(k) The Executive Secretary shall be authorized to look into complaints, to make investiga- tions, to conduct special studies, to file reports and make recommendations to the selectmen and the town meeting.
(1) The Executive Secretary shall have access to all town books, records, and papers. He may, without notice, cause the affairs of any department, or activity under his supervision, or the con- duct of any officer or employee appointed by him, to be examined.
(m) The Executive Secretary shall perform such other duties, consistent with his office, as may be required of him by the selectmen, by the town by-laws, and by the specific powers and duties pro- vided hereinafter in this Act.
(n) Annual Budget and Approval of Warrants
1. All officers, boards, and commissions of the town shall submit to the Executive Secre-

tary in writing detailed estimates of their appropriations required for the efficient and pro- per conduct of their respective departments and offices, and such further information, in such form and at such times, as the Executive Secretary may require. On or before the fifteenth of November of each year, the Executive Secretary shall prepare and submit to the Finance Committee a budget for the ensuing year, and all supplementary information in such form and detail as the Finance Committee may require.
2. Approval of Warrants
Warrants for the payment of town funds shall be submitted to the Executive Secretary. The selectmen may delegate specific authority in writing to the Executive Secretary to ap- prove payment of warrants and said delegations of authority shall be sufficient authority to authorize payment by the town treasurer. Where this authority has not been delegated to the Executive Secretary, warrants must be approved by the selectmen.
3. Investigation of Claims
Whenever any payroll, bill, or other claim against the town is presented to the Execu- tive Secretary, he shall, if the same seems to be of doubtful validity, excessive in amount, or otherwise contrary to the interests of the town, refer it to the selectmen, who shall im- mediately investigate, and determine what payment, if any, should be made. Pending such investigation and determination by the selectmen, payment shall be withheld.
(o) The Executive Secretary shall supervise the administration of all departments and activi- ties of the Town, subject to the direction and advice of the Board of Selectmen, as hereinafter pro- vided. With the approval of the selectmen, he may also supervise and direct such other activities and undertakings of the Town, not otherwise subject to his supervision, as may be requested of him from time to time by the office, board or committee having control thereof.
(p) The Executive Secretary may appoint and remove all town employees, in any department, commission, board or officers, over which he has supervision and direction. Such officers or employees shall have the right of appeal to the Board of Selectmen, which shall act as a board of appeal, and said board shall, after full consideration, make a decision which shall be final.
Section 7. Removal of Executive Secretary
The selectmen, by a majority vote of the full membership of the Board, may remove the Ex- ecutive Secretary, in accordance with the following provisions. At least fifteen days before such proposed removal shall become effective, the selectmen shall file a preliminary resolution with the town clerk setting forth in detail the specific reasons for his proposed removal, a copy of which resolution shall be sent by registered mail to the Executive Secretary. The Executive Secretary may reply in writing to the resolution and may within said fifteen day period request a public hear- ing. If the Executive Secretary so requests, the Board of Selectmen shall hold a public hearing not earlier than ten days nor later than fifteen days from the filing of such request. After such public hearing, if any, otherwise at the expiration of thirty days following the filing of the preliminary resolution and after full consideration, the selectmen, by a majority vote of the full membership of the Board, may adopt a final resolution of removal. In the preliminary resolution the selectmen may suspend the Executive Secretary from duty, but in any case his salary shall continue to be paid until the expiration of one month after the date of the final resolution of removal.
Section 8. Collector of Taxes and Town Treasurer
The existing office of Town Treasurer and the existing office of Collector of Taxes shall be merged into a single office and one person shall serve as Town Treasurer and Collector of Taxes. This person shall be appointed by the Board of Selectmen upon the recommendation of the Execu- tive Secretary, and shall have the powers, perform the duties, and be subject to the liabilities and penalties now or hereafter imposed by law upon town treasurers and town collectors of taxes. The separate existing offices of Town Treasurer and Tax Collector shall be continued until such time as the person appointed to both offices shall have qualified under the provision.
Section 9. Appointment of Board of Assessors
There shall be a Board of Assessors consisting of three persons to be appointed by an ap- pointive authority consisting of (1) the town moderator, (2) a member of the Board of Select- men, and (3) a member of the existing Board of Assessors. In addition, there shall also be em- ployed by the Board a full time qualified assessor to perform the actual duties of assessing pro- perty. At the first annual town meeting following acceptance of this act, the said authority shall

