On motion made by Mr. Moynihan, Chairman of the Finance Committee, duly seconded, it was VOTED to raise and appropriate and appropriate by transfer from Available Funds, on items recom- mended, sums of money for the necessary Town charges and expenses, together with the authority to credit the value of old equipment to be turned in toward the purchase price of new equipment; said sums of money to be expended under the direction of the respective Boards, Committees or Officers of the Town in the amounts and for such purposes only as recommended for 1964 in the report of the Finance Committee or amendments thereto.


Following are the amendments of the Finance Committee to the budget article :


Item 40 - Change to $3,250.00 instead of $5,075.00 (Police Department - Capital Outlay). To be used for 1 police cruiser and 1 radar machine. (Final vote changed this amount to $1,750.00)


Item 43 - Change Fire Department Salaries re Fire Prevention from 600 hrs. at $1.80 per hour to 409 hrs. at $2.50 per hr.

The meeting was called to order at 8:00 p.m. by Mr. Kimball.


Unanimous consent was given to the admittance of specified unregistered voters of the Town.


On motion of Mr. Wendt, Chairman of the Board of Selectmen, it was unanimously voted to ad- journ to Monday, March 16, 1964 at 8:00 p.m. in the High School Auditorium and Gymnasium, if nec- essary, if the business of the meeting was not completed in this second session.

With all the items of Article 8 acted on, it was UNANIMOUSLY VOTED to accept the article with amendments in its entirety.


A motion to reconsider action on this entire article was defeated.

ARTICLE 9. VOTED


that the Town raise and appropriate $22,000 .- $5,500. to be raised in the Tax Levy and $16,500. to be transferred from Available Surplus Funds - for the construction of Chapter 90 Highways in ac- cordance with the provisions of Chapter 90 of the General Laws - the money to be used for the straight- ening of Salem Street.


ARTICLE 10. VOTED


that the sum of $9,143.34 be transferred from Available Surplus Funds to Chapter 782 to recon- struct Chestnut Street for a distance of 1,800 feet from Main Street, said sum to revert back to Available Surplus Funds when reimbursed by the Commonwealth.

ARTICLE 11. VOTED


that the sum of $5,764.00 be raised in the Tax Levy to reconstruct LOCUST STREET for a dis- tance of 600 feet.


ARTICLE 12. VOTED


that the sum of $10,000. be raised in the Tax Levy to be used to rebuild the dam on Pillings Pond at Summer Street, improve the drainage at Nells Hole and other locations in the Town where necessary, and to clear the channels and brooks in other areas in the Town where such action is needed or neces- sary, said work to be under the direction of the Road Commissioner.


After completion of action on Article 12, on motion of Mr. Condon, duly seconded, it was voted to adjourn to Monday evening, March 16, 1964, in the High School Auditorium.

Adjourned Town Meeting Held Monday, March 16, 1964


The meeting was called to order at 8:00 p.m. by Mr. John Kimball, Moderator.


Unregistered persons wishing to attend the meeting were admitted by unanimous consent of the vo- ters and were seated on the stage.


The first order of business was to take up action on ARTICLE 23.


Unanimous consent was received by the moderator not to read this article before the vote was taken, Mr. Kimball referring to it as the Selectmen-Executive Secretary Form of Government article as published in the recommendations of the Finance Committee on pages 26, 27, and 28.


The article was DEFEATED by a vote of 47 in favor, 419 opposed.


The article as appearing in the Finance Committee recommendations is noted below :


ARTICLE 23.


To see if the Town will vote to authorize the Board of Selectmen to take the necessary steps to fill with the Legislature the following act :


A Proposed Act Establishing A Selectmen-Executive Secretary Form of Government for the Town of Lynnfield


Section 1.


Upon the acceptance of this Act by the Town of Lynnfield, as hereinafter provided, the annual town elections of said town for the purpose of electing town officers and to take action on such mat- ters as are by law to be determined by ballot, shall be held on the first Monday of March in each year, and the annual meeting for the transaction of all other business shall be held on the second Monday of March in each year at 8:00 o'clock in the evening.


Section 2. Election of Selectmen, Terms, Vacancies.


There shall be three selectmen in the Town of Lynnfield. The selectmen in office at the first town election following acceptance of this Act shall continue in office until their successors are elected. At the first annual town meeting thereafter, the Voters shall elect one selectman for a three year term to replace the selectman whose term expires, and each year thereafter one selectman for a three year term. Vacancy by reason of death, resignation, change of residence from the town, or other disability, shall be filled by a special election in accordance with the provisions of Massachusetts General Laws, Chapter 41, Section 10.


Section 3.


The selectmen shall have and exercise all the powers, duties, and responsibilities now or hereafter conferred or imposed upon Boards of Selectmen by any provision of law. The selectmen shall be re- sponsible for formulating a general policy for administering the affairs of the town. They may direct and advise the executive secretary in any matters pertaining to the duties of his office hereinafter pro- vided for. They shall be responsible for the furnishing of information as to the affairs of the town, and may represent the town at public meetings and hearings. The selectmen shall receive such com- pensation, if any, as the town may by vote determine.

