RECORD OF ACTION TAKEN AT SPECIAL TOWN MEETING HELD JUNE 17, 1963 IN THE HIGH SCHOOL AUDITORIUM
Pursuant to the foregoing warrant, the legal voters of the Town of Lynnfield met in the High School Auditorium in the said Town of Lynnfield on Monday, June 17, 1963.
The meeting was called to order at 8:05 P.M. by John H. Kimball, Moderator, who then pro- ceeded to read the call for the meeting. Unanimous consent was given to the admission of certain unregistered voters.
The part of the warrant preceding the articles was read by the Moderator. On motion made and duly seconded it was now voted to dispense with the further reading of the articles of the war- rant until taken up for action. That part of the warrant following the articles, including the signa- tures of the Selectmen and the return of service of the constable was then read by Mr. Kimball.
ARTICLE 1.
VOTED UNANIMOUSLY to amend Chapter 2 of the By-Laws of the Town of Lynnfield by adding thereto the following item:
There shall be a Wage Study Committee consisting of five (5) members who shall be appointed by the Board of Selectmen no later than April 15th of each year as follows :
One (1) member shall be appointed in 1963 for a term of one year.
Two (2) members shall be appointed in 1963 for a term of two years. Two (2) members shall be appointed in 1963 for a term of three years. Thereafter members shall be appointed each year for a term of three years.
Within thirty (30) days after such appointments, the Wage Study Committee shall meet and organize, elect a Chairman and shall cause to be kept a true record of its proceedings.

The Wage Study Committee shall be authorized to obtain the services of a Clerk to maintain all records and to keep a true record of its proceedings. The remuneration for said clerk shall be as established at a Town Meeting.
Said Committee shall serve in an advisory capacity to the Town. All salary changes or class- ification changes for any town employee or position of the Town shall first be referred to the Wage Study Committee and a recommendation shall be made by the Committee, or if thirty (30) calen- dar days shall elapse from date of submission and no report is made, it shall be assumed that the Committee's recommendation is favorable to the proposed change, but the Town may take any ac-
tion it desires at a Town Meeting regardless of whether or not the foregoing requirements have been met.
The duties of the Committee shall be as follows :
1. Make a continuing analysis and evaluation of the jobs and positions involved in the conduct of the business activities of the Town of Lynnfield.
2. Maintain a salary and rate structure for the Town and make recommendations for any changes necessary to maintain a pay scale representing satisfactory and proper remuner- ation for work performed. This includes rates, wages, salaries, fees and/or fringe benefits.
3. Secure formal job descriptions for each position from Department Head, copies of which shall be available to all interested Committees or Boards and employees.
4. The Wage Study Committee and Finance Committee shall meet to review recommendations not later than November 1, each year.
ARTICLE 2.
VOTED UNANIMOUSLY to amend the By-Law relating to certain positions of Employment and Salaries in Highway, Moth, Tree, Park and Cemetery Departments, Public Libraries and Gen- eral Government of the Town of Lynnfield, as accepted in Article 2 of the Special Town Meeting of June 25, 1951 (Chapter 19 - Town of Lynnfield By-Laws), and subsequently amended, by adding the following item which has been recommended by the Wage Study Committee, to the General Government Group directly following the item "Veterans' Services, Director of":

ARTICLE 3.
VOTED to transfer from Available Funds in the treasury the sum of $60.00 for the remunera- tion of the Wage Study Committee Clerk to cover the balance of 1963.
ARTICLE 4.
VOTED UNANIMOUSLY to transfer from Available Funds the sum of $200.00 to Item 24, of Article 9, Town Clerk Salaries as enacted at the 1963 Annual Town Meeting.
ARTICLE 5.
On motion of Mr. Palizzolo, duly seconded, it was unanimously VOTED to indefinitely postpone action on this article, namely :
"To see if the Town will vote to transfer from available funds a sum of money to Item 4, of Article 9, Accountant Salaries, as enacted at the 1963 Annual Town Meeting."
ARTICLE 6.
A motion made by Mr. Brady to have this article and article 7 taken up together was defeated. Also, a motion by Mr. Moynihan, Chairman of the Finance Committee, to have a secret ballot on this article was defeated.
VOTED 297 in favor, 184 opposed, to accept Chapter 19 of the Acts of 1963 providing for the establishing an alternate schedule of minimum annual compensation for Police Officers in the Town of Lynnfield.
For the first year of service fifty-five hundred dollars.
For the second year of service six thousand dollars.
For the third and each succeeding year of service sixty-three hundred dollars.
A motion to reconsider this article was defeated, 239 opposed, 197 in favor.

