2. The Vote was put whether it is the mind of ye Town to Impower M' Jonas Bond their Pfent Reprefentative in the Name & behalf of Watertown to Adrefs ye Great & General Court at their prefent Sefsion for Releaf refpecting the Tax laid upon Watertown in the Laft Tax bill.


And ye Vote paft in the Affirmative.


3. The Act Relating to the better prefervation & Increafs of Deer with in this Province was Red. And Voted an chofe Edward Harrington & Jona" Bemis for the Ends Set forth in Sd Act.


At a Meeting of ye Selectmen at Capt Joseph Coollidgs on ye Ioth day of Decembr. 1739 At Sd Meeting ye Selectmen wth ye Afsent of Two of His Majesty's Juftices of ye Peace bound Daniel Maddocks a poor child of John Maddocks of abot. four years & half old (who was caft upon Sd Town) To Jofiah Perry of sd Town Weaver untill he Should Arive to Twenty one years of Age.


The Selectmen defired Capt. Coollidge to receive the cloth at M' Ebenezer Stones belonging to Mary Maddocks for her ufe, and M' Stone is Defired to Deliver the Same to Capt Coollidge. ordred the Treafurer to pay out of ye Treafury the Sum of five pounds to Capt Coollidge to procure Some Necefsary Clothing for Sd Mary Maddocks, alfo to pay or order the payment of 10 / to M' Stephen Palmer of Cambridge for keeping Daniel Maddocks abovesd the Space of Ten days.

Ordred the Clerk to Isue out Warrants to warn the Freeholders and other Inhabts. of Watertown Quallifyed to Vote in Town Affairs that they Afsemble at ye Publick Meeting houfe in Sd Town on Munday the Tenth Day of March Next at nine of ye Clock in the morning for the ends following. vizt.


To Choofe Selectmen a Clerk & Treafurer Conftable or Con- ftables and all Such other Town Officers as by Law are required to be chofen Annually in ye month of March ; & to chofe a Sexton.


To grant ye Revd M' Seth Storer his Salery for ye Pfent year According to Contract.


And to know ye Mind of ye Town what Sum of money they will grant as an Addtion to the Revd M' Storers Sallery for ye Year Current.


To grant money for ye Support of ye Grammer & Englifh School for ye year Currant.

Harris Esq'. one of ye Com- mittee who were Chofen by Watertown before Divided to Sell Lands lying to ye ways. thofe Bonds wch were given to Sd Com- mittee by thofe Pfons who purchafed Land of them, and gave Bond to them for ye Ufe of sd Watertown yt Sd Bonds may be lodged in the Treafurey that they may be ready for a Divifion between ye Towns of Watertown and Waltham when ye proper time calls for it.


To hear the Petition of John Coollidge jun" who prays that he may have Liberty for the hanging of a Great Gate acrofs ye Town way Near his Dwelling houfe in the place where he has had Liberty formerly.


To know the mind of ye Town whether they will Let out the Banks & landing places belonging to the Town by Charles River for ye prefent Year to Such Pfon or Pfons who Shall Appear to hire the Same, and give Security to the Town for what they Shall Lett for.


And for ye Town to Manifest their mind with relation to Swine runing at Larg.


And to Order the Conftables to Notify Those Perfons that the Town is Indebted to to bring their refpective Acct. to ye Selectmen at the Houfe of ye Widow Mary Learneds, in Sd Watertown Inholder on fryday the 7th. of March Next at three of ye Clock afternoon in Ord' to have them Laid before the Town.

At the abovesd Meeting the Selectmen Agree'd wth M' Nath1: Harrington To keep the Grammer & Englifh School in Watertown for the prefent Year for the Sum of Seventy five pounds, the Year to begin the firft of this Inftant March. To wch Agreem'. M' Nath'. Harringon Confented.


The Alteration of ye Town way aCrofs M'


Town Way Altred Oliver Livermores Land made by a Vote of the Town at their Meeting on ye 10th Inftant in Anfwer to ye prayer of Sd Livermores Petition is as follow's. vizt.


That the Sd Way may Continue it's Corfe from Pains Lot Still on the Eaft Side of the Petitioners Land untill it coms into the Town way, leading to the Country Road (by John Coollidges) the Dividing Line between the Petitioners Land, and the Land of Mefsrs. Joseph Coollidge & John Haftings to be the Eafterly Bounds of Sd Way, from Said pains Lot, And the Said way to take it's wydth from Sd Bounds Wefterly Conformably to the Northerly part of the Sd way Except in the Hollow and there to be Wyder for Convenancy of ye Cafy and Advantage of ye Hill. And to be An Open way over the Petitioners Land for the ufe of ye Town ; in lew of that part of ye old way left out by this Alteration ; the Petitioner referving all the fruit Trees. & other Trees Standing on Said way.


