Application being made by the Board of War of this State for a Sum of Money put into the hands of their Commissary, and for other purposes, An order was drawn on the Treasurers of the State in favor of the Chairman of the said Board of War, for the Sum of Two Thousand Pounds.


Colo. Morgan, Lieutenant of the County of Berks, attended the Council, and requested to be furnished with One hundred and Fifty Stand of Arms; thereupon,


An order was drawn on the Continental Board of War for One hundred and fifty Stand of Arms, to be delivered to Jacob Morgan, Esq'r, Lieutenant of the County of Berks, and also One Thousand Five Hundred Flints.


An order was drawn on the Treasurer of the State in favor of the aforesaid Colo. Morgan, for the Sum of Five hundred Pounds.


The Council having taken into consideration the returns of Jus- tices from the several Districts of the County of Northumberland, Agreed, That the following Gentlemen be Commissioned as Justi- ces in the said County, Viz : Samuel Hunter, Thomas Hewitt, Robert Crawford, John Weitzel, Robert Martin, Michael Troy, John Livingston, Samuel Allen, John Aurand, William Shaw.


Ordered, That Samuel Hunter and Tho's Hewitt be Commis- sioned to administer to the Justices of the County of Northum- berland, the Oaths or affirmations required to be taken by them by the Constitution of this Commonwealth.


The Townships of Bald Eagle and Munsey not having made their returns according to Law, Justices for these Townships not to

Mr. Egar and Mr. Dunwiddee informed the Council that Charles Lukens, Sheriff elect of the County of York, declines serving in that Office.


The Council took into consideration the returns of Justices elected in York County, and Agreed, That the following gentlemen be appointed Justices of the Peace for the County of York, and Commissioned accordingly, Viz : David McCannaughy, Richard Mc- Allister, William McClean, William Scott, William Leas, David Jameson, Josiah Scott, William Smith, Sam'l Ewin, David Wat- son, John Chamberlin, Andrew Thompson, John Hinkle, John Har- bach, Robert Stephenson, Archib'd McClean, James Nailor, Thomas Douglas, Dan'l Messerly, Benja. Colo. William Henry attended the Council, & he was requested to Summon the Sub-Lieutenants and direct them to exert them- selves to Arrange the Militia of the City of Philadelphia, and hold them in readiness, effectually to oppose the enemy on the shortest notice.


The Speaker of the Hon'ble House of General Assembly having informed His Excell'y the President, that the House desired a Con- ference with the Council, And his Excellency now laying the same. before the Board, Agreed, That the Council will meet the House in conference this Afternoon at 3 O'Clock.


Benja. Brannon, Esq'r, Sub-Lieutenant of the County of Ches- ter, informing the Council that there were several Companies of Artillery Men formed in that County, and requested that they may be furnished with a Piece of Artillery proper for exercising the

Men, and also a few Pounds of Powder for practising the Firings with ;


Ordered, That Colo. Sam'l Mifflin be requested to deliver to Colo. Brannon a proper Piece of Artillery for exercising a Company, and Twelve Pounds of Powder.


On motion, Agreed, That James Young, John Ord, Plunket Flee- son, Isaac Howell, and Philip Boehm, be appointed Judges of the City Court, and Commissioned Accordingly.


On Motion, Agreed, That John Haley, Esq'r, be appointed Clerk of the said Court and Commissioned Accordingly.


The Council being informed of a Dissatisfaction among some of the People, at the present frame of Government, Agreed that the following representation be made to the General Assembly, to wit :


" To the Hon'ble the Representatives of the Freemen of the Common- wealth of Pennsylvania in General Assembly met:


" The Supreme Executive Council of the said Commonwealth beg leave to represent :


" That they are sorry to find the present Constitution of this State so dissatisfactory to any of the well affected Inhabitants thereof, and would gladly concur in any suitable and safe measure for the removal of this uneasiness; That they are of opinion this might be greatly attained by taking the sence of the Majority of the Elec- tors throughout the Counties on the important Question, whether a Convention be holden at some proper time to reconsider the frame of Government formed by the late Convention ? That to fix the exact mode of obtaining the mind of the Majority on this subject, most properly belongs to their Representatives; That the Council hope that if some suitable mode of advising & getting the People at large to declare themselves, and if this were advised and pub- lished at this time, great ease and relief would be thereby given to some persons who are dissatisfied as aforesaid ; and that unanimity in the common cause, so necessary at this time, will be promoted.