ARTICLE 7.
VOTED 263 in favor, 70 opposed to transfer from Available Funds the sum of $4500.00 to cover the necessary increases in the salaries of the Police Department.
Before action on Article 8 was completed, a motion made and duly seconded to reconsider action on Article 7 was defeated.
ARTICLE 8.
On motion by Mr. Palizzolo, duly seconded, it was VOTED 129 in favor, 81 opposed to in- definitely postpone this article, namely :
"To see if the Town will vote to transfer from Available Funds a sum of money for the purposes of retaining professional services to evaluate the insurance program of the Town, to be expended by the Board of Selectmen."
ARTICLE 9.
VOTED UNANIMOUSLY to transfer from Available Funds the sum of $1,046.15 to pay a past debt due to Maurice Day, an employee of the Town.
There being no further business to come before the meeting, on motion by Mr. Condon, duly seconded, it was unanimously voted to adjourn sine die and so ordered by the Moderator.

VOTED 358 in favor, 10 opposed, to appropriate $120,000.00, in addition to amounts previ- ously appropriated, for constructing, originally equipping and furnishing a school building on town- owned property on Essex Street formerly known as the Laubner, and the Melch Bros. property and that to raise this amount $10,000.00 be transferred from Available Surplus Funds, and that the Treasurer, with the approval of the Selectmen, be authorized to issue $110,000.00 in bonds or notes under Chapter 44 of the General Laws as amended, so that the whole loan shall be paid in not more than ten years from date of issue of the first bond or note, provided, however, that no part of the funds herein appropriated shall be expended for equipping and furnishing the said school building.
There being no further business to come before the meeting, on motion by Mr. Condon, duly seconded, it was unanimously voted to adjourn sine die and it was so ordered by the Moderator.

ARTICLE 1.
On motion made by Mr. Ralph Howland, Town Counsel, duly seconded, it was VOTED UNANIMOUSLY to appropriate by transfer from available funds in the treasury, the sum of $20,500. to settle the Eminent Domain case arising from action of the Town at the Annual Town Meeting of 1962 in taking approximately 36.1 acres, more or less, of land of Dennis Laubner.
ARTICLE 2.
On motion made by Mr. Ralph Howland, Town Counsel, duly seconded, it was VOTED UNANI- MOUSLY to appropriate by transfer from available funds in the treasury, the sum of $700. to settle the Eminent Domain case arising from action of the Town at the Annual Town Meeting of 1962 in taking approximately 1 acre, more or less, of land of Melch Bros.

ARTICLE 3.
On motion made by Mr. Ralph Howland, Town Counsel, it was VOTED to authorize the Select- men to dispose of the police cruiser recently damaged in an accident for the best offer it can secure therefor.
ARTICLE 4.
On motion of Mr. John Rodgers, Chairman of the Municipal Office Building Committee, it was voted 125 in favor, 52 opposed, to appropriate by transfer from available funds in the treasury, the sum of $13,000. to be expended under the supervision of the Municipal Office Building Committee for the purpose of completing the cupola of the aforementioned Municipal Office Building.
By way of explanation, Mr. Rodgers broke down the $13,000. figure as follows: $12,000. for the cupola and $1,000. for architect's fees.
A motion to indefinitely postpone action on this article was lost.
At this time, on motion by Mr. Charles Kessler, duly seconded, and amended by Mr. Ralph Howland, town counsel, it was VOTED to adjourn the town meeting sine die, and it was so or- dered by the Moderator.
With this vote of the meeting, the following articles of the warrant were left without action being taken :
ARTICLE 5.
To see if the Town will vote to authorize the Board of Selectmen to take the necessary steps to file with the legislature the following act:
A PROPOSED ACT ESTABLISHING A SELECTMEN - EXECUTIVE SECRETARY FORM OF GOVERNMENT FOR THE TOWN OF LYNNFIELD.
Section 1.
Upon the acceptance of this Act by the Town of Lynnfield, as hereinafter provided, the annual town elections of said town for the purpose of electing town officers and to take action on such mat- ters as are by law to be determined by ballot, shall be held on the first Monday of March in each year, and the annual meeting for the transaction of all other business shall be held on the second Monday of March in each year at 8:00 o'clock in the evening.
Section 2. Election of Selectmen, Terms, Vacancies.
There shall be three selectmen in the Town of Lynnfield. The selectmen in office at the first town election following acceptance of this Act shall continue in office until their successors are elected. At the first annual town meeting thereafter, the Voters shall elect one selectman for a three year term to replace the selectman whose term expires and each year thereafter one selectman for a three year term. Vacancy by reason of death, resignation, change of residence from the town, or other disability, shall be filled by a special election in accordance with the provisions of Massachusetts General Laws, Chapter 41, Section 10.
Section 3.
The selectmen shall have and exercise all the powers, duties, and responsibilities now or here- after conferred or imposed upon Boards of Selectmen by any provision of law. The selectmen shall be responsible for formulating a general policy for administering the affairs of the town. They may direct and advise the executive secretary in any matters pertaining to the duties of his office hereinafter provided for. They shall be responsible for the furnishing of information as to the af- fairs of the town, and may represent the town at public meetings and hearings. The selectmen shall receive such compensation, if any, as the town may by vote determine.
The Board of Selectmen shall appoint on merit and fitness alone, for a term not to exceed one year, and may remove for cause, the Town Counsel, Board of Appeals, Fire Chief, Superintendent of Public Works, Board of Public Welfare, Constables, Director of Civil Defense, Library Com- missioners, and the Executive Secretary, and other officers and/or committees as hereinafter provided.
Section 4. Appointment of Executive Secretary.
Within a reasonable time after the acceptance of this Act, the selectmen shall appoint, for a term not to exceed three years, a town administrator to be designed as Executive Secretary, who

