On motion made and seconded, the following article was defeated (61 in favor, 35 opposed - 2/3 vote required)
"To see if the Town will vote to amend Zoning By-Laws, Section 2 (c) 9 by striking out subsection 9 and inserting in lieu thereof the following:
Any of the following additional uses, if authorized by the Board of Appeals:
a. Any of the uses, which the Board of Appeals may authorize in single residence A, B, C, and D districts as set out in section 2(b) 11 and subject to the same conditions as therein specified.
b. Any other retail business or service establish- ment supplying commodities or performing personal or consumer services primarily for residents of the surrounding neighborhood, provided that such use is similar to the uses hereinbefore listed in general character, extent of business hours, number of persons or cars to be attracted, and in effect on adjacent property and improvements (but not including any use specifically listed herein in a less restricted district, nor any use whose stock in trade consists primarily of large bulky objects not normally subject to being carried away by the customer on his person or in his automobile."
ARTICLE 35.
On motion of Mr. Fletcher, duly seconded, it was
VOTED UNANIMOUSLY to accept as a public way Beechwood Road, as laid out by the Board of Selectmen and approved by the Planning Board and as shown on plan entitled "Plan of Land in Lynnfield, Mass." dated January 13, 1970, by Dana F. Perkins and Sons, Inc., C.E.'s to be recorded in Essex South District Registry of Deeds, said Beechwood Road running from Lakewood Road northwes- terly to Lockwood Road a distance of 445.71 feet more or less, to its end, and having a width of 25 feet or however said road may be more accurately described.
ARTICLE 36.
On motion of Mr. Gorshel, duly seconded, it was
VOTED to raise and appropriate the sum of $3,555. to be used to construct Beechwood Road as described in Article 35 of this Annual Town Meeting.
ARTICLE 37.
On motion of Mr. Gorshel, duly seconded, it was
VOTED UNANIMOUSLY to accept as a public way Cedarwood Road, as laid out by the Board of Selectmen and approved by the Planning Board and as shown on a plan entitled "Plan of Land in Lynnfield, Mass." dated January 16, 1970 by Dana F. Perkins and Sons, Inc., C.E.'s to be recorded in Essex South District Registry of Deeds, said Cedarwood Road running northeasterly from Summer Street a distance of 672.06 feet to its end and having a width of 40 feet.
ARTICLE 38.
On motion of Mr. Gorshel, duly seconded, it was
VOTED UNANIMOUSLY to raise and appropriate the sum of $5,275. to be used to construct Cedarwood Road as described in Article 37 of this Annual Town Meeting.
ARTICLE 39.
On motion of Mr. Gerry, duly seconded, it was
VOTED to appropriate the sum of $20,600. to reconstruct a portion of Chestnut Street from Cooks Farm Lane to Lowell Street and a portion of Lowell Street from Chestnut Street to North Hill Drive, $4,571.67 to be transferred from funds paid to the Town by the Commonwealth of Massachusetts under Chapter 768 of the Acts of 1969 and the balance of $16,028.33 to be raised in the tax levy.

ARTICLE 40.
On motion of Mr. Eckert, duly seconded, it was
VOTED to transfer the care and custody from the Recreation Commission to the Board of Selectmen the land located off Main Street in the Town of Lynnfield and bounded and described as set forth in deed of the Whitney Construction Company, Inc., to the Town, dated September 28, 1961, and recorded with Essex South Registry of Deeds, Book 4835, Page 165.
ARTICLE 41.
On motion of Mr. Maney, duly seconded, it was
VOTED UNANIMOUSLY to transfer the care and custody of the following parcels of land from the Board of Selectmen to the Conservation Commission:
1. Sixteen (16) acres of land in Reedy Meadow described in Essex Probate Court No. 174650.
2. Two (2) acres of land off Main Street described as parcel number 3 in deed recorded in Essex South District Registry of Deeds in Book 4242, Page 71, or however the same may be more accurately described.
ARTICLE 42.