appoint one assessor for a three year term to replace the assessor whose term expires, and shall appoint each year thereafter one assessor, whose term also expires, for a three year term. If a va- cancy occurs in the Board, the vacancy shall be filled forthwith by the aforesaid appointive au- thority. Upon the appointment and qualification of assessors as provided in this section, the terms of office of the members of the then existing Board of Assessors shall terminate. The assessors shall organize for the proper conduct of their duties and shall act primarily as a Policy and Re- view Board. The assessors shall possess all the powers and rights and be subject to all the duties and liabilities conferred or imposed by law upon assessors of towns.
Section 10. Town Clerk
The selectmen shall appoint, upon the recommendation of the Executive Secretary, a Town Clerk for a term of three years. The existing office of Town Clerk shall be continued until the ten- ure of the present incumbent terminates. The Town Clerk shall be under the supervision of the Executive Secretary and shall have the powers, perform the duties, and be subject to the liabilities and penalties now or hereafter conferred or imposed by law upon town clerks.
Section 11. Finance Committee
There shall be a Finance Committee consisting of nine members to be appointed by an ap- pointing authority consisting of (1) the town moderator, (2) a member of the Board of Selectmen, and (3) a member of the Finance Committee. At the first annual town meeting following accep- tance of this Act, the said appointive authority shall appoint three members for a three year term to replace the members whose terms then expire, and each year thereafter shall appoint three mem- bers for a three year term to replace the members whose terms then expire. The appointive au- thority shall forthwith fill any vacancy that shall occur on the Board.
Section 12. Department of Public Works
The existing offices of Highway Commissioner, Park and Cemetery Commissioner and Tree Warden and Moth Superintendent, shall be abolished. The highway department, the park and cem- etery department, and the tree and moth department shall be merged into one department, to be known as the Department of Public Works, which shall be under the direction and supervision of the Superintendent of Public Works. The said superintendent shall be appointed by the Board of Selectmen, and shall be under the direction and supervision of the Board of Selectmen.
The Department of Public Works shall be responsible for the care, maintenance, and operation of all town buildings and grounds other than schools and school grounds. It shall assume all the duties and functions heretofore performed or required by law to be performed by the highway de- partment, the park and cemetery department, and the tree and moth department.
The Department of Public Works, may subject to the prior approval of the Board of Select- men, perform such duties and functions as may be requested by any other department of the Town, including, but not limited to, the following: the School Department, the Planning Board, and the Conservation Commission.
The Superintendent would be responsible to and under the supervision of the Board of Select- men, and would be specifically responsible for the following, but not limited thereto :
1. Preparation of annual plans and budget for his department.
2. Periodic reporting to selectmen of the performance of his department with respect to any plans which the Board has approved.
3. Custody of all town owned equipment assigned to his department.
4. Supervision of all personnel in his department either directly or indirectly through his foreman.
5. Advise the selectmen of changes required in organization, work practices, town by-laws, or any other procedures affecting the performance of his functions.
Section 13. By-Laws, Rules, etc
All laws, by-laws, rules and regulations in force in the Town of Lynnfield when this Act takes effect, not inconsistent with its provisions, whether enacted by authority of the town or any other authority, shall continue in full force and effect until otherwise provided by law, by-law or vote. All other laws, by-laws, rules and regulations, so far as they refer to the Town of Lynnfield, are hereby repealed and annulled, but such repeal shall not revive any pre-existing enactment.
Section 14. Submission of Act and Time of Taking Effect
This Act shall be submitted to the qualified voters of the Town of Lynnfield for acceptance at

the town election to be held in the year 19 - -. The vote shall be taken by ballot in answer to the following question, which shall be printed on the official ballot :
"Shall an Act passed by the general court in the year 19 - - entitled 'An Act establishing a selectmen-executive secretary form of government for the Town of Lynnfield' be accepted ?"
Upon acceptance by a majority of the qualified voters as herein provided, this Act shall take effect for the purposes of the annual town meeting for the year of its acceptance, and for all things that pertain to said election. Appointees of the officers and boards abolished and consolidated by this Act shall continue to draw compensation at the same rate and to exercise the same powers and authority as theretofore provided until provision otherwise is made.
ARTICLE 6.
To see if the Town will vote to place on the official ballot for the 1964 Annual Town Meeting the following question in accordance with the provisions of Chapter 41, Section 69C of the General Laws: "Shall section 69C to 69F inclusive of Chapter 41 of the General Laws, providing for the establishment of a Board of Public Works exercising the powers of certain other departments and town office be accepted ?"
ARTICLE 7.
To see if the Town will vote to place on the official ballot for the 1964 Annual Town Meeting the following question in accordance with the provisions of Chapter 41, Section 21 of the General Laws: Shall the Town vote to have its Selectmen appoint a board of assessors?
ARTICLE 8.
To see if the Town will vote to authorize the Selectmen to appoint an executive secretary in accordance with the provisions of Chapter 41, Section 23A of the General Laws, or what action it will take thereon.
ARTICLE 9.
To see if the Town will vote to direct the Town Government Study Committee to prepare on or before January 24, 1964, a complete set of (A) proposed amendments to the Town By-Laws for the purpose of implementing all those recommendations contained in the Town Government Study Committee Report submitted in February, 1962, which require action by the Town Meeting ; and (B) proposed amendments to the Massachusetts General Laws for the purpose of implemen- ting all those recommendations contained in the aforementioned Town Government Study Commit- tee Report which require amendatory action by the General Court. The Committee shall obtain the comments of the Town Counsel in preparing its recommendations and shall obtain his approval as to legal form for all of the recommendations it submits. Three copies of the report shall be sub- mitted to each of the following: Board of Selectmen, Finance Committee and Town Clerk, plus such other copies as may be directed by the Board of Selectmen."
