RECORD OF ACTION Taken at Special Town Meeting Held June 2, 1966 in the Junior High School Auditorium


Pursuant to the foregoing warrant, the legal voters of the Town of Lynnfield met in the Junior High School Auditorium in the said Town of Lynnfield on Thursday, June 2, 1966.


The meeting was called to order at 8:00 P.M. by John H. Kimball, Moderator, who, with the consent of the voters, admitted unregistered per- sons to the meeting and they were seated in the front row of the auditorium.


The call for the meeting was read by the Mod- erator as was that part of the warrant preceding the articles. There being no objection, the arti-

ARTICLE 1.


On motion of Mr. Robert Perkins, Chairman of the Board of Selectmen, it was Voted (100 in favor, 40 opposed-2/3 vote required) to authorize the Board of Selectmen to acquire by purchase if possible or by eminent domain, for school pur- poses: A certain parcel of land on the northwest- erly side of Forest Hill Avenue, Lynnfield, shown as lot #2 on a "Plan of Land in Lynnfield owned by Fairway Homes, Inc." dated April 5, 1965, drawn by John W. Parsons, Surveyor, and re- corded in Essex South District Deeds, Plan Book 104, Plan 93 and containing 8.2 acres according to said plan.

ARTICLE 2.


On motion of Mr. Robert Perkins, duly sec- onded, it was Voted to transfer the sum of $8,- 200.00 from Available Surplus Funds for the ac- quisition of the land described in Article 1.


ARTICLE 3.


On motion of Mr. Robert Perkins, duly sec- onded, it was Voted (111 in favor, 30 opposed) to authorize the Board of Selectmen to acquire by purchase if possible or by eminent domain, for use for future expansion of Town Hall facilities, or use as a site for future municipal buildings, or use for highway garage facilities or use as a municipal parking area: A certain parcel of land with the buildings thereon in the Town of Lynn- field, owned by Raymond R. Pearson and Evelyn G. Pearson and described in a deed dated Decem- ber 9, 1946 and recorded in Essex South District Deeds, Book 3503, Page 360, together with a cer- tain easement granted by Susan B. Taylor to Raymond R. Pearson and Leon E. Pearson dated October 27, 1934 and recorded with said Deeds at Book 3030, Page 561, and together with a certain easement or right of way reserved by said Ry- mond R. Pearson in Deed dated December 4, 1946 and recorded with said Deeds at Book 3517, Page 566.


ARTICLE 4.


On motion of Mr. Robert Perkins, duly sec. onded, it was Voted to transfer from Available Surplus Funds the sum of $30,000.00 for the ac- quisition of the land described in Article 3.


ARTICLE 5.


On motion made and seconded, it was Voted to Indefinitely Postpone action this article, namely-

"To see if the Town will vote to amend Chap- ter 3 of the Town By-Laws by adding at the end of subdivision 1, the following: The Finance Committee shall consider any or all municipal questions for the purpose of making reports or recommendations to the Town, and by adding at the end of subdivision 3 the following :- but this provision shall not limit the powers of the Finance Committee to consider any or all muni- cipal questions, and to make reports or recom- mendations thereon."


ARTICLE 6.


On motion of Mr. Dane, of the Finance Com- mittee, it was Voted to Indefinitely Postpone ac- tion on this article, namely -


"To see if the Town will vote to ratify and confirm the action of the Finance Committee in publishing in the Shoppers News dated March 3, 1966, its recommendation on the referendum question pertaining to the tenure for the Town Accountant, the cost of which the Town Ac- countant has refused to pay on the ground that the action of the Finance Committee exceeded its authority, and direct the Town Accountant to make payment therefor, contingent upon adoption by the Town of the amendment to the By-Laws contained in Article 5 and upon the approval thereof by the Attorney General or the passage of ninety days from the date of said adoption without disapproval of the At- torney General, whichever occurs first."


ARTICLE 7.


Voted Unanimously that the Town transfer from Available Surplus Funds the sum of $1,- 002.33 to pay a bill of Data Tabulating Company dated September 30, 1965 which was incurred by the Board of Assessors.


ARTICLE 8.


Voted Unanimously that the Town transfer from Available Surplus Funds the sum of $15.00 to pay the expense of an injury to a municipal building custodian in 1965.


ARTICLE 9.


Voted Unanimously that the Town transfer from Available Surplus Funds the sum of $12.50 to pay for an expense of the Board of Selectmen for printing which occurred in 1965.


Action having been completed on all of the articles of the Special Town Meeting warrant, on motion of Mr. Robert Perkins, duly seconded, it was Voted to adjourn SINE DIE at 10:05 P.M.

RECORD OF ACTION Taken at Special Town Meeting Held October 3, 1966 in the Junior High School Auditorium


Pursuant to the foregoing warrant, the legal voters of the Town of Lynnfield met in the Junior High School Auditorium on Monday, October 3, 1966.


The meeting was called to order at 8:00 P.M. by John H. Kimball, Moderator.


With the consent of the voters, unregistered persons named by the Modertor were admitted to the meeting and were seated on the stage.


The call for the meeting was read as was the part of the warrant preceeding the articles. Since there was no objection, the articles would be read when taken up for action. The balance of the warrant was then read and also the return of service of the constable.


ARTICLE 1.


