RECORD OF ACTION TAKEN AT SPECIAL TOWN MEETING HELD OCTOBER 20, 1969 IN THE JUNIOR HIGH SCHOOL AUDITORIUM
Pursuant to the foregoing warrant, the legal voters of the Town of Lynnfield met in the Junior High School auditorium in the said Town of Lynnfield on Monday, October 20, 1969.
The meeting was called to order at 8:00 P.M. by John H. Kimball, Moderator.
With the consent of the voters, unregistered persons named by the Moderator were admitted to the meeting and they were seated on the stage.
The call for the meeting was read by Mr. Kimball, and that portion of the warrant preceding the articles. The Moderator then announced that unless there was any objection, the articles would not be read until taken up for action. There being none, Mr. Kimball read that part of the warrant following the articles including the signatures of the Selectmen and the constable's return of service.

On motion of Mr. H. Joseph Maney, Chairman of the Board of Selectmen, it was voted unanimously to adjourn to Thursday, October 30, 1969 at 8:00 P.M. in the Junior High School Auditorium should the busi- ness of the meeting not be completed in this session.
ARTICLE 1.
Mr. Vaugh Young, Clerk, read the following recom- mendation of the Planning Board regarding this article. "Recommendation of the Planning Board Relative to Article I of the Special Town Meeting Warrant: " In accordance with Chapter 40A of the Massachus- etts General Laws, Section 6 a duly advertised Public hearing was held on October 15th in the Lynnfield Jun- ior High School Auditorium at which time three mem- bers of the Board were present and acted throughout on Article I as contained in the Warrant for the Special Town Meeting to be held on October 20th, 1969 at 8:00 p.m."
"The Planning Board has felt for some time that the property described in this article is land that should be acquired for future municipal and/or recreational use. Such use would not only benefit the Town but would also put protection of the aesthetic and histor- ical values of the area in the hands of the Town. "Much of the property in the area is presently used for municipal or public purposes, but all of this property has been used in strict accordance with the zoning laws, and we do not feel that anything has been done to de- tract from the value of the property under consider- ation in this article."
"We must also point out that no really urgent need has been demonstrated to us for the additional services that are permitted in a limited business zone. Further, the proponents of this article admit to having no plans for the area. And further it has not been shown that this proposed change is part of a general reevaluation or re- alignment of the zoning plan of the town."
"In view of the above we feel that to rezone this pro- perty at this time could very possibly result in con- struction of a type that would be permanently detri- mental to the very special character of the area."
"The Planning Board recommends that this article be defeated."
On motion of Mr. Allen Rideout, duly seconded, this article (noted below) was defeated - 67 in favor, 263 opposed.
"To see if the Town will amend its Zoning By-Laws by voting to establish as a LIMITED BUSINESS DIS- TRICT land fronting on South Common Street owned by Allene L. Rideout, also known as Allene H. Rideout, said land being Parrcells "B" and "C", totaling 3.25 acres, shown on "Plan of Land in Lynnfield Centre, Mass. belonging to Susan B. Taylor" by S.C. Mitchell, Civil Engineer, dated Oct. 1, 1926 and filed in Essex
Registry of Deeds as Plan #5, Book of Plans 49 at Sa- lem, Mass."
A motion for reconsideration was defeated.
ARTICLE 2.
On motion of Mr. Theodore C. Regnante, duly seconded, it was voted to refer this article to the Plan- ning Board and the Historical Commission for fur- ther study. (Article noted below)
"To see if the Town will amend its Zoning By-Laws by voting to establish as a LIMITED BUSINESS DIS- TRICT land fronting on Main Street, known as the "Haskell property", formerly owned by Henry A. Has- kell, said land being parcels "A" and "D", totalling 6.98 acres, shown on "Plan of Land in Lynnfield Cen- tre, Mass. belonging to Susan B. Taylor" by S.C. Mit- chell, Civil Engineer, dated Oct. 1, 1926 and filed in Essex Registry of Deeds as Plan #5, Book of Plans 49 at Salem, Mass."
ARTICLE 3.
On motion of Mr. Roger Gerry, Town Accountant, duly seconded, it was VOTED UNANIMOUSLY to transfer the sum of $4,000. from Interest on Temporary Loans Account to the Group Insurance Account.
ARTICLE 4.
On motion of Dr. Thomas Devaney, duly seconded, it was VOTED to transfer the sum of $5,000. from In- terest on Temporary Loans Account to the School De- partment account for other School Services Expense.
ARTICLE 5.
On motion of Mr. Carl Davis, duly seconded, it was VOTED UNANIMOUSLY to transfer the sum of $2,842. from the Interest on Temporary Loans Account to the Fire Department Expense Account.
ARTICLE 6.
On motion of Mr. Gorshel, duly seconded, it was VOTED to accept as a PUBLIC WAY, ALDERNEY WAY, as laid out by the Board of Selectmen and ap- proved by the Planning Board, and as shown on a plan of land entitled "Windermere" and recorded in Essex South District Registry of Deeds in Plan Book 103, Plan 8, being bounded and described as follows:
Beginning on the Easterly side of Chestnut Street and continuing in an Easterly direction for a distance of approximately 887 feet more or less and having a width of 40 feet.
At this point, on motion of Mr. Maney, duly seconded it was VOTED to postpone action on Articles 7 and 8 to October 30, 1969 at 8:00 P.M. in the Junior High School Auditorium.

