Colonel Epinetus White, Colonel Jolin Ball and Colonel Thomas Rogers, members who sat at the house of Salmon Tryon at Balls- town Springs in said county on Monday, the 8th of September, 1794, and at the house of John Rogers at Ballstown in said county on Monday, the 5th day of October, 1795


The above board of officers report in favor of Major (Aaron) Comstock as being entitled to the first majority in the regiment commanded by Lieutenant Colonel (Jolin) Vandenburgh-The Council approve of the same.


The Council find that William Waldron is entered as resigned in their minutes-Lib. C, page 20. 1


RESOLVED, that his Excellency the Commander-in-chief be, and he is hereby requested to convene the said board without delay to report the facts respecting the pretensions of James Dunning, John Doney, Uriah Gregory, Asher Cook, William W. Teller and William Clerk and also their opinion thereon.


The Council approves the opinion of the board that Major (John) Wood is entitled to rank before (Captain) Jesse Toll.


The Council also approves the opinion of the said board that Ezra Buel's claim is inadmissible. -


The Council do not concur in opinion with the said board that Solomon Campbell is injured by the appointment of Deliverance Andrews as captain, inasmuch as they cannot learn that quarter- masters commonly rise in their respective beats.


It appears by the index to the aforesaid minutes that Hezekiah Dunham has resigned.

The Council do not agree to the removal of Major Scovel upon the principles suggested in the report aforesaid.


The Council do not perceive any sufficient reason for removing Lieutenant Colonel Rogers, and consider the claims of Daniel Mor- gan and Killian Winne as unfounded.

RESOLVED, that the resignation of Lieutenant Henry Traux of Colonel (John H.) Wendell's regiment be and the same is hereby accepted, the same having been transmitted to this Council by the major general of the division of which the said regiment is a part.

Whereas the Council in their session in March, 1794, in order to terminate the disputes and discontents which then existed and still continue in the brigade commanded by Brigadier General (David) McCarty by reason of his having been appointed to that office, did agree to a resolution contained in a paper filed among the papers of the Council, but which was inadvertently omitted to be entered by their clerk in the book of their proceedings, which resolution is in words following vizt:


" That a court be instituted to enquire what rank David McCarty. " esquire, held in the late army of the United States or in the troops " raised for the defence of this State or in the militia thereof. pre- vious to his appointment of brigadier general specifying the dates

" of his several commissions, and whether he at any time resigned "any and what commission and when, that his Excellency be " pleased to direct that such court report with all convenient speed " to the end that this Council at its next meeting may do what is " right and just in the premises."


And whereas the late Commander-in-chief, by his instructions to ' the adjutant general, dated the 21st day of April, 1794, did instruct and authorize him " to appoint a board of officers in all cases where " controversy existed, and did particularly instruct him to report " the facts with impartiality relative to the dispute which existed in " General McCarty's brigade." And, whereas divers circumstances have occurred to prevent the execution of the said instructions and orders respecting the said dispute. And, whereas, Colonel Philip Conine, who conceives himself to be aggrieved and injured by the said appointment, is solicitous that his pretensions be considered and decided upon agreeable to his former representation and it appearing to the Council highly expedient that the dissention which prevails in the said brigade should without further delay be terminated;


THEREFORE, RESOLVED, that the Council do respectfully request the Commander-in-chief to cause the above resolution of the Coun- . cil and the instructions of the former Commander-in-chief to be ; executed without further delay.


His Excellency the Commander-in-chief having on the recom- mendation of the adjutant general thought proper to form a troop of horse in that part of General (Abraham) Oothoudt's brigade of militia in the county of Albany comprizing the regiments com- manded by Colonels (John) Myndertse, (Johannes) Dietz, and (Jacob) Hockstrasser-therefore, Resolved, that the following officers be and they are hereby appointed for the said troop:
