1656, Oct. He and others were brought to trial at Boston. He came into court with his bat on and confessed he Inud forsaken the ordinances and resorted to the Quakers, and he and the others were banished on pain of death. 1657, Mar. 15. The jury appointed to view the corpse of Simon Davis, late deceased, two years old son of Nicholas Davis; declared that the corpse was taken out of the water in the creek dend, but could not find any violence offered to him that might be cause of death.
1659, Jun. He, having left Barnstable " to reckon with those with whom he traded in Boston and to pay some debts," was appre-| hended and sent to prison and sentenced by the court to banishment upon pain of death if after the 14th of September following he should be | found in jurisdiction of Massachusetts, While he was in court " seeing how slightly they made of the Marshal's cruelty, his wicked and unjust usages of them, destroying their cattle," &c., " the said Nicholas spreading his arms abroad spoke in testimony and zeal that he was a wit- Dess for the Lord against their oppression, and would have declared wherein, but they suffered him not to speak, but committed him to prison."