The Board of Selectmen shall appoint on merit and fitness alone, for a term not to exceed one year, and may remove for cause, the Town Counsel, Board of Appeals, Fire Chief, Superintendent of Public Works, Board of Public Welfare, Constables, Director of Civil Defense, Library Commissioners, and other officers and/or committees as hereinafter provided.


Section 4. Appointment of Executive Secretary.


Within a reasonable time after the acceptance of this Act, the selectmen shall appoint, for a term not to exceed three years, a town administrator to be designated as Executive Secretary, who shall be a person fitted by education, training, and experience, who may also qualify as an engineer to perform the duties af the office of Executive Secretary, as hereinafter provided and defined. He need not be a resident of the town or of this Commonwealth, when appointed, but shall, if so requested by the Board of Selectmen, reside in the town during his term of office. He may be appointed for successive terms of office, and in the event of his temporary absence or disability, the Board of Selectmen may appoint any suitable person to perform the duties of the Executive Secretary.


Section 5. Compensation of Executive Secretary.


The Executive Secretary shall receive such compensation, not exceeding the amount appropriated therefor, as the selectmen shall determine.


Section 6. Powers and Duties of the Executive Secretary.


(a) The Executive Secretary shall supervise, direct, and shall recommend for appointment by the selectmen, on merit and fitness alone, for such terms of office as the selectmen may deem appropriate, the Town Accountant, Town Clerk, Tax Collector and Treasurer, Veterans Director, Board of Health, Registrars of Voters, Building Inspector, Wire Inspector, Sealer of Weights and Measures, Dog Officer, and such other boards, officers, and committees as may be designated by the selectmen or the town meeting.


(b) Subject to the prior approval of the Board of Selectmen, the Executive Secretary may re- organize, consolidate or abolish departments, commissions, boards or offices under his jurisdiction, in whole or in part, and he may establish such new departments, commissions, boards or offices as he deems necessary, and in so doing, may transfer the duties and powers, and so far as possible, in ac- cordance with the vote of the town, the appropriations of one to another.


(c) The Executive Secretary, subject to the approval of the selectmen, and within the general wage scale established by town meeting, shall fix the compensation of all town officers and employees under his supervision.


(d) The Executive Secretary shall attend all regular meetings of the Board of Selectmen.


(e) The Executive Secretary shall keep full and complete records of his office, as determined by the Board of Selectmen, and shall render as often as may be required by the selectmen a full report of any operations under his supervision.


(f) The Executive Secretary shall keep the selectmen fully informed as to the needs of the town, and shall recommend to the selectmen for adoption such measures requiring action by them or by the town, as he may deem necessary or expedient.


(g) The Executive Secretary shall purchase all supplies, materials, and equipment, and shall award all contracts for all departments and activities of the town, except as otherwise provided by law.


(h) The Executive Secretary shall act as the personnel record officer of the town, and serve as ex officio clerk to the Wage Study Committee.


(i) The Executive Secretary shall administer, either directly, or by others reporting to him, all pro- visions of general and special laws applicable to the town, all by-laws, and all regulations established by the selectmen.


(j) The Executive Secretary shall have access to all town books and papers for information neces- sary for the proper performance of his duties. He shall establish such administrative procedures as may be required to provide for the proper accountability and control of all town assets, to provide for the proper recording and retention of all vital records of the town.


(k) The Executive Secretary shall be authorized to look into complaints, to make investigations, to conduct special studies, to file reports and make recommendations to the selectmen and the town meeting.

(1) The Executive Secretary shall have access to all town books, records, and papers. He may, without notice, cause the affairs of any department, or activity under his supervision, or the conduct of any officer or employee appointed by him, to be examined.


(m) The Executive Secretary shall perform such other duties consistent with his office, as may be required of him by the selectmen, by the town by-laws, and by the specific powers and duties provided hereinafter in this Act.


(n) Annual Budget and Approval of Warrants


1. All officers, boards, and commissions of the town shall submit to the Executive Secretary in writ- ing detailed estimates of their appropriations required for the efficient and proper conduct of their respective departments and officers, and such further information, in such form and at such times, as the Executive Secretary may require. On or before the fifteenth of November of each year, the Executive Secretary shall prepare and submit to the Finance Committee a bud- get for the ensuing year, and all supplementary information in such form and detail as the Fi- nance Committee may require.


2. Approval of Warrants


Warrants for the payment of town funds shall be submitted to the Executive Secretary. The selectmen may delegate specific authority in writing to the Executive Secretary to approve pay- ment of warrants and said delegations of authority shall be sufficient authority to authorize pay- ment by the town treasurer. Where this authority has not been delegated to the Executive Sec- retary, warrants must be approved by the selectmen.


3. Investigation of Claims


Whenever any payroll, bill, or other claim against the town is presented to the Executive Secre- tary, he shall, if the same seems to be of doubtful validity, excessive in amount, or otherwise contrary to the interests of the town, refer it to the selectmen, who shall immediately investi- gate, and determine what payment, if any should be made. Pending such investigation and de- termination by the selectmen, payment shall be withheld.


