A Letter from Meriwether Smith & Richard Henry Lee, Esq'rs, inclosing a Letter from John Campbell, dated October 16, 1778.


The Council took into consideration the cases of John Roberts and Abram Carlisle.


Petition of divers Freeholders was read; and also the Notes taken by the Chief Justice on their respective trials, (many others having been before read.)


Notes of the Chief Justice on each of the said Cases were read.


Samuel Wallis, of Northumberland, attended and offered to Council some facts relative to the Credit in which. John Roberts was at Gen'l Howe's Head Quarters; and


On Consideration,


He was ordered to draw up in Writing what he has to offer, and affirm to the truth thereof before a Justice of the Peace.

Major Gen'l Armstrong & Brig'r Gen'l Lacey attended the Council, and a conference was had on the present situation of the State with respect to Military affairs.


James Claypoole, Esq'r, offered to the Council Blair M'Clena- ghan & David Chambers, both of this City, as sureties for his faithful performance of the duties of his office as Sheriff of the City and County of Philadelphia, & the same were approved of.


Ordered, That. Wm. Allison be directed to request of the As- sistant Quarter Master General, for four Spades & four Shovels, for the use of the State, to be returned to him, or accounted for by the State.


A Letter from Brig'r Gen'l, John Lacy was read, wherein he re- signs the office of Agent for seizing of forfeited Estates for the County of Bucks, in consequence of his being elected one of the representatives of the said County to serve in General Assembly.


The Council resumed the consideration of the cases of John Roberts and Abraham Carlisle ; And after solemn consideration, and the Question being put, shall a Reprieve be granted to John Roberts and Abram Carlisle, or either of them ? The same was carried in the Negative.


Application was made to Council for a small quantity of Plank, to repair a Bridge on Richmond, or Point no point Road, near Kensington.


Ordered, That Wm. Allison be directed to deliver to David Blyth and John Shults, as much Plank as will repair the Bridge above Kensington, on Richmond Road.

An order was drawn on the Treasurer in favor of Will'm Cris- pin, Commissary of the State Fleet, or his order, for the Sum of Two Thousand Pounds, to be charged to his account ; Also an or- der on the Treasurer in favor of Thomas Nevil, for the Sum of One hundred Pounds, to be charged to his account.


William Marshall of the City of Philadelphia, Pilot, named in the Proclamation the thirtieth day of October last, and required to render himself and abide his legal trial, &ca, attended in Coun- cil, and on examination, it appeared that the name of the said Wm. Marshall was inserted in the said Proclamation thro' the mis- information of one of the Agents for seizing of forfeited Estates in the City of Philadelphia; and there did not appear any reason to believe that he had adhered to, or in anywise aided and assisted the Enemies of this Sate, or of the United States of America.


The Council having a just regard to the preservation of the good Character of a Citizen of the State, both for the present and in future,


Ordered, That a certificate be made out under , the less Seal of the State, Signed by the Hon'ble Vice President, and attested by the Secretary, setting forth the aforesaid case, and that the same be delivered to the said William Marshall; And that a Nole Pro- sequi be issued in his case.


Ordered, That the foregoing Minutes be Published in Mr. Dun- lap's Paper.


Ordered, That the Sum of Two Hundred & Fifty Dollars be paid to the Hon'ble Geo. Bryan, Esq'r, or his order, for the Sum of One Hundred & Fifty Pounds.


An order was drawn on the Treasurer in favor of the Hon'ble Thomas Urie, Esq'r, or his order, for the Sum of One Hundred and fifty Pounds, in part of his Wages.

An order was drawn on the Treasurer in favor of Jac'b Stine- mitz, or his order, for the Sum of One hundred & Twenty-four Pounds Six Shillings & Three Pence, for Bricks.


Henry Rhoads, Esq'r, one of the Justices of the Peace for the County of Bedford, sent into Council a resignation in Writing, of his Office of a Justice of the Peace for the said County, & the same is accepted accordingly.


Agreeable to the order of the day, Capt. McFee & Rachel Wal- ker, attended the Council, & put in their claim to the Reward of One thousand Dollars, offered by this Council on the thirteenth July last, to the person or persons who should take and secure James Fitzpatrick, Blacksmith, a noted Robber. And the Clai- mants being heard & their claims considered ; thereupon,


Ordered, That the Sum of Five hundred Dollars be paid to Rach'l Walker, & Five Hundred Dollars be paid to Capt. Robert McAffee, being in the whole the Sum of One thou -. sand Dollars, offered by this Council as a reward for seizing James Fitzpatrick, Blacksmith, the Robber lately executed at Chester ; & An order was drawn on the Treasurer for the said sum accord- ingly.