That part of ye old way Left out by this Alteration is Difcon- tinued by ye Vote of ye Town.

Made their reporte to the Town, which was as follow's.


We the Subfcribers A Comtee : Appointed by the Town of Water- town to prepar And Draw up (wth ye Advice and Concurrance of ye Hon'ble Thomas Graves Fra: Foxcroft And Sam1. Danforth Esq'. A Comtee: Appointed by the Court of General Sefsions. of ye peace for the Stateing of ye publick ways in Sd Watertown) what may be proper for the Town to Act upon wth Relation to the peaceable Settling of Sd ways wch have been So long Subfisting, and to make reporte at the Adjournment of ye Town Meeting on ye Twenty fourth of this Inftant.


Do Reporte as follow's. (having ye Advice & Concurrance of ye Hon'ble Gentlm", above Named) That the best and most proper Method for the peaceable Settling the Said Affair of ye ways (under the prefent Circumftances) is as follow's. vizt.

That the Publick Road from Waltham Line to Cambridge Line, be Stated as to it's Corfe and Wydth as is hereafter Discribed. vizt. From Waltham Line So far as the Road runs Againft the Land of Capt Sam1. Garfield, the Bounds of Sª Road So far, to be the fence on the North side as it Now Stands, and the Line Made by the Towns Comtee. (for Difpofing of Land &c) with the Sd Garfield on the South Side, the Road there being better than four Rods wyde. And from thence to Jon" Browns Barn, the South bound of Sd Road to be, the fence as it Now Stands So far, And the North Bounds to be Agreeable to the Line Made by the Towns Comtee aforesd wth Sam1 Hager John Brown Epm Cutter and John Fiske Againft their Lands. the Road there being five or Six rods wyde in Some places. And from Sd Browns Barn to Taynters Lane (So Called) the Bounds of sd Road to be the Lines Made by ye Towns Comtee aforesd with the Said Jona" Brown on ye South Side againft His Land, And John Taynter on the North Side Againft his Land the Road there being between four and five Rods wyde. And from Said Lane So far as John Whitneys Land Reaches the Road to be four Rods wyde And the Line Made by Sd Comtee. with the Sd Whitney Againft his Land to be the North Bounds. And from thence to the Lane below Thomas Saltmarthes the Sd Road to be better than four Rods wyde. And the Line Made by the aforesd Comtee. with the Sd Saltmarth againft the Land He is in the Pofsefsion off to be the South wefterly Bounds of sd Road. And from thence to the Dwelling houfe of ye Widw. Mary Learned the fence on the South Side of Sd Road as it Now Stands, to be South Bounds of sd Road, And the Lines Made by the Towns Comtee. aforesd with Joshua Learned Againft his Land and wth ye Sd Mary againft her Land to be the North Bounds of sd Road, the Road being five Rods wyde or more againft the Sd Jofhuas Houfe, and four Rods at ye sd Widws. Houfe. And the Road from thence to Jenifons Lane to be as to the Corfe and wydth as the fence now Stands on both Sides thereof Except Againft the Land of Nath1. Harris Esq" between his Barn & the Houfe of David Learned and there to be Agreeable to what ye Sd Harris bot. of ye Towns Comtee. abovesd. And from Sd Jenifons Lane, to Parrys Lane (So Called) Said Road to be four Rods Wyde. & the fence on the North Side of the Road as it Now Stands to be the North Bounds. Excepting only, that ye Corner or Notch of Land between Amos Bonds & Benj". Haftings be Straightened Agreeable to w Thos Bond Deceafed bot of sd Comtee. And from Parrys Lane afore Sd to the Lane by the Burrying place, the Road to Continue four Rods in Wydth the fence on the South Side as it now Stands, to be the South bounds of Sd Road Except againft the Mowing Land belonging to the Heirs of Thos Coollidge Deceafed, And there the Line to be Agreeable to what the Comtee. abovesd Sold to ye Sd Thos: Decd. And from Sd Lane by the Burrying place, So far as againft the Dwelling houfe of Jonathan Church, the fence as it Now Stands