On motion of Mr. Robert Rourke, Chairman of the Conservation Commission, it was Voted that the Board of Selectmen and the Conservation Commission be authorized and instructed to ex- ercise the option of the Town, given to it by Thomas Costa and Susie Costa and dated June 17, 1966, to purchase certain land with the build- ings thereon and the easements, privileges and appurtenances belonging thereto, being part of the property formerly known as the Hudson Farm, which land is situated northerly of Main

Street, Lynnfield, and contains 34 acres, more or less; that said real estate be purchased in the name of the Town and be in the custody and under the management and control of the Con- servation Commission for conservation purposes, as authorized by Section 8-C of Chapter 40 of the General Laws, and any amendments thereof; and that an appropriation of $31,918.50 be authorized to complete the purchase, such sum to be raised by transfer of $27,500.00 from Available Surplus Funds and by expenditure of $4,418.50 from the Conservation Fund.


A motion to reconsider action on this article was defeated.


ARTICLE 2.


Voted to appropriate by transfer from Avail- able Surplus Funds the sum of $945.00 for the purchase of radar equipment and signs, said radar equipment to be in the custody and for the use of the Police Department of the Town of Lynnfield.


At this time it was voted to take up action on Article 8 of the warrant. (Passed by a 2/3 vote.)


ARTICLE 8.


On motion of Mr. Frederick D. Eble, Chairman of the Library Building Committee, duly sec- onded, it was Voted 314 in favor, 149 opposed (2/3 voted required) that the Town appropriate the sum of $25,000.00 to be added to the funds appro- priated by vote of the Town under Article 7 of the Annual Town Meeting of 1966 for the con- struction of an addition to the Green Library, and for the original furnishing and equipping thereof, and for remodeling, reconstructing and making extraordinary repairs to the existing library, all in accordance with plans which have been ap- proved in accordance with the vote of the Town adopted under Article 13 of the Annual Town Meeting of 1963; the appropriation hereby made to be provided by borrowing said sum of $25,- 000.00 under the provisions of General Laws, Chapter 44, Section 7, clause (3) by the Treasurer of the Town of Lynnfield, with the approval of the Board of Selectmen of said Town, who shall issue bonds or notes of the Town therefore pay- able in accordance with said Chapter 44, said Treasurer and Selectmen being hereby authorized to do all acts necessary and incidental to said borrowing; said borrowing to be made in con- junction with any borrowing authorized by said vote under Article 7 of the Annual Town Meeting of 1966 and the total resulting borrowing to be made for a term of not more than 3 years.


A motion to reconsider action on this article was defeated.


ARTICLE 3.


On motion of Mr. Colby Burbank, duly sec- onded, the following article was Indefinitely Post- poned.


"To see if the Town will vote to raise by transfer from Available Surplus Funds, a sum of money for an engineering survey and study of an area along the northerly side of Pillings Pond between Summer Street (near Archer Lane) and Pillings Pond Road; said survey and study to determine the most advantageous lay- out of a way that would run between Summer Street and Pillings Pond Road, said funds to be expended by the Planning Board, or what ac- tion it will take thereon."


ARTICLE 4.


On motion of Mr. Robert Kautz, duly seconded, it was Voted that the sum of $1,500.00 be trans- ferred from Available Surplus Fund for prelimi- nary appraisals and surveys of possible recre- ational sites in the Town of Lynnfield, said funds to be expended by and said preliminary ap- praisals and surveys to be made under the direc- tion and control of the Recreational Sites Com- mittee and the Board of Selectmen of the Town of Lynnfield.


ARTICLE 5.


On motion of Mr. Theodore Palizzolo, duly sec- onded, it was Voted to transfer from the Russett Lane account the sum of $917.27 and to transfer the sum of $582.73 from Available Surplus Funds to the Gasoline Account of the Town of Lynnfield making a total of $1,500.00.


ARTICLE 6.


On motion of Mr. S. Peter Gorshel, Town Coun- sel, duly seconded, it was Voted Unanimously to amend Chapter 19 of the By-Laws of the Town of Lynnfield by deleting the amounts presently specified in step 5 pertaining to the following positions of Employment and Salaries in High- way, Moth, Tree, Park and Cemetery Depart- ments, Public Libraries and General Government of the Town of Lynnfield and substituting there- for the mounts set forth opposite the same:

ARTICLE 7.


On motion of Mr. Robert Perkins, Chairman of the Board of Selectmen, it was Voted to amend the By-Laws of the Town of Lynnfield by delet- ing Chapter 8, Sections 2 and 4 thereof and sub- stituting therefor the following Section 2:


"No person shall behave in a rude and/or disorderly manner or use any indecent, profane or insulting language, gestures or objectionable sounds, or assemble in a disorderly manner with others, or remain upon any sidewalks


(1) in any public way, lane, alley or other public place, or


(2) in or near any dwelling house, building or other place to which the public has the right of access as invitees;


"no person shall remain upon any doorstep, portice or other projection from any dwelling house or other building within the Town. Vio- lation of this By-Law shall be punished by a fine of not less than twenty dollars nor more than fifty dollars for each violation.


The violation of this By-Law shall be deemed a misdemeanor for which the violator may be arrested without a warrant by any police offi- cer of the Town of Lynnfield."


Action having been completed on all the arti- cles of this special town meeting, on motion of Mr. Perkins, duly seconded, it was Voted to ad- journ SINE DIE at 10:05 P.M.