The Council took into Consideration the returns of Justices for the County of Westmoreland, and Agreed to appoint the following Gentlemen for Justices of the said County, Viz : Edward Cook, John Guthrey, Charles Forman, John More, James Marshall, Christ'n Truby, Philip Rogers, Joseph Huston, Robt. Adams, James Bair, Hugh Martin, Jas. McGarraugh, John Beard, Andrew Robb, Robt. Richy.


Ordered, That they be Commissioned accordingly.

SUPREME EXECUTIVE COUNCIL.


Ordered, That a Dedimus potestatum be issued to Archibald Locky, Edward Cook, and John More, of the County of Westmore- land, to administer to the Justices of the said County the Oaths or Affirmations required to be taken by them by the Constitution of this Commonwealth.


On motion, Agreed, That the Prothonotaries of the several Coun- ties be appointed and Commissioned to be Judges of the Court of Common Pleas in their respective Counties.

Application being made by the Board of War and the Navy Board, for a sum of Money to each of them ; thereupon,


An order was drawn on the Treasurer of the State in favor of the Chairman of the Board of War, (or his order,) for the sum of Two Thousand Pounds, for which that Board is to Account.


An order was also drawn on the Treasurer of the State in favor of the Chairman of the Navy Board, (or his order,) for the Sum of Two Thousand Pounds, for which that Board is to account.


William Lyons, Esq'r, Prothonotary of the County of Cumber- land, appeared in Council, and took the Oaths required by the Constitution to qualify him for that Office.

Agreed, That James Claypoole be appointed Sheriff of the County of Philadelphia.

A Circular Letter to the Lieutenants of the Counties of Chester, Lancaster, and York, Philadelphia, Bucks, Cumberland, Berks, and Northampton, was this day written, to forward the first Class of the Militia immediately, and to hold the second Class in readi- ness to march at the shortest notice. In the several Letters now written to the Lieu'ts, the Sum of Money sent as mentioned.


An order was drawn on the Treasurer of the State in favor of Colo. Robert Smith, Lieutenant of the County of Chester, for the Sum of One Thousand Pounds, for which he is to account.


An order was also drawn on the Treasurer in favor of John Weitzel, Esq'r, Lieutenant of the County of Northampton, for the Sum of One Thousand Pounds, for which he is to account.

Ordered, That the Lieutenants of the Counties of Philadelphia, Chester, & Berks, be desired to send, Viz. : Philadelphia, Thirty Waggons, Chester, Forty Do., Berks, Thirty Do.


The Council taking into their consideration the appointing of Burgesses, Assistants, and other Officers, for the Borough of Lan- caster, Agreed that William Bausman & Casper Shaffner be appoint- ed Burgesses, and that William Bausman shall be called Chief Burgess within the said Borough ; and Paul Zantzinger, Christ'r Crawford, Matthias Graaf, Will'm Ross, Adam Reigart, & Ludowick Stone, Assistants; Peter Rowhigh, Constable, & Peter Shaffner, town Clerk, of the said Borough of Lancaster.

Order on the Contenental Board of War to Capt. Dougherty, for Thirty-five stand of Arms & accoutrements, for a Company of Volunteers, who propose to turn out with two Pieces of Cannon.


His Excell'y reports that the President of Congress had delivered to him an order on the Continental Board of War for One thousand stand of Arms, and that he had endorsed the same to Capt. John Campbell, of the City Guards.


Capt. Moulder applied for Sixty belts, Sixty Knapsacks, Sixty Cartridge boxes, & Sixty Canteens, and an order was drawn on the Board of War of this State for the same.


A Company of Artillery offering their service to the Public, and the Officers of it requesting to be Commissioned ; thereupon,


Ordered, That the following Gentlemen be Commissioned as Officers of the said Company, Viz. : Henry Daugherty, Capt. ; Win- gate Newman, Capt .; Lieu't James Craig, 1st Lieu't; Alex'd Henderson, 2d Lieu't; Will'm Greenway, Lieut's fire-worker.


The following resolution of Congress was before the Board, and read, Viz. :

"In Congress Assembled, Saturday 14th June, 1777.


" Resolved, That Maj'r Gen'l Arnold be authorized to take upon him the Command of all the Militia now at Bristol, and in every other part of the River to the Eastward of Philadelphia, which have been called forth into service by a requisition of the 24th Day of April last, & that he be authorized to dispose of himself & the Troops under his Command, in such a manner as he shall Deem best adapted to promote the Public Service."


