Ordered, That Jacob S. Howell, 'do immediately take the neces- sary measures, in conjunction with Mr. James Meas, to have the Linens purchased by his Excell'y the late President, of John Max- well Nesbitt, Esquire, brought from Maryland, where they now are, to this City.


The Council having now determined to employ Colonel John Bull to direct the Workmen, & to complete the works ordered by this Council at Billingsport & Mud Island, It now Agreed, That Colo. Bull be allowed for the aforesaid service the Sum of Three Pounds # Diem, & forage at Billingsport for one horse.


Col. Bull having recommended Mr. Will'm Armstrong as Pay- master & Steward at Billingsport & Mud Island,


Ordered, That Mr. Will'm Armstrong be appointed Paymaster & Steward at Billingsport & Mud Island, & that his pay be Twen- ty-five Shillings $ diem.


An order was drawn on the Treasurer in favor of Capt. Will'm Oldham, of the 5th Pennsylvania Reg't, or his order, for the Sum of One thousand & five hundred Dollars, for the recruiting Service, to be charged to his acco't.


Ordered, That Mr. Rob't Alison be directed to deliver to Col. Bull such of the Plank & other Timber, Spikes, &ca., taken from the Redoubts of the Enemy, as he may have occasion, for to com- plete the works ordered to be erected at Billingsport & Mud Island, & also one or two of the Guard Houses, for Barracks.

Col. John Proctor, Paymaster of Militia for the County of West- morland, having requested that a Sum of Money may be sent to him to Pay the Militia of that County with, & Moses Watson, of the said County, being now here for the purpose of carrying the Money to Col. Proctor;

An order was drawn on the Treasurer in favor of Ensign Will'm Snyder, of the 6th Pennsylvania Reg't, or his order, for the Sum of Eight Hundred Dollars, for the recruiting service, to be charged to his account.


Ordered, That Mr. Will'm Crispin be directed to supply the Workmen at Billingsport & Mud Island with provisions.


Ordered, That Dr. Berkenhout be sent within the Enemies' lines near the City of New York, and that he be escorted by some suitable person, who shall have in charge to prevent the Doctor from receiving any Letters for that City.


Ordered, That the following Gentlemen be appointed Officers of the Chatham & Hancock Galleys in the service of this State, Vizt : George Meyers, first Lieutenant; & John McClance, second Lieu- tenant of the Chatham Galley ; And Nicholas Fitzsimmons, first Lieutenant; and Joseph Quality, second Lieutenant of the Han- cock Galley ; And That commissions be made out accordingly.

Ordered, That Capt. Hazlewood be directed to obey the War- rant of the Hon'ble Chief Justice in conducting Fitzpatrick from this City to the Borough of Chester, & also in conducting such other Prisoners as the Chief Justice shall order to be removed.


An order was drawn on the Treasurer in favor of Col. Will'm Clark, for the Sum of five Thousand Pounds, for the purpose of paying the Militia of the County of Cumberland, to be charged to his account.


Ordered, That the Secretary apply to Commodore Hazlewood to procure an exact account of the Vessels, Boats, Cannon, Sails, Stores, & other furniture of the State Fleet, & lodge the same with the Secretary, distinguishing such part thereof as may be neces- sary for the Three Galleys commanded by Captains Boys, Garland, & Roads, & the Three Guard Boats, commanded by Captains Hazle- wood, Beazeley, & Martin.


An order was drawn on the Treasurer in favor of Captain John Pearson, of the 9th Pennsylvania Reg't, for the Sum of Two Thousand Dollars, for the recruiting Service, for which he is to' account.


Licu. Jacob Vanderslier, of the 9th Pennsylvania Reg't, laid before the Council instructions for his entering on the Recruiting service, given him by the Lieu. Colonel of the said Regiment ; And thereupon, Recruiting instructions were issued to him in the County of Berks, with orders to the Lieutenant of the County of Berks for Money.

Ordered, That a Pass be granted to John Tittermary to go to the City of New York.


An order was drawn on the Treasurer in favor of Major Will'm Armstrong, Paymaster & Steward at Billingsport & Mud Island, or his order, for the Sum of Five Hundred Pounds, to be charged to his account.

Col. mentions that Capt. Stiles informed him that two Shallop load of Tools & Stores, belonging to the State, had. been delivered at Allentown, & that he understood that the Con- tinental Quarter Master had received them as Continental Stores. Qur.


Petition of George Douglass, praying in effect, to be permitted to go to Scotland, was read;


And on consideration,


Ordered, That the Petition of George Douglass be not granted.


The Council resumed the Consideration of the case of Lieu. Joseph Wilson & John Lawrence, now under sentence of Death, & reprieved until this day; and thereupon,


Ordered, That the Execution of the Sentence of Death passed upon Lieu. Joseph Wilson & upon John Lawrence, be suspended for fifteen days from this date.


The Petition of Eve Joder & Esther Blackman, referred to this Council by the order of the Hon'ble House of General Assembly, was now read ; & the same being considered,

The Hon'ble Vice President laid before the Council a draft of Congress, in the following words, Vizt :


" For 52,000 Dollars.


6 PHILADELPHIA, Septem. 10, 1778. 64 Sir :


" Pay to the Hon'ble the Delegates of the State of Pennsylva- nia, or their order, the Sum of Fifty-two Thousand Dollars, it being to be by them delivered to the President & Council of that State, for the Payment of Cloathing purchased for the Army, The said State to be accountable.


" I Am, sir, Your very humble serv't, (" Signed,) HENRY LAWRENS, President.


" To MICHAEL HILLEGAS, Esq'r, Continental Treasurer."


And the said draft was indorsed in the following words :

An order was drawn on the Treasurer in favor of John Parker, Bricklayer, or his order, for the Sum of Forty Pounds, to be Charged to his account.


The Council having received information that the Seventh Class of Militia lately called into service, will fall greatly short of the number of Men required for guards in this City ; therefore,


Ordered, That the eighth Class of the Militia of the City of Philadelphia be called into service as soon as possible, His Excell'y Gen'l Washington having again requested that the regular Troops now in the City be sent forward to Camp.

Bedford, Esq'rs, Archibald McClean, of the County of York, Esq'r & John Hubley of the County of Lancaster, Esq'r, be appointed & commissioned to try & determine, according to Law & the custom of this Commonwealth, a certain Henry Bunthunt, alias Henry Bunter, now confined in the Goal of the County of Bedford, La- bores, charged with having killed & murdered a certain Daniel Wencil, Son of a certain John Wencil, of the said County of Bed- ford.


An order was drawn on the Treasurer in favor of William C. Bradford, Pay-master of the Fleet, or his order, for the Sum of three Hundred Pounds, to be charged to bis account.

Capt. Will'm Craig, of the 3d Pennsylvania Reg't, laid before the Council orders from Brig'r Gen'l Wayne, for his entering on the recruiting service, & thereupon recruiting Orders were given to Capt. William Craig, of the 3d Pennsylvania Reg't, to draw on Lieut. John Wentzell of the County of Northampton, for Money.


Ordered, That Mary McBean have a pass into the City of New York.


A Transcript of the Record of the Court of Oyer & Terminer and General goal delivery held at Chester, in & for the County of Chester, on Tuesday the fifteenth day of September, in the year of our Lord One Thousand Seven Hundred & Seventy eight, being now read, it appears that James Fitzpatrick, late of the County of Chester, Blacksmith, was convicted, on his own confession, of Bur- glary & larceny, & thereupon the Justices of the said Court passed sentence that the said James Fitzpatrick be banged by the neck 'till he be dead ; And the said Record being now considered, it is


Ordered, That the Sentence of death passed upon James Fitz- patrick aforesaid, be executed on Saturday the 21st of this present Month, between the Hours of 10 o'clock in the forenoon & 2 o'clock in the afternoon, at the usual place of Execution ; That a Warrant under the less Seal of the State, for the said purpose, be now issued, and the same was accordingly issued.

The following orders were drawn on the Treasurer, agreeable to Certificates signed by the Committee of the Hon'ble House of General Assembly, & laid before the Council, viz: One in favor of Henry Haller, one of the Commissioners for purchasing of Cloathing, or his order, for the Sum of Ten Thousand five Hun- dred & Seven Pounds & fifteen Shillings, to be charged to his ac- count; One in favor of Robt. Craig, one of the said Commissioners, or his order, for the Sum of Nine Thousand three hundred & twelve Pounds one Shilling & two Pence, to be charged to his ac- count ; One in favor of James Johnston, one of the said Commis- sioners, or his order, for the Sum of Two Thousand five hundred & Eighty-eight Pounds, to be charged to his account ; and one in favor of the said James Johnston for the Sum of One thousand Three hundred & forty-eight Pounds, to be by him delivered to William Chambers, one of the said commissioners, & the same to be charged to the said W'm Chambers.

The Council took into consideration the Petition of Maurice Lisk, a Private belonging to the Bull-dog Galley, setting forth that he is incapable of performing the duties required of him as a pri- vate of the said Galley ; thereupon,


Ordered, That the said Maurice Lisk be discharged from further service on board said Galley.


