Record of Action Taken at Annual Town Meeting Held March 9, 1964 in the High School Auditorium
Pursuant to the foregoing warrant, the legal voters of the Town of Lynnfield met in the High School Auditorium in the said Town of Lynnfield on Monday, March 9, 1964.
The meeting was called to order at 8:00 p.m. by John H. Kimball, Mod- erator; who, with the consent of the voters, admitted certain unregistered persons to the meeting and they were seated on the stage.
The call for the meeting was read by the Moderator as was that part of the warrant preceeding the articles. Mr. Kimball then announced that unless there was any objection, the articles would not be read until taken up for action. There being none, the Moderator read that part of the war- rant following the articles, including the signatures of the Selectmen and the return of service of the constable.
On motion made by Mr. Harry Wendt, Chairman of the Board of Select- men, duly seconded, it was voted to recess the annual town meeting until the two articles in the special town meeting warrant were dissolved.

Mr. Kimball read the call for the special meeting, the part following the articles, signature of selectmen and the return of service of the constable. With the consent of the voters, the articles were not read until taken up for action.
ARTICLE 1.
On motion of Mr. Howland, duly seconded, it was voted that the Town will assume liability in the manner provided by Section 29 of Chapter 91 of the General Laws, as most recently amended by Chap- ter 5, Acts of 1955, for all damages that may be incurred by work to be performed by the Department of Public Works of Massachusetts for the improvement, development, maintenance and protection of tidal and non-tidal rivers, harbors, tide-water, foreshores and shores along a public beach, including the Merrimack and Connecticut Rivers, in accordance with Section 11 of Chapter 91 of the General Laws, and authorize the Selectmen to execute and deliver a bond of indemnity therefor to the Com- monwealth.
ARTICLE 2.
On motion of Mr. Howland, duly seconded, it was voted unanimously to accept the provision of Sec- tion 29A of Chapter 91 of the General Laws (added by Statute 1963, Chapter 608) providing for the construction of structures by cities and towns to protect private property along shores.
On motion of Mr. Wendt, it was voted unanimously to adjourn the special town meeting sine die.
With the business of the special town meeting completed, action now reverted to the business of the annual town meeting warrant.
On motion made by Mr. Harry Wendt, Chairman of the Board of Selectmen, it was voted to ad- journ to Thursday, March 12, 1964 in the High School Auditorium, and gymnasium if necessary, if the business of the annual town meeting was not completed in this first session.
ARTICLE 1. VOTED UNANIMOUSLY
that Walter M. Riggs, J. Warren Smith, James C. Fletcher be appointed Field Drivers; that J. Warren Smith be appointed Pound Keeper ; that Perley P. Burrill, Daniel Kelleher and J. Warren Smith be appointed Wood Measurers.
ARTICLE 2. VOTED
on motion of Mr. Palizzolo, Town Accountant, that the reports of Town Officers and Special Com- mittees as published be received and placed on file without ratification of any action taken or author- ization of any action proposed.
ARTICLE 3.
On motion of Mr. Moynihan, Chairman of the Finance Committee, it was VOTED that effective April 1, 1964, the compensation of elected officers of the Town to be fixed as follows, as required by General Laws, Chapter 41, Section 108, as amended :

Because of amendments proposed by Mr. Thwing to change the salaries of the assessors, and Mr. Collier of the Wage Study Committee to increase the salaries of all the elective officers, this article was voted as a divided article.
A motion to reconsider on this article was defeated.
ARTICLE 4. VOTED UNANIMOUSLY
that the dog license money in the amount of $1,577.04 refunded by the County of Essex in 1963 be transferred to Item 123 of Article 8, Expenses of the Library Budget.
At this time, on motion of Mr. Ralph Dwight, it was voted that Article 23 be taken out of order and that it be taken up at the meeting to be held March 16 at 8:00 p.m. in the High School auditorium and gymnasium, if necessary.
ARTICLE 5.
On motion of Mr. Palizzolo, Town Accountant, duly seconded, it was VOTED UNANIMOUSLY to authorize the TOWN TREASURER, with the approval of the Board of Selectmen, to borrow money from time to time in anticipation of the revenue for the financial year beginning January 1, 1965, and to issue a note or notes as may be given for a period of less than one year, in accordance with Sec- tion 17, Chapter 44 of the General Laws.
ARTICLE 6.
The following article was DEFEATED - 157 in favor, 290 opposed.
"To see if the Town will vote to accept Chapter 478 of the Acts of 1963 increasing the amounts of PENSION AND RETIREMENT ALLOWANCE payable to certain former public employees, (Provides for increases of $100, $200, and $300, depending upon age and length of service and where amount received does not exceed $2800.)"
ARTICLE 7. VOTED
to amend the By-Law relating to certain positions of employment and salaries in Highway, Moth, Tree, Park and Cemetery Departments, Public Libraries and General Government of the Town of Lynn- field, accepted in Article 2 of the Special Town Meeting of June 25, 1951 (Chapter 19 - Town of Lynn- field By-Laws), and subsequently amended, also Article 2 of the Special Town Meeting of June 17, 1963, by establishing all hourly PAY RATES AND CLASSIFICATION in accordance with the salary sched- ule as specified on page 5 of the recommendations of the Finance Committee provided, however, that no incumbent now employed shall suffer any loss or decrease in compensation.
