The year 1963 began with the Board calling a Special Town Meet- ing to authorize the construction of a new two and a half million dollar high school on Essex Street. It is expected that this school will be in use by January of 1965.


As the result of favorable action on Article 31 at the Annual Town Meeting the Board was able to institute an algae control program for Pillings Pond in an effort to contain and ultimately eliminate the rapid growth of weeds, and with the hope of eventually restoring this body of water to its original beauty.


A Special Study Committee appointed by the Board has recommended that consolidation of the Lynnfield and Lynnfield Center Water Districts be deferred to a later date, it being felt that no real improvement in efficiency or economic gains would be realized by a consolidation at this time.


The Board of Selectmen and four members of the School Commit- tee, acting as a joint committee, elected Richard D. Morrow to fill the vacancy on the School Committee caused by the untimely resignation of Frank Thomas. Mr. Morrow will serve until the next Annual Town Election.


A Special Town Meeting authorized the establishment of a perma- nent Wage Study Committee to completely investigate and advise the Town in the matter of compensation and fringe benefits for Town em- ployees. To date the Committee has completed its recommendations on the Police and Fire Departments and is currently in the midst of evalu- ating all other positions in the Town Government.


One of the biggest problems that the Board of Selectmen has faced during the current year is in the matter of available funds from which to pay the obligations authorized by the Town Meetings. Although the fiscal year begins on January 1st and ends on December 31st, the real estate taxes, which constitute the principle source of revenue, are not due until November 1st of the fiscal year. It is therefore necessary for the Selectmen to authorize the Treasurer to borrow funds from time to time in anticipation of revenue expected to be received prior to the end of the fiscal year. This method of financing is quite costly inasmuch as interest must be paid to the various lending institutions who furnish the working capital. It is hoped that in the future another source of funds will become available so as to eliminate or at least minimize the necessity of this borrowing practice.


On December 1, 1963 the New England Telephone and Telegraph Company provided many Lynnfield residents with an opportunity to sub- scribe to an unlimited metropolitan service. This enables telephone users in the Edgewood exchange to have unlimited calls both within Lynnfield and to the Metropolitan Boston area. In addition, the telephone company has expanded its service so as to include the City of Peabody and the Town of Saugus. It may appear that this move was slow in coming about, but it was instituted by the Board of Selectmen several years ago, and one should realize that a great deal of design work and the construction of a new telephone building in Lynnfield was necessary, prior to its im- plementation.

A new Town Hall is now under construction and it is expected to be completed and occupied in early March of 1964. The old Meeting House on the common is being restored under the direc- tion of the Lynnfield Historical Society, and although this promises to be a lengthy project, it is expected that ultimately it will resemble the original Meeting House.


Your Town Report was awarded second prize in the Town Report Contest held by the Mass- achusetts Selectmen's Association for towns in our population category. The Town Report Com- mittee should be congratulated for their excellent work, both on this re- port and for prior years, since awards have been received for the ex- cellence of the Town Report for at least the past six years.


The Board of Selectmen has appointed a Committee headed by the Town Counsel to bring the by-laws of the Town up to date, and has requested an appropriation to provide for their consolidation and pub- lishing.


The Board wishes to thank all of the dedicated town employees, elected and appointed public officials, and various townspeople who have cooperated with us during the past year and have assisted so as to make our job a little easier.

Town Counsel


The past year has been a very busy one, which is to be expected as the Town grows.


This department has been called upon very frequently for advice and for oral and written opinions by the Selectmen, Town Officers, De- partment Heads and Committee Members relative to matters concerning their duties and departments. I. believe the Town now has more active committees in operation than ever before in its history, and it seems that sooner or later they need legal advice.


I have drafted many contracts for the purchases of vehicles, machin- ery, equipment, supplies, and work, labor and materials, together with easements, petitions for street acceptances, deeds and releases, various articles for town meeting warrants and other necessary legal documents. I have also kept abreast of the passage of new laws affecting municipal- ities and furnished copies thereof to the departments concerned.

All meetings of the Board of Selectmen were attended as were town meetings and also board and committee meetings when requested.

Lynnfield v. Sharpe - Damage to Police cruiser.


Lynnfield v. Twin City Automobile Leasing Corp. - Excise Taxes - Peabody Court.


Lynnfield v. Lynn Rendering Corp. - Excise Taxes - Peabody Court.


Brown & Carpenter v. Lynnfield - Suit on electrical sub-bid on new High School - Decree for Town in Suffolk Superior Court - Appealed to Supreme Court.


I was asked by the Selectmen to form a new committee to revise and codify the Town By-Laws. This has been done and work will start the first of the year. This project should be done every five years or so as the by-laws change rapidly with each town meeting and they should be collected and kept up to date in one book.


At this time I wish to thank the Selectmen, Town Officers, Department Heads, Town Employees, Board and Committee members and all others who have been most considerate, cooperative and helpful to me in the performance of my duties.

The Board of Appeals currently meets in the Selectmen's Room at the Town Hall on the first Tuesday of each month to act on all cases submitted one month or more prior to the hearing date.


Procedural Rules and all decisions of the Board are a matter of public record on file with the Town Clerk. Any person aggrieved by a decision of the Board is entitled to appeal to the Superior Court within 20 days of the filing of the decision.