Ordered, That a Copy of the foregoing resolution be sent to the President and Supreme Executive Council of the State of Pennsyl- vania for their concurrence.


On motion,


Ordered, That the 2d Class of the Militia of the County of Philadelphia, Chester, Bucks, Lancaster, York, Cumberland, Berks, & Northampton, be Ordered to march to the places to which the first Class of the said Counties respectively are ordered ; and that the third Class be got in readiness to march, and also that the 1st and 2d Class of the City Militia be ordered to march for Bristol, & that the 3d Class hold themselves in Readiness to march at the shortest warning.


On motion.


Resolved, That the 1st class of the Militia of the County of Northumberland, be ordered to march to Bristol, and that the 2d be got in readiness to march at the shortest notice. As the great demand for money has drained our Treasury, and a Considerable Sum is immediately wanted for paying of substitutes and other purposes, necessary to get the Militia ready for the field, and the Money ordered to be struck by the General Assembly cannot be signed in time; thereupon,


Resolved, That Application be made to Congress to lend the Council the Sum of Fifty Thousand Dollars, to be repaid in a few days, so as that it may not pass to the General Account of the State.


The Secretary laid before the Council a Letter which he this Day received from John Kidd, Esq'r, dated the 31st May, wherein he expressed that he is obliged to decline the honor of becoming one of the Executive Council, on account of bis state of health.

Agreed, That Colo. Bull be appointed Adjutant Gen'l of the Militia of this State.


On Motion, agreed, That Colo. Walter Stewart be appointed Colo. of the State Regiment in the room of Colo. Bull, who is promoted to be Adjutant General.


One of the Delegates of this State in Congress, informed the Council that Congress had ordered twenty Copies of their minutes to be Delivered to this State.


Ordered, That the Secretary apply for the said minutes, retain them in his hands, to be disposed of as the Council shall direct.


Capt. Montgomery attended the Council with a Message from Gen'l Mifflin, informing the Council that Gen'l Sullivan had or- dered the Militia collected at Coryel's Ferry to march forward to- ward the Enemy in New Jersey, and that is, therefore, necessary to send a number of the militia to occupy that Post, which is now entirely vacant.


Jonath'n Bayard Smith, Esq'r, sent in by the Secretary, a draft of Congress, signed by the Speaker, on John Gibson, Esq'r, Au- ditor General, for the Sum of Fifty Thousand Dollars, payable to the Hon'ble The President & Supreme Executive Council of the State of Pennsylvania, or their order, it being advanced to said. State, for which it is to be accountable. -


Ordered, That the same be made payable to Dav'd Rittenhouse, Esq'r, Treasurer of the State.


Ordered, That a Draft be made out on Dav'd Rittenhouse. Esq'r, Treasurer, in favor of John Maxwell Nesbitt, Esq'r, Trea- surer of the Board of War, for the Sum of Twenty Thousand Dollars, for which sum he is to account.


An order was also drawn on the Treasurer, in favor of Lewis Granow, Esq'r, Sub-Lieutenant of the County of Chester, for the Sum of Four Thousand Dollars, to be charged to Robert Smith, Esq'r, Lieutenant of the said County, for the purpose of procu- ring Substitutes, Blankets, &c.

The Council taking into consideration the case of Jos. Richard- son, now confined in the Gaol of the County of Lancaster, where he has been for near Four Months, on a charge of Counterfeiting and uttering the Bills of Credit of New Jersey, &ca, & no applica- tion having been made to this State respecting him ; thereupon,


Resolved, That the said Jos. Richardson be enlarged, on giving reasonable bail for his appearance, &ca, to answer the said charge.


An order was drawn on the Continental Board of War for One Thousand stand of Arms, to be delivered to Colo. Bull, Adjutant General of the State.

An order was drawn in his favor on Dav'd Rittenhouse, Esq'r, Treasurer, for the Sum of Thousand Dollars, to be applied in pro- curing Substitutes, and purchasing Blankets, &ca.


A letter from Rich'd Peters, Esq'r, Secretary to the Continental Board of War, enclosing the following Resolves of Congress of the Ist April, was presented by his Excell'y, the President of the Board, and read, viz :


"By the United States in Congress assembled. " April 1st, 1777.