His Land to be the North Bounds, and from Sd Sawins Land to the fore mentioned place Said Road to be four Rods Wyde. And from Againft Churches Houfe aforesd. Leaving the South fence Gradually, and the Line to run Streight to a Stake and heap of Stones, full four Rods South of the Southeaft Corner of of Said Churches Land, Said Line to be the South Bounds of Sd Road, and the Sd Churches Wall as it Now Stands to be the North Bounds. And from thence to Stephen Sawins houfe the Sd Road to be four Rods wyde, the fence as it Now Stands on the North Side, to be the North Bounds of sd Road, And from Simon Coollidges fence upon the Hill and Againft Sd Sawins Houfe to be the South Bounds there. And from thence Sd Road to run to the Bow of ye fence Againft Chriftopher Grants Land (Near a dry Elm Stump) the fence on ye South Side as it Now Stands to be the South Bounds of sd Road So far, And Sd Road to be four Rods wyde. And from Sd Bow the Line to Run Streight to a Stake and heap of Stones wch is full four Rods South from the Southweft Corner of Cornelious Waldo's Land, Sd Line to be the South Bounds of sd Road and the Road to be full four Rods Wyde. And from Grants Corner (So called) to Cambridge Line the fence as it Now Stands on Each Side of ye Road be the Bounds. Except Againft M' Amos Marritts Land Near Cambridge Line aforesd. where the Road is but Two Rods wyde there the Road to wyden into Sd Marritts Land (if need be) Agreable to ye Repourt of A former Comtee: from ye Court of General Sefsions of ye peace for the County of Midd".


That the Publick Way turning out of ye Publick Road by Jona": Churches aforeSd and So leading by the Meeting houfe, and So to Waltham line Near Jofhua Warrins, be Stated & Settled as to it's Corfe and Wydth as follows viz. That from the Publick Road aforeSd to John Coollidges houfe Sd Way be three Rods Wyde the fence as it Now Stands on the North Side to be the North Bounds Except againft Sª Coollidges Land and there to be Agreeable to w he bot of ye Towns Committee aforesd. and from Sd John Coollidges to John Kimballs Houfe Sd Way to be four Rods Wyde Except againft the Southweft Corner of Henry Brights Land and there to Streighten Some (if need be) to Accommodate a Uniforme Line. the Line Made By the Towns Comtee afores wth ye Sd John Coollidge againft his Land to be the North Bounds of Sd Way there, and M' Henry Brights Wall fence as it Now Stands to be the North Bounds of Sd way againft his Land, and a Streight Line from Near the Southeaft Corner of M' Jonas Bonds Land to the Southeaft Corner of Thos Biscos Orchard to be the North Bounds of sd Way So far, And the Wall fence to be the North Bounds

from thence to ye Sª Kimballs And from ye sd Kimballs to Waltham Line aforesd, the fence as it Now Stands on both Sides of the Way to be the Bounds of Said Way Except where the fence dos not Stand Upon the Line made by ye Towns Comtee. Aforesd and in Such place or places the Line made by Sd Comtee. to be the Bounds on that Side where it is.


That all other Town ways in which the Comtee. Abovesd made Alteration by Sale of Land be Establifhed as to there Corfe and Wydth Agreeable to wt was done in Such ways by Sª Comtec. Except in the Lane by Samuel Parrys And there the Lane to be better Accomodated.


The Publick Ways aforeSd Never the lefs to be Subject to Such Alterations as the Afore Named Gentlemen the Courts Comtee. (upon a view) think proper to be made.


And that all the Land Lying as Ways which Shall not be included in the Publick Ways, when Stated and Confirmed by ye Court of Sefsions that is Not yet Difpofed of remain to ye ufe and at the Sole difpofe of ye Town Agreeable to ye Article of Dividing Watertown relating to the Ways.

Honourable Gentlemen the Courts Commtee. abovesd with a Copy of the Reporte and the Votes of ye Town thereupon relating to the Settlement of the Ways abovesd. and to requeft of them (if the votes of ye Town be Agreeable to them) to reporte to ye Hon'ble Court of General Sefsions of ye peace for ye County of Middx in favour of Sd Votes and Settlement, That the Court abovesd Approv- ing and Accepting of Such a Reporte, the Publick ways in Watertown may be as to their Corfe and Wydth Settled and Confirmed.


Which if once Effected (in our Humble Opinion) will be for the Tranquilitie of Said Town.

The Vote was put whether it is the Mind of ye Town to Choofe a Committee to wait on the Hon'ble Gentlemen the Courts Comtee. wth a Copy of the Reporte and the Vote of the Town thereupon, as alfo to wait on them ye sd Commtee. when they do Come to Town to take a View of ye Publick ways, and Alfo requeft of them in the Towns behalf that if what the Town has done relating to the Ways be Agreeable to them that they wld Reporte to ye Honourable Court of Sefsions &c in favour thereof.


And ye Vote past in the Affarmative.


Voted and Chofe M' Jonas Bond, Joseph Mafon & Nath1. Harris Esqrs. to be a Committee for ye Ends abovesaid.


Then Voted and Adjourned this Meeting and ye Remaining buifnefs not yet Acted upon to the Eleventh day of April Next at four of ye Clock after Noon to this place.


At a General Town Meeting of ye Freeholders and other Inhabi- tants of Watertown on the Eleventh day of April 1740 by Adjournment.