On motion of Mr. Maney, duly seconded, it was VOTED to adjourn this Town Meeting SINE DIE with- out action being taken on Articles 7 and 8 which are noted below.
ARTICLE 7.
To see if the Town will vote to authorize and in- struct the Board of Selectmen to acquire by purchase or by eminent domain for SCHOOL PURPOSES a por- tion of a certain parcel of land owned by Emily E. Weir located on the northerly side of Main Street, Lynnfield, said parcel containing 13 acres, more or less, or how- ever the same may be more accurately described, or what action it will take thereon.
ARTICLE 8.
To see if the Town will vote to appropriate by bor- rowing a sum of money to pay for the acquisition of the land described in Article 7 of this Special Town Meeting, or what action it will take thereon.

RECORD OF ACTION TAKEN AT SPECIAL TOWN MEETING HELD DECEMBER 1, 1969
IN THE JUNIOR HIGH SCHOOL AUDITORIUM
Pursuant to the foregoing warrant, the legal voters
of the Town of Lynnfield met in the Junior High School auditorium in said Town of Lynnfield on Monday, De- cember 1, 1969.
The meeting was called to order at 8:05 P.M by John H. Kimball, Moderator.
With the consent of voters, unregistered persons named by the Moderator were admitted to the meeting and they were seated on the stage.
At the request of Mr. Clyde Warburg, Chairman of the Finance Committee, for additional time for con- sultation with his committee, the Moderator declared a recess until 8:25 P.M. at which time the meeting was again called to order.
The call for the meeting, and that portion of the warrant preceding and following the articles were read by the Moderator. With the approval of the voters, the articles were to be read at the time of being taken up for action.
ARTICLE 1.
On motion of Mr. Irving Burns, Chairman of the School Site Selection Committee, duly seconded, it was VOTED 158 in favor, 23 opposed, that the Town au- thorize and instruct the Board of Selectmen to acquire for the Town for school purposes by purchase or by eminent domain under General Laws, Chapter 79, cer- tain lands located in the Town, northwesterly of Main Street and northwesterly of the southwesterly end of Wheeler Street, as follows:
1. The fee in a parcel of land shown as Lot 2A on the plan hereinafter referred to and containing 9.27 acres according to said plan.
2. The fee in a parcel of land shown as Lot 2B on said plan and containing .39 acres according to said plan.
3. An easement in gross in the full width and length of a strip of land 50 feet wide, extending from said Wheeler Street southwesterly 90 feet and shown on said plan as "50" R.O.W.", (Right of Way). Said easement is for the purpose of using said strip of land for all purposes for which public ways are now and may in the future be used in the Town, including the right of surface passage and the right to install utilitise drainage facilities and the like above and below ground.
4. The owner of the fee in said strip of land may also make use of it for the aforesaid purposes and may make any other use of it not inconsistent with said easement.
5. An easement to construct and maintain slopes in strips of land 20 feet wide adjoining the full

length of the southeasterly and southwesterly lines of said strip of land shown as "50' R.O.W.", (Right of Way). Said Lots 2A and 2B and said "50' R.O.W." are shown on plan by Hayes Engi- neering Inc. dated October 16, 1969, entitled "Plan of land in Lynnfield owned Whitney Con- struction Company", to be recorded with Essex South District Deeds.
Said Lots 2A and 2 B and said "50' R.O.W." are part of the land conveyed to Whitney Construc- tion Company, Inc. by deed of Emily E. Weir dated October 20, 1969, recorded with said deeds in Book 5644, Page 605.
ARTICLE 2.
On motion of Mr. H. Joseph Maney, Chairman of the Board of Selectmen duly seconded, it was VOTED 151 in favor, 28 opposed, that the Town appropriate the sum of $45,300.00 to pay for the acquisition of land for school purposes authorized by the vote under Article 1 of this Special Town Meeting, and that to raise this ap- propriation, the Town appropriate by transfer from Available Surplus Funds the sum of $13,300.00, to ap- propriate by transfer from the Interest on Temporary Loans Account the sum of $5,000.00 and to authorize the treasurer to borrow with the approval of the Board of Selectmen the sum of $27,000.00 under Chapter 44, Section 7(3) of the General Laws as amended.
A motion by Mr. Spencer Champbell, duly seconded to amend this figure to $60,000.00 for the land and right of way was defeated.
ARTICLE 3.
On motion of Mr. Freeman Towers, duly seconded, it was VOTED to transfer the amount of $635.85 from the Interest on Temporary Loans Account to the Map- ping Committee Account.
All business of this Special Town Meeting having been completed, on motion of Mr. Maney, duly second- ed, it was VOTED to adjourn SINE DIE.