Examination of the Claims of Capt. McAffee & Mrs. Walker to the Reward for taking Capt. Fitz Patrick, August 23, 1778.


Rachael Walker .- " She was up Stairs; heard screaming, came down; a boy told her Capt. Fitz was there ; Capt. Fitz asked her how she did, & expressed his sorrow at the disturbance ; Fitz told McAffee to prepare for a march ; laid down his sword & Pistol, & raising his foot to the Bedstead, in order to put up at heels a pair of Pumps taken from Capt. McFee; She winked at McFee to seize Fitz; he seemed to decline; She winked again, & on seeing McFee's motion as if to seize Fitz, she also sprang forward & seized Fitz; but whether before or at the same time that McFee seized him, is not certain, but there could have scarely been a moment dif- ference ; Fitz seized a Pistol, which she griped in his hand & pre. vented him from firing it; That she afterwards took the Pistol stood Centry at the door."

Capt. McFee says, "he is not certain at what time the Young Woman seized Fitz, but that the persons present said he had seized him first, & had several turns with him on the floor before any per- sons interferred ; Since the time, has had two Oat Stacks burned, & that the same time destroyed the Pans, &ca, in the Milk House, Cut the manes & tails of his Horses, but not wounded." With- drew.


Council ordered the Secretary to ask Captain McFee if he had obtained from his Father & Mother a renunciation of claim to any part of the reward for apprehending Capt. Fitz :


And the Secretary having proposed to him the said Question, Capt. McFee replied, " there is no occasion ; they have made no claim, & there can be no reason for their renouncing a claim which they have not made, no more than that every other Person should make a renunciation."


Edward Biddle & Samuel Meredith, Esq'rs, a Committee of Gen- eral Assembly, attended in Council, & informed the Council That the House of General Assembly was now met, had chosen their Speaker, & were ready for any business which the Council may have to lay before the House.

An order was drawn on the Treasurer in favor of Capt. Nehemiah Stokely, of the eighth Pennsylvania Regiment, or his order, for the Sum of One Thousand & Six hundred Dollars, for the Recruit- ing Service for the said Regiment, & to be charged to his ac- count.


Ordered, That the Classes of Militia of the several Battalions near the City of Philadelphia, who from the vicinity of the Enemy could not be called into service in their turn, be now ordered into service to do duty as City Guards; & that the Lieutenant of the County of Philadelphia be directed to exert himself to the utmost to have them ready for duty by Saturday next.

The Hon'ble James M'Clean, Esq'r, elected Councellor for the County of Cumberland, & the Hon'ble Matthew Smith, Esq'r, elected Councellor for the County of Lancaster, respectively took the Oaths required by the Constitution to qualify them to act as Councellors.


An order was drawn on the Treasurer in favor of Major Gen'l John Armstrong, of the Militia of this State, or his order, for the sum of Four hundred & thirty-one Pounds & twelve shillings, balance due to him for his Pay & Rations to the 5th of March, 1778, and to be charged to Congress.


Representation of Charles Campbell, late Sub-Lieutenant of the County of Westmorland, praying the Payment of a bill drawn by him on Council, & a consideration of his case, was read ; and thereupon,


Ordered, That the representation of the case of Charles Camp- bell be referred to the Ilon'ble House of General Assembly.

Ordered, That Capt. Wade in the State Sloop, do comply with the directions of the Marine Committee of Congress, by preceeding the French Frigate Chimere down the Bay of Delaware, for the purpose of reconnoitering.


Gen'l Lacey & Col. Knox, a Committee of the Hon'ble House of General Assembly, attended in Council & laid before Council a Letter from Gen'l Wayne, to the Hon'ble House of Assembly, in- closing divers Letters from the Officers of the Army, & the same were read.


Josiah Wood produced an account for making Six Hundred Shovels for the use of the Army, & three hundred handles for Shovels, & a Certificate in support of the said account, signed by Colo. John Bull; and thereupon,


An order was drawn on the Treasurer in favor of Josiah Wood, for the Sum of Two hundred and Seventy Pounds, for shovels made by him for the State of Pennsylvania.


The Council resumed the consideration of the return of the Election for Justices of the Peace for the Northern liberties of the City.of Philadelphia; and thereupon,


Ordered, That Henry Negle & Joseph Copperthwaite be ap- pointed & Commissioned to be Justices of the Peace for the Coun- ty of Philadelphia.