On motion of Mr. Gorshel, duly seconded, it was
VOTED UNANIMOUSLY to accept as a public way Cortland Lane West (portion) as shown on plan entitled "Definitive Plan of Tophet Hill" by Hayes Engineering Inc., dated September 3, 1965, and recorded with Essex South District Registry of Deeds in Plan Book 106, Plan 9 and bounded and described as follows:
Beginning at the intersection of the Northerly line of Cooks Farm Lane and Cortland Lane West as shown on said plan and running Southwesterly and Southerly a distance of 715 feet and having a width of 40 feet or however the same may be more accurately described.
ARTICLE 43.
On motion of Mr. Gorshel, duly seconded, it was
VOTED UNANIMOUSLY to accept as a public way Cooks Farm Lane as shown on plan entitled "Definitive Plan of Tophet Hill" by Hayes Engineering, Inc., dated September 3, 1965, and recorded with Essex South District Registry of Deeds in Plan Book 106, Plan 9 and bounded and described as follows:
Beginning on the Easterly side of Chestnut Street and running Southeasterly a distance of 720 feet, more or less, to its end at Cortland Lane West, and having a width of 40 feet.
ARTICLE 44.
On motion of Mr. Brodbine, duly seconded, it was
VOTED UNANIMOUSLY to accept as a public way, Daly Road as laid out by the Board of Selectmen and approved by the Planning Board and shown on a Subdivision Plan entitled "Plan of Land in Lynnfield," which plan is recorded in Essex South District Registry of Deeds in Plan Book 112, Plan 19, and bounded and described as follows:
Beginning on the Westerly side of the Newburyport Turnpike, and running Westerly and Southerly a distance of 660 feet more or less and having a width of 40 feet, or however the same may be more accurately described.
ARTICLE 45.
The report of the Planning Board relative to this article was read by Mr. Vaughn Young.
"In accordance with Chapter 40A of the General Laws, Section 6, a duly advertised Public Hearing was held by the Planning Board at the Town Hall on March 4, 1970 at 8:00 p.m. at which time four members of the Board were present and acted throughout on Article 45 as contained in the Town Warrant for the Annual Town Meeting to be held March 9, 1970.
"The Planning Board recommends disapproval of Article 45 as presently submitted to the Town in the Warrant for this Town Meeting. The Planning Board would, however, approve such an amendment to the Zoning By-Laws if the proponents of this article offer amendments which would in effect put in the hands of the Building Inspector very strong powers to revoke the permit for such a directory-type sign as herein proposed should the sign become detrimental by reason of its appearance or general maintenance.
"The Planning Board has traditionally maintained a strong restrictive stand on signs. By their very nature, signs must attract attention and there seems to be some unwritten rule that the more distasteful they are, the more attention they will attract. We are wary of extending the present permitted uses for signs. However, in the instance of directory-type signs generally as proposed in this article, we feel that should the proper amendments be accepted, there would be

On motion of Mr. Simmons, duly seconded, this article was VOTED - 63 in favor, 19 opposed,
to amend the zoning by-laws of the Town of Lynnfield by adding to Chapter 10, part II, Section 12, "Sign Regulations," (b) the following:
3. A directory-type sign for identification of the several tenants or occupants in the area may be placed in a prominent place for the benefit of foot vehicular traffic. Each tenant will be allotted for his identification on the sign an area not in excess of 24" horizontally and 6" vertically (144 square inches) and the total area of the sign shall not exceed 10 square feet. Other ornaments may not protrude from the sign more than 4 inches in any direction with the exception of hardware necessary to attach the sign to a post. Such a sign should be in good taste and may be white lighted indirectly, but may not be lighted by flashing or intermittent lights. Said sign shall be placed in a safe location at the normal entrance to the area in which the tenants or occupants are located and also be located so as not to obstruct the normal vision of traffic. Said sign shall not be suspended or placed so as to overhang a public or private way and will be no higher at its lower extremity than 3 feet above the ground. Permission for the installation of any directory sign not attached to a building will be in writing from the fee holder of title and accompany any request for a permit or variance. Said request to include a scale drawing of the proposed sign and said permit, when issued shall indicate that the permit for said sign may be revoked by the Building Inspector if it is not properly maintained.
and by deleting the word "one" in the first sentence of said Chapter 10, Part II, Section 12 (b) and substituting therefor the word "two."
