Mrs. Thomas Friend Loses Son's Child She Took from Chil drens' Home; Own Parent"Plans to Put Girl in Catholic Home.
A drama" which " tugged , the heart strings of onlookers was ennot- ed outalde Judge Quy D. Kirby's courtroom this morning when 6- year-old Madeline Friend was taken from the custody of her grand- mother. Mrs. Thomas Friend, by ber mother. Mrs. Sterling Friend. to whom she had been awarded a few minutes earlier by the court. The grandmother was the mother of the child's father, who was shot and killed five years ago.
Bobbing and with tears streaming from her big blue eyes, Madeline. who had been in the grandmother's custody since she was a month old. grasped the grandmother's skirts and did not want to leave her. 8he finally was persuaded, however, and was led to another part of the car ridor.
Took Calld from Orphanage.

The drama started inside the courtroom when Judge Kirby called the case and asked the grandmother If she had .an attorney.
"I have no money with which to bire a lawyer." Mre. Friend- declared: "but I have had this child since she wu a tiny baby and it would not be fair to take her from me now. I have witnesses to prove that I cared for her properly. I took her from the childrens' home, where ber mother left her. when the was so alck she couldn't hold up her little head."

The court directed that the trial proceed and Val Mason, attorney for the mother, called Mrs. T. K. Bow- man. Mrs. Bowman testified she thought the mother should have je ;. custody of the child_
Mrs. Harry Gabriel, in whose the mother of the child is od ployed as s domestic, was the next witness. 8he testified that the
mother had been In her employ for 1012 months and was of good char- acter. She pays the mother $6 a week for her services, she said.
Father Was Slain.
The mother testified that it wen her intention to put the child in & Catholic home at Nevada after the Christmas holidays.
Judge Kirby then directed the grandmother to Introduce her wit- nesses. Mr. Mason took the mattor In hand and had a son-in-law, who livea at the home of the grand- mother testify The son-in-law told of the treatment of the child during the past three years he lived at the residence of the grandmother. The grandmother has furnished the child with food, clothing and other neces- alties, he said, and was well cared for. His wife was called and told a similar story. .
Mr. Mason then turned to the grandmother and asked her if she wanted to take the stand. "I have told all I know to say." she said.
Judge Kirby then announced tha he could see no reason why th child should not be awarded to th mother and. granted her the cus tody.
Throughout the trial Madeline large blue eyes wandered about th courtroom. She is a beautiful chi and blond curls protruded from t neath the red stocking-cap she wo She was led from the courtroom the grandmother and the moth took charge of her there.

Jacob Ritterbush, 85, retired merchant who moved bera recently .from Nelson. Neb., died at 6 o'clock yesterday morn- ing at his home, 602 Cherry street. He is survived by bis wife, two sons, Fred O .. and Charles E. Ritterbush, hoth of Nelson.' Neb., and four daughters, Mrs. R. G. Bush of Mountain Grove, Mo., Mrs. Charles Geary of St. Louis, Mrs. F. J. Jones of Springfield and Miss Mildred C. Ritterbush of Nelson. . Mr. Ritterbush Was a member of Masonic lodge No. 77 at Nelson, and a Noble of the Shrine temple at Hastings. Neb. The body will ben sent this afternoon'by the Alma Loh- meyer funeral home to Nelson for burial.
