On motion of Mr. Maney, Chairman of the Board of Selectmen, duly seconded, it was VOTED to adjourn to Monday, March 23, 1970 at 8:00 P.M. in the Junior High School and the gymnasium if necessary if the business of the meeting was not completed in this fourth session.


ARTICLE 9.


On motion of Mr. Freeman Towers, duly seconded, it was


VOTED to raise and appropriate the sum of $6,000. for a survey and study of drainage conditions of the Town, the results of said survey and study to be placed on Town-owned maps and said funds to be expended by the Selectmen.


A motion to INDEFINITELY POSTPONE action on this article was defeated.


ARTICLE 10.


On motion of Mr. Maney, duly seconded, it was VOTED to INDEFINITELY POSTPONE this article which is listed below:


"To see if the Town will vote to endorse the establishment by the Board of Selectmen of the position of "Town Engineer;" to raise and appropriate or appropriate by transfer from available surplus funds a sum of money to be used to pay the salary of said position and to include in the "Unclassified Budget" items to cover the necessary costs; and the subsequent appointment by the Board of Selectmen thereto of a qualified licensed engineer. Said appointee shall perform engineering services as required by the Board of Selectmen, Planning Board, Board of Health, Highway Department, Drainage Committee and all other departments of the Town and maintaining adequate records of all work performed, or what action it will take thereon."

VOTED to raise and appropriate the sum of $750. to be used by the Board of Selectmen to pay the cost of placing additional names on the Town's War Memorial plaque.


ARTICLE 12.


On motion of Mr. Gorshel, duly seconded, it was


VOTED to raise and appropriate the sum of $350. to be used by the Town's By-Law Revision Committee for studies, clerical and stenographic expense, conduct of hearings, if any, and publication of notice thereof, and all other activities necessary and incidental to the purpose of said committee.


ARTICLE 13.


On motion of Mr. Maney, duly seconded, it was


VOTED to raise and appropriate the sum of $1,500. to be expended by the Board of Selectmen for the continuance of the control of algae, weeds and other aquatic nuisances in Pillings Pond.


ARTICLE 14.


On motion of Mr. Keenan, duly seconded, it was


VOTED to raise and appropriate the sum of $7,500. for the Conservation Fund.


ARTICLE 15.


On motion of Mr. Rodham, duly seconded, it was


VOTED UNANIMOUSLY to INDEFINITELY POSTPONE action on this article which is listed below:


"To see if the Town will vote to endorse the establishment by the Board of Selectmen of the position of "Town Mechanic," to raise and appropriate

or appropriate by transfer from available funds a sum of money to be used to pay the salary of said position and to include in the "Unclassified Budget" or in any other appropriate Town Budget of items to cover the necessary costs; to endorse the subsequent appoint- ment by the Board of Selectmen thereto of a qualified mechanic, said appointee to maintain and make repairs on all Town-owned motor vehicles, or what action it will take thereon.

ARTICLE 16.


On motion of Mr. Burke, duly seconded, it was


VOTED to raise and appropriate the sum of $1,500. to be used by the Pillings Pond Study Committee for engineering, legal, clerical and all other services necessary and/or incidental to the purposes of said committee.


ARTICLE 17.


On motion of Mr. Myles Burke, duly seconded, it was


VOTED to authorize the continuance of the Committee for Study of Low Income Housing for the Elderly.


ARTICLE 18.


On motion of Mr. Arthur Foulds, duly seconded, it was


VOTED to authorize the Board of Selectmen to appoint a Secondary School Building Committee of seven citizens; said committee to obtain preliminary plans, sketches, and estimates of costs for construction of school facilities to be attached to the Senior High School on land owned by the Town; provided, however, that the plans, sketches and estimates be submitted to the following boards and committees:


1. Board of Selectmen


3. Finance Committee


2. School Committee


4. Planning Board


and that the approval of the plans and sketches by at least three of these boards of committees be secured before the Secondary School Building Committee reports to the Town; and that the Town vote to raise and appropriate the sum of $12,000. for the use of the Secondary School Building Committee.


ARTICLE 19.