The Petition of Joseph Green, convicted of having gone into the City of Philadelphia while in the possession of the British Army, & fined Fifty Pounds, praying in effect to have the said fine remitted, was read & considered ; thereupon,


Ordered, That the fine laid by the Court of Quarter Sessions of the Peace for the County of Bucks, on Joseph Green, for having gone into the City of Philadelphia while in the possession of the British Army, be remitted, as to such part thereof as is due to the State.


The Secretary reports that Rob't Levers, Esq'r, had sent down twenty Casks of Indigo, belonging to the State, & that the same is now in his hands.


Ordered, That the Secretary do apply to Mr. Thomas Lawrence to sell the same, & to contract with him on the best terms he can , as to the Commissions to be paid for selling the same.

An order was drawn on Commodore John Hazlewood, to delicer to the Navy board of Congress, for Public Service, 6 Swivel Guns & two Cohorns, & Iron Shot in a quantity which the said board may judge to be Sufficient.


A Memorial from John Morris, Jun'r, Clerk of Assembly, set- ting forth that he has orders from the General Assembly to procure ' 300 printed Copies of the Acts of the first & second sittings of the first General Assembly of this Commonwealth, but having no directions to prefix the declaration of Independence and the Consti- tution, prays the advice of Council therein ; whereupon Council recommend & instruct Mr. Morris to prefix said pieces to the Copies Aforesaid, as a proper introduction thereto ; And he is also desired to get An impression of at least 300 Copies of the Laws now in force, enacted by the last Assembly of the State of Penn- sylvania, the same being, it is apprehended, out of Print, & not Suf- ficiently known.


Ordered, That a Dedimus Potestatem be issued, authorizing & appointing the Hon'ble William Augustus Atlee, Esq'r, William Henry, Esq'r, & John Hubley, Esq'r, & either of them, to admin- ister the Oaths or Affirmation, required by Law to qualify the re- spective Borough Officers elect of the Borough of Lancaster, & also all other the Officers Commissioned by this Council, saving always. the administration of such oaths and affirmations as the laws of this State have directed to be otherwise taken.


Ordered, That Commodore Hazlewood be instructed to procure a quantity of Wood, necessary for the Gallies and Guard boats, on the best terms he can, either at Morris's River or elsewhere, on Delaware, & that he give orders to a prudent Officer to purchase the same.


Passes ordered :- Ann Wall, Wife of a British Soldier; Mary Smith, a Glazier's Wife; Catharine Trott, a Hessian Officer's Wife.


Ordered, That a Warrant be issued to remove the body of James Fitzpatrick from the Goal of the City of Philadelphia to the Goal of the County of Chester. 1

An order was drawn on the Treasurer in favor of the Hon'ble James Edgar, Esq'r, or his order, for the Sum of One thousand Pounds, to be charged to Mr. William Morrison, Commissioner of Cloathing for the County of York, for which sum the said William Morrison is to account, the same to be deliv'ed to him by the Hon'ble James Edgar, Esq'r.


Lieu. Henry Piercy, of the 2d Pennsylvania Reg't, having been some time in the Recruiting Service, & a Considerable Sum appear- ing to be due to him, recruiting instructions was given to him to enter on that Service in the County of Chester, to receive from the Lieutenant of the said County of Chester the Sum of Two Thou- sand Dollars, for which Sum he is to account.


The Secretary laid before the Council a Letter from the board of War, requesting the loan of the Plan of the Delaware, in the hands of Mr. Rittenhouse, for a day or two, in order that Colo. Lamey may take a Copy of such part of it as may be useful in executing Gen'l Washington's orders to him.


Ordered, That the Secretary apply to Mr. Rittenhouse & pro- cure from him the Draft of the River Delaware, & lend it to the board of War for a few days, in order that Colo. Lamey may take a copy of such parts of it as may be useful in executing the orders of his Excell'y Gen'l Washington.


The Council being informed by the Attorney General that the Estate of Traitors, held in right of their Wives during Coverture, & by courtesy, is forfcited by Acts of Treason ; thereupon,


Ordered, That the Agents for seizing of forfeited Estates, be in- structed to seize such Estates, in the respective Counties, as belong to Traitors in right of their Wives, the same being deemed to be forfeited to the State, so far as such Traitors have Title during Co- verture, or in right of Courtesy.

Philp Boehm, Esq'r, attended the Council, & represented that he had accepted the Commission of the Peace for the County of Philadelphia, & the Commission appointing him one of the Jus- tices of the City Court, from a desire to render his Country the as- sistance which it was in his power to give during a time of diffi- culty ; but he now finds that his health is so greatly impaired as to render it impossible for him' to discharge the duties thereof, & therefore he now resigns his said Offices.
