ASSIGNMENTS .- Voluntary assignments may be made by debtor for benefit of general creditors, under statutory formalities. No preferences allowed except wages of employes, earned within six months prior thereto if assignor makes no preference ; three months wages preferred by law. Release not granted. Any preference made by debtor by the sale of property, mortgage, or other security, within sixty days prior to date of assign- ment, shall be void and of no effect, provided the party benefited had reasonable cause to believe such debtor insolvent, and by confession of judgment within same period, void absolutely. If suit for recovery on account of preference or fraud is not brought by assignee within sixty days after assignment, any creditor may sue therefor upon giving bonds to assignee of $1,000.
ATTACHMENT may be issued at any time before judgment, in all actions on con- tract, express or implied, where plaintiff shows by affidavit that fact, and that the debt exceeds $50, and that the affiant has good reason to believe one of the following cases to exist : That defendant has absconded or is about to abscond from the State, or is con- cealed therein to the injury of his creditors ; that he has assigned, disposed of, or con- cealed, or is about to, any of his property, with intent to defraud his creditors ; that he has removed or is about to remove any of his property out of the State, with like intent ; that he fraudulently contracted the debt or incurred the obligation for which this action is brought ; that he is a non-resident or it is a foreign corporation ; that he had fraudu- lently conveyed or disposed of his property, or part of it, to defraud his creditors. Attachment may also be made for debt to become due, on filing similar affidavit, and giving undertaking for three times amount of claim. Attachment may issue in Justice Court, upon grounds nearly identical, where debt exceeds $5.
CHATTEL MORTGAGES are valid between the parties thereto, but void as against any other persons, unless the possession of the mortgaged property be delivered to and retained by the mortgagee, or unless the mortgage, or a copy thereof, be filed with the clerk of the village, town, or city where the mortgagee resides, or if he is a non-resident. where the property is situated at the time of making the mortgage. Such chattel mort- gage ceases to be valid, except as between the parties, at the expiration of two years, unless, within thirty days next preceding the expiration of the two years the mortgagee or his agent make and annex to the mortgage, or a copy thereof, on file, an affidavit setting forth the interest of the mortgagee in the property mortgaged. The effect of such affidavit renews the force of the mortgage for two years. Similar renewals may be made at the end of each two years. It is a misdemeanor to sell or dispose of chattels mortgaged, with intent to defraud. No specified time in which mortgaged property must be sold to pay debt. Chattel mortgage upon household furniture or exempt chat- tels of married man invalid without signature of wife witnessed by two witnesses.
DEEDS .- A deed of quit claim and release of the form in common use is sufficient to pass all the estate which the grantor could convey by deed of bargain and sale. No covenant is in any case to be implied in any conveyance. Deeds executed within this State, of lands or any interest of lands therein, must be executed in the presence of two witnesses, who shall subscribe their names to the same as such, and the persons executing must acknowledge the execution before any judge or court commissioner, clerk of a cir- cuit court, county clerk, notary public, or justice of the peace ; and the officer taking the acknowledgment must indorse a certificate of the acknowledgment, and the true date of making it under his hand. A scroll answers for a seal.
EXEMPTIONS .- Library, household furniture, etc, $200 ; firearms, $50 ; necessary team, cattle and utensils ; 1 year's provisions ; tools or stock in trade of mechanic, miner, or other person, $200 ; library and implements of professional man, $200 ; print- ing material, presses, etc., $1,500; homestead, in country, 40 acres, or in town plat, one fourth of an acre. upon them for support, for three months next preceding the issue of any process, to the amount of $60, only for each month in which such earnings are made or secured. No personal property is exempt as against any debt remaining of its purchase price.
INTEREST .- Legal, 7 per cent .; by contract in writing, 10. Usury forfeits all interest.
JUSTICE'S JURISDICTION .- $200, may enter judgment by confession to $300.
JUDGMENTS .- Judgments of the circuit court become a lien on all real estate of the judgment debtor within the county, and from the date of its being docketed to the clerk's office ; this lien holds for ten years. A transcript of the judgment of a justice of the peace may be docketed in the circuit court clerk's office, and becomes then a lien on real estate, and is regarded as a circuit court judgment for its enforcement and collection. A transcript of the docket of a judgment in any circuit court clerk's office may be filed and docketed in any other county, and becomes a lien on all real estate of the judgment debtor in any county where docketed, from that date, and is enforced by execution issued from the county where judgment was rendered.
LIMITATION OF ACTIONS .- On contracts not under seal, 6 years ; judgments of courts within the State and on sealed instruments, cause accruing within the State, 20 years ; foreign judgments and specialties, cause accruing without the State, 10 years ; recovery of bonds, 20 years.
MARRIED WOMEN retain all property for their exclusive use and benefit which is acquired from any source except their husband, and may convey it and do business as if unmarried. Widow is entitled to dower of one-third in all lands owned by husband at any time during marriage, unless lawfully barred.
MORTGAGES are executed precisely as deeds, except the wife need not join in a pur- chase money mortgage to bar dower. Any conveyance, however, in whatever form, will be held a mortgage on familiar equity principles, if in reality a security for debt. If a power of sale be inserted, they may be foreclosed by advertisement. One year's redemption is allowed after sale in such cases, but the common and better practice is to foreclose by suit in Circuit Court, and after sale, which cannot take place until after the expiration of one year's redemption ; after judgment no redemption is allowed. Redemption before sale must include 10 per cent. interest from date of judgment. A reasonable solicitor's fee is allowed in addition to taxed costs. No strict foreclosures allowed of mortgages. No mortgage or sale of a homestead valid unless the wife joins.
PROOF OF CLAIMS SENT FOR COLLECTION .- It being necessary to sue in the name of the real party in interest, creditors sending claims for collection should give their names in full. In case of a firm, full name of the individuals composing the firm should be given, and if creditor is a corporation, that fact should be stated.
REDEMPTION. - Of lands sold under execution, 1 year, or by subsequent creditor, 15 months ; mortgage, 1 year ; taxes, 3 years.
REVIVOR .- Part payment or new promise in writing, if by one joint debtor, revives the debt only as to him.
STAY OF EXECUTION .- Only on justice's judgments, $10 to over $50, exclusive of costs, one to four months.
WITNESS .- Party in interest may be, unless opponent is dead.