(0) The Executive Secretary shall supervise the administration of all departments and activities of the town, subject to the direction and advice of the Board of Selectmen, as hereinafter provided. With the approval of the selectmen, he may also supervise and direct such other activities and undertakings of the town, not otherwise subject to his supervision, as may be requested of him from time to time by the office, board or committee having control thereof.


(p) The Executive Secretary may appoint and remove all town employees, in any department, com- mission, board or offices, over which he has supervision and direction. Such officers or employees shall have the right of appeal to the Board of Selectmen, which shall act as a board of appeal, and said board shall, after full consideration, make a decision which shall be final.


Section 7. Removal of Executive Secretary


The selectmen, by a majority vote of the full membership of the Board, may remove the Executive Secretary, in accordance with the following provisions. At least fifteen days before such proposed re- moval shall become effective, the selectmen shall file a preliminary resolution with the town clerk setting forth in detail the specific reasons for his proposed removal, a copy of which resolution shall be sent by registered mail to the Executive Secretary. The Executive Secretary may reply in writing to the resolu- tion and may within said fifteen-day period request a public hearing. If the Executive Secretary so re- quests, the Board of Selectmen shall hold a public hearing not earlier than ten days nor later than fift- een days from the filing of such requests. After such public hearing, if any, otherwise at the expira- tion of thirty days following the filing of the preliminary resolution and after full consideration, the sel- ectmen, by a majority vote of the full membership of the Board, may adopt a final resolution of removal. In the preliminary resolution the selectmen may suspend the Executive Secretary from duty, but in any case his salary shall continue to be paid until the expiration of one month after the date of the final resolution of removal.


Section 8. Collector of Taxes and Town Treasurer


The existing office of Town Treasurer and the existing office of Collector of Taxes shall be merged into a single office and one person shall serve as Town Treasurer and Collector of Taxes. This person shall be appointed by the Board of Selectmen upon the recommendation of the Executive Secretary, and

shall have the powers, perform the duties, and be subject to the liabilities and penalties now or hereafter imposed by law upon town treasurers and town collectors of taxes. The separate existing offices of Town Treasurer and Tax Collector shall be continued until such time as the person appointed to both offices shall have qualified under this provision.


Section 9. Appointment of Board of Assessors.


There shall be a Board of Assessors consisting of three persons to be appointed by an appointive authority consisting of (1) the town moderator, (2) a member of the Board of Selectmen, and (3) a member of the existing Board of Assessors. In addition, there shall also be employed by the Board a full time qualified assessor to perform the actual duties of assessing property. At the first annual town meeting following acceptance of this Act, the said authority shall appoint one assessor for a three year term to replace the assessor whose term expires, and shall appoint each year thereafter one assessor, whose term also expires, for a three year term. If a vacancy occurs in the Board, the vacancy shall be filled forthwith by the aforesaid appointive authority. Upon the appointment and qualification of as- sessors as provided in this section, the terms of office of the members of the then existing Board of Assessors shall terminate. The assessors shall organize for the proper conduct of their duties and shall act primarily as a Policy and Review Board. The assessors shall possess all the powers and rights and be subject to all the duties and liabilities conferred or imposed by law upon assessors of towns.


Section 10. Town Clerk


The selectmen shall appoint, upon the recommendation of the Executive Secretary, a Town Clerk for a term of three years. The existing office of Town Clerk shall be continued until the tenure of the present incumbent terminates. The Town Clerk shall be under the supervision of the Executive Secre- tary and shall have the powers, perform the duties, and be subject to the liabilities and penalties now or hereafter conferred or imposed by law upon town clerks.


Section 11. Finance Committee


There shall be a Finance Committee consisting of nine members to be appointed by an appointing authority consisting of (1) the town moderator, (2) a member of the Board of Selectmen, and (3) a member of the Finance Committee. At the first annual town meeting following acceptance of this Act, the said appointive authority shall appoint three members for a three year term to replace the members whose terms then expire, and each year thereafter shall appoint three members for a three year term to replace the members whose terms then expire. The appointive authority shall forthwith fill any va- cancy that shall occur on the Board.


Section 12. Department of Public Works


The existing offices of Highway Commissioner, Park and Cemetery Commissioner, and Tree War- den and Moth Superintendent, shall be abolished. The highway department, the park and cemetery de- partment, and the tree and moth department shall be merged into one department, to be known as the Department of Public Works, which shall be under the direction and supervision of the Superintend- ent of Public Works. The said superintendent shall be appointed by the Board of Selectmen, and shall be under the direction and supervision of the Board of Selectmen.


The Department of Public Works shall be responsible for the care, maintenance, and operation of all town buildings and grounds other than schools and school grounds. It shall assume all the duties and functions heretofore performed or required by law to be performed by the highway department, the park and cemetery department, and the tree and moth department.


The Department of Public Works may, subject to the prior approval of the Board of Selectmen, perform such duties and functions as may be requested by any other department of the town, includ- ing, but not limited to, the following : the School Department, the Planning Board, and the Conserva- tion Commission.