On motion of Mr. Vaughn Young, duly seconded, it was


VOTED to raise and appropriate the sum of $6,500. to be expended under the direction of the Planning Board for a study of current Lynnfield zoning and planning with particular reference to business zoning, multiple family dwellings and the effect of Chapter 774 of the Acts of 1969.


ARTICLE 20.


On motion of Mr. Maney, duly seconded, it was


VOTED UNANIMOUSLY to raise and appropriate the sum of $2,000. for appraisals, surveys, engineering and legal services necessary in the acquisition of land for rubbish disposal purposes.


ARTICLE 21.


On motion of Mr. Barry Plunkett, duly seconded, it was


VOTED to raise and appropriate the sum of $8,000. to be used by the Town's Charter Commission under General Laws (Ter. Ed.) Chapter 43B, for consulting fees, stenographic expense, costs of conducting hearings including publication of notice thereof and for any and all other expenses necessary and incidental to the proper discharge of its duties.


ARTICLE 22.


On motion of Mr. Warburg, duly seconded, it was


VOTED UNANIMOUSLY to appropriate by transfer from Available Surplus Funds the sum of $47,539.26 to be placed in the Stabilization Fund.


ARTICLE 23.


On motion of Mr. Maney, duly seconded, it was


VOTED to raise and appropriate the sum of $4,685. to be used to construct a parking lot adjoining the present Town Hall parking lot on a portion of land formerly known as the Pearson property.


ARTICLE 24.


On motion of Mr. Gerry, duly seconded, it was


VOTED UNANIMOUSLY to appropriate the sum of $25,000. for the construction of Chapter 90 highways in accordance with the provisions of General Laws, Chapter 90 and that the sum of $18,750. be transferred from

Available Surplus Funds and the sum of $6,250. be raised in the tax levy and to cause any reimbursements received from the Commonwealth of Massachusetts and the County of Essex to revert to Available Surplus Funds.


ARTICLE 25.


On motion of Mr. Maney, duly seconded, it was


VOTED UNANIMOUSLY to instruct the Board of Selectmen to file a bill in the Massachusetts Legislature authorizing the Town of Lynnfield to withdraw from the Massachusetts Bay Transportation Authority.


ARTICLE 26.


On motion of Mr. Maney, duly seconded, it was VOTED to adopt the following petition to the members of the Great and General court of the Commonwealth of Massachusetts:


The Town of Lynnfield hereby petitions the Great and General Court of the Commonwealth to respect the financial plight of the cities and towns by rejecting all legislation which would place added costs, directly or indirectly, on the municipalities without providing for local acceptance or for funding by other than local taxation.


The Town of Lynnfield further petitions that the legislature do everything in its power to further implement the concept of "Home Rule" including the rejecting of special or general legislation, which detracts from the legitimate right of the municipal employer to bargain collectively with its employees.


And that the Town vote to direct the Selectmen to cause a copy of this petition to be forwarded to the Governor, and to all of the members of the Great and General Court and the Mayors and Selectmen of the Commonwealth. ARTICLE 27.


On motion of Mr. Gerry, duly seconded, it was


VOTED to transfer the sum of $500. from the Sale of Lots and Graves Fund to be used to extend Forest Hills Cemetery.


ARTICLE 28.


On motion of Mr. Gorshel, duly seconded, it was


VOTED to raise and appropriate the sum of $142. to reimburse the men of the Lynnfield Fire Department for the premium paid by them for weekly indemnity insurance, said reimbursement to take place only if the Massachusetts Legislature acts favorably upon a bill placed before it that will allow the Town of Lynnfield to do so legally.


ARTICLE 29.


On motion of Mr. Maney, duly seconded, it was VOTED UNANIMOUSLY to amend Chapter 22 of the by-laws as follows:


Section 5


A. Add the following sentence to the first paragraph: Any grievance must be presented in or within five (5) calendar days of the occurrence of the alleged grievance.


B. Delete Step 1, Step II and Step III as presently written and substitute therefore the following:


Step 1 Whenever an employee has a grievance relating to his employment he shall orally make it known to his immediate superior making it clear to his superior that he is presenting a grievance in accordance with this clause. His superior shall attempt to resolve the grievance and shall verbally respond to the employee within five (5) working days of being told of the grievance. If the grievance is not satisfac- torily resolved the employee may then take Step II.