ARTICLE 46.
This article was acted on after action completed on Article 8 at the first session of the annual town meeting.
ARTICLE 47.
On motion of Mr. Roger Gerry, duly seconded, it was
VOTED to INDEFINITELY POSTPONE this article which reads as follows:
"To see if the Town will vote to authorize the Board of Assessors to use such free cash as may be in the treasury, or any part thereof, in computing the tax rate for the current year, or what action it will take thereon."

RECORD OF ACTION TAKEN AT SPECIAL TOWN MEETING HELD MAY 11, 1970 IN THE JUNIOR HIGH SCHOOL AUDITORIUM
Pursuant to the foregoing warrant, the legal voters of the Town of Lynnfield met in the Junior High School auditorium in the said Town of Lynnfield on Monday, May 11, 1970.
The meeting was called to order at 8:05 P.M. by Mr. Harry C. Wendt, Moderator.
The call for the meeting was read by Mr. Wendt and that portion of the warrant preceding the articles. Consent of the voters was given to the reading of the articles when being taken up for action. Mr. Wendt read the remainder of the warrant following the articles including the signatures of the Selectmen and the return of service of the constable.
ARTICLE 1.
On motion of Mr. Gordon Wilkes, duly seconded, it was
VOTED UNANIMOUSLY to INDEFINITELY POSTPONE this article, noted below.
"To see if the Town will vote to create a HISTORIC DISTRICT and a HISTORIC DISTRICT COMMISSION to administer the same by amending the town's By-Laws by adding the following as Chapter 26 thereof, entitled "Historic District:"

There is hereby established Historic a District Commission under the provisions of the "Historic Districts Act," General Laws, Chapter 40C, consisting of seven (7) members and three (3) alternate members, appointed by the Board of Selectmen, including one (1) member, where possible, from two (2) nominees submitted by the Lynnfield Historical Society, one (1) member, where possible, from two (2) nominees, one (1) of whom shall be submitted by the Massachusetts State Chapter of the American Institute of Architects and one (1) of whom shall be submitted by the Boston Society of Landscape Architects, and one (1) member, where possible, from two (2) nominees of the Board of Realtors covering Lynnfield. One (1) or more of the foregoing shall be a resident of an Historic District established in Lynnfield pursuant to the Historic Districts Act.
When the Commission is first established, two (2) members shall be appointed for a term of one (1) year, two (2) shall be appointed for a term of two (2) years, and three (3) shall be appointed for a term of three (3) years; their successors shall be appointed in like manner for terms of three (3) years. When the Commission is first established, three (3) alternate members shall be appointed for a term of one (1) year, one (1) member shall be appointed for a term of two (2) years and one (1) member shall be appointed for a term of three (3) years; their successors shall be appointed in like manner for terms of three (3) years.
Section 2 (HISTORIC DISTRICT)
There is hereby established an Historic District under the provisions of the Historic Districts Act, General Laws, Chapter 40C, bounded and described as shown on plan entitled "Historic District in Lynnfield, Mass." by Hayes Engineering, Inc., dated April 27, 1970, scale 1"=100', said plan being on record with the Town Clerk.
Section 3
The Historic District Commission shall have all the powers and duties of historic district commissions as provided by the Historic Districts Act, General Laws, Chapter 40C, and of subsequent amendments thereto.
Section 4
The Historic District Commission shall adopt rules and regulations for the conduct of its business not inconsistent with the provisions of the Historic Districts Act, General Laws, Chapter 40C, and may, subject to appropriation, employ clerical and technical assistants or consultants and may accept money gifts and expend same for such purposes.
Section 5
When taking action under the provisions of the second paragraph of Section 7 of the Historic Districts Act, General Laws, Chapter 40C, the Historic District Commission shall make a determination within sixty (60) days after the filing of the application for a certificate of appropriateness, or such further time as the applicant may in writing allow.