shall be a person fitted by education, training, and experience, who may also qualify as an engi- neer to perform the duties of the office of Executive Secretary, as hereinafter provided and de- fined. He need not be a resident of the Town or of this Commonwealth, when appointed, but shall, if so requested by the Board of Selectmen, reside in the town during his term of office. He may be appointed for successive terms of office, and in the event of his temporary absence or disability, the Board of Selectmen may appoint any suitable person to perform the duties of the Executive Secretary.
Section 5. Compensation of Executive Secretary.
The Executive Secretary shall receive such compensation, not exceeding the amount appropri- ated therefore, as the selectmen shall determine.
Section 6. Powers and Duties of the Executive Secretary.
(a) The Executive Secretary shall supervise, direct, and shall recommend for appointment by the selectmen, on merit and fitness alone, for such terms of office as the selectmen may deem appro- priate, the Town Accountant, Town Clerk, Tax Collector and Treasurer, Veterans Director, Board of Health, Registrars of Voters, Building Inspector, Wire Inspector, Sealer of Weights and Mea- sures, Dog Officer, and such other boards, officers, and committees as may be designated by the sel- ectmen or the town meeting.
(b) Subject to the prior approval of the Board of Selectmen, the Executive Secretary may re- organize, consolidate or abolish departments, commissions, boards or offices under his jurisdiction, in whole or in part, and he may establish such new departments, commissions, boards or offices as he deems necessary, and in so doing, may transfer the duties and powers, and so far as possible, in accordance with the vote of the town, the appropriations of one to another.
(c) The Executive Secretary, subject to the approval of the selectmen, and within the general wage scale established by town meeting, shall fix the compensation of all town officers and em- ployees under his supervision.
(d) The Executive Secretary shall attend all regular meetings of the Board of Selectmen.
(e) The Executive Secretary shall keep full and complete records of his office, as determined by the Board of Selectmen, and shall render as often as may be required by the selectmen a full report of any operations under his supervision.
(f) The Executive Secretary shall keep the selectmen fully informed as to the needs of the town, and shall recommend to the selectmen for adoption such measures requiring action by them or by the town, as he may deem necessary or expedient.
(g) The Executive Secretary shall purchase all supplies, materials, and equipment, and shall award all contracts for all departments and activities of the town, except as otherwise provided by law.
(h) The Executive Secretary shall act as the personnel record officer of the town, and serve as ex officio clerk to the Wage Study Committee.
(i) The Executive Secretary shall administer, either directly, or by others reporting to him, all provisions of general and special laws applicable to the town, all by-laws, and all regulations estab- lished by the selectmen.
(j) The Executive Secretary shall have access to all town books and papers for information necessary for the proper performance of his duties. He shall establish such administrative proce- dures as may be required to provide for the proper accountability and control of all town assets, to provide for the proper recording and retention of all vital records of the town.