Step II . The employee shall put his grievance in writing on a form to be supplied by the Town Clerk and present it to his department head who may.be the same person as in Step 1. He shall also present a copy of the grievance to the Clerk of the Personnel Board. The department head shall attempt to resolve the grievance and shall submit an answer in writing on a form to be supplied by the Town Clerk to the employee with a copy to the Clerk of the Personnel Board within five (5)


working days of the receipt of the grievances. If the grievance is not satisfac- torily resolved hereunder the employee may then take Step III.


Step III


The employee shall file a written state- ment of his grievance with the Personnel Board and request an informal hearing before the same at its next regular meeting, or at a special meeting if the Board deems this advisable. The Board shall notify the appropriate department head and/or superior to be present at said hearing. All parties, including the Board, . shall be entitled to be represented by a ยท

duly authorized representative. Within fifteen (15) days of the hearing, all parties shall be notified in writing of the decision of the Board, which decision shall be in writing. The decision of the Personnel Board shall be final and binding on all parties with regard to all grievances except as may be otherwise provided in contracts negotiated between the Town and a certified bargaining unit of employees.


Section 10


Add to first paragraph of subsection "e" the words "subject to the provisions of subsection "a" of this section."


Section 13


SICK LEAVE


Delete the provisions of Section 13 and substitute therefor the following:


a. Persons employed on a permanent full-time basis after 120 calendar days will be allowed sick leave with pay on the basis of one (1) working day for each month of service. Sick leave not used in any year may be accumulated, not to exceed ninety (90) working days in the aggregate.


Persons employed on a permanent part-time basis after eighty (80) days actually worked shall be allowed sick leave with pay on the basis of one (1) part-time day for each twenty (20) days actually worked. Sick leave not used in any year may be accumulated not to exceed sixty (60) part-time working days in the aggregate.


b. Accrued sick leave will be determined from attendance records since January 1, 1957. Upon termina- tion of employment, employees shall not be entitled to any direct or indirect payment for unused sick leave.


c. Sick leave will be granted to employees only under the following conditions:


1. When incapacitated by sickness or injury.


2. When, because of exposure to contagious disease, the presence of the person at work would jeopardize the health of others.


3. In case of death in the immediate family (husband, wife, children, parents, brothers, sisters, mothers- in-law or fathers-in-law), employees may be granted sick leave with pay not to exceed three (3) calendar days in each instance.


d. Injury, illness or disability, self-imposed, or as a result of alcohol or drugs not taken as medically prescribed treatment will not be considered a proper claim for sick leave benefits.


e. With the department head's approval, vacation time may be converted to sick leave if no sick leave time is available.


f. A medical certificate may be required as proof of sickness, injury or exposure to contagious disease. Failure to report absence promptly or to obtain a required certificate within seven (7) calendar days after request will provide the department head sufficient reason for disapproving a sick leave request.


g. If any employee is injured while performing his duty, and such accident is covered by Workmen's Compensation, he shall receive sick leave up to the extent of his credits until payment under Workmen's Compensa- tion Law begins. In addition, he may receive partial sick leave allowance payments which, when added to disability compensation, will result in full payment of regular salary. Any absence resulting from such injury that is in excess of available sick leave or vacation credits, shall be deemed leave of absence without pay.


h. Traffic supervisors shall be allowed one (1) working day of sick leave for each month of service not to exceed seven (7) working days per year.


i. No sick leave will be granted to temporary employees.


j. Unauthorized absence or abuse of sick leave shall be grounds for disciplinary action by the Town up to discharge of the employee.


Section 14


HOLIDAYS


Delete the provisions of the present Section 14 and substitute therefor the following:


a. Permanent full-time and permanent part-time employees, excluding temporary employees, shall receive their regular straight time pay for the following Legal Holidays falling on a regular day of work.