An order was drawn on the Treasurer in favor of Lieu. Col. North, or his order, for the sum of One hundred & Thirty- Six Dollars, bounty due to Ensign George Knox for enlisting John Kennedy into the 9th Pennsylvania Regiment.


An account of Expences & Pay due for attending the Light House, was laid before the Council by Eleanor Hitchcock, Widow of John Hitchcock, deceased, Amounting to the sum of Forty-Six Pounds twelve Shillings & six Pence.


Ordered, That it be recommended to the Officer appointed to collect the duty of Tonnage for the support of the Light House, &ca., to settle the account of the Widow of John Hitchcock, and pay her the Balance due to her.


An order was drawn on the Treasurer in favor of Thomas Shep- erd, or his order, for the Sum of, Twenty Two Pounds & Ten Shil- lings, for 30 bushels of Lime, for the use of the House of Office, & some repairs in the State House.

Ordered, That the Secretary do attend the Hon'ble House of General Assembly, & acquaint the House that the Council are in- formed that a hearing on the return of the Election for the County of Chester is to be had in the House to-morrow, in the forenoon, & as the determination of the Election for Sheriffs will depend on the same evidence as that of the representatives in General Assembly, they propose to the Hon'ble House that the Council be admitted to attend the hearing, & to take such notes of the proceedings as they may judge to be necessary to assist them in their determination, con- cerning the Election of Sheriffs for the said County of Chester.


A Letter from Col. Heartley, dated 9th instant, was read, &


Ordered, That the same be laid before the Hon'ble House of Assembly.


The Secretary reports that he had delivered the Message to the Hon ble House according to order, & that the Speaker was pleased to say, That the House will take into consideration the message from Council.


An order was drawn on the Treasurer in favor of James Loug- head, paymaster of the City Militia, for the Sum of One Thousand & five hundred Pounds, to pay the Militia now to be discharged, & to charge the same to account of the said James Loughead.


The Clerk of the Hon'ble House of General Assembly attended in Council, & returned Colo. Hartley's Letter, and he informed Council, That the House was ready to join a Committee of Council to assist in representing to Congress the situation of the frontier Counties.


The Clerk of the House again attended & informed the Council, That the House of Assembly had taken into consideration the ver- bal Message from Council, & that the House are disposed to ac- commodate the Council within the Bar at the hearing of the case of the Chester County Election, & that the hearing was, on motion, put off 'till Thursday next.


Ordered That the Secretary inform the House, That Council propose to apply to Congress, thro' the Delegates of the State, for the March of some of the Confederate Troops, & that if any diffi- culty arise in the case, Council was inform the House and ask their assistance.

It appearing by the Records that John Ellwood, late of Bucks County, Pilot, is convict of High Treason at a Court of Oyer & Terminer, holden on the Twentieth day of October last, & sentenced to be hanged by the Neck 'till he is dead ; it is


Ordered, That a Warrant for the Execution of said sentence on Wednesday the Second day of December next, between the hours of Ten of the Clock in the forenoon, & two of the Clock in the After- noon of the same day, be issued.


An order was drawn on the Treasurer in favor of Robert Alli- son, or his order, for the Sum of Six hundred Pounds, to be charged to his account.


William Denny, David Denny, & John Culbertson, all of the County of Chester, were offered as Sureties for Robert Smith, Es- quire,- his faithful performance of the Duties of his Office as Sheriff of the said County of Chester, & the same were approved of.

Ordered, That James Moore, Evan Evans, Patterson Bell, & Philip Scott, Esquires, be Commissioned by Dedimus Potestatum ; that they or one of them do adminaster to Robert Smith, Esq'r, Sheriff of the County of Chester, & to David Denny, Gent., Coro- ner of the said County, the Oaths or Affirmations of allegiance re- quired by Law to qualify them respectively for the discharge of their said Offices.

. The Council taking into Consideration the case of Joseph Wilson & John Lawrence, now under Sentence of Death :


Ordered, That Joseph Wilson & John Lawrence, now under Sentence of Death, be Pardoned, & that a Pardon be issued accord- ingly.


The Council taking into Consideration the case of Charles Wil- liams, convicted of Felony at the City Court, & now under sentence to receive twenty-one Lashes & pay a fine of ; and it appearing that a certain hath since confessed that she was guilty of the Felony whercof the said Charles Edwards was so convicted, which, with some other circumstances, rendering it in some degree uncertain whether or not the said Charles Williams had been guilty of the said Felony ; & thereupon,
