid before the Council, attested by the affidavit of Solomon Baker to be a true copy of a petition addressed to the Council of Appointment, subscribed by Elkanah Day, late a lieu- tenant colonel commandant of a regiment of militia. in the county of Washington, by Peter P. French, first major, John West, an ensign, and David Carswell, adjutant, in the said regiment, and by Casparus Baine, a captain, and John Beatty, a lieutenant, in the regiment of militia lately commanded by David Thomas, esquire, and several other persons; and among other things, praying the restoration of Jolin Williams to the command of the brigade, and arraigning the conduct of the late Council, and requesting, if the prayer of their petition could not be granted, that they might be gratified in accompanying their brother officers in their removal from military services-whereupon, Resolved, that the request of the said Peter P. French, John West, David Carswell, Casparus Baine and John Beatty be granted, and that their said petition be considered as an irregular resignation and as such be accepted accordingly.

The Council agreeably to their resolution of the 19th of last month, having heard Major Beriah Phelps, Captain Thomas Trus- dall, and Lieutenant Nathan Kellog in their vindication on the charges exhibited against them: and it appearing to the Council that the testimony produced as well in support of the charges against the, said officers as in their exculpation was too vague and uncertain to enable the Council to form a correct decision in the premises: and inasmuch as the said charges, if substantiated, are of such a nature as to subject the said officers to trial by court-martial; therefore, Resolved, that the said complaint be dismissed, and that his Excel- lency the Commander-in-chief be respectfully requested to. take such farther order for the investigation of such charges as justice may demand and the good of the public service require-Mr. (Jacobus) Van Schoonhoven, dissenting.

ALBANY COUNTY.
In Lieutenant Colonel Commandant John Wendell's regiment, in the city of Albany:
Gerrit Bogert, captain, George Hutton, lieutenant, and Gideon Fairman, ensign, of a company of light infantry, to take rank from the date of their former commissions respectively.
His Excellency the Commander-in-chief having thought proper, on the report and representation of the adjutant general, to establish an additional company of light infantry in the said regiment, under the restrictions however mentioned in the application therefor.
Resolved, that Peter Fryer be captain, Benjamin Hilton, lieuten- ant, and Jonathan Brooks, ensign, thereof under the conditions aforesaid.

COLUMBIA COUNTY.
1803. October 10.
On the report and recommendation of the brigade inspector of the brigade of militia of Columbia county, made with the approba- tion of the brigadier general of the said brigade, his Excellency the Commander-in-chief has thought proper to order the raising of a company of light infantry in the city of Hudson in the regiment whereof Jacob R. Van Rensselaer is lieutenant colonel command- ant-RESOLVED, that Charles Holt be captain, Marshall Jenkins, junior, lieutenant, and Leverett Cruttenden, ensign, of said company.