The Legal Holidays are:


January 1st First Monday in September 3rd Monday in February October 12


1/2 Day on Good Friday


November 11


3rd Monday in April 1/2 Day before Christmas


Thanksgiving Day


Last Monday in May July 4th Christmas Day

To be eligible for such holiday pay, an employee shall have worked or have satisfactorily presented himself for work, on the regularly scheduled work day before the holiday, and the first one (1) after it unless absence on either or both work days is approved by the department head.


b. If required to work on a holiday enumerated above, such employees shall receive time and one-half for the hours actually worked in addition to their regular pay.


c. Traffic supervisors will receive regular straight time pay for school holidays.


d. When a legal holiday under paragraph "a" falls on a Saturday, the Friday immediately preceding shall be observed and when it falls on a Sunday, the Monday immediately following shall be observed. Permanent full-time and part-time employees shall receive straight time pay for ten (10) legal holidays during each year.


Section 16


Full-time employees shall be allowed leave to fulfill jury duty. If the jury fees, exclusive of travel allowances, received by said employee for such jury duty shall be less than the regular pay received by him from the Town, the difference between said fees and regular pay shall be paid to such employee by the Town. However, as a condition to receiving such payment, the employee agrees that if during such jury duty he is discharged for the day or major portion thereof during regular work hours, he will report to his supervisor for such work as may be assigned. An employee performing such jury duty and who desires the benefit of this article shall be required to present weekly to his department head a certificate by the court or any duly authorized representative as to the time spent by the employee in such jury duty during such week.


ARTICLE 30.


On motion of Mr. Gorshel, duly seconded, it was


VOTED to amend the by-laws by deleting Chapter 2, Section J thereof which section deals with the establish- ment, organization and conduct of the Wage Study Committee.


ARTICLE 31.


On motion of Mr. Maney, duly seconded, it was


VOTED UNANIMOUSLY to INDEFINITELY POSTPONE action on this article which is noted below:


"To see if the Town will vote to raise and appropriate, appropriate by transfer from available funds, or by borrowing, or from any or all of such sources, an additional sum of money to pay for the acquisition of the land described in the vote under Article One of the Special Town Meeting of December 1, 1969, being the portion of the land in Lynnfield owned by Whitney Construction Company described in deed of Emily G. Weir dated October 20, 1969, and recorded with Essex South District Registry of Deeds in Book 5644, Page 605, or what action it will take thereon.

ARTICLE 32.


On motion of Mr. Maney, duly seconded, it was


VOTED to accept as a public way Edgemere Road (portion) as shown on plan of land entitled "Plan of Land in Lynnfield, Mass." dated January 12, 1970 by Hayes Engineering Inc., said portion of Edgemere Road being that which begins at its intersection with Archer Lane as shown on said plan and running westerly, northerly and northeasterly a distance of 197 yds. and having a width of 50 feet, or however the said portion of Edgemere Road may be described.


ARTICLE 33.


On motion of Mr. Gorshel, duly seconded, it was


VOTED to raise and appropriate the sum of $6,000. to be used to construct the portion of Edgemere Road described in Article 32 of this Annual Town Meeting.


ARTICLE 34.


The report of the Planning Board relative to this article was read by Mr. Vaughn Young.


"In accordance with Chapter 40A of the General Laws, Section 6, a duly advertised Public Hearing was held by the Planning Board at the Town Hall on March 4, 1970 at 8:00 p.m. at which time four members of the Board were present and acted through on Article 34 as contained in the Town Warrant for the Annual Town Meeting to be held March 9, 1970.


"The Planning Board recommends the adoption of Article 34 for the following reasons:


"The amendment to the Zoning By-Laws as proposed in this article will serve to eliminate gasoline service stations as a permitted use in Limited Business areas with Board of Appeals approval.

"At a Special Town Meeting held on June 26, 1967 the town saw fit to amend the section of the Zoning By-Laws that we are presently considering to permit such a use. The amendment voted at that Town Meeting resulted in the establishment of a gasoline service station at the corner of Salem and Summer Streets. One of the main arguments that was put forward by the proponents of the article permitting gasoline service stations in Limited Business areas with Board of Appeals approval was that there was really only one location presently existing in town that the Board of Appeals could approve for the establishment of a gasoline service station. Realistically, the amendment of June 26, 1967 has served its purpose and therefore the Planning Board feels that the best interests of the town would be served by a further amendment of Section 2 (c) 9 so as to eliminate this permitted use.