" Resolved, That no Officer already appointed, or to be hereafter appointed, in the Army of the United States, shall take rank by virtue of a Commission antedated, but Rank shall be determined by the time of appointment, unless otherwise directed by special resolution of Congress.


" Resolved, That it be recommended to the Legislatures, and in their recess to the Executive Powers of the respective States, that they forthwith transmit to the Board of War exact lists of all offi- cers appointed by them in the Continental Army, with the date of their Commissions, and time of appointment."

Ordered, That a Copy of said Resolves & Letter be transmitted to the Board of War, and that the said Board be requested to furnish this Council with the List of Officers appointed by this State, with the times of their appointment, and the dates of their Commissions, and an account of all Monies expended on account of Prisoners of War.


The following Resolve of the General Assembly being laid before the Council was read, viz. :


"In General Assembly, Tuesday June 10th, 1777.


" General Mifflin desired leave to be introduced into the House ; which being done, he informed that he had it in charge from His Excell'y Gen'l Washington, to Assure them that it was his firm opinion that the Enemys Army meditated a sudden & immediate attack upon some part of this State, and that he, therefore, ear- mestly requested that the Militia of this State, and particularly of this City and its neighbourhood, might be ordered to hold them- selves in readiness to march at a moment's warning to such parts as may be necessary." It was thereupon,


Ordered, that Dr. Gardner & Mr. M'Clean, be a Committee to wait on the President and Council, and inform them of the said intelligence, and request them, in the name of this House, to take the most speedy & effectual measures to answer the purposes of His Excell'y the General's message, & to frustrate the hostile intentions of the Enemy ; thereupon,


Ordered, That a Copy of the said Resolve be delivered to the Delegates of this State in Congress, and that they be requested to transact this business with Congress in the way they shall think most proper.


Ordered, That application be made to the Board of War for an estimate of the Expences of levying & clothing the State Battalion now commanded by Colo. Stewart, The Regiment of Artillery com- man ded by Colo. Proctor, and the Company under Capt. Pugh, with the state of the said Battalions & Company.


Colo. Kirkbride applied for a further Sum of Money to procure Substitutes in the room of such of the Militia as refuse or neglect to go into service ; thereupon,


An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer, in favor of Colo. Kirkbride, for the Sum of Two Thousand Dollars, for the purpose of procuring Substitutes, &ca.

His Excell'y the President laid before the Council a Letter from Gen'l Arnold, dated 18 June, 1777, enclosing Copy of a Letter from his Excell'y Gen'l Washington, relative to fortifying Delaware River.


James Young, Esq'r, attended in Council, & took the Oath re- quired by the Constitution to Qualify him to act as a Justice for the City & County of Philadelphia.


An order was drawn on the Board of War of this State in favor of Will'm Henry, Esq'r, Lieutenant of the City, for as many Knapsacks, Canteens, &ca., as he may call for.


Mr. Parker, a member of the Hon'ble House of General Assem- bly, laid before the Council the following Resolve of the Hon'ble House, viz :


"In General Assembly, Thursday June 19, 1777.


'' On motion,


"Resolved, That the President and Council be Authorized & impow- ered to borrow from the Congress any sum of Money not exceeding One Hundred Thousand Dollars, to answer the immediate exigen- cies of the State, and to be repaid in a very short time, out of the moneys now issuing by virtue of the Two Hundred Thousand Pounds Act enacted at the last sitting of this House.

On motion, agreed, That a Copy of the Resolve of General As- sembly, empowering this Council to borrow of Congress 'the Sum of One Hundred Thousand Dollars, be delivered to the Delegates of this State in Congress, and the President is desired to write to the Hon'ble John Hancock, Esq'r, President of Congress, re- questing that Congress will lend to this State the Sum of Fifty Thousand Dollars, in addition to the like Sum already borrowed of them, to serve the present emergency.


Mr. Proctor reports that Rob't Levers, Esq'r, appeared before him some time ago, and took the Oaths required by the Constitu- tion to qualify him to act as Prothonotary of the County of North- ampton, and Qualify the Magistrates of that County.

The great inconveniences arising from the Waggoners bringing their Waggons into the State House Yard, & the noise of the Drums, which greatly incommodes, not only the Council, but also the Con- gress and General Assembly, whenever the Companies or Battal- ions exercise or Parade in the Yard, & having been observed by the Council with great concern ; thereupon,


Ordered, That no Drums be admitted into the State House Yard, & that the Waggoners be forbid to bring their Waggons into the State House Yard without permission so to do.
